The bill provides for enhanced penalties in the case of involuntary manslaughter or homicide by vehicle when the offense is the result of a violation of section 3316 (relating to prohibiting text- based communications). Any person who negligently causes serious bodily injury to another person as the result of a violation of section 3316 (relating to the prohibition of text- based communications) and who is convicted of violating section 3316 commits a felony of the second degree when the violation is the cause of the injury. HB 1057 Ellis, Brian (PN 1375) Amends Title 75 (Vehicles) adding language providing for motor fuels taxes and alternative fuels taxes. The rate of tax applicable to each alternative fuel subject to tax shall be computed by the Department of Revenue on a gallon equivalent basis and shall be published as necessary in the Pennsylvania Bulletin. The tax imposed shall apply to the entire amount of alternative fuel used or sold and delivered. Also adds a new subchapter known at the Electric Vehicle Road Fee Act. Provides that concurrent with submitting an annual vehicle registration application and fee to the Department of Transportation, an owner of an electric vehicle shall submit the electric vehicle road fee. The Department of Revenue shall compute the fee for each major vehicle class defined in the CAFE standards. Requires the electric vehicle road fee to equal the average annual vehicle fee tax within each vehicle class. The average annual vehicle fee computation shall be as follows: (1) the vehicle average miles driven divided by the miles per gallon equivalent per vehicle as determined by the department and (2) the quotient under (1) shall be multiplied by the oil company franchise tax rate for gasoline and the product shall be the average annual vehicle fuel fee. Requires the department to annually determine the electric vehicle road fee for each vehicle class, to be published in the Pennsylvania Bulletin on or before December 15 of each year. The subchapter relating to the electric vehicle road fee shall take effect January 1, 2016, and the remainder shall take effect July 1, 2015, or immediately, whichever is later. HB 2025 Reese, Mike (PN 3352) Amends Title 75 (Vehicles), in registration of vehicles, adding that temporary registration cards issued to a vehicle acquired in Pennsylvania for transportation to another state for registration shall be valid for 60 days. Additionally, in inspection of vehicles, further providing for suspension of certificates of appointment and for certification of mechanics. The bill authorizes the imposition of a monetary penalty on inspection stations that are not properly equipped or otherwise in violation. A schedule of all penalties, points and suspension may be established by the department by publishing a notice in the Pennsylvania Bulletin until the regulations governing these penalties are promulgated by the department. HB 2026 Jozwiak, Barry (PN 3253) Amends Titles 51 (Military Affairs) and 74 (Transportation), in Department of Military Affairs, providing for Civil Air Patrol; and, in authority of Department of Transportation, further providing for authority of department. Title 51 is amended by adding that the department shall be a liaison for the Civil Air Patrol and shall, notwithstanding any law, provide administrative support in accordance with this section and within the limits of authorized appropriations. The department shall: (1) Receive and supervise the expenditure of State funds appropriated by the General Assembly or secured by the Commonwealth for the use and benefit of the Civil Air Patrol within this Commonwealth; (2) Supervise the maintenance and use of Commonwealth facilities used by the Civil Air Patrol; and (3) Receive, from the Commonwealth or the Commonwealth's instrumentalities, requests for approval for assistance by the Civil Air Patrol in natural or man-made disasters or emergency situations. Title 74 is amended by repealing provisions granting the Department of Transportation authority to expend Commonwealth funds for search and rescue operations and organ transport by the civil air patrol, and educational materials and equipment related thereto. blood draw services to law enforcement upon request to perform a legal blood draw on behalf of the agency from persons suspected of violating 75 Pa.C.S. 1543(b)(1.1) (relating to driving while operating privilege is suspended or revoked), 3735 (relating to homicide by vehicle while driving under influence), 3735.1 (relating to aggravated assault by vehicle while driving under the influence), 3802 (relating to driving under influence of alcohol or controlled substance) or 3808(a)(2) (relating to illegally operating a motor vehicle not equipped with ignition interlock). Additionally, in Title 42, the bill extends criminal laboratory user fee to EMS agencies, which shall be used solely for provisions of criminal laboratory services. The paramedic user fee for laboratory services provided by a paramedic shall be paid to the emergency medical services agency and shall be used solely for the provision of criminal laboratory services. SB 290 Rafferty, John (PN 1751) Amends Title 75 (Vehicles), in general provisions, defining "ignition interlock limited license" and providing for its issuance to individuals whose operating privileges have been suspended for offenses involving alcohol; providing for blood testing; in licensing of drivers, further providing for occupational limited license and providing for ignition interlock limited license; and, in driving after imbibing alcohol or utilizing drugs, further providing for ignition interlock and for the offense of illegally operating a motor vehicle not equipped with ignition interlock. Eliminates chemical tests on urine for the purpose of determining the alcoholic concentration of blood or the presence of a controlled substance. Further provides the Department of Transportation shall issue an interlock limited license only upon securing proof that one motor vehicle owned, leased, or principally operated by the person, whichever the person most operates has been equipped with an approved ignition interlock system. Provides guidelines related to timing and repeat offenses. The amendment of 75 PA.C.S. 1547(a), (c) introductory paragraph, (2) and (3), (g.1), (h), (i) and (j) shall take effect immediately. SB 1108 Scavello, Mario (PN 1752) Amends Title 75 (Vehicles) adding autocycles as a special designation under the definition of motorcycles and providing for their registration and titling. Stipulates that autocycles are to be operated with a motor vehicle license. Includes other provisions related to seatbelt requirements, helmets and windshields. Also provides a combination of vehicles which is hauling milk to or from a manufacturer may be permitted by the Department of Transportation and local authorities to move upon highways within their respective jurisdictions 24 hours a day, seven days a week, except during inclement weather as defined in the department's regulations, if the gross weight does not exceed 95,000 pounds and the weight of any non-steering axle does not exceed 21,000 pounds. Further provides a permit may be issued for this type of movement upon an interstate highway. An application to the department for the movement of milk, except for raw milk, shall designate the route the applicant requests to use. The amendment or addition of 75 Pa.C.S. 3752(a) and 3753(b) (7) are effective January 1, 2018; the remainder is effective in 60 days. SB 1152 Browne, Patrick (PN 1591) Amends Title 75 (Vehicles), in other required equipment, further providing for restraint systems; and making an editorial change. Babies under age two shall be in a rear- facing child passenger restraint system. Further, the driver of a passenger car, Class I truck, Class II truck or motor home operated in this Commonwealth shall: if under 18 years of age, be secured in a properly adjusted and fastened safety seat belt system; and secure or cause to be secured in a properly adjusted and fastened safety seat belt every vehicle occupant eight years of age or older but under 18 years of age. During the first year following the effective date, law enforcement shall only issue verbal warnings to individuals who are in violation. Effective in 60 days. The committee held a public hearing on legislation providing for enforcement and collection of alternative fuel taxes.

HB 1057 Ellis, Brian - (PN 1375) Amends Title 75 (Vehicles) adding language providing for motor fuels taxes and alternative fuels taxes. The rate of tax applicable to each alternative fuel subject to tax shall be computed by the Department of Revenue on a gallon equivalent basis and shall be published as necessary in the Pennsylvania Bulletin. The tax imposed shall apply to the entire amount of alternative fuel used or sold and delivered. Also adds a new subchapter known at the Electric Vehicle Road Fee Act. Provides that concurrent with submitting an annual vehicle registration application and fee to the Department of Transportation, an owner of an electric vehicle shall submit the electric vehicle road fee. The Department of Revenue shall compute the fee for each major vehicle class defined in the CAFE standards. Requires the electric vehicle road fee to equal the average annual vehicle fee tax within each vehicle class. The average annual vehicle fee computation shall be as follows: (1) the vehicle average miles driven divided by the miles per gallon equivalent per vehicle as determined by the department and (2) the quotient under (1) shall be multiplied by the oil company franchise tax rate for gasoline and the product shall be the average annual vehicle fuel fee. Requires the department to annually determine the electric vehicle road fee for each vehicle class, to be published in the Pennsylvania Bulletin on or before December 15 of each year. The subchapter relating to the electric vehicle road fee shall take effect January 1, 2016, and the remainder shall take effect July 1, 2015, or immediately, whichever is later.

Chairman Taylor commented, "If you follow this committee at all you know one of our main priorities is to try to mitigate the expenditures from the Motor License Fund and adjust how we are spending that money to get it to its core mission of roads and bridges." He said," This particular measure in front of us today is a way to enhance the Motor License Fund and to see we are efficiently administering the proper fees and taxes." Chairman Taylor added, "This bill offers some alternatives to the ways we collect those fees and taxes."

Minority Chairman Keller echoed Chairman Taylor's comments, adding, "Our mission should be to make sure the Motor License Fund is healthy and doing its main job of fixing roads and bridges." He also said, "I would like to find out what we can do today."

Dan Hassell, Deputy Secretary for Tax Policy, Pennsylvania Department of Revenue, provided committee members with a brief overview of Act 3 of 1997 which he said "made major changes in the taxation of motor fuels in Pennsylvania and fixed a number of problems for taxpayers and the department." He commented, "Act 3's diesel fuel and International Fuel Tax Agreement (IFTA) enhancements were very successful in improving fairness and compliance with the tax law." Hassell added, "As you know there has been rapid growth and innovation in the availability and use of alternative fuels for vehicles but the tax law has not kept pace." He explained, "Current law requires electric vehicle owners to file monthly reports with the Revenue Department calculating and paying fuel tax on the amount of electricity their vehicle consumes. However, in the absence of some mechanism for tax reporting, owners of those vehicles are able to use the public highways without contributing to the cost of road maintenance."

According to Hassell, "House Bill 1057 imposes a road-use registration fee on electric vehicles in exchange for exempting them from the payment of road use taxes on electricity actually consumed by the vehicles." He continued, "As provided in the bill, PennDOT would administer the fee as part of the annual vehicle registration." Hassell explained that the fee would be calculated and published by the Department of Revenue on a gasoline-gallon equivalent basis, which is the same formula currently used for the taxation of all alternative fuels and would be based on the energy used annually by an average electric vehicle. He told the committee members. "Given current prices, we expect the fee to be approximately $73 for 2017." Hassell also explained that the legislation moves the point of taxation for alternative fuels up to the distributor level so that it is similar to how gasoline and diesel fuel are currently

He pointed out, "However, this bill also allows a distributor or user to maintain the retail imposition of fuel taxes in situations where it is more practical to do so." He went onto highlight some other provisions contained in the legislation.

Hassell outlined some of the provisions in the department's recommended amendment to the legislation which he said are designed to "clarify various technical issues in the bill." The provisions in the amendment include:  Allowing for the use of package delivery services as an alternative to US Postal Service;  Resolving a conflict in current law concerning how the calculated tax rate is rounded up or down;  Providing an updated effective date;  Making other minor clarifications in the statute.

Chairman Taylor wanted to know if there is a more standard way to collect the tax other than through the registration process. Hassell explained that currently for gasoline and diesel fuel it is the distributor that pays the tax in general. He further explained, "The anomaly that we have for alternative fuels is it is imposed on the user at the point where the fuel is put into a tank and that creates some complications." Hassell said, "This bill makes alternative fuels more like diesel in that the tax is remitted by the distributor." Chairman Taylor asked about the provision imposing a road- use registration fee. Hassell responded that currently owners of electric vehicles should be filing tax returns on a monthly basis and the legislation imposes a registration fee instead of that obligation.

Rep. Pyle asked if the owner of an electric vehicle would pay for consumption or if they would pay an annual fee. Hassell indicated they would pay an annual fee would be in place of any fuel tax on the electricity. Rep. Pyle then asked about CNG vehicles. Hassell responded that the tax would be imposed on the fuel that is sold by the distributor similar to what is being done today. Rep. Pyle asked why that same approach could not apply to electric vehicles. Hassell said that the issue is the cumbersome nature of requiring an owner of an electric vehicle to remit a monthly tax return for $5 or $10 per month for fuel. Rep. Pyle wanted to know why electric vehicles are treated so differently than standard gasoline vehicles. Chairman Taylor interjected that there is currently a tax on electric vehicles and no one complies. Hassell replied, "That is true." Jack Frehafer, Office of Chief Counsel, Pennsylvania Department of Revenue, indicated that the only compliance with the current law is from a "handful of commercial businesses." Hassell added that "the tax is imposed now and the question is how it is best collected." Chairman Taylor observed, "We are imposing the tax now as Rep. Pyle is suggesting and no one is paying." Hassell responded, "Yes."

Rep. Pyle asked why a plug-in could not put into the distribution device. Hassell indicated that part of the problem would be a homeowner would have no way of doing that if they had a plug-in vehicle. Frehafer added that to do what Rep. Pyle is suggesting would be to put a meter on the source of the electricity or have the device on the vehicle but indicated he did not know if there is technology to do that. He pointed out that other states are using an annual registration fee.

Minority Chairman Keller asked what vehicles would be covered by the fee. Hassell responded that it would apply to any kind of vehicle that has a plug-in. Chairman Keller asked if only $658 is being collected on the electric vehicles. Hassel confirmed that it has been less than $1,000 per year. Chairman Keller asked about the cost to PennDOT to make the changes in their system to collect the taxes under the bill. Hassell responded that "he did not have that figure." He added that PennDOT does have some concerns about that and that is why his department's proposed amendment included changing the effective date of the legislation.

Rep. Briggs wanted to know the tax rate on just the use of electricity. Hassell explained that there is no separate tax on electricity that goes to the Motor License Fund but there is a General Fund tax on electricity in the form of a gross receipts tax at 5.9 percent.

Rep. Harper spoke about her experiences in having a hybrid car and she reported she still paid the gas tax. Frehafer explained that there are two types of hybrids. The one, such as a Toyota Prius, uses an electric engine as a back-up to the main gasoline engine. He said that the legislation does not apply to that type of hybrid. Frehafer further explained that the second type uses the electric engine as its primary source of propulsion. He said that the bill applies to vehicles with an electric plug-in.

Rep. Heffley commented that he agrees with Rep. Pyle that the tax should be collected at the point of consumption. He expressed misgivings with the proposed registration fee because a person driving a minimum amount of miles in

PLS’s Transportation Recap – Copyright 2016 – Pennsylvania Legislative Services – www.mypls.com May 26, 2016 a year would pay the same fee as someone driving 20,000 miles per year. Rep. Heffley spoke about the need to figure a way to tax someone who plugs into their home.

Rep. Neilson wanted to know how much funding is lost through the exemptions in the bill. Hassell explained that the exemptions exist in current law and the legislation just clarifies them. Rep. Neil asked about the impact of the exemptions on the Motor License Fund. Hassell said that they have no effect.

Rep. Matzie asked if there are any projections on the number of electric vehicles in Pennsylvania in the coming years. Hassell responded that he has not asked PennDOT but it is his understanding PennDOT is looking at it.

Jason Wagner, Director of Policy and Government Relations, Associated Pennsylvania Constructors (APC), highlighted a new report from the American Road & Transportation Builders Association (ARTBA) report examining how different states tax alternative-fuel and electric vehicles. According to Wagner, "The report notes that the use of alternative-fuel cars and light trucks is expected to grow from 21.5 million vehicles in 2016 to 29.3 million in 2021." He explained, "Alternative-fuel vehicles include electric cars and trucks, hybrids and vehicles that run on propane, fuel cells and natural gas." Wagner outlined some of the report's findings in regard to the strategies being used by states to address the issue of alternative-fuel vehicles. These findings include:  45 states levy a cents-per-gallon excise tax on the purchase of alternative fuels;  10 states require electric vehicle owners to pay a fee;  13 states provide the option for alternative fuel vehicle owners to pay a fee rather than an excise tax;  6 states require alternative fuel dealers to obtain a special fuel license or pay a fee; and  2 states apply only the state general sales and use tax to alternative fuels.

Wagner reported, "In Pennsylvania, alternative fuels currently include compressed natural gas (CNG), liquefied natural gas (LNG), propane, electricity, hydrogen and other gasoline-alcohol blends." He added, "Since 1997, the Vehicle Code has placed the point of taxation for alternative fuels at the 'dealer-user' level." Wagner argued that Act 3 "has become increasingly less effective in administering the taxes on these fuels." He told committee members, "The bill as proposed would modernize outdated laws and simplify compliance by adopting industry standards for collecting revenue on alternative fuels and clarify the point of taxation by bringing it line with conventional fuels, such as gasoline and diesel." Wagner expressed his group's concern with the increasing amount of revenue being directed from the Motor License Fund to the State Police budget. Concluding his testimony and expressing support for the bill, Wagner observed, "It is most important to note that House Bill 1057 does not impose a new tax but rather will help reform and streamline the collection of an existing levy that was first created in 1997 by the General Assembly to ensure fair and equitable taxation and enforcement across all fuel types."

George Wolff, Founder, Keystone Transportation Funding Coalition, observed, "This subject is important to the whole coalition because we want to make sure that everyone using the highway pays their fair share." He spoke about the dilemma caused by the various types of electric vehicles and other alternative fuels and how to tax those who have those types of vehicles.

Chairman Taylor wanted to know what percentage of the vehicles on the road today are the electric plug-in version. Wagner said that he did not have Pennsylvania-specific numbers but the US Energy Information Administration reports there are currently 21.5 million vehicles in 2016 which is 9 percent of the country's vehicle stock and the number is expected to grow to 29.3 million in 2021 or about 12 percent of the entire fleet. He noted that would be all alternative fuel vehicles.

Minority Chairman Keller commented that it is his understanding the compressed natural gas is much easier to collect the tax on than with electric vehicles. Wagner said, "Yes." Wolff commented, "In the past we always thought electric as for automobiles but there is a move now to go to delivery trucks."

Rep. Heffley pointed out that commercial vehicles pay a highway use tax. He expressed his belief that commercial delivery trucks would be paying that tax. Wagner said that he did not know the answer.

HB 1597 Murt, Thomas - (PN 2304) Act designating a portion of State Route 2026, also known as Blair Mill Road, in Montgomery County as the Private First Class Paul T. Wright Memorial Highway. Effective immediately. - The bill was unanimously reported as amended.

A07506 by Taylor, changes the effective date from "immediately" to "60 days". The amendment was unanimously adopted.

SB 983 McGarrigle, Thomas - (PN 1219) Amends Title 75 (Vehicles) adding language to allow the parent, including an adoptive parent or foster parent, of a child or adult child who is in their care to secure a disability license plate for their vehicle. Effective in 60 days. - The bill was unanimously reported as committed.

Rep. Kinsey wanted to know if the bill would apply to the situation where the vehicle is registered in the name of the husband only and the wife has a disability or is otherwise impaired. David Kozak, a member of the committee's staff, responded, "As it is written, it would not." Eric Bugaile, the committee's executive director, indicated discussion have been held about expanding the bill or introducing a new bill to address some of the other issues that have arisen.

Chairman Taylor announced that today is the final committee meeting for the committee's secretary Bonnie Glatfelter who is retiring. He expressed the committee's appreciation for her work as the committee's secretary.

HB 2025 (PN 3252) Amends Title 75 (Vehicles), in registration of vehicles, adding that temporary registration cards issued to a vehicle acquired in Pennsylvania for transportation to another state for registration shall be valid for 60 days. Additionally, in inspection of vehicles, further providing for limited liability of inspection station or mechanic, for suspension of certificates of appointment and for certification of mechanics. The bill authorizes the imposition of a monetary penalty on inspection stations that are not properly equipped or otherwise in violation. A schedule of all penalties, points and suspension may be established by the department by publishing a notice in the Pennsylvania Bulletin until the regulations governing these penalties are promulgated by the department. Babies under age two shall be in a rear-facing child passenger restraint system. HB 1484 Gillen, Mark - (PN 3338) Amends Act entitled "An act providing for the designation of certain trees and land on the grounds of the State Capitol in Harrisburg as "Soldiers' Grove" in honor of war veterans; imposing duties upon the Department of General Services; and making an appropriation," adding that the department shall arrange for the fabrication of a plaque in honor of any war or armed conflict officially engaged in by the United States commencing after the Vietnam Conflict. ABATE RALLIES FOR TEXTING WHILE DRIVING LAW By Mike Howells, Pennsylvania Legislative Services | May 23, 2016

Motorcycle advocacy coalition ABATE today held its annual Capitol rally, marking May as Motorcycle Safety Awareness Month in Pennsylvania, and urging support for HB 853, known as Daniel’s Law, which would increase penalties for driving-while-texting.

Charles Umbenhauer, ABATE’s state lobbyist, thanked Gov. Tom Wolf for signing a proclamation designating May as Motorcycle Safety Awareness Month, as well as the Department of Transportation (PennDOT) for supplying public notice signs to be put up around the commonwealth. He said over the course of his time in Harrisburg he has watched Pennsylvania become one of the safest states in the nation for bikers.

Umbenhauer indicated the focus of this year’s ABATE rally is to offer support for HB 853, which would increase penalties for driving-while-texting. The bill, known as Daniel’s Law, is named for Daniel Gallatin, a father, grandfather and veteran who while pulling out of his daughter’s driveway on his motorcycle was hit and killed in 2013 by a women who was texting.

Gallatin’s daughter Michelle Gallatin-Baughman described in detail the events surrounding her father’s death and noted the woman involved ultimately spent only 60 days in jail. She emphasized how dangerous it is to drive

Rep. Joe Petrarca (D-Westmoreland), minority chairman of the House Judiciary Committee, where the bill is currently awaiting consideration, told ABATE members “we are committed to getting this done,” and indicated it could be voted on as early as this week. He added the committee is also considering legislation that would include motorcycles under the state’s Lemon Law and legislation dealing with profiling of motorcyclists.

Rep. Gibbons thanked Gallatin-Baughman and her family for their efforts to shed light on the dangers of texting- while-driving and emphasized the need to put penalties in place to drive home how serious an issue it is. He noted there is “far too casual a relationship between people and their phones” while driving, and noted HB 853 was modeled on the state’s DUI law.

Rep. Harry Readshaw (D-Allegheny), a longtime ABATE advocate, highlighted the upcoming Ride to Gettysburg, an annual event in which bikers ride from Harrisburg to Gettysburg to raise funds for the Daniel Lady Farm on Hanover Road in Gettysburg, as well as Pennsylvania Monuments Project. The 2016 Ride is scheduled for September 24th.

At the rally Sen. John Eichelberger (R-Blair) awarded ABATE’s 2016 Sen. Clarence Bell Scholarship Award to Kutztown University student Kate Hughes. ABATE chapters also submitted their annual BikePACcontributions.
