INTRODUCTION Prior to May 1980, the French domestic law on arbitration" had not been subject to any substantial legislative reform since the early nineteenth century. The procedural part of that law, which contained practically all of the French legislative provisions apply- ing to arbitration, was out of date and in need of reconsideration. Despite the considerable French procedural law reforms enacted in 1975,2 articles 1005 through 1028 of the Nouveau Code de procg- dure civile had not been revised to any significant extent since the enactment of the Code de procedure civile in 1806. 8 A. The Antecedent Legislation The French legal system had been living with provisions on domestic arbitration which, per force, contained gaps 4 and did not respond to many of the fundamental doctrinal issues that had sur- faced in arbitral practice and court litigatiort dealing with arbitra- tion since 1806.1 Despite the absence of modern legislation, con- temporary French courts exhibited a remarkably receptive attitude towards arbitration, and recourse to arbitration was frequent in 1. The most striking of these examples is the Synod of Pistoia (1786), the high-water mark of “late Jansenism.” Most of the reforms of the Synod were harshly condemned by Pope Pius VI in the Bull Auctorem fidei (1794), and late Jansenism was totally discredited in the increasingly ultramontane nineteenth-century Catholic Church. Nevertheless, many of the reforms implicit or explicit in the Pistoian agenda – such as an exaltation of the role of bishops, an emphasis on infallibility as a gift to the entire church, religious liberty, a simpler and more comprehensible liturgy that incorporates the vernacular, and the encouragement of lay Bible reading and Christocentric devotions – were officially promulgated at Vatican II.

    Margarita Decretalium The Margarita Decretalium ("Pearls of the Decretals") is the index that appears at the end of the Decretales Gregorii IX , or Liber Extra , volume 2 of the three-volume Corpus Juris Canonici , online at http://digidev.library.ucla.edu/canonlaw/ It is an index to the text of the decretals themselves, in contrast to the Materiae Singulares at the beginning of the volume, which is an index to the Ordinary Gloss (q.v.). The Margarita index seems to have been assembled during the late thirteenth century, some time before the appearance of the Liber Sextus in 1298. Most of the references to the legislation of Innocent IV (1243-54) and Gregory X (1272-76) are to their Novellae, even when specifying decretals that were incorporated into the Sext (their position in the Sext is indicated in the expanded edition of the Margarita below). Occasionally one does see a reference to the Sext (for instance in the entry, "Accusatio contra inopem," referring to Innocent IV's decretal Frequens from the Second Council of Lyons, Sext 2.5.1, but this is undoubtedly the work of later editors). Each entry in the original index gives only the title and chapter incipit of the relevant decretal, in addition to the column number; in the edited index below, the book, title, and chapter numbers have been added.
