I am so thankful for finally receiving the doctoral degree in Public Administration (DPA) at the University of Baltimore (UB), which was my goal for returning to the United States. I had received much inspiration, encouragement, and assistance during the journey. First, I would like to thank the honorable faculty members of my dissertation committee, Dr. Lenneal Henderson, the chair, Dr. Ed Gibson, and Dr. Arron Wachhaus who had intellectually guided me through the process. Without the approval of the research project by the Chair, Dr. Henderson, regarding the citizen participation (CP) project which occurred in Taiwan, I would not have been able to complete my project smoothly. The detailed reviews of context and the helpful suggestions received from Dr. Wachhaus and Dr. Gibson also enriched the structure and the content of the dissertation. I cannot express enough appreciation for the time and voluntary assistance provided by my committee. I always remember the excitement I felt when Dr. Henderson called me “Scholar Tseng” from the beginning which reminded me of becoming a professional scholar to honor my degree and UB where I have had my dream came true. I want to thank my husband who gave me the final push to join the DPA program in 2013. I have learned so much from the program that enriched my life, and I believe it will be reflected in my future career. I will always remember the excitement and inspiration from the first class regarding “The Theory of Public Administration” which convinced me that I had made the right choice in returning to the campus and turning down an excellent job offer in Taiwan, even though I might have had an easier path there. Thanks to those voices who reminded me of the value of pursuing the doctoral degree as a life-long achievement that can never be lost. In particular, I would like to thank Dr. Lai, the respectful administrator I worked with to complete the case project in my dissertation. Dr. Lai inspired me to have faith in the integrity and morality of public servants in Taiwan. Without his confidence in me back then, I would not have been able to complete the CP project that helped me to choose my final dissertation topic and smoothly finish the time-consuming interviews.     Post-disaster Reconstruction Laws and Indigenous Adaptive Strategies in Taiwan: Focusing on Post-Typhoon Morakot Reconstruction Yung-hua Kuo PhD Candidate, School of Law, University of Washington Abstract This paper examines and analyzes how the Taiwanese government and indigenous peoples responded to and recovered from natural disaster impacts, as well as their considerations and relating issues. In August 2009, the heavy rainfall of Typhoon Morakot triggered serious floods and mudslides throughout southern Taiwan and damaged many indigenous communities. After the disaster, the Taiwanese government rushed to adopt land conservation and relocation as major reconstruction methods. By designating risky lands as “Special Zones” and “Safety Doubtful Zones,” the government restricted land use and relocated a large number of indigenous people from their homelands in the mountains to the lowlands. The land zoning and relocation process was criticized as hurried, careless, and limited local participation. The relocated indigenous people also have faced legal, cultural, economic difficulties associated with displacement. In response to the official reconstruction policy, the Taiwanese indigenous peoples implemented multiple strategies to adapt to the environment changed by the disaster: relocation, reconstruction, and return. Although each adaptive strategy had advantages and disadvantages, the indigenous communities adopted the strategies according to their specific contexts. The flexible adaptive strategies are more likely to help the affected indigenous people recover from natural disaster impacts by applying their unique culture and traditional knowledge. I. Background: An Unexpected Disaster of Typhoon Morakot On the early morning of August 9th, 2009, a massive landslide occurred in a mountainous region of Kaohsiung Municipality, Taiwan. The large quantity of mud instantly buried the entire Xiaolin village and killed 491 people.

The study traces land history of indigenous peoples and development of disaster laws in Taiwan. Based on the history, the study takes post–Typhoon Morakot recovery as an example to examine reconstruction laws and indigenous adaptive strategies in response to natural disaster effects in contemporary Taiwan. By presenting the problems, this dissertation aims to provide suggestions for enhancing protection on Taiwanese indigenous land rights in natural disaster situations. Since the seventeenth century, indigenous peoples’ land has been encroached by settlers and taken by the governments as state-owned property. Indigenous communities were relocated to reach assimilation and development. Only in recent decades, social movements have urged the government to recognize the collective and individual rights of indigenous people. In regard of disaster laws in Taiwan, from 1945 to 1999, disaster effects were handled by executive power through local administrative regulations and presidential emergency decrees, whose function was limited to retrospective measures.

    The restoration of sediment-related disasters and driftwood from national forest in Taiwan caused by Typhoon Morakot in 2009 Su Chin Chen *, Jau Pao Wang **, Chun Hsien Yang ** Department of Soil and Water Conservation, National Chung Hsing University* Forestry Bureau, Council of Agriculture, Executive Yuan** ABSTRACT: The number and area of new landslide, according to the interpreted SPOT images, caused by Typhoon Morakot in 2009 is estimated as 30,223 and 43,996 ha, respectively. The new landslide area in 2009 increased by about 16,392 ha in comparison with the landslide area in 2008. The heavy rainfall with a return period well over 200 years during Typhoon Morakot centralized in southwestern and southeastern Taiwan, and that also resulted in serious landslide disasters in national forest. Four forest working circles, including Chishan, Laonong, Pintung, and Dawu, are the most serious landslide zones with the landslide ratio over 8.0%. The Forestry Bureau assesses and ranks the seriousness of the disasters by using slope, the number of protected objects, the distance from the disaster to the protected objects to execute the restoration of sediment disasters and landslide in national forest. Due to the most torrential rain in the past 50 years caused by Typhoon Morakot, a large number of trees in the mountain area were destroyed. They became the driftwood, with a total weight of about 1.52 million tons, which ended up at the farmlands and ports. In order to recover agricultural products and livelihoods, Forestry Bureau made strategy for disaster prevention and reduction. Based on the strategy, Forestry Bureau sweeps away the driftwood by estimating its distribution, overcomes the issues caused by the heavy rainfall disaster, and helps the victims to recover their life.
