5. The 5th Respondent is the Chairm an of the 4th Respondent and at all tim es m aterial to this Petition, the Chief Executive O fficer of the Com m ission w ith a decisive role in all m atters affecting the Presidential Election.

6. The 5th Respondent w as the Chief Electoral Com m issioner and Returning O fficer at the Presidential Election. In addition to the 5th Respondent, the 7th – 808th Respondents and num erous other officers including ad-hoc staff acted as agents of the 4th Respondent in the conduct of the April 21, 2007 election.

10. Your Petitioners state that at the end of the Presidential Election referred to in paragraphs 8 and 9 above, Alhaji U m aru Musa Yar’Adua of the People’s Dem ocratic Party (PDP) w as returned elected as announced by the 6th Respondent on the 23rd of April, 2007 w ith a total score of 24,638,063; and on the w ebsite of INEC w ith a total score of 24,784,227.

11. Your Petitioners shall contend that the scores ascribed to each of the candidates as show n above w ere not a true reflection of the candidates’ actual scores but rather the product of deliberate w rong entries and allocation of figures m ade by the 4th Respondent’s agents or officers at the Polling U nits, W ards, Local Governm ent Areas and State Collation Centres.

The declared results of the Presidential Election held on 21st of April, 2007 is hereby pleaded.

12. In the perform ance of its statutory functions in the conduct of elections including the Presidential Election, the 4th Respondent, its agents and officers are constitutionally and statutorily enjoined to be independent, neutral, fair, im partial, and at all tim es to act in the interest of the Federal Republic of Nigeria.

13. Your Petitioners aver that under Section 29 (1) of the Electoral Act, 2006, the 5th Respondent and all other officers and agents of the 4th Respondent are m andatorily required to affirm or sw ear to an O ath of allegiance to the Federal Republic of Nigeria and neutrality in the conduct of the election as provided for in the Second Schedule of the Electoral Act.

14. Your Petitioners state that the Presidential Election held on 21st of April, 2007 w as vitiated by acts of unlaw ful exclusion, w idespread corrupt practices, bias and partiality; your Petitioners also state that the result of the Election w as substantially affected by non- com pliance w ith the provisions of the Electoral Act, 2006.

15. The grounds on w hich this Petition is based are:

(a). the 1st Petitioner w as validly nom inated by the 3rd Petitioner but w as unlaw fully excluded from the election;

ALTERNATIVELY TH AT:-

(b) the election w as invalid by reason of corrupt practices;

(c) the election w as invalid for reason of non-com pliance w ith the provisions of the Electoral Act, 2006 as am ended; and

(d) the 1st Respondent w as not duly elected by the m ajority of law ful votes cast at the April 21, 2007 Presidential Election.

16. FACTS OF UNLAW FUL EXCLUSION

The facts on w hich the ground of unlaw ful exclusion is based are:

(a) The 1st Petitioner w as duly nom inated by the 3rd Petitioner as its candidate for the 21st April, 2007 Presidential Election;

(b) U pon the nom ination of the 1st Petitioner, the nom ination form w as duly com pleted and subm itted to the 4th Respondent;

(c) After subm ission, the 4th Respondent on 28th day of Decem ber, 2006 invited all the candidates including the 1st Petitioner to its screening and verification exercise;

(d) Subsequent to the screening and verification exercise, the 4th Respondent published a statem ent of the full list of the nam es of candidates standing nom inated pursuant to the Electoral Act;

(e) In the statem ent of the full nam es of candidates standing nom inated published by the 4th Respondent, the nam e of the 1st Petitioner w as unlaw fully excluded;

(f) In addition to sub paragraphs (a) - (e) above, the 4th and 5th Respondents, at different public fora and after nom ination RT/A/1/LT/Election Petitions - 38 -

had closed, repeatedly declared and stated that the 1st Petitioner w as disqualified from contesting the April 21, 2007 Presidential Election and im placably m aintained this position until the day of the election.

(g) The Petitioners w ill contend further that the 4th and 5th Respondents w ere biased and deliberately failed to give the Petitioners equal opportunity as w as given to other candidates to participate in the April 21, 2007 Presidential Election.

(h) The Petitioners w ill contend that the action of the 4th and 5th Respondents as enum erated in paragraphs (a) – (f) above, w as deliberate and effectively excluded the 1st and 2nd Petitioners from engaging in a m eaningful and effective contest as a candidate at the election for w hich he had been validly nom inated by the 3rd Petitioner.

Particulars of Unlaw ful Exclusion

i. The 3rd Respondent by a letter dated 18th January, 2007 actually instigated the events that led to the unlaw ful exclusion of the 1st Petitioner.

ii. U pon becom ing aw are of the letter by the 3rd Respondent during the screening, the 1st Petitioner, in his capacity as a nom inated candidate, replied, through his Counsel, to the 4th Respondent, inform ing the 4th Respondent that the allegations m ade by the 3rd Respondent w ere unfounded.

iii. The 4th Respondent at no tim e thereafter reverted to the Petitioners about their response.

iv. O n the 7th day of March, 2007, the Federal H igh Court in Suit N o.: FH C/ABJ/CS/03/2007 betw een Action Congress vs. IN EC & Anor., Judgm ent w as delivered by Kuew um i J. in w hich it w as adjudged, am ongst others, that the 4th Respondent lacked pow er to disqualify a candidate at an election and that such pow er lies w ith the Court of Law .

The said Judgm ent shall be relied upon. RT/A/1/LT/Election Petitions - 39 -

v. Thereafter, in defiance of the said Judgm ent, the 4th Respondent proceeded to publish its official list of candidates excluding the nam e of the 1st Petitioner. In addition, the said list w as posted on INEC w ebsite. vi. A letter w as w ritten by the 3rd Petitioner to the 4th and 5th Respondents on the 9th day of February, 2007 com plaining about the unlaw ful exclusion of its candidate. vii. The 4th Respondent replied the Petitioner’s letter on 17th February, 2007 declining to revisit the unlaw ful exclusion.

The letters are hereby pleaded. viii. Follow ing the insistence of 4th Respondent on the 1st Petitioner’s unlaw ful exclusion, an action w as instituted at the Federal H igh Court, Abuja in Suit N o.: FH C/ABJ/CS/152/2007 (Alhaji Atiku Abubakar & Anor vs. IN EC & Anor.) before Tijani Abubakar J., Judgm ent w as delivered on the 3rd day of April, 2007 w hereupon it w as declared as follow s:

“(1) That an order is m ade directing the Defendants not to exclude the 1st Plaintiff from contesting the election to the office of the President of the Federal Republic of N igeria.

(2) That if excluded it is hereby ordered that Defendants include the N am e of the 1st Plaintiff as the Presidential Flag bearer of the 2nd Plaintiff.

(3) That the Defendants are hereby restrained from excluding the nam e of the 1st Plaintiff as the Presidential candidate of the 2nd Plaintiff except upon pronouncem ent by a Court of Law .”

The Judgm ent w hich is still subsisting shall be relied upon at the trial. ix. Your Petitioners shall lead evidence that in defiance of the O rder/Judgm ent of the Court, the 4th and 5th Respondents persisted in their decision to unlaw fully exclude the Petitioners, and stated that it w ould only obey O rders m ade by the Suprem e Court. x. Your Petitioners shall lead evidence that apart from the final list of presidential candidates published by the 4th Respondent on 15th March, 2007, no further am ended, supplem entary or m odified list of Presidential candidates w as published by the 4th Respondent in w hich the nam e of the Petitioners w ere included. xi. Notw ithstanding the fact that the 1st Petitioner w as unlaw fully excluded, the 4th Respondent proceeded to allocate 2,637,848 votes to the 1st Petitioner as a candidate in the election. xii. By reason of the unlaw ful exclusion, it becam e practically im possible for the 1st Petitioner to present him self effectively as a candidate at the election and for his supporters to canvass for votes on his behalf. xiii. The 1st Petitioner w as, prior to the election, a tw o-term Vice President, w ho had w on tw o (2) previous Presidential Elections on a joint ticket w ith the incum bent President, General O lusegun O basanjo. xiv. U pon joining the 3rd Petitioner, the 1st Petitioner pulled a substantial follow ership w hich stood him in good stead to have w on the election but for the 4th Respondent’s acts of unlaw ful exclusion. xv. In the course of seeking reversal of his unlaw ful exclusion, a Judgm ent of the Suprem e Court w as delivered on Monday, 16th April, 2007 w here it w as adjudged that the 4th Respondent had no pow er to disqualify a candidate in an election w ithout a law ful Court O rder. Notw ithstanding the Judgm ent of the Federal H igh Court of 3rd April, 2007 and the Judgm ent of the Suprem e Court of 16th April, 2007, the 4th Respondent still refused to restore and/or publish the nam e of the 1st Petitioner on the list of candidates standing nom inated as at Tuesday, 17th April, 2007.

xvii. O n Tuesday 17th April, 2007, the 809th Respondent in contravention of the Electoral Act, 2006, and the Constitution of the Federal Republic of Nigeria, 1999 issued an O rder prohibiting cam paign and public m eetings until after the date of the Presidential Election, w hich O rder w as brazenly enforced by the law enforcem ent agencies.

xviii. By the prohibition order issued by the 809th Respondent, the Petitioners w ere effectively deprived of the opportunity to undertake their electioneering cam paign up to the 20th of April, 2007, w hen by law cam paigns w ere to cease.

xix. That the party sym bol of the 3rd Petitioner as approved by the 4th Respondent w as not reflected on the ballot paper used for the April 21, 2007 Presidential Election the object and effect of w hich w as to exclude the Petitioners from a m eaningful and effective participation in the election.

At the trial, your Petitioners shall rely on New spaper publications, video recordings, m obile phone visual recordings, photographs, correspondences, and other form s of com m unications and other relevant docum ents exchanged betw een the parties.

17. FACTS OF NON COM PLIANCE

The facts on w hich the ground of non com pliance is based are:

(a) Your Petitioners hereby repeat all the facts pleaded in paragraph 16 above and adopt sam e as facts in support of the ground of Non Com pliance w ith the Electoral Act and the INEC Guidelines by the 4th – 808th Respondents and officers w ho

acted for the 4th Respondent in the conduct of the presidential election of 21st April, 2007.

(b) Your Petitioners further state that in the conduct of the Presidential Election, there w as non-com pliance in that:

i. U p to and including the date of election, 21st of April, 2007, there w as no final voters’ list as prescribed by the Electoral Act, 2006 as am ended. The result w as that a m ultitude of eligible voters w ere disenfranchised throughout the federation.

ii. Election w as not held at the sam e tim e and day throughout the federation. The tim e fixed by the 4th Respondent for election w as 8.00am – 3.00pm .

iii. O n the 19th of April, 2007, the 4th Respondent arbitrarily changed the tim e of the poll of April 21, 2007 to com m ence at 10.00am and close at 5.00pm .

iv. In the few places w here election took place at all, the actual voting exercise in m ajority, if not in all the Local Governm ent Areas, in practically all the states of the federation except Abuja and Lagos, did not open earlier than 2.00pm and continued till the early hours of the next day. The electoral officers nam ely 7th – 808th Respondents acting under strict instruction of their Resident Electoral Com m issioners saw to it that the acts and gross neglect particularized in the preceding and succeeding sub- paragraphs herein w ere deliberately created.

v. Eligible voters w ho turned up at the appointed hour of the voting at 8.00am , w ere disenfranchised as they w ent back hom e believing that the elections w ould not hold.

vi. In respect of late polls w hich ran into the late hours of the night, fear and insecurity discouraged eligible voters from casting their votes in the few places w here election took place at all.

RT/A/1/LT/Election Petitions - 43 - vii. The ballot papers used for the April 21, 2007 Presidential Election w ere w ithout serial num bers, w ithout counterfoils and w ere not in booklet form as prescribed by the Electoral Act, 2006 and INEC Election Manual. viii. In consequence, it becam e im possible to trace or audit ballot papers issued (used and unused) by the 4th Respondent for the purpose of the election throughout the federation. ix. The approved party sym bol of the 3rd Petitioner w hich w as w ell know n to its team ing supporters w as not reflected on the ballot papers w ith the result that a lot of eligible voters could not vote for the Petitioners. x. By contrast, the party sym bol of the 3rd Respondent w as properly and correctly reflected on the ballot paper thereby giving the 1st Respondent an undue advantage at the election. xi. The 4th Respondent did not publish the full list of validly nom inated candidates in the April 21, 2007 Presidential election as required by the Electoral Act, 2006. xii. In the few places w here voting took place at all, there w as m ultiple voting, scores of candidates w ere not entered by the Presiding O fficers at the polling units in Form EC8As; the form s w ere not signed by the Presiding O fficers at the polling units nor countersigned by party agents except for those of the 3rd Respondent. Results w ere not announced at the designated Polling U nits and at the various designated w ards, collation centers, in m ost Local Governm ent Areas in all the states of the federation except Lagos and Abuja. xiii. Form s EC8As and EC8Bs w ere produced in tw o parallel copies in duplicates bearing the sam e serial num bers to generate parallel results one of w hich invariably is authenticated and relied upon sim ply because m ajority votes w ere allocated to the 3rd Respondent therein. Typical exam ples of these duplicitous result form s are RT/A/1/LT/Election Petitions - 44 -

those from Benue South Senatorial District in Benue State, and num erous other states. xiv. Counting of votes w as not done at the polling units w here elections w ere held and no results w ere declared at the Polling U nits as prescribed by law . Instead, the 6th Respondent purported to have relied on results collated at state levels based on “scores TRANSMITTED ELECTRO NICALLY from the polling units and/or local governm ents across the nation.”

Notice is hereby given to the 4th – 42nd Respondents to produce before this Honourable Court all the used and unused ballot papers, Form s EC8A, EC8B, EC8C, EC8D, EC8D(A), EC8E, EC25 and EC40C used during the 21st April, 2007 Presidential Election. xv. Your Petitioners aver that the electoral m aterials w ere not m ade available to m ost of the states of the federation, local governm ent, w ards and polling units, by the 4th Respondent, its agents and officers, on the 21st of April, 2007 for the Presidential Election, thereby denying m ajority of the electorate the right to vote for candidates of their choice in general and the 1st Petitioner in particular. xvi. Your Petitioners aver that there are about 120,000 polling units scattered along the length and breath of the federation of Nigeria w ith som e of them located in riverine and m ountainous areas.

Notice is hereby given to the 4th Respondent to produce the list of all the polling units in Nigeria, w ard by w ard, local governm ent by local governm ent, at the trial of this Petition. xvii. Your Petitioners further aver that som e of the electoral m aterials actually arrived Nigeria in the evening of Friday, 20th April, 2007 from the Republic of South Africa thereby m aking it logistically im possible to distribute to the various polling units, w ards, local governm ents and the RT/A/1/LT/Election Petitions - 45 -

states of the federation before the date fixed for the election.

Reliance w ill be placed on South African New spaper, Mail& G uardian of April 26 to M ay 3 2007. xviii. Your Petitioners aver that som e other of the electoral m aterials w ere flow n into Nigeria on the day of the election by private chartered flight.

Reliance is hereby placed on Air Traffic Flight Schedule (Data) at the M urtala M oham m ed Airport of 20 th and 21st April, 2007. xix. Your Petitioners w ill contend at the trial of this Petition that w ith the terrain and rem oteness of m any local governm ent areas and states of the federation, coupled w ith the fact that there w as need to sort out the m aterials for distribution, such election m aterials could not have been distributed and w ere not so distributed by the tim e fixed for the election. xx. Your Petitioners aver that there w as no open secret voting during the 21st April, 2007 Presidential Election in m ost parts of the federation as there w as no polling booths erected for the election. xxi. In the few places w here elections took place, people w hose nam es w ere not on the voters’ register voted. xxii. In the few places w here election took place, m any persons w ho had not attained the age of 18 years, voted. xxiii. In m any states, people voted in private houses, unauthorized, and undesignated places. xxiv. The requisite form s m eant for use in the distribution and authentication of electoral m aterials w as not used by the 4th Respondent and its officers in the conduct of the election.

RT/A/1/LT/Election Petitions - 46 - xxv. Before and during the election, the 5th Respondent exhibited acts of gross bias w ith im punity against the person and candidature of the 1st Petitioner including:

a. publicly calling the 1st Petitioner a ‘frustrated politician’;

b. falsely describing the 3rd Petitioner as an illegal organization not having being registered by INEC;

c. after the Judgm ent in Suit No.: FH C/ABJ/CS/03/07 pleaded in 16 (iv) above, the 5th Respondent boasted that he w ill not com ply w ith the Judgm ent unless com pelled by the Suprem e Court;

d. in the course of processing the 1st Petitioner’s nom ination, the 5th Respondent falsely denied receipt of the 1st Petitioner’s photograph required to be placed on the ballot paper w hen in actual fact sam e had been duly delivered. xxvi. Your Petitioners aver that w hile election results from 25 states of the federation w ere still being aw aited on 23rd day of April, 2007, the 5th Respondent excused him self and w ent out of the collation center at the H eadquarters of the 4th Respondent leaving behind the party agents, to announce the result of the Presidential Elections, declaring the 1st Respondent the w inner and m aking pronouncem ents of victory for the 1st – 3rd Respondents as the Returning O fficer allegedly on the basis of scores ‘TRANSMITTED ELECTRO NICALLY ’ from various polling units and w ards throughout the country.

As at the tim e of declaration of the result, state by state breakdow n of the votes, or the percentage basis upon w hich the 1st Respondent w as declared w inner w ere not disclosed and till date have not been so disclosed. xxvii. No Form EC8D(A) w as com pleted before the result of the election w as announced; w hereas the Return Form EC8E w as required by law to be produced from RT/A/1/LT/Election Petitions - 47 -

FO RM EC8D(A) w hich itself m ust have been produced from FO RM EC8D to be brought by the respective state resident electoral com m issioners, w ho m ust have collated the scores subm itted to him from FO RMS EC8Cs he m ust have collated from Electoral O fficers of each of the Local Governm ent Areas in the state , w hile the form s EC8Cs w ere to contain the collated results subm itted by W ard Supervisory Presiding officers on the basis of Polling units result Form EC8As prepared by the presiding officers. xxviii. The election w as fundam entally flaw ed and did not m eet the m inim um standard of dem ocratic election anyw here in the w orld as attested to in the several post-election reports, issued by num erous and reputable local and international observers as w ell as print and electronic m edia houses officially invited by the 4th Respondent to m onitor the election.

Notice is hereby given to 4th Respondent, its agents and officers to produce Form s EC.25 and EC.40C used to record the distribution of election m aterials from the National Headquarters dow n to the various polling units in all the Local G overnm ents in each of the 36 States of the Federation.

Notice is also given to the 4th Respondent, its agents and officers, to produce before this Honourable Court the Voters’ Register for the presidential election, local governm ent by local governm ent, ballot papers (used and unused), list of the party agents earlier given to 4th Respondent by the political parties together w ith their specim en signatures.

The 4th Respondent, its agents and officers are hereby put on notice to produce the results Form s EC8A, EC8B, EC8C, EC8D, EC8D(A) and EC8E in each of the polling units, w ards, Local G overnm ents, in all the 36 states of the federation including the Federal Capital Territory,

Abuja for both the Presidential and the National Assem bly elections.

Evidence shall be led to establish the aforem entioned allegations through CD and video clips, m obile phone visual recordings, photographs, international and local observers’ report, new spapers and m agazines including The New s Magazine, Tell, The G uardian, ThisDay, Nigerian Tribune and The Nation.

18. CORRUPT PRACTICES

The facts on w hich the ground of corrupt practices is based are:

(a) Your Petitioners aver that the election w as invalid by reason of w idespread corrupt practices com prising ballot stuffing, m ultiple voting, ballot boxes snatching, intim idation, over- voting, inflation of results, bribery, under supply of voting m aterials, threats, falsification, beatings, killings, by the 1st – 4th Respondents, their agents and officers. These corrupt practices occurred in virtually all the States of the Federation, Local Governm ent Areas, w ards, and polling stations, but featured m ore especially in the follow ing states:

ANAM BRA STATE

i. In Anam bra State election m aterials arrived late from Enugu w hich affected onw ard distribution to the 21 Local Governm ent Areas. In Aw ka North, Aw ka South, O nitsha North, Nnew i North Local Governm ent Areas, hijacked ballot papers w ere stuffed in ballot boxes even w hen there w as no actual voting, ballot boxes w ere snatched, to the extent that the 2nd Petitioner, Chief Edw in U m e Ezeoke, vice presidential candidate of All Nigeria Peoples Party (ANPP) and the incum bent Governor of Anam bra State, could not vote w hereas results w ere declared by the 4th Respondent. Further:

i. In Nnew i South, O nitsha South, O nitsha North, Nnew i North, Ekw usigo, Njikoka, Anaocha Local Governm ent Areas, there w as absolutely no election. RT/A/1/LT/Election Petitions - 49 -

Election m aterials for the presidential and national assem bly elections w ere later found abandoned in the bush at Nnew i North and O nitsha South Local Governm ent Areas. ii. In Idem ili North Local Governm ent Area, there w as no exercise in all the w ards except O bosi w ard m ainly because election m aterials arrived late in the evening, and they w ere subsequently returned to the INEC office at O gidi. iii. In Idem ili South Local Governm ent Area, actual voting took place only in Aw ka-Etiti W ard I for just one hour. The other eleven (11) w ards, election m aterials arrived betw een 6.00pm and 8.00pm and they had to be returned to the INEC office at O joto. iv. In Aw ka South Local Governm ent Area, voting took place for only an hour in Nibo I & II, Nise II, and Am aw bia II & III, all the other rem aining 15 W ards did not hold any election due to late arrival of m aterials or absence of INEC officials. v. In Aw ka North Local Governm ent Area, m aterial w as distributed only to Mgbakw u W ard, Achalla I, II, and III. vi. In O rum ba North Local Governm ent Area, the m aterials left the Local Governm ent Secretariat at about 6.30pm ; none of the m aterials w as seen in any w ard or polling station. vii. In O gbaru Local Governm ent Area, there w as no election in the w hole of O kpoko Area com prising of 6 w ards. In the rest of the w ards, the election m aterials w ere returned to INEC office because of darkness. viii. In Dunukofia Local Governm ent Area, election w as held for about an hour, the electoral officer despite m y personal intervention refused to avail any party RT/A/1/LT/Election Petitions - 50 -

agent w ith the result as collated at the w ards, claim ing that he had only three (3) copies of the result sheet.

ix. In Ihiala Local Governm ent Area, the m aterials w ere dispatched from the local governm ent Secretariat at about 6.30pm ; none of the election m aterials w as sighted in any w ard, m uch less an election taking place.

x. In Aguata Local Governm ent Area, the exercise w as m arred by unbelievable height of irregularities, intim idation and non-com pliance w ith know n electoral rules and regulations. Labour Party for instance, w on w ith 90% votes for H ouse of Representative election w hile PDP purportedly ‘sw ept’ w ith landslide victory in the presidential and senate elections.

ADAM AW A STATE ii. In Adam aw a State particularly in Yola the Governor w as placed under house arrest and prevented from casting his vote; m ajority of eligible voters in Adam aw a North Senatorial District w ere prevented from voting, ballot papers w ere stuffed in ballot boxes, ballot boxes w ere snatched, election m aterials m eant for voting w ere abandoned in the bush, w ith several agents of the 1st – 4th Respondents arrested in connection w ith these offences. Card carrying m em bers of 3rd Respondent w ere recruited as ad-hoc staff of 4th respondent to conduct the election. Election m aterials w ere not delivered in the few local governm ent areas and or w ards before 1pm , w here it w as delivered at all. This deprived m ajority of eligible voters w ho turned out early, of the opportunity to vote, as they had to leave on sighting no electoral officers and m aterial. This pattern of m alpractice w as replicated in nearly all the local governm ent areas of the State as typified by Num an, Shelleng, Fufore, Mubi, Lam urde and Madegali Local Governm ent Areas. In Nasaraw a Yola North Local Governem nt Area w here voting m aterials arrived at RT/A/1/LT/Election Petitions - 51 -

about 1pm the voting w as stopped at 4pm , as against the 5pm officially perm itted.

Protest letters to the State Resident Electoral Com m issioner from the 3rd Petitioner’s officials in Adam aw a State shall be founded upon including letters dated 22/4/07 and 23/4/07.

BAUCHI STATE iii. In Bauchi State, especially in Bauchi North Senatorial District, the Presidential Election did not hold on Saturday, the 21st of April, 2007 but on Sunday, 22nd April, 2007. Ballot papers w ere stuffed in ballot boxes, ballot boxes snatched, w ith several agents of the 1st – 4th Respondents arrested in connection w ith these offences.

BAYELSA STATE iv. Election m aterials arrived very late in all the local governm ent headqutres. In som e cases they never arrived at all ow ing to the riverine and diffcicult terrain of the state. In all the lopcal governem tn areas of bayesla state w ithtout exception, election m aterial released to 4th respondent offcials did not include Result form s EC8As, EC8bs, and EC8Cs. As a result, som e supervisory presiding officers, afraid for their lives, sim ply disappeared from the local governm ent INEC offices w here they incom plete lection m aterial w ere delivered to them . They never show ed up at the w ard level to distribute the election m aterials to the officers w ho w ere to conduct the election at polling unit levels. As a result election never took place at all Bayelsa State. Nevertheless, results w ere allocated at the Local governm ent levels and transm itted to the Resident Electoral Com m issioner in w ho in turn announced victory for the 3rd Respondent in the presidential election. As a result the 3rd Petitioner’s party agents at w ard and poling unit levels found them selves lonely and idle at their duty posts as the 4th Respondent officers w ere now here to be found . This w as the experience in Kolokum o/Opolkum o, Ogbia, Southern Ijaw , Brass and Yenagoa Local G overnem nt Areas and the other others.

In the few cases w here election m aterials, but w ithout result form s , arrived, they w ere w ere so sm all they had to be rationed at the rate of 50 pieces of ballot papers per polling units, notw ithstanding that a polling unit has, on the average, about 500 registered voters.

BENUE STATE iv. In Benue State, the election m aterials w ere brought in late in m ost parts of the state, except Makurdi, the state capital. In few places in various local governm ent areas w here election took place at all, election m aterials w ere not distributed earlier than 3.00pm . Indeed, in Gw er Local Governm ent Area election did not hold at all but results w ere announced by the electoral officer after the election had been diverted to the house of the Local Governm ent Caretaker Chairm an w ho is a PDP stalw art.

There w ere ballot stuffing, violence and intim idation of the voters and the ballot papers w ere not serially num bered. Election m aterials w ere handed over to PDP stalw arts to m anipulate as suited their fancy. Retired m ilitary officers, w ho belonged to 3rd Respondent, used their connection in the arm y hierarchy to influence the security personnel deployed on the day of election to collude w ith 3rd Respondent in perpetrating rigging, intim idating and m aim ing opponents. A vivid exam ple w as that of one Chief Godw in Daboh Azuana, a PDP chieftain w ho patrolled the Vandekya Local Governm ent Area in a 12-seater bus protected by arm ed m obile policem en to snatch electoral m aterial m eant for the conduct of the election. Sim ilarly in Buruku Local Governm ent , a local governm ent caretaker chairm an, honourable Azor Chim egh diverted 23 ballot boxes out of 2y6 provided for Mbapen W ard to the Local Governm ent Secretariat, w here they w ere thum b printed and votes arbitrarily allocated to PDP as w inner. Form EC8As and EC8Bs w ere produced in tw o parallel copies in duplicates bearing the sam e serial num bers to generate parallel results one of w hich invariably is authenticated and relied upon sim ply because m ajority votes w ere allocated to the 3rd Respondent therein. As a result m ost agents opposition parties, to the PDP controlled governm ent in Benue State did not have copies of election results to audit and confirm their authenticity at various level of collation.

Typical exam ples of these duplicitous result form s are those from Benue South Senatorial District in Benue State; w hich w ere discovered to have been replicated in other states of the federation follow ing identical pattern.

CROSS RIVER STATE v. In Cross River State, the Presidential Election did not take place on Saturday, 21st April, 2007; in Cross River North Senatorial District, in fact, election w as conducted on Sunday the 22nd of April, 2007 because election m aterials w ere not flow n in w ith m ilitary aircraft until about 6.15pm on Saturday evening and this affected the follow ing local governm ents: O goja, Yala, Boki, Bekw ara, O banliku, and O budu that bestride tw o senatorial districts. During the conduct of the said election on Sunday, 22nd April, 2007, the agents and officers of the 3rd Respondent w ere given m aterials as presiding officers and supervisors. The Presidential Election w ere carried out by the 3rd Respondent’s personnel and resulted in m ost voters being disenfranchised. No notice of the arbitrary change of the date of election w as officially announced , and m ost voters never got know of m uch less see the election allegedly held on the follow ing day; instead voters w ent to attend their Sunday church services, w hich situation w as exploited by the agents of 3rd and 4th Respondent to concoct spurious election results at Local Governm ent levels in w hich m ajority of votes w ere allocated to the 1st Respondent.

In Cross River South Senatorial District that com prises of Calabar South, Municipal, O dukpani, Akam kpa, Bakassi and Akpaberio Local Governm ent Areas election took place on the 21st day of April, 2007; election m aterials w ere handed over to PDP officials w ho conducted election in their residences. There w as no voting at the designated polling units in nearly all the Areas. H ow ever, in som e polling units, few ballot papers w ere taken there w ithout result sheets.

Also, in Cross River Central, on the 21st day of April, 2007, election m aterials w ere distributed w ithout result sheet to Abi, Biase, O bubura, Ikom and Etung Local Governm ent Areas. The thum b printing w as done by the PDP officials under the protection of the police and m ilitary m en in som e areas like Ikom Four Corner and Edor.

EBONYI STATE vi. In Ebonyi State, election m aterials w ithout election result form s w ere all that w ere distributed to the various local governm ent areas outside of Abakaliki m ostly very late in the evening such that they never got to their destinations in good tim es to be used for the election. Irregularities m asterm inded by officials of the 4th Respondent, intim idation w ith active support of security agents characterized the election w here it held at all particularly in Afikpo South, Ebonyi South, O haozara, Ivo, Afikpo North, ballot papers w ere stuffed in ballot boxes, ballot boxes w ere snatched; election m aterials m eant for voting w ere abandoned in the bush, w ith several agents of the 1st – 4th Respondents arrested in connection w ith these offences.

EDO STATE vii. In Edo State particularly in Akoko Edo Local Governm ent Area in Edo North Senatorial District, and Edo Central Senatorial District com prising Esan Central, Esan North- East, Esan South-East, Esan W est, Esako Central, and Igueben, ballot papers w ere stuffed in ballot boxes, ballot RT/A/1/LT/Election Petitions - 55 -

boxes w ere snatched, w ith several agents of the 1st – 4th Respondents arrested in connection w ith these offences.

EKITI STATE viii. Voting m aterials w ere snatched by hoodlum s accom panied by the police in all the 11 w ards of Ido-O si Local Governm ent Area. U nauthorized private vehicle w ith Registration Num ber LD 365 LFD and AK 345 DK w ere used to convey election m aterials instead of the approved vehicles of the 4th Respondent. Also in Ido-Ekiti, hoodlum s snatched ballot boxes and this w as reported to the police.

ENUG U STATE ix. In Enugu State, particularly in Ezeagu Local Governm ent Area, election did not take place in 19 out of the 20 w ards. There w ere late arrivals of election m aterials and no supply of election m aterials. In Akpugoeze in particular, the 4th Respondent’s officials w ere not present and there w ere no election in som e parts of the state.

In O ji River, there w as no election because of late arrival of electoral m aterial and there w ere no result sheets save for Inyi W ards I and II w here voting started at about 5.00pm .

In Enugu North Local Governm ent Area, election m aterials arrived w ithout result sheets sam e for U denu Local Governm ent Area.

In Nsukka Local Governm ent Area, the 4th Respondent’s agents cam e and started accreditation for few m inutes and later packed up the m aterials w ith the aid of the police fully arm ed, left the place to unknow n area, at about 7.00pm .

G OM BE STATE x. In Gom be State particularly in Gom be South Senatorial District, ballot papers w ere stuffed in ballot boxes, ballot boxes w ere snatched; election m aterials m eant for voting w ere abandoned in the bush, w ith several agents of the 1st – 4th Respondents arrested in connection w ith these offences. In the few places w here voting too place at all, election m aterials did not arrive local governm ent areas until about 3pm , m aking it im possible for several eligible voters w ho had w aited all day to vote; m ajority had to leave in the belief that the election m aterial w ere not forthcom ing because nobody w as on hand to explain the reason for the delay in he arrival of election m aterials to them . Despite these delays, even w here election m aterial s eventually arrived, irregularities and m alpractices reported to law enforcem ent agents against 3rd and 4th respondent officials w ent unchecked. Evidence abound of the foregoing incidents and non – com pliance w ith the Electoral Act and guideline in m ost local governm ent areas including Kaltungo, Gom be, Akko, Tom be and Local Governem tn Areas as w ell as Kw am i, Funakaye, Nafida and Dukku Local Governm ent Areas .

IM O STATE xi. In Im o State, particularly in O w erri North and South Local Governm ent Areas, there w ere no election m aterials. W here election m aterials arrived at all, it did as late as 5.30pm , and I nsoe cases 7pm . The election m aterials m eant for the Local Governm ent Areas w ere diverted to the Governm ent H ouse, O w erri w here thum b printing took place.

- In Njiaba Local Governm ent, there w ere no election m aterials at the polling units, particularly in O kigw e and O rlu senatorial zones. Voters w ere intim idated by the presence of heavily-arm ed m obile policem en and m ilitary m en on patrol. The few ballot papers brought to the

Local Governm ent Areas w ere distributed to agents and loyalists of the 3rd Respondent.

- Further, there w ere no election m aterials and no election took place as at 3.30pm in the follow ing local governm ent areas: Ehem e-Mbano, Isialam bano, O nuim o, Njaba, O bow u, Ihite U bom a, and O w erri m unicipal.

- The w ard Chairm an and supervisor of the 3rd Petitioner w as disallow ed from voting in his polling unit at Achiga polling booth in U gbule W ard of Njeaba Local Governm ent Area.

- Supporters of the 3rd Respondent along w ith political hoodlum s attacked the said Chairm an, beating him m ercilessly and had to be rushed to the Christian Com m unity Clinic at U m uaka tow n, but had to be transferred to the Federal Medical Centre in O w erri as a result of the seriousness of the injury.

- There w ere unlaw ful thum b printings by agents of the 3rd Respondent.

- In Ehim e-Mbano Local Governm ent Area, election m aterials w ere not brought until after the tim e prescribed by the 4th Respondent thereby resulting in no election in that Local Governm ent Area. Voters w ho had earlier com e w ent hom e disappointed.

- In Nkw ere Local Governm ent Area, election m aterials w ere brought late in a private vehicle arm ed w ith thugs and m ilitary personnel.

- Also in Ibele W ard of Njeaba Local Governm ent Area, there w as no election as at 6.00pm because the 3rd Respondent’s officials along w ith the policem en in particular PC No.: 413347 diverted the election m aterials. RT/A/1/LT/Election Petitions - 58 -

JIG AW A STATE xii. In Jigaw a State, the election m aterials w ere brought in late and this infuriated the youths w ho set the state office of the 4th Respondent on fire. There w ere ballot stuffing, violence and intim idation of the voters and the ballot papers w ere not serially num bered.

KATSINA STATE xiii. In Katsina State, election w as characterized by short supply, or non-delivery and high-jacking of election m aterials. There w as lack of result Form s EC8As and EC8Bs. Arm ed thugs recruited from outside the state w ere unleashed on the electorates and non PDP party agents in various local governm ent areas. These thugs w ere supported by police and arm y personnel to harass non PDP supporters and party agents. They colluded w ith INEC officials and PDP stalw arts to snatch ballot boxes and ballot papers w hich w ere taken aw ay to unknow n destinations only to be returned under police protection filled w ith thum b-printed ballot papers. Incidents of these m alpractices w ere ram pant in Batagaraw a, Mani, Daura and m ajority of other Local Governm ent Areas including Katsina, the state capital.

Voter vigilance led to spontaneous resistance of this intim idation and m alpractices by the electorates leading to fatalities. There w ere several outbreak of violence and m aim ing throughout the state w hich effectively disrupted elections in m any poling units as the atm osphere w as unsafe for voting or counting of votes in m any local governm ent Areas. Nevertheless, the 4th Respondent returned m ind-boggling results in favour of the 1st Respondent in the State.

Som e of the incidents w ere reported to the State and National O fficers of 4th Respondent, and the Nigeria police but no action w as taken to brig them to justice. In cases w here PDP suspects w ere arrested by the police, they w ere released in no tim e before the end of the voting RT/A/1/LT/Election Petitions - 59 -

thereby creating a feeling of helplessness in the citizenry that the PDP w as above the law .

KEBBI STATE xiv. In Kebbi State, the Governor of Kebbi State, Adam u Aliero, a m em ber of the 3rd Respondent brought ballot boxes stuffed w ith ballot papers into Yaw uri and repeated sam e at Argungu Local Governm ent Area in com pany of stern an battle ready arm ed soldiers and police driving in convoy. Election m aterials w ere brought late into the state. As a result of late arrival of election m aterials, In the few places w here voting took place at all, election m aterials did not arrive local governm ent areas until about 3pm , m aking it im possible for several eligible voters w ho had w aited all day to vote; m ajority had to leave in the belief that the election m aterial w ere not forthcom ing because nobody w as on hand to explain the reason for the absence of election m aterials to them . Despite these delays, even w here election m aterials eventually arrived, irregularities and m alpractices w ere perpetrated by agents of 3rd and 4th Respondents in collusion w hich law enforcem ent agents. The prevalence of the foregoing incidents and non–com pliance w ith the Electoral Act and guideline w ere m ost glaring in Besse, Jega, Zuru, Yauri, Danko-W asagu and Local Governm ent Areas.

KW ARA STATE xv. In Kw ara State, election m aterials w ere brought in late. No election took place in Kw ara South Senatorial District except in Irepodun Local Governm ent Area. In Central Senatorial zone of the state, announcem ent of postponem ent of senatorial election m isled the team ing voters into believing that the Presidential Election w as equally postponed.

In Kw ara North, it w as reported on the NTA Television that election started at 10.00am in Iyaru village and by 10.30am , voting had closed. The ballot boxes w ere filled RT/A/1/LT/Election Petitions - 60 -

w ith thum b-printed ballot sheets. Five (5) ad hoc staff em ployed by the 3rd Respondents and their agents w ere arrested and m ade confessional statem ents on the television.

In Ifelodun Local Governm ent, election results w ere prepared by PDP in w hich one Sam uel Jim oh w itnessed all Form EC8Bs, as the 3rd Respondent’s agents in all the w ards of the Local Governm ent, although no election took place.

The Form EC8Bs in the said Ifelodun Local G overnm ent Area of Kw ara State shall be founded upon as typical evidence of unlaw ful voting in private residences of the 3rd Respondent’s supporters in several states of the federation. Sim ilar incidents shall be relied upon particularly as m ay be procured from inspection and copying of election result form s in the custody of the 4th Respondent pursuant to the Order of this Court m ade on M onday, 14th April, 2007 at the instance of the Petitioners.

KOG I STATE xvi. In Kogi State, particularly in O kene, O kehi, Ajaokuta, Dekina and Ankpa Local Governm ent Areas, election m aterials arrived late. There w ere no voting in m ost of the polling units in all the Local Governm ent Areas, election m aterials w ere diverted by unknow n persons in all the Local Governm ent Areas and soldiers and police m en w ere shooting and carted aw ay election m aterials from the Local Governm ent Areas.

In Yagba East, Kabba/Gunu, Ajaokuta, Ida, Igala, Mela/O doki, O lam aboro and O fu Local Governm ent Areas, no election took place in m ost of the w ards because of late arrival of election m aterials, including result form s, acts of thuggery by PDP supporters w ho high jacked ballot boxes and took them to private and unknow n destinations to thum b-print. filled w ith thum b-printed ballot papers in com pany of arm ed policem en.

NASSARAW A STATE xvii. There w as no voting in Nassaraw a W est Senatorial District. In the other senatorial districts of the state, Election m aterials w ere brought late into the state. there w as pervasive late arrival of election m aterials, In the few places w here voting took place at all, election m aterials did not arrive local governm ent areas until about 3pm , m aking it im possible for several eligible voters w ho had w aited all day, to vote; m ajority had to leave in the belief that the election m aterial w ere not forthcom ing because nobody w as on hand to explain the reason for the absence of election m aterials to them . Despite these delays, even w here election m aterial s eventually arrived , irregularities and m alpractices w ere perpetrated by agents of 3rd and 4th respondents in collusion w hich law enforcem ent agents w ho beat up or intim idated identified opposition party agents , and som e traditional rulers w ho offered their palaces as sanctuary for rigging. The prevalence of the foregoing incidents and non–com pliance w ith the Electoral Act and guideline w ere m ost glaring in Aw e, Keana, Lafia, Dom a, Nasaraw a, Kokona and O bi Local governm ent Areas w here results presented at the Local Governm ent collation centres and w ards levels show ed m anipulation of figures. Results Form s w ere duplicated w ith sam e serial num bers and used to replace genuine results from polling units and w ards from . Protests by 3rd petitioners agents at the local governm ent collation centers across the state w ere ignored, as w ell as at the State collation level.

NIG ER STATE xviii. In Niger State, at Suleja Local Governm ent Area, w hen the election w as com pleted, counting w as not done at the polling unit. Ballot papers w ere carried to the 4th Respondent’s office by the agents of the 3rd Respondent. RT/A/1/LT/Election Petitions - 62 -

Counting could not be effected as irate youths threatened to burn dow n the 4th Respondent’s secretariat but for the intervention of the Em ir of Suleja.

In Minna Tow nship, som e m em bers of the 3rd Respondent w ere caught w ith ballot boxes. This incidence w as reported to the police and those agents w ere kept in police custody at Minna.

Further, electoral boxes w ere stolen from the follow ing w ards in Minna Central:

a. Makera w ard; b. H assan Kukuruku; c. Kofan Nadak; d. Ansarudin Mosque; and e. H ospital Gate.

Evidence shall be led to establish the aforem entioned allegations through video clips, photographs, international and local observers’ report, new spapers and m agazines including The New s Magazine, Tell, The G uardian, ThisDay, Nigerian Tribune and The Nation.

OG UN STATE xix. Election in Abeokuta North, Abeokuta South, O w ode O bafem i, O deda, Ew ekoro, Ifo, Ijebu East, Ijebu North East, Ijebu O de , Rem o North ,Yew a South , Yew a North Local Governm ent Areas, w ere characterized by m ind boggling irregularities. Ballot papers w ere stuffed in ballot boxes, ballot boxes snatched, w ith several agents of the 1st – 4th Respondents arrested in connection w ith these offences. There w as late delivery of election m aterials and undersupply of ballot papers so that eligible voters w ere disenfranchised for lack of ballot papers. Even w here voting took place, the ballot boxes w ere snatched before close of polls and counting of ballots by PDP supporters aided by soldiers and arm ed policem en w ho w ere to provide security during the election. PDP supporters w ere seen carrying arm s, alongside arm ed security personnel. Agents of 3rd Petitioners w ere prevented from observing the conduct of the elections, beaten up w here they insisted on their right. Most of these incidents of electoral m alpractices w ere captured on video and phone recordings and photographs w hich shall be founded upon.

OSUN STATE xx. Voters w ere intim idated by security officials particularly in Ife Local Governm ent Area, also in Inisa, O do-O tin Local Governm ent Areas; agents of the 3rd Petitioner w ere driven aw ay from the polling units by security agents.

In m ajority of the Local Governm ent Areas, the delivery of election m aterials w as abysm ally late and did not reach a substantial num ber of w ards until the official tim e for the close of election. The earliest sighting of election m aterials at polling units w ere recorded at about 11pm . Even then ballot boxes and papers w ere hijacked by soldiers and PDP party faithfuls. Elections w ere not declared at the polling units hence opposition party agents including the 3rd Petitioner never sighted the election result form s in the various polling units and w ards assigned to them for election m onitoring. There w as brazen intim idation and killing of non PDP voters and party agents particularly in Ilesha Area. Video recordings of som e of these incidents shall be founded upon at the trial.

OYO STATE xxi. Voters w ere intim idated by security officials particularly in O gbom oso Local Governm ent Area, also; agents of the 3rd Petitioner w ere driven aw ay from the polling units by security agents.

In m ajority of the Local Governm ent Areas, the delivery of election m aterials w as abysm ally late and did not reach RT/A/1/LT/Election Petitions - 64 -

a substantial num ber of w ards until the official tim e for the close of election. The earliest sighting of election m aterials at polling units w ere recorded at about 11pm . Even then ballot boxes and papers w ere hijacked by soldiers and PDP party faithfuls. Elections w ere not declared at the polling units hence opposition party agents including the 3rd Petitioner never sighted the election result form s in the various polling units and w ards assigned to them for election m onitoring. There w as brazen intim idation and m aim ing of identified non PDP voters and party agents leading to fatalities. Video recordings of som e of these incidents shall be founded upon at the trial.

RIVERS STATE xxii. There w as non delivery of election m aterials, in m ost of the local governm ent of areas except the state capital port H arcourt. In Port H arcourt the delivery of election m aterials w as abysm ally late and did not reach a substantial num ber of w ards until the official tim e for the close of election. The earliest sighting of election m aterials at polling units w ere recorded at about 1pm . Even then ballot papers w ere undersupplied thereby disenfranchising m ajority of eligible voters.

Even w here voting took place, the ballot boxes w ere snatched before close of polls and counting of ballots by PDP supporters aided by soldiers and arm ed policem en w ho w ere to provide security during the election. Som e PDP supporters w ere seen carrying arm s, alongside arm ed security personnel. Agents of 3rd Petitioners w ere prevented from observing the conduct of the elections; they w ere beaten up w here they insisted on their right. Incidents of this nature typified the conduct of the election in Tai, O yigbo, Port H arcourt, Akuku –Toru, O krika, Bonny, Degem a, Gokana, Asari-Toru, Angulam a and Elem e Local Governm ent Areas in the State.

The election m aterial supplied at w ards and local governm ent levels did not include result form s EC8As and EC8Bs on w hich scores w ere to be recorded and transm itted to Local Governm ent and State capital for further collation. As a result the opposition party agents at the state collation centre objected to the collation done by the State Resident Electoral com m issioner. They thus refused to sign the final result for state collation at the presidential election, on the basis that the results w ere product of vote allocation and not collation.

Most of these incidents of electoral m alpractices w ere captured on video and phone recordings and photographs w hich shall be founded upon.

ZAM FARA STATE

xxi. In Zam fara State, election m aterials w ere brought in late and as a result, no election w as held up to the tim e fixed for election w as over in virtually all the local governm ent areas w ith the exception of the state capital. As a result, m ajority of eligible voters w ere disenfranchised; and opposition party agents, particularly those of 3rd Petitioners, w ere deprived the opportunity to observe the conduct of the election. Nevertheless, the 4th Respondent upheld the election results from all the local governm ent areas in the state in w hich a m ajority of the votes allegedly cast w ere allocated to the 3rd Respondent, w hose loyalists constituted the bulk of the ad-hoc staff recruited to conduct the elections.

19. In all the acts of m alpractices and irregularities set out in the preceding paragraphs herein, the 811th – 1576th Respondents are just a few of INEC officials below the level of the Electoral O fficers w ho directly aided, participated in assisting the 4th – 808th Respondents in a carefully plotted schem e to foist the 1st Respondent on the Nigerian electorate in disregard of the santity of their franchise as guaranteed by the Electoral Act, 2006. The Presiding O fficers and Poll Clerks at polling unit level w ere practically pow erless to exercise their m andate given the collusion of law enforcem ent agencies in the m isconduct of the election and com prom ising RT/A/1/LT/Election Petitions - 66 -

integrity and security of election m aterials w here they w ere distributed at all at the local governm ent and w ard levels.

Evidence and Reports of Independent Election Observes and the m edia that covered the election w ith unrestricted access throughout the 36 states of Nigeria and the Federal Capital Territory, Abuja are consistent w ith the facts of corrupt practices pleaded above in even greater details, and shall be founded upon at the trial.

20. Before and during the election, the 5th Respondent exhibited acts of gross bias w ith im punity against the person and candidature of the 1st Petitioner including:

a. publicly calling the 1st Petitioner a ‘frustrated politician’;

b. falsely describing the 3rd Petitioner as an illegal organization not having being registered by INEC;

c. after the Judgm ent in Suit No.: FH C/ABJ/CS/03/07 pleaded in 16 (iv) above, the 5th Respondent boasted that he w ill not com ply w ith the Judgm ent unless com pelled by the Suprem e Court;

d. in the course of processing the 1st Petitioner’s nom ination, the 5th Respondent falsely denied receipt of the 1st Petitioner’s photograph required to be placed on the ballot paper w hen in actual fact sam e had been duly delivered.

21. In addition to the specific instances of election m alpractices stated above, the 4th Respondent abruptly announced postponem ent of the National Assem bly election in several constituencies spanning 29 states of the federation on the day of the election, thereby m isleading eligible voters into believing that the Presidential Election w as equally postponed.

22. Your Petitioners state that the 1st Respondent did not score m ajority of law ful vote cast at the 21st April, 2007 Presidential Election by reasons of the facts pleaded in the preceding paragraphs of this Petition w hich are herein repeated. Evidence shall be led by the Petitioners to show that the results credited to the 1st and 2nd RT/A/1/LT/Election Petitions - 67 -

Respondents w ere collated from unlaw ful votes recorded from the polling units to the collation centers.

23. Your Petitioners aver that w hile election results from 25 states of the federation w ere still being aw aited the 5th Respondent excused him self and w ent out of the collation center at the H eadquarters of the 4th Respondent leaving behind the party agents and announced the result of the Presidential Elections, declaring the 1st Respondent the w inner and m aking pronouncem ents of victory for the 1st – 3rd Respondents as the Returning O fficer.

24. Your Petitioners state that results from 11 states then available w ere not enough to support the return of the 1st Respondent as the w inner of the election.

Your Petitioners w ill rely on the CD and video clips of the announcem ent m ade by the 5th Respondent and the detailed results of the Presidential Election, state by state and local governm ent by local governm ent at the trial of this Petition as m ay be obtained in the course of Court ordered inspection m ade on M onday, 14th April, 2007; w ritten, visual and audio reports of international and local observers especially NDI, IRI, EU, JDPC, and TM G .

Notice is hereby given to each and all the Respondents herein to produce originals and/or adm issible Certified True Copies of each and/or all of the docum ents referred to in this Petition w hich in the ordinary course of official business are either w ith them , in their custody or under their control for the purpose of the trial in this Petition.

6. It m ay be determ ined that the 5th, 7th – 42nd Respondents as officials of the 4th Respondent, w ho directly and negligently m is- conducted the April 21, 2007 Presidential Election in contravention of the provision of the Electoral Act, 2006 be recom m ended for crim inal prosecution by the Attorney General pursuant to Section 157 of the Electoral Act, 2006.

7. It m ay be recom m ended that the 5th, 7th – 42nd Respondents w ho supervised and/or m is-conducted the April 21, 2007 Presidential Election be prohibited from participating in the conduct of the fresh election w hich m ay be ordered in consequence of this Petition.

8. And for such order or further orders as the H onourable Court m ay deem fit to m ake in the circum stance.
