Please bring this copy. www.venice.coe.int CDL-REF(2012)003 - 2 - The Parliament - relying on Hungary’s legislative traditions based on popular representation; - guaranteeing that in Hungary the source of public power shall be the people, which shall pri- marily exercise its power through its elected representatives in elections which shall ensure the free expression of the will of voters; - ensuring the right of voters to universal and equal suffrage as well as to direct and secret bal- lot; - considering that political parties shall contribute to creating and expressing the will of the peo- ple; - recognising that the nationalities living in Hungary shall be constituent parts of the State and shall have the right ensured by the Fundamental Law to take part in the work of Parliament; - guaranteeing furthermore that Hungarian citizens living beyond the borders of Hungary shall be a part of the political community; in order to enforce the Fundamental Law, pursuant to Article XXIII, Subsections (1), (4) and (6), and to Article 2, Subsections (1) and (2) of the Fundamental Law, hereby passes the following Act on the substantive rules for the elections of Hungary’s Members of Parliament: 1. Interpretive provisions Section 1 For the purposes of this Act: Residence: the residence defined by the Act on the Registration of the Personal Data and Resi- dence of Citizens; in the case of citizens without residence, their current addresses. -

LEAGUE OF NATIONS INCIDENTS WHICH HAVE OCCURRED ON THE FRONTIER BETWEEN HUNGARY AND YUGOSLAVIA COMMUNICATION FROM THE HUNGARIAN GOVERNMENT Note by the Secretary-General : The Secretary-General has the honour to communicate to the Council, for consideration, the following letter, dated May 8th, which he has received from the Hungarian Government. LETTER FROM THE HUNGARIAN MINISTER FOR FOREIGN AFFAIRS TO THE SECRETARY-GENERAL OF THE LEAGUE OF NATIONS. Budapest, May 8th, 1934. On behalf of the Royal Hungarian Government, I have the honour to communicate to you, and through you to the Council of the League of Nations, the following application : Subject of the Application. The Hungarian Government has for several years past been watching with the greatest anxiety the serious incidents that are continually occurring at the frontier between Hungary and Yugoslavia in consequence of the patently hostile attitude of the Yugoslav authorities and officials towards the Hungarian population. Those authorities and their officials are con stantly—and, it would seem, systematically—committing acts and taking measures which result in fatal incidents and other atrocities and deplorable occurrences. The outcome of all these proceedings is a situation unparalleled in Europe, and one of which the gravity cannot but be realised. Reasons. 1 he countless complaints made in this connection by the population of the frontier-zone against the Yugoslav authorities, and also the attitude of the Yugoslav Government in refusing to make any attempt at a direct settlement of the dispute in question, make it imperative to appeal to an international authority. -

UDK: 327(497.1:439)’’1945/1946’’ 32(497.5)’’1945/1946’’ Izvorni znanstveni članak Received: September 7, 2012 Accepted: September 28, 2012 THE CROATIAN CONTRIBUTION TO PLANS FOR REVISION OF THE YUGOSLAV- HUNGARIAN BORDER IN 1945-1946 Petar BAGARIĆ∗ Th e Border Commission attached to the Presidency of the Government of the Federal State of Croatia prepared plans to revise the Yugoslav- Hungarian border during the period from the end of the Second World War to the Paris Peace Conference. Th is work introduces the Commission’s staff and presents its operating methods and the results of its work, as well as its rela- tions with federal institutions in Belgrade. Key words: Federal state of Croatia, Democratic Federal Yugoslavia, Hun- gary, Baja Triangle, Border Commission, alteration of borders. Introduction At the end of the Second World War in Europe, preparations commenced for a peace conference that would determine the peace conditions for the defeated states. Th e status of the defeated states was infl uenced by various factors: the time of their transfer to the Allied side, their armed contribution to the Allied victory or the number and strength of the victorious states which had territorial demands against their territories. Th e Democratic Federal, or Federal People’s Republic of Yugoslavia came out of the war as a victor and as the legal successor to the Kingdom of Yugoslavia. Th is meant that it could place before Hungary the matter of Hungarian occupation of territories such as Prekomurje, Međimurje, Baranja and Bačka during the Second World War and seek material and territorial compensation. -

HUNGARY Hungary is a republic with a population of approximately 10 million and a multiparty parliamentary democracy. Legislative authority is vested in the unicameral parliament (National Assembly). The National Assembly elects the head of state, the president, every five years. The president appoints a prime minister from the majority party or coalition. The National Assembly elections on April 11 and 25 were assessed as free and fair, with the conservative Fidesz- Christian Democrat (KDNP) coalition winning enough seats in the second round to achieve a two-thirds majority. Fidesz's prime ministerial candidate, Viktor Orban, took office on May 29. Security forces reported to civilian authorities. Human rights problems included police use of excessive force against suspects, particularly Roma; new restrictions on due process; new laws that expanded restrictions on speech and the types of media subject to government regulation; government corruption; societal violence against women and children; sexual harassment of women; and trafficking in persons. Other problems continued, including extremist violence and harsh rhetoric against ethnic and religious minority groups and discrimination against Roma in education, housing, employment, and access to social services. RESPECT FOR HUMAN RIGHTS Section 1 Respect for the Integrity of the Person, Including Freedom From: a. Arbitrary or Unlawful Deprivation of Life There were no reports that the government or its agents committed arbitrary or unlawful killings during the year. In December 2009 the Somogy County Military Prosecutor's Office pressed charges against 10 prison guards at the Kaposvar prison for causing the death of a pretrial detainee and physically assaulting nine other inmates in February 2009. -

It aims to guarantee the effective and lasting preservation and protection of Jewish cemeteries and mass graves throughout the European continent. Identified by the Hebrew phrase Lo Tishkach (‘do not forget’), the Foundation is establishing a comprehensive publicly-accessible database of all Jewish burial grounds in Europe, currently featuring details on over 9,000 Jewish cemeteries and mass graves. Lo Tishkach is also producing a compendium of the different national and international laws and practices affecting these sites, to be used as a starting point to advocate for the better protection and preservation of Europe’s Jewish heritage. A key aim of the project is to engage young Europeans, bringing Europe’s history alive, encouraging reflection on the values that are important for responsible citizenship and mutual respect, giving a valuable insight into Jewish culture and mobilising young people to care for our common heritage.
