Award of Contract CAP2011 Outdoor Fitness Equipment and Surfacing Project

The Honorable Mayor Fournier and Members of the City Commission:

At its June 11, 2018 meeting, the city commission approved the program year 2018-2019 community development block grant (CDBG) program’s annual action plan which includes activities and funding levels.

The city will utilize CDBG funds to design, purchase and install high quality, durable outdoor fitness equipment and improve existing playground equipment at Cody Park, Barton Park - north, Waterworks Park, and Grant Park. It should be noted that the city maintains a lease agreement with the School District of the City of Royal Oak for use of property associated with Grant Park. The lease agreement requires written permission from the district for additional improvements. It also expires in 2020. The superintendent of recreation has been communicating with representatives from the district regarding permission and an addendum to extend the length of the agreement.

The city is proceeding with the purchase and installation of Kompan outdoor fitness equipment at each of the four parks. Kompan equipment is highly regarded, durable, and reliable in comparison to a host of other manufacturers of outdoor fitness equipment. Kompan is one of two approved suppliers of park and playground equipment that participates in the US Communities national cooperative purchasing program. The city is a participating member in US Communities. As a participating public agency, the city can benefit from existing, competitively solicited contracts between US Communities approved suppliers, such as Kompan, and US Communities lead public agencies. This is accomplished via the recitals in the Master Intergovernmental Cooperative Purchasing Agreement (MICPA). The recitals state that lead agency has competitively solicited and selected goods, products and services. Participating public agencies, like the city, can conserve resources and reduce procurement costs by sharing in the existing agreement pricing established by the lead agency and the supplier that was awarded their contract.

The city utilizes its membership in the US Communities national cooperative purchasing program on a regular basis. Since 2012, the city purchased over $616,000 of materials and/or services via its membership in the US Communities. The city has acquired CDBG funded items via US Communities. This project is no exception.

American Athletix LLC of Muskegon is Kompan’s supply and installation partner in the State of Michigan. American Athletix, and its subcontractors, work with Kompan’s design professional to create a design of the installation and price list of products and services. The city’s contract would be directly with American Athletix based on the discounted price structure under the original Kompan contract available to all participating public agencies in US Communities.

Participation in the US Communities contract for Kompan products and services garners tremendous time savings and discounts. However, not all items associated with the activity are covered under the Kompan contract. For example, concrete walkways must be constructed within the parks to allow barrier-free access to all existing play structures and new outdoor fitness Page 2 of 2

equipment settings. The contract references per unit prices for materials associated concrete, sand, and stone. Staff has verified the reasonableness of the per unit pricing based on figures from recent city projects. The total of these prices, not included in the Kompan contract covered by the US Communities, is ancillary to the overall project cost and within market rate pricing.

The superintendent of recreation has selected Kompan products for each park depending on the park setting and composition of the surround neighborhood. The products are illustrated in the quote provided from American Athletix (Attachment 1). The equipment features a downloadable app so that individuals and groups may better understand the full range of features/abilities of the equipment and design training schedules and track their progress. The city is committed to continue to build outdoor fitness equipment in many neighborhood parks as a park common feature.

Each park contains existing children’s playground equipment. Depending upon the type of playground equipment, an area (fall zone) with appropriate protective ground surfacing is required to prevent injury from falls. The city currently utilizes shredded wood mulch within its fall zones. When maintained annually at the appropriate depth, shredded wood mulch is an appropriate material to reduce serious injuries. Maintenance is costly both in terms of purchase and distribution of the wood mulch. Therefore, each fall zone will be replaced with an artificial turf material due to its durability, longevity and superior protection from injuries.

The city must expend its CDBG funds in a timely manner according to federal regulations. For the city to achieve the appropriate expenditure threshold, it’s critical that the activity be implemented in the fall of 2018 and not wait until the spring of 2019. If the city fails to meet the threshold, the city must forfeit CDBG funds.

If the city commission agrees, the following resolution is recommended for approval:

Be it resolved, the city commission hereby awards contract CAP2011 – outdoor fitness equipment and surfacing project to American Athletix, LLC of Muskegon, Michigan at price not to exceed $893,103 and directs staff to issue a purchase order in said amount; and

Be it further resolved, the mayor and city clerk are authorized to execute the contract documents for the project.

1.3 Quality Assurance

A. Qualifications 1. IPEMA Certification- Products must be IPEMA certified to ASTM F1292-13 (go to www.ipema.org for certificate). 2. The FibarPIP system shall be warranted by Fibar for any defects in materials and workmanship for two (2) years from the date of completion.

B. Design and Detailing 1. The FibarPIP system is utilized when an impact-absorbing surface is required within the use zone of playground equipment. Each system is engineered to meet CPSC, ASTM F 1292 Impact Attenuation, ASTM F 1951 wheelchair mobility criteria, and complies with ASTM F 2223 Standard Guide for ASTM Standards on Playground Surfacing. 2. Substrate over which FibarPIP may be installed includes concrete, asphalt, or compacted aggregate. 3. All other substrates must be approved by Fibar prior to installation. 4. Part II: Products

2.1 General: No substitution of other materials shall be permitted.

2.2 The depths of FibarPIP Poured-in-Place necessary to provide the critical fall height is as follows:

2.4 Mixing and Preparation Binder/SBR and binder/EPDM mix ratios shall be determined by the specified system.

Part III: Execution

3.1 Inspection Before applying FibarPIP, installer will evaluate the substrate and site conditions. No work will begin until the condition of the substrate is approved by the installer.

3.2 Poured-in-Place System Primer: when required apply primer using a 3/8" nap roller at a rate 300 square feet per gallon. Do not apply over crushed stone base. Prime all vertical interfaces of curbs, etc.

A. SBR base layer

a. Binder to rubber ratio shall be 15% by weight to achieve proper resiliency. b. Mix binder and SBR rubber in a paddle type mixer for 1 to 2 minutes or until rubber particles are encapsulated. c. Spread this mix to the desirable thickness using a screed bar. d. Using a steel trowel, uniformly compact the mix. Periodically lubricate the trowel with mineral spirits as work progresses. Do not saturate the rubber surface with cutting agents. e. Allow base layer to cure to point of supporting foot traffic without deforming the base layer and before proceeding with the EPDM wear surface.

B. EPDM Wear Surface

a. Binder to rubber ratio shall be 20% by weight to achieve maximum durability. b. Mix EPDM and binder in paddle type mixer for 1 to 2 minutes or until materials are thoroughly encapsulated. Using a screed bar, level the mix over the base layer. c. Using a steel trowel uniformly compact the mix. Periodically lubricate the trowel with soapy water as work progresses. Do not saturate the rubber surface with cutting agents.

d. Allow wear surface to cure 24 to 72 hours before opening the area for play. The surface must be tack free before attempting to walk on the surface.

4. Cleanup Clean all tools with mineral spirits.

5. General Precautions Wear protective clothing and safety glasses when handling materials. Follow all safety precautions on packaging labels. Refer to Material Safety Data Sheets for safety information.

Visual Inspection

1. Sand, mud, pea gravel, etc. will need to be removed to prevent loss of impact attenuation. These particles will require the use of a vacuum with sufficient strength to penetrate the depth of the surface. At no time should the surface be pressure- washed.

Remove debris such as stones, broken glass, contaminants, or other foreign objects. In heavily-used parks, inspect daily.

2. The maintenance procedures and costs should be known and provided for prior to purchase to ensure the performance and longevity of the surface and playground.

3. Cleaning - Surface may be cleaned with a broom, blower, or street pressure hose.

4. Vandalism - Any acts of vandalism that alter the original surface must be repaired.
