GLOSSARY Affected – Means project affected household consisting of such persons, his Household or her spouse, minor sons, unmarried daughters, minor brothers or unmarried sister, father, mother and other members residing with him/her and dependent on him/her for their livelihood. Displaced Person – In the context of involuntary resettlement, displaced persons are (DP) those who are physically displaced (relocation, loss of residential land, or loss of shelter) and/or economically displaced (loss of land, assets, access to assets, income sources, or means of livelihoods) as a result of (i) involuntary acquisition of land, or (ii) involuntary restrictions on land use or on access to legally designated parks and protected areas. Compensation – Payment in cash or in kind of the replacement value of the acquired property. Grievance – The committee established under the subproject to resolve the Redressal local grievances. Committee Involuntary – Addresses social and economic impacts that are permanent or Resettlement temporary and are (i) caused by the acquisition of land and other fixed assets, (ii) by change in the use of land, or (iii) restrictions imposed on land as a result of a project. Land Acquisition – The process whereby land and properties are acquired for the purpose of the project construction Rehabilitation – The measures provided under the resettlement plan other than payment of the compensation of acquired property. Replacement Cost – The method of valuing assets to replace the loss at market value before the project or dispossession, or its nearest equivalent, plus any transaction costs such as administrative charges, taxes, registration, and titling costs. Replacement cost is based on the market value before the project or dispossession, whichever is higher. Resettlement – All the measures taken to mitigate all or any adverse impacts of the project on the DPs property and/or livelihoods including compensation, relocation (where relevant), and rehabilitation

1. Introduction and Project Description 1. The hydropower potential of Himachal Pradesh is about 27,436 MW, which is about one- fourth of the total hydropower potential of India. The Government of Himachal Pradesh (GoHP) in its Hydropower Policy (2007), has fixed its targets to harness the hydropower with the goal to become the "hydropower state" of the country. The state's hydropower policy includes the development of infrastructures such as road access and transmission interconnections to facilitate hydropower generation and its further evacuation to encourage investment from the state, central government and private sectors. Majority of the hydropower generation projects are run-off- the river type. Implementation of the hydro policy will improve state financial health by earning revenue from supplying surplus power to the National Grid. In addition to developing its hydropower resources, HP has to build out its electric transmission infrastructure so that the additional power can be efficiently transmitted within the state and exported to the national grid. 2. For improvement / strengthening of existing infrastructures and addition of new infrastructure for effective power evacuation, the Government of Himachal Pradesh (GoHP) through the Government of India (GoI), has requested the Asian Development Bank (ADB) for a Multi-Tranche Financing Facility (MFF) to provide financial assistance to the power sector investment program in the state. The investment program covers investments for transmission of clean energy to National Grid of India by the construction of pooling substations and extra-high-voltage (EHV) transmission lines. To implement this, the GoHP has established Himachal Pradesh Power Transmission Corporation Limited (HPPTCL) vide HP Government notification no. MPP-A (1)- 4/2006-Loose dated 11th September 2008 and HPPTCL was declared as the State Transmission Utility (STU). Vide notification no. MPP-A (3)-1/2001-IV dated 10th June 2010. 3. The $350 million investments in the MFF to be supported by ADB, will contribute to support the economic development in HP through expanded power supplies from clean energy sources, and support a sustainable state electricity sector in the state. The Himachal Pradesh Clean Energy Transmission Investment Program (HPCETIP) is expected to produce the following outcomes: (i) increase in availability of clean energy downstream at polling stations for effective power evacuation in a financially sustainable manner, (ii) improvement of state finances and power sector financial viability from sales revenue earned from power exports, (iii) improve sector governance, (iv) improve capacity in HPPTCL for better planning, implementation, and management of power evacuation infrastructure, and energy efficiency through a better power management program, and (v) improvement in standards of environmental and social safeguards in the sector. With ADB support, the proposed program will sustain the energy sector reform agenda and is expected to help attract other long-term financiers to the state. 4. The Tranche 1 sub-projects are located in Kinnaur, Mandi, Kangra and districts of Himachal Pradesh. Himachal Pradesh extends from the Shivalik Hills in the south to the Great Himalayan ranges including a slice of trans-Himalayas in the north. The state falls between latitude 30’22” and 30’12” north and longitude 75’45” and 79’04” East. It is located between the Ravi River in the west and Yamuna River in the east. Its greatest length is 355 Km from the north-western extremity of Chamba to the South-eastern tip of Kinnaur and the maximum width is 270 Km from Kangra in Southwest to Kinnaur in the northeast. The altitude ranges from 450 to 6500 meters above mean sea level, which increases from West to East and South to North. The

2. Purpose of the Report 5. The purpose of the semi-annual social monitoring report (SMR) is to analyze periodically over the total implementation period of the project to comply with the approved safeguard documents. 6. This report covers resettlement and social safeguard monitoring results to comply with the spirit of ADB policy to ‘enhance stakeholders’ trust ‘in and ability to engage with ADB and thereby increase the development impact (of projects) in which disclosure of safeguard monitoring is a prominent aspect. This report covers the status of resettlement implementation and addressing all the issues related to social safeguards, with reference to the progress achieved and the status during the reporting period. 7. This report outlines the monitoring implementation of social safeguard activities from July to December 2018 in accordance with the ADB Safeguard Policy Statement (SPS), 2009. 3. Social Safeguards Categorization 8. The subprojects under Loan 2794-IND (Tranche 1) do not have any significant involuntary resettlement impacts and the project overall has been categorized as ‘B’ for involuntary resettlement (IR) and ‘C’ for Indigenous People (IP) in accordance with the ADB’s SPS 2009, which applies to this project. 4. Sub-projects under HPCETIP (Loan 2794- IND) Tranche I 9. The Tranche I comprise of six sub-projects (five substations and one transmission line 220 kV of 25.813 km and 400 kV of 3.076 km long). The list of the subprojects under HPCETIP (Loan 2794-IND) along with their scope, IR impact, status of Resettlement Plan (RP) implementation, and physical progress is presented below in Table 1. 5. Sub-projects implementation (Land Acquisition, Resettlement, and Rehabilitation) 5.1. Scope of Land Acquisition, Resettlement, and Rehabilitation. 10. The three sub-stations located at Bhoktoo, Wangtoo, and Pandoh are being constructed on the government land (forest land) for which necessary permissions have been obtained. The remaining two sub-stations located at Gumma (Pragati Nagar) and Chambi (Shahpur) are being constructed on land acquired from the private owners. The transmission line (Hatkoti to Gumma {Pragati Nagar} including LILO of Jakhri- Abdullahpur) requires the construction of 95 towers, of which 73 are located on privately-owned land. Details of land acquisition for tower footings are presented in Annexure 1: Details of land acquisition for Tower footings. For the construction of Gumma (Pragati Nagar) sub- station, 2.47 hectares (ha) of private land belonging to one affected household (AH) and Chambi sub-station, 1.06 ha of private land belonging to three AHs has been acquired. The location of Chambi sub-station has been changed from government to private land.

5.2. Status of Implementation of resettlement activities: I. 220/400 kV sub-station at Pragati Nagar (Gumma): 11. The land required for construction of sub-station at Pragati Nagar (Gumma) belongs to one AH and amount of INR 34.28 million was paid as compensation for the land (INR 32.96 million) and trees (INR 1.32 million) in 2012 and site was handed over to the contractor in 2014. The land has been acquired through the compulsory provisions of acquisition of the Land Acquisition Act (LAA), 1894. The compensation of land was paid prior to the start of civil works. The details of compensation are provided as Annexure 2 II. 132 kV sub-station at Chambi: 12. The land was acquired through mutual consent from three AHs and the compensation amount of INR 15.97 million was paid in 2015, and the site was handed over to the contractor in 2016. The compensation of land was paid prior to the start of civil works at the time of mutation in the presence of the legal entity (Tehsildar). The details of compensation are provided as Annexure 3 III. 220 kV D/C transmission line from Hatkoti to Pragati Nagar (including LILO of Jakhi to Abdullahpur): 13. The 220 kV Hatkoti to Gumma and LILO of Jakhi to Abdullahpur transmission lines require the construction of 95 towers. Out of 95 transmission towers, 80 (58 towers are on private land and 22 are on government or forest land) for 220 kV Hatkoti to Gumma transmission line and while remaining 15 (all on Private land) are under LILO of Jhakri to Abdullahpur transmission line. Structures of two AHs are going to be affected by Tower no DE-2, under LILO of Jhakri to Abdullapur transmission line. The land required for the construction of transmission towers in Hatkoti to Gumma (including LILO of Jakhi to Abdullahpur) transmission line is being acquired through mutual consents which are being witnessed by the third party. 14. Till the end of this reporting period, land for 70 transmission towers (58 towers of Hatkoti- Pragati Nagar and 12 towers of LILO of Jakri to Abdullahpur transmission line) has been made available for construction. The land belonging to 96 AHs has been procured for construction of 70 towers. The land for 68 transmission towers has been acquired through mutual consent from 94 AHs. The negotiations were done in the presence of Tehsildar and witnessed by the third party. Out of the 94 AHs, 10 AHs are coming under vulnerable Community. The land for these towers has been mutated in the name of HPPTCL after paying the due compensation. An amount of INR 33.59 million has been paid as compensation for land and other assets. In addition to that, a total of INR 11.72 million has been paid for fruit and non-fruit bearing trees affected due to the acquisition of land for construction of tower foundation. The negotiations with two landowners of two transmission towers were not successful and as such the HPPTCL has obtained the user rights of both the tower locations under Clause 10 (B) of the Indian Telegraphic Act, 1885 and an amount of INR 0.06 million has been paid as compensation for fruit and non-fruit-bearing trees. The land will be used HPPTCL while as ownership rights continue to be enjoyed by the owners. The payment of compensation of land and trees affected due to the land acquisition was done prior to taking possession of land and commencement of civil works. The status of compensation payments for towers in the transmission line of Tranche 1 is summarized in Table 2.

PGCIL, Central Transmission Utility (CTU), GoI team visited site on dated 18/08/2017 for LILO arrangement of 400 kV proposed transmission line and after physical verification of the site they advised that tower no-DE-II should be spotted in such a way that tapping with tower JAT-129 shall be almost at right angle and the level of DE-II be kept in such a way that loading on existing line/JAT 129 of PGCIL will be minimum. Hence DE II tower has been planned to place adjacent to JAT 129 at right angle fulfilling the condition of PGCIL. The tower location chart has been prepared as per the condition of PGCIL and approved by the Design office. Tower footing land of DE-II is going to affect structures of two AHs and which needs to demolish. The valuation of the structures has been done as per the basic schedule of rates in vogue and the compensation amount is calculated as per the agreed resettlement framework and new land acquistion act 2013. Copy of the approved calculation sheet of compensation is provided in Annexure 5. Detailed consultation with the AHs has been made and agreements are signed. Out of the total estimated cost INR6.7 million, an initial amount of INR 1.1 million has been paid to the AHs at the signing of agreements. Agreement copies are provided in Annexure 6. Till the end of the reporting period, the construction of transmission lines has impacted trees belonging to 180 AHs and paid INR 11.72 million. The payment of compensation for trees affected due to land acquisition was done prior to taking possession of land and commencement of civil works. As per the agreed resettlement framework, an additional amount of INR 18,900/-(equivalent to three months wages) as vulnerable assistance has been paid to each VAH. A amount of INR 0.15 million has been paid as compensation to nine vulnerable AHs and payment of one vulnerable AH is under process. The details are attached as Annexure 10. 6. Institutional Arrangements 22. HPPTCL is the Executing Agency (EA) of the state government and is responsible for overall execution of the projects under HPCEIP, supervising the implementation of the resettlement plans and ensuring compliance with the loan covenants. The Project Management Unit (PMU) is headed by the Managing Director (MD) and supported by two Directors (one Director (Planning and Contracts) and Director (Projects). Besides, that HPPTCL has eight PIUs (Gumma, Bhabanagar, Rohroo, Sarabai-I, Sarabai-II, Chambi, Chamba, Lahal) which are headed by the Senior Managers. 23. The Environment and Social Cell (ESC) at the corporate level monitors the policy and implementation related social and environmental impacts of all projects executed by the HPPTCL. The ECS at present comprises of one officer of the Deputy Manager who is supported by Social & R&R consultants and are responsible for day to day functioning of ESC. The order copy of the constitution is attached as Annexure 11. The HPPTCL has also a designated Land Acquisition Officer, who is responsible for coordination with the local revenue office, district administration, and acquisition of land and payment of compensation. The status of the staffing for land acquisition is provided as Table 7

The grievance redress committee (GRC) has been constituted by HPPTCL vide no- HPPTCL/ADB-F-33/2016-10446-50 dated 27/03/2017 at PMU and PIU levels. The initial grievances are being received at PIUs and fifteen days of time has been allotted to redress the grievances, if the grievances could not be addressed at the PIU level or AP is not satisfied with the resolution of the grievance, same shall be forwarded to GRC at Head office level. Till the end of the reporting period, a total 29 grievances have been received at PIU level, out of which 14 are related to fruit & non-fruit tree compensation, 11 are related to land compensation, three are related to pavement & debris disposal and rest one is related to structure. GRC at PIU level is able to resolve 13 grievances and two are under process, besides this 14 AHs has approached the court of law for enhancement of the compensation amount under the provisions of Land Acquired Act (LAA), 1894 out of which eight were dismissed by the court and other six matters are presently sub-judice. The composition of the GRC at PMU and PIU is presented in Table 8 & Table 9. 8. Consultation with Stakeholders 25. The ADB-approved safeguards documents have been disclosed on HPPTCL website in line with ADB's SPS 2009 requirements. The translation of the safeguard document has been made and available with PIUs and uploaded in HPPTCL website. The sample copy of the document (Cover Page) provided in Annexure 14 Up to the reporting period a total of 39 consultations (29 informal and 10 formal) were carried out with 398 stakeholders. During the reporting period, 10 formal consultations have been carried out with 96 stakeholders and details of public consultation are presented as Annexure 15, Photographs in Annexure 17 and attendance sheet in Annexure 19. During the consultation, it was found that people are aware of the project and rendering full support to the projects. Almost all are fully cooperatives & happy to get employment in the construction work of the projects. Few villagers were express their concern on safety and effect on the quality of Apple production and provided clarity by the technical persons. 9. Capacity Building Initiatives 26. For proper and smooth implementation of RP implementation and safeguards compliance as per ADB requirement, the capacity building of all the stakeholders involved in implementation work is very important. The philosophy behind this initiative is to develop a better understanding of the problem and to enhance productivity and efficiency. Till the end of the reporting period, five capacity building initiative was carried out and 171 number of participants have participated in the program and details is provided as Annexure 16, photographs of the consultation as Annexure 18 and attendance as Annexure 20. Similarly, 18 staffs of HPPTCL has been attended different safeguard training during the reporting period, details are provided in Table 11. 12. Conclusion 28. Land selection for the substation and towers will be in non-sliding zones and excavation and other construction activities will be carried out in scientific way. All the compensation has been paid prior to commencement of civil works.
