MOTION TO SUSPEND AND REMAND FOR CONSIDERATION OF ADDITIONAL EVIDENCE

Applicant, IMH Columbia, LLC, (“Applicant”) requests that the Board suspend the appeal regarding Serial No. 88/094,045 and remand the application to the Trademark Examining Attorney for reconsideration of new evidence.

Under 37 CFR § 2.142(d), the evidentiary record in an application should be complete prior to filing of the ex parte appeal; if the appellant wishes to introduce additional evidence after an appeal is filed, the appellant should submit a request to the Board to suspend the appeal and remand the application for further examination. See also TBMP § 1207.01.

Applicant previously submitted additional evidence in the form of a consent agreement in order to overcome the 2(d) refusal. 4 TTABVUE 1. The application was remanded to the

Examining Attorney, who withdrew the 2(d) refusal but maintained the 2(e)(4) refusal.

Attorney was going to maintain the 2(e)(4) refusal, Applicant was made aware of additional

evidence that will support its argument against the 2(e)(4) refusal that had not been previously

made of record.

Applicant therefore requests that the Board suspend the appeal and remand the application to the Examining Attorney so that the Examining Attorney has the opportunity to review this additional evidence. For ease of reference and review, Applicant attaches the appeal brief to the

Board with the additional evidence referenced in the Exhibits to the brief.

Applicant respectfully submits that the additional evidence is highly persuasive of registrability, and respectfully requests that the Examining Attorney withdraw his Section 2(e)(4) refusal based on the attached arguments and additional evidence which Applicant wishes to make of record.

I. DESCRIPTION OF THE RECORD

On August 27, 2018, Applicant filed a Section 1(b) application for registration of THE

MERRIWEATHER for “hotel services” in Class 43.

On December 13, 2018, the Examiner issued an Office action requiring additional

information from the Applicant and initially refusing registration based on an alleged likelihood of confusion with the marks Registration No. 4,839,304 for MERRIWEATHER for

“entertainment services, namely, providing a facility for musical concerts, music festivals and live show performances; entertainment, namely live music concerts; arranging and conducting of concerts; conducting entertainment exhibitions in the nature of music festivals; entertainment in the nature of music festivals” in Class 41. The Examiner also initially refused registration on the ground that Applicant’s mark is primarily merely a surname under Section 2(e)(4) of the

Trademark Act, 15 U.S.C. § 1052(e)(4).

Applicant responded to the first Office action on April 17, 2019 providing the requested information and arguing against the Section 2(d) refusal based on the dissimilarity of the services, and arguing against the Section 2(e)(4) refusal on the grounds that the surname is rare, no one associated with the Applicant has the surname, there are other recognized meanings for the term, and the applied-for mark does not have the structure and pronunciation of a surname.

The Examiner issued a second and final Office action on April 29, 2019 maintaining the

Section 2(d) refusal based on an alleged likelihood of confusion with the mark of the cited

registration, the Section 2(e)(4) primarily merely a surname refusal, and the request for information.

Applicant filed a notice of Appeal on October 28, 2019. Applicant then filed a Motion to

Suspend and Remand for Reconsideration with the Trademark Trial and Appeal Board (“TTAB”)

on November 27, 2019. In its Request for Reconsideration, Applicant submitted a consent from the owner of the registration cited in the Examiner’s 2(d) Refusal.

The Examiner issued a Reconsideration Letter on December 17, 2019 maintaining the

Section 2(e)(4) refusal and withdrawing the 2(d) refusal and the information requirement. The

Board resumed the proceedings on December 17, 2019, granting Applicant sixty (60) days to file its appeal brief.

II. STATEMENT OF THE ISSUES

The only remaining issue on this appeal is whether Applicant’s mark THE

MERRIWEATHER for “hotel services” in Class 43 is primarily merely a surname under Section

2(e)(4) of the Trademark Act.

III. RECITATION OF FACTS

Applicant IMH Columbia, LLC, DBA Sheraton Columbia Town Center (“Applicant”) is a hotel operator. On August 27, 2018, Applicant filed an application to register the mark THE

MERRIWEATHER for “hotel services” in Class 43, on the basis of 1(b), intent to use. (See

Application). As noted in response to the Examiner’s request for information, Applicant does not yet have a website showing use of the mark in connection with the applied-for services, and the mark is not yet in use. (See April 17, 2019 response to Office Action). Applicant intends to operate

a hotel under the mark THE MERRIWEATHER.

As also noted in the response to the Examiner’s request for information, no person

associated with Applicant has the surname Merriweather. (See April 17, 2019 response to Office

Action).

IV. ARGUMENT

In determining whether or not the mark of a pending application is primarily merely a

surname under Section 2(e)(4) of the Lanham Act, the analysis is whether when the mark is viewed

in relation to the goods or services for which registration is sought, its primary significance to the

purchasing public is that of a surname. Earnhardt v. Kerry Earnhardt, Inc., 864 F.3d 1374, 123

USPQ2d 1411, 1413 (Fed. Cir. 2017). The Trademark Trial and Appeal Board (TTAB) may consider the following factors in their analysis: 1) the rarity or frequency of exposure to the public of the mark being used as a surname; 2) whether anyone connected with the applicant has the mark as a surname; 3) whether the mark has any recognized meaning other than a surname; 4) whether the mark has the structure and pronunciation (or look and feel) of a surname; and 5) whether the manner in which the mark is displayed might negate any surname significance. In re Benthin

Mgmt. GmbH, 37 USPQ2d 1332, 1333-34 (TTAB 1995). The TTAB may consider other probative

factors, and the weight accorded each factor in the analysis and the relevance of each factor are

decided on a case by case basis. Id. After a prima facie showing of surname significance by the

Examining Attorney, the TTAB must weigh all the evidence from the Examining Attorney and the

Applicant. In re Sava Research Corp., 32 USPQ2d 1380, 1381 (TTAB 1994). Any doubt must be

resolved in favor of the Applicant. Benthin, 37 USPQ2d at 1334.

A. Applicant’s Mark has Meanings Other Than a Surname.

Applicant’s mark THE MERRIWEATHER has meanings, associations, and connotations

other than a surname, including as a music venue, an album, a neighborhood in Columbia,

Maryland, a font, and a given name. Because these associations, connotations, and meanings are

so prevalent, the relevant purchaser of the Applicant’s hotel services would not consider THE

MERRIWEATHER to primarily merely be a surname.

The Examining Attorney argues that MERRIWEATHER does not appear in the dictionary and that the term appears to have no other recognized meaning or significance other than a surname. (See December 13, 2018 Office action). Applicant submits that due to other uses of

“Merriweather” that are commonly known to the public, and in particular to the relevant purchasing public, the term is not primarily known as a surname.

The most prominent use of “Merriweather” is in connection with the Merriweather Post

Pavilion1, a concert venue in Columbia, Maryland. (See, Exhibit A). The venue is particularly famous because of its role in the history of rock and roll, hosting concerts by Jimi Hendrix, Janis

Joplin, the Who, and Led Zeppelin in the 1970s, and for its acoustics and amphitheater designed

by Frank Gehry. Id. The fame of the venue also led to the band Animal Collective naming an

album after it (Merriweather Post Pavilion, released in 2009), which sold over 200,000 copies by

2012. (See, Exhibit C). Applicant notes that the mark MERRIWEATHER that was the subject of

the application originally cited against the Applicant in the 2(d) refusal is used in connection with

the Merriweather Post Pavilion, and registered without a 2(f) claim. (See Attachments 42-44 to

December 13, 2018 Office action and current TSDR information attached as Exhibit D). As the

Trademark Trial and Appeal Board has stated that the U.S. Patent and Trademark Office should

avoid inconsistent practices, Applicant submits that it should not be singled out and subjected to

inconsistent treatment in this case. See, e.g., In re Woman’s Publishing Co., 23 USPQ2d 1867,

1878 (TTAB 1992).

Merriweather is also the name of a neighborhood/district near Columbia, Maryland and near the Merriweather Post Pavilion. (See Attachment to Applicant’s April 17, 2019 response to the December 13, 2018 Office action). Furthermore, Merriweather is the name of a common font.

(See, Exhibit E). The first 4 pages of search results when performing a Google search for the word

“Merriweather” are all references to the Pavilion, the album, the font, the neighborhood in

Columbia, Maryland, the Merriweather Coffee + Kitchen Café in New York, or Merriweather’s, a skin care retail store. (See Exhibit F). There are no references to Merriweather as a surname in any of the first 4 pages. Id.

Merriweather (and slight variations in spelling, including the phonetically equivalent

Meriwether) is also a given name, as in Marjorie Merriweather Post, and including the famous explorer Meriwether Lewis (of Lewis and Clark). (See Exhibit G). The finding that a term is a given name, in addition to having other meanings, is significant evidence that the applied-for mark will not be considered primarily merely a surname. See Ex Parte Omaha Cold Storage Co., 111

USPQ 189 (Com’r Pat & Trademarks 1956) (finding DOUGLAS not primarily merely a surname because it is a given name, in addition to being the name of cities, streets, and a type of tree). The significance of the use of the phonetically equivalent Meriwether in connection with the given name of a well-known historical figure Meriwether Lewis especially supports the contention that

Merriweather will not be viewed primarily merely as a surname. See In re Monotype Corp. PLC,

14 USPQ2d 1070, 1071 (TTAB 1989).

Given the multitude of uses, associations, and connotations of Merriweather in manners other than a surname that are prevalent in the public, including as a place, a given name, a concert venue, an album, and a font, among others, the relevant purchasing public is likely to not conclude that THE MERRIWEATHER is primarily merely a surname.

B. The Look and Feel and Structure of Applicant’s Entire Mark is Not That of a

Surname

The mark THE MERRIWEATHER does not have the look and feel of merely a surname,

in part due to the other meanings, associations, and connotations described above, but also because

of the inclusion of the article THE. Instead, it has the look and feel of a proper name of a building.

The mark, when considered as a whole, is THE MERRIWEATHER. The TTAB must

consider the mark as a whole in order to determine whether a mark is registrable. Earnhardt v.

Kerry Earnhardt, 864 F.3d at 1378-9. Articles such as “THE” are not used with singular surnames in English. (See Exhibit H on the use of articles with proper nouns in English). While referring to an entire family or group of people sharing a surname may require the use of an article (“the

Smiths”), referring to a singular person by their surname never requires an article and is

ungrammatical. Id. On the other hand, referring to buildings, including the proper name of

buildings, frequently includes an article such as “the” (e.g. “the Empire State Building”). Id.

This grammatical structure is particularly true of names of individual hotels. Applicant

intends to use the applied-for mark THE MERRIWEATHER in connection with a hotel (providing hotel services). The names of individual hotels are often referred to in this same manner and are

known as such, with the article “the” included in the hotel name: The Ritz-Carlton, The Inn at

Penn, The Bellevue, The Edgewater Inn, The Warwick New York, The Plaza, The Carlyle, The

Mark. (See examples of such use attached as Exhibit I).

The Examining Attorney contends that the element “THE” is nondistinctive, not

significant, and does not alter the primary significance of the mark as a whole from that of a

surname. (See December 13, 2018 Office Action). Applicant respectfully disagrees. The article

“THE” may be small, but based on the rules of English grammar, it changes the nature of the noun

that follows; or, approaching the grammar in reverse, singular noun surnames cannot be used with the article “THE.” Thus the seemingly insignificant element plays a significant role in the look and feel of the applied-for mark in connection with hotel services. Accordingly, because of the

structure, look, and feel of the mark in its entirety, the primary significance of the mark to the

purchasing public is not that of a surname.

C. “Merriweather” is a Rare Surname

An important factor in determining whether the applied-for mark will be considered primarily merely a surname by the relevant purchasing public is the frequency of the surname in the population. Benthin, 37 USPQ2d at 1332; In re Joint-Stock Company Baik, 84 USPQ2d 1921

(TTAB 2007). The more rare the surname, the less likely that the purchasing public will view the

mark as primarily merely a surname. Id. The Examining Attorney has submitted examples of 500

individuals from a LEXIS database of nationwide phone numbers and names. (See Attachments 1-

4 to December 13, 2018 Office Action). Applicant submits that Merriweather is a rare surname. In

the 2010 census database of surnames appearing more than 100 times, Merriweather has a

nationwide count of 4793 individuals with the surname. (See excerpt from census database found

at https://www.census.gov/topics/population/genealogy/data/2010_surnames.html attached as

Exhibit J). This is not a frequent enough count for “Merriweather” to be a common surname nor

for it to have enough exposure in the public to be considered primarily merely a surname. See In re United Distillers PLC, 56 USPQ2d 1220 (TTAB 2000) (finding HACKLER to be a rare surname with 1,295 listings in a Phonedisc database). As the relevant purchasing public of

Applicant’s hotel services has not been exposed to THE MERRIWEATHER with any frequency

as a surname, the relevant public is not likely to view the mark as primarily merely a surname, particularly in connection with the services of the application.

D. No Person Associated with Applicant has the Surname Merriweather

Applicant has confirmed to the Examining Attorney that no person associated with

Applicant has the surname Merriweather. (See April 17, 2019 Response to Office Action). This point is considered neutral. Baik, 84 USPQ2d at 1921.

E. All Doubts are Resolved in Favor of the Applicant

Applicant submits that the above evidence and argument has established that THE

MERRIWEATHER, when considered in its entirety, will not be perceived by the purchasing

public as primarily merely a surname in connection with hotel services. The impact of the mark, particularly with the element THE, is that of a hotel/building name, and not of a surname, particularly given all of the other non-surname associations and connotations of “Merriweather” that Applicant has demonstrated to be common in the public awareness.

To the extent that there are any doubts, the TTAB must resolve any doubts in favor of the

Applicant and approve the application for publication; if any others believe they will be harmed from the use of THE MERRIWEATHER in connection with hotel services, they will have the opportunity to file a notice of opposition. Benthin, 37 USPQ2d at 1334.

V. CONCLUSION

For the reasons stated above, Applicant submits that the mark of the Application is not

primarily merely a surname under Section 2(e)(4) of the Lanham Act.

Accordingly, Applicant respectfully requests that the Board reverse the final refusal to register and allow the mark of the present application to proceed to publication.

Children Adelaide Close Post attended the Mount Vernon Seminary and Eleanor Post Hutton College (now the George Washington University's Dina Merrill Mount Vernon Campus). She maintained a close Parent(s) Charles William "C. W." Post lifelong relationship with her alma mater and Ella Letitia Merriweather served as its first alumna trustee. Today, a Awards Legion of Honour collection of her correspondence with Mount Vernon administrators is maintained by GWU's Special Collections Research Center.[2] Post's complete collection of personal papers, as well as those of her father, are held by the University of Michigan's Bentley Historical Library.[3]

Lifestyle [ edit ]

In addition to Hillwood and other estates, Post's other lavish home was Mar-a-Lago in Palm Beach, Florida. Designed by Marion Sims Wyeth and Joseph Urban, Post willed Mar-a-Lago to the United States federal government in 1973 as a retreat for presidents and visiting foreign dignitaries.[4] The mansion was not, however, used for this purpose, prior to being declared a National Historic Landmark in 1980.[5][6] Mar-a-Lago, Marjorie Merriweather Post and her second husband, E. F. Hutton, owned Sea Post's estate on Palm Beach Island Cloud (Hussar V), the largest privately owned sea- going yacht in the world at the time.[7] Post also owned Camp Topridge on Upper St. Regis Lake in the Adirondacks, which she considered a "rustic retreat".[8] It included a fully staffed main lodge and private guest cabins, each staffed with its own butler. The expansive Great Camp, built in 1923 by Benjamin A. Muncil, eventually contained nearly 70 buildings, as well as a Russian dacha, on 300 acres. It was one of only two Adirondack camps to be featured in Life magazine. Another home, which she shared with Joseph Davies in Washington, D.C., was called Tregaron.[9]

Some of Post's jewelry, bequeathed to the Smithsonian Institution in Washington, D.C., is displayed in the Harry Winston exhibit. Post funded a U.S. Army hospital in France during

World War I, and, decades later, the French Boathouse at Camp Topridge government awarded her the Legion of Honour, in the degree of Commander. The Merriweather Post Pavilion, an outdoor concert venue in Columbia, Maryland, is named for her.[12]

In 1971, she was among the first three recipients of the Silver Fawn Award, presented by the Boy Scouts of America. The 425-acre (172 ha) Lake Merriweather at Goshen Scout Reservation in Goshen, Virginia, was named in her honor.

Russian art collection [ edit ]

During the 1930s, the Soviet government under Joseph Stalin began selling art treasures and other valuables seized from the Romanov family and former Russian aristocrats after the Russian Revolution to earn hard currency for its industrialisation and military armament programs. Critics[who?] have claimed that these items were expropriated; however, Post and Davies's transactions were from the recognised governmental authority.[13] Neither she nor Davies were involved with the original seizing of the items. Allegations later surfaced that many works of art from the Tretyakov Gallery and other collections were either donated or offered at nominal prices to Post and Davies, who were both art collectors. Davies is also alleged to have purchased art expropriated from Soviet citizens well after the Russian Revolution, including victims of Stalin's Terror at discount prices from Soviet authorities.[14][13]

Many of the items, which remain under the control of the Post estate or its agents, can be viewed at Hillwood, her former estate.[15] Hillwood has operated as a private museum since Post's death and displays her French and Russian art collection, featuring the work of Fabergé, Sèvres porcelain, French furniture, tapestries, and paintings.[16]

Personal life [ edit ]

Post married four times. In 1905, she married investment banker Edward Bennett Close of Greenwich, Connecticut, and they divorced in 1919. Together, they had two daughters:[16]

Adelaide Close (1908–1998), who married three times,[15] to Thomas Wells Durant, Merrall MacNeille, and Augustus Riggs IV. Eleanor Post Close (1909–2006), later known in the media as "Eleanor Post Hutton", married six times,[15] to film director Preston Sturges, Etienne Marie Robert Gautier, George Curtis Rand, Hans Habe, Owen D. Johnson (son of author Owen Johnson), and orchestra conductor Léon Barzin.

Post was married for a second time, in 1920, to financier Edward Francis Hutton. In 1923, he became the chairman of the board of the Postum Cereal Company, and they developed a larger variety of food products, including Birdseye Frozen Foods. The company became the General Foods Corporation in 1929. Post and Hutton divorced in 1935. They had one daughter:

Nedenia Marjorie Hutton (1923-2017), better known as the actress Dina Merrill.[16]

In 1935, Post married her third husband, Joseph E. Davies, a Washington, D.C. lawyer. They had no children and were divorced in 1955. From 1937 to 1938, in a crucial period leading up to World War II, Davies served as the American ambassador to the Soviet Union, ruled at that time by Joseph Stalin. During this time, Davies and Post acquired many valuable Russian works of art from Soviet authorities.

In 1951, their Long Island estate, which she had Marjorie Merriweather Post and her husband Ambassador Joseph E. Davies purchased in 1922 with Hutton, located in Brookville, (center) with Carlton Skinner at a New York, was sold to Long Island University for presentation of a Naval Reserve $200,000. It became C.W. Post College in 1954, now Pennant. known as LIU Post. In 1966, she became honorary housemother of Zeta Beta Tau's Gamma Delta chapter, often hosting the fraternity brothers for brunches. Post served as the honorary house mother of the college's first local fraternity, Sigma Beta Epsilon, which, in 1969, became the New York Beta chapter of Sigma Alpha Epsilon. Since Post had borne only girls, she referred to the fraternity of sons-in-law as her "boys", while they called her "Mother Marjorie". Post was honored by Sigma Alpha Epsilon fraternity as a "Golden Daughter of Minerva".[citation needed]

Her final marriage, in 1958, was to Herbert A. May, a wealthy Pittsburgh businessman and the former master of fox hounds of the Rolling Rock Hunt Club in Ligonier, Pennsylvania. That marriage ended in divorce in May 1964 and she subsequently reclaimed the name Marjorie Merriweather Post.[16]

Post died at her Hillwood estate on September 12, 1973, after a long illness, and was buried there.[16] She left the bulk of her estate to her three daughters.[17]

She appears as a character in the movie Mission to Moscow (1943), played by Ann Harding.

She is played by Morgan Bradley in the documentary The Food that Built America (2019).

As of 2008, a film based on The New York Times feature "Mystery on Fifth Avenue", describing a riddle-laden renovation of a triplex undertaken by Eric Clough and the architectural firm 212box, built for Merriweather Post in the 1920s,[18] was in development by J. J. Abrams.[19]

Edit links without guitar. Drawing inspiration from Panda Bear's Person Pitch, the band used samplers as its primary instruments. The group debuted nine of these songs, most of which would later appear on the album, in May 2007 and toured with them through 2008.

Recording [ edit ]

To record their eighth studio album, Animal Collective sought the services of Ben H. Allen as co- producer. In an interview with the Baltimore City Paper, Allen stated that the band chose him due to "my work with Gnarls Barkley, and wanted my low-end expertise".[7] According to band- member Brian Weitz, while "[t]hat was the original attraction", Animal Collective was also impressed by his eclectic music tastes, "[h]e seemed to be somebody that technically knew how to work in [urban hip-hop], but was open-minded to other styles as well. . . . knowing that he’d been involved in a lot of the Bad Boy Records stuff from the '90s was exciting to us".[4] Subsequently, the band and Allen met over a few conference calls on Skype in January 2008, and began recording on February 1 at Sweet Tea Recording Studio in Oxford, Mississippi.[7][4]

Privacy during the sessions was paramount for the group, and a significant factor for choosing Sweet Tea. According to Allen, "During the whole month we worked on the album, the only people there were me, my assistant, and the band. No phones or computers. . . . It’s a small town, we were in the South, no one knew who they were. It was nonstop [work]".[7] The studio also offered other advantages; Dave Portner felt Sweet Tea was "the vibiest studio I’ve ever been in. It feels like you’re making music in a living room that just happens to have a Neve 8038 desk in it".[4] Further, since Animal Collective planned to record a sample-heavy album, the studio's large control room was ideal; Weitz stated, "we wanted to do most of the tracking in the same room as the engineer".[4] On Merriweather Post Pavilion, the band wanted to capture a live sound on record, just as it intended to on Strawberry Jam. However, recording methods for the two albums were very different, in Noah Lennox's words, "we went about them in totally opposite ways". While on Strawberry Jam they worked with a live foundation (over which they added few overdubs), on Merriweather... they "tracked pretty much every sound individually on its own channel, so that we’d have complete control over every sound in the mixing process".[8]

The band adopted a number of unorthodox recording practices. For instance, Animal Collective set up its PA systems in the control room in an attempt to replicate the group's live sound; Weitz said, "since so much of [the album] was electronic and sample-based, we used those PA speakers to make the samples".[4]

The track was subsequently posted on many blogs, including Pitchfork, but was later removed virtually everywhere by the international internet policing company Web Sheriff.[16][17] On November 24, it was incorrectly reported that the band Grizzly Bear had leaked the track through their blog.[18] Ed Droste of Grizzly Bear later clarified that they had only reposted the track as many other blogs had done.[18] A low-quality vinyl rip of the album leaked online on December 25, 2008.[19]

The album was released on vinyl in the United States on January 6, 2009.[20] It was released on both vinyl and CD in the UK on January 12, and on CD and digitally in the United States on January 20.[21] Peaking at number 13 on the United States Billboard 200,[22] by 2012 the album had sold over 199,000 copies, more than twice as many as the group's previous top-seller, Strawberry Jam.[23] In 2009. It was awarded a silver certification from the Independent Music Companies Association which indicated sales of at least 30,000 copies throughout Europe.[24]

Merriweather Post Pavilion was met with universal Professional ratings acclaim. At Metacritic, which assigns a normalized Aggregate scores

rating out of 100 to reviews from mainstream Source Rating critics, the album has received an average score AnyDecentMusic? 8.4/10 [25] [26] of 89, based on 36 reviews. Slant Magazine Metacritic 89/100 [26] and Uncut gave the album five out of five Review scores stars.[37][38] Stephen Troussé of Uncut wrote that Source Rating the album "feels like one of the landmark AllMusic [27] American albums of the century so far."[37] The A.V. Club A[28] Andrzej Lukowski of Drowned in Sound wrote "Is Entertainment Weekly A−[29] Merriweather Post Pavilion the flawless album that The Guardian [30] it's been willed to be? Pitchfork's Mark Richardson gave the album a 9.6 out of 10 rating, stating the album is "striking in its immediacy and comes across as friendly and welcoming".[33] Later that year, Pitchfork ranked Merriweather Post Pavilion 14 on their Top 200 Albums of the 2000s list and also the Album of the Year for 2009.[41] The A.V. Club's Andy Battaglia called the album a "summation and an expansion of everything Animal Collective has done so far, with a sharper focus on melody and more emboldened vocals that drive the songs."[42] Dave Simpson of The Guardian gave the album four out of five stars, declaring the album sound as "their most 'pop'" and the album itself as "a joyful, transcendent record somehow reminiscent of kids let loose in a musical sandpit."[43] Entertainment Weekly's Leah Greenblatt awarded the album an A- stating that although it "won't land the band the opening slot on a Coldplay tour", the album "cleaves closer to Person Pitch's more listener-friendly aesthetic".[44]

In their 2009 end of year coverage, UK music magazine Clash named 'Merriweather Post Pavilion' its Album of the Year, publishing an in-depth look at the album and interview with the band's Noah Lennox (a.k.a. Panda Bear).[45] Spin Magazine ranked it the best album of the year,[46] as did Entertainment Weekly and KEXP.[47] Rolling Stone placed it at 14 on their list[48] and it ranked 30th in The Wire's annual critics' poll.[49] Readers across Canada voted the album the No. 2 experimental[50] and No. 7 electro album of 2009 in Exclaim! magazine.[51] In 2010, the album was included in the book 1001 Albums You Must Hear Before You Die.[52]

Quick help Problem Even after studying articles for years, many non-native speakers of English find it challenging to use articles, especially Consultant bios in formal academic writing in English. This kind of writing in general uses more nouns than other types of writing1, and every noun requires a decision about articles. In addition, this decision can have an important impact on a noun’s Resources for meaning, and failure to use articles appropriately can also result in poor readability of a text for an American academic instructors reader. Although native speakers of English have internalized these decisions and rarely have to think about article choice, non-native speakers of English must constantly think about whether to use a/an, the, or ø (no article). Making Dissertation an appropriate choice—that is, a choice that does not violate English grammar rules and delivers the writer’s intended Retreat meaning—can be complicated. Step 2: Determine whether each proper noun is singular or plural. Article usage with a proper noun is affected by more than whether the noun uses a singular or plural form.

Proper nouns in a singular form infrequently use articles. For example, you would not use an article with the following singular proper nouns: Thursday, Geography 1301, Coffman Union

Proper nouns in a plural form frequently use the. For example, you would use the with the following proper plural nouns: the Girl Scouts, the Minnesota Twins

Step 3: Determine whether the noun belongs to a category that typically uses ø or the. Some article usage with proper nouns is not necessarily dependent on whether the noun is plural or singular. This kind of article usage must simply be memorized.2

The following categories of proper nouns frequently use ø: Proper nouns used as possessives (Darwin’s Theory of Evolution).

Names of a single mountain, lake, or island (Mount Everest, Lake Calhoun, Harriet Island).

Names of a continent, country, province, state, or city, except for those that contain the words “united” or “union,” or use an “‘of’ phrase” (North America, Canada, Quebec, Minnesota, Minneapolis).

Names of a college or university, except for those that contain an “‘of’ phrase” (Hamline University, Macalester College).

The following categories of proper nouns frequently use the: Family names made plural with an “s” (the Pinkers).

Names of large regions, oceans, or rivers (the Midwest, the Atlantic Ocean, the Mississippi River).

Names of mountain ranges (the Rocky Mountains or the Rockies).

Names of countries that use a plural form or contain the words “united,” “union,” or an “‘of’ phrase” (the Bahamas, the United States, the European Union, the Republic of Korea).

Names of most buildings or structures (the Empire State Building).

Names of companies that contain the words “company,” “corporation,” or “foundation,” or that include “the” as part of the registered or official name (the Ford Motor Company, the Unocal Corporation, the Mozilla Foundation, The Nature Conservancy).

Names of theories, effects, devices, scales, etc. m odified by a proper noun used as an adjective (the Doppler effect)

Step 4: Treat article usage with acronyms and abbreviations in the same way as nouns that are spelled out. (This is true for proper nouns and common nouns.) If a noun spelled out takes a/an, the, or ø, treat the noun's acronym or abbreviation the same way.

The UN [The United Nations] has played a key role in the stabilization of Haiti after the 2010 earthquake. (singular proper noun)

Pocket PCs [personal computers] are becoming increasingly popular. (plural common noun)

An HDTV [a high definition television] has a clearer picture and better sound than an SDTV [a standard definition television]. (singular common noun)

When an acronym or abbreviation is used as an adjective, choose the article according to the noun being modified:

The NASA [National Aeronautics and Space Administration] virtual telescope is currently providing high resolution images of Mars. (The choice of article, in this case “the,” refers to the common noun “virtual telescope,” not the proper noun “NASA.”)

Microsoft is the current leader in PC [personal computer] technology. (The choice of article, in this case ∅, refers to the common noun “technology,” not “PC,” which is also a common noun.) Step 5: Be prepared to seek help with exceptions. Even though the rules and resources above can help you control a large percentage of your article usage with nouns, there are an unfortunate number of exceptions. Using a good learner’s dictionary such as The Longman Dictionary of Contemporary English, asking a native-English-speaking friend, analyzing sample texts that use the proper noun(s) under question, and/or working with a writing consultant in Student Writing Support can help you note these exceptions.
