TITLE: Approve Parcel Requesting Inclusion in Certified Agricultural District Pursuant to Chapter 523 of the Laws of 2003

WHEREAS, Chapter 523 of the Laws of 2003 amended NYS Agriculture and Markets Law to provide that any county containing a certified agricultural district shall designate an annual thirty day period within which a land owner submit to such body a request for inclusion of land which is predominantly viable agricultural land within a certified agricultural district prior to the established review period, and

WHEREAS, pursuant to Resolution No. 318 of 2003, the Washington County Board of Supervisors designated the period of December 1 to of each year as the amend period for certified agricultural districts in Washington County, and

WHEREAS, a duly advertised public hearing was held on November 20, 2020 to hear recommendations and comments concerning the parcel requesting inclusion, and

WHEREAS, the Washington County Agricultural and Farmland Protection Board has met and recommend that the parcel be included in the respective Agricultural District; now therefore be it

RESOLVED, that due to the fact that these lands are currently in agricultural production, the inclusion thereof will not have a significant environmental impact and therefore a negative declaration shall be prepared with the Chairman of the Board of Supervisors authorized to execute those documents necessary for said determination; and be it further

WHEREAS, pursuant to Article 25A of the Agriculture and Markets Law, Consolidated Agricultural District No. 5 in the Towns of Cambridge, Jackson, Salem and White Creek is now due for its eight year review, and

WHEREAS, a duly advertised public hearing was held on November 20, 2020 to hear recommendations and comments concerning the district, and

WHEREAS, pursuant to SEQRA, a negative declaration and notice of determination of non significance was issued, and

WHEREAS, the Washington County Agricultural and Farmland Protection Board has met and recommend that the District be reaffirmed; now therefore be it

RESOLVED, that the Washington County Board of Supervisors hereby reaffirms Consolidated Agricultural District No. 5 for an additional eight years.

TITLE: Ratify Agreement Between Washington County and the Washington County Sheriff’s Association PBA for Years 2020 – 2022

WHEREAS, the membership of the Washington County Sheriff’s Association PBA have ratified a proposed collective bargaining agreement with Washington County for the years 2020 - 2022; now therefore be it

RESOLVED, that Washington County does hereby ratify the aforesaid agreement; and be it further

RESOLVED, that the Chairman of the Board of Supervisors is hereby authorized to execute the agreement with the Sheriff’s PBA in a form approved by the County Attorney.

BUDGET IMPACT STATEMENT: The total net cost inclusive of health insurance adjustment is 7.72% for three years for an average of 2.57% a year.

TITLE: To Authorize One-Time Compensation for COVID-19 Incident Management Team Members and Buyback of Up to Two (2) Weeks of Vacation Time for Exempt Employees

WHEREAS, the COVID-19 Pandemic has caused unprecedented disruption to County operations in 2020, and

WHEREAS, in recognition of the increased risk posed to employees who continued to work during the nationwide lockdown earlier this year the Board of Supervisors authorized time and a half hazard pay for all hourly employees who reported to work, and

WHEREAS, the Board of Supervisors recognizes that many exempt employees worked throughout this period as well, and

WHEREAS, the members of the County’s Incident Management Team put in tremendous effort and hours throughout the year as well, and

WHEREAS, the Finance Committee has recommended that all members of the Incident Management Team receive a one-time compensation in the amount of $5,000 in recognition for their efforts in response to this challenging situation, and

WHEREAS, the Finance Committee has also recommended that all exempt employees be eligible to have up to two (2) weeks of vacation time purchased back by the County at the employee’s standard daily rate of pay in recognition that many exempt employees worked throughout the nationwide shutdown and may not be able to use all of their accrued time; now therefore be it

RESOLVED, all exempt employees are eligible to have up to two (2) weeks of accrued vacation time bought back by the County at the employee’s regular daily pay rate; and be it further

RESOLVED, such election must be made in full-day increments, and all eligible employees must notify the County Treasurer of their intent to exercise this option prior to , 2020.

BUDGET IMPACT STATEMENT: One-time compensation to the Incident Management Team will cost $30,000. Estimated monetary cost for the buyout of vacation time is $75,000 but may be higher or lower depending on the utilization of exempt employees electing to exercise this option.

TITLE: To Appoint Commissioner of Elections; Republican

WHEREAS, the term of Leslie Allen, incumbent Election Commissioner Republican Party ends December 31, 2020, and

WHEREAS, the Washington County Republican Committee has recommended the appointment of Thomas C. Rogers as Republican Commissioner on the Board of Elections in accordance with Article 3 of the Election Law; now therefore be it

RESOLVED, that Thomas C. Rogers is hereby appointed as Commissioner of the Board of Elections; Republican effective January 1, 2021 for a term expiring December 31, 2024.
