Twenty-five Years of Consumer Bankruptcy in Continental Europe: Internalizing Negative Externalities and Humanizing Justice in Denmark y JasonJ. Kilborn*, John Marshall Law School, Chicago, USA Abstract This paper explores the problems and processes that led to the birth of consumer bankruptcy in continental Europe, a process that began in Denmark in January1972 andculminatedwiththe adoption of the Danish consumer debt adjust- ment act, G×ldssaneringslov, on 9 May 1984. While this law is often described in primarily humanitarian terms, in the sense of o¡ering a respite to ‘‘hopelessly indebted’’ individuals, both the motivation for the law and its intended scope were not simply accretions on an already multi-layered welfare system. Instead, the law was designedprimarilyasapragmatic responseto economically wastefulcollections activities that imposed negative externalities on debtors, creditors, and especially Danish societyand state co¡ers; the law was intendedto forcecreditorsto internalize (or eliminate) these externalities with respect to all debtors unable to pay their debts within a reasonable period of 5 years. The paper also examines the growing pains of this new system. The law originally left signi¢cant administrative discretion to judges, which produced vast disparities in treatment of cases in di¡erent regions of the country. Ultimately, a reform implemented in October 2005 made the system more accessible, more unitary throughout the country, and more humane. The e¡ects of this reform are already visible in statistical observations of the system, though signi¢cant regional variations persist. Giventhe striking coincidence in tim- ing, this paper also o¡ers brief comparative comments on the parallel designöbut verydi¡erente¡ectöof the most signi¢cant reformofthe USconsumerbankruptcy law, also e¡ective in October 2005. -

A Haif-Democratiic Russia Will Always Be a Half-Aliy to the United States MICHAEL MCFAUL AND NIKOLAI ZLOBIN T he improvement in Russian-American relations is one of the few positive fac- tors in the muddled picture of international relations today. Russian president Vladimir Putin's support for the American struggle against international terror- ism has elevated communications between two former enemies to a new level Politicians on either side of the ocean are calling the. United States and Russia "allies ." Noting the decisiveness with which President Putin supports the United States and Washington's extremely positive reaction to this, many Russian politi- cians and public figures have begun speaking openly of Russia's entry into West- ern organizations and unions. Membership in the World Trade Organization is discussed in Moscow as an obvious reward that Russia should receive for sup- porting American military actions; entry into the European Union is brought up as a relatively near goal, and so forth. The hopes are great, but do they reflect reality? Inflated expectations and skewed assessments of the speed and character of Russia's integration into the West are dangerous. It is true that the new situation brings forth many hopes, but it also provides the groundwork for possible future disillusion. Russia's drive toward integration must be welcomed, but without open discussions concerning the entire range of problems hampering the development of relations between Russia and the West, Russian and American officials are simply exaggerating unrealistic expectations, the collapse of which could seriously complicate relations in the future. This is a replay of the situation ten years ago, when an absence of pragmatism led to the appearance of hopes that were never realized. -

EDITOR’S NOTE: In late 2013 the publisher Lexington Books, a division of Rowman & Littlefield, put out the book Imposing, Maintaining, and Tearing Open the Iron Curtain: The Cold War and East-Central Europe, 1945–1989, edited by Mark Kramer and V´ıt Smetana. The book consists of twenty-four essays by leading scholars who survey the Cold War in East-Central Europe from beginning to end. East-Central Europe was where the Cold War began in the mid-1940s, and it was also where the Cold War ended in 1989–1990. Hence, even though research on the Cold War and its effects in other parts of the world—East Asia, South Asia, Latin America, Africa—has been extremely interesting and valuable, a better understanding of events in Europe is essential to understand why the Cold War began, why it lasted so long, and how it came to an end. A good deal of high-quality scholarship on the Cold War in East-Central Europe has existed for many years, and the literature on this topic has bur- geoned in the post-Cold War period. -

7/2019 From Cold War to Civil War: 75 Years of Russian-Syrian Relations — Aron Lund PUBLISHED BY THE SWEDISH INSTITUTE OF INTERNATIONAL AFFAIRS | UI.SE Abstract The Russian-Syrian relationship turns 75 in 2019. The Soviet Union had already emerged as Syria’s main military backer in the 1950s, well before the Baath Party coup of 1963, and it maintained a close if sometimes tense partnership with President Hafez al-Assad (1970–2000). However, ties loosened fast once the Cold War ended. It was only when both Moscow and Damascus separately began to drift back into conflict with the United States in the mid-00s that the relationship was revived. Since the start of the Syrian civil war in 2011, Russia has stood by Bashar al-Assad’s embattled regime against a host of foreign and domestic enemies, most notably through its aerial intervention of 2015. Buoyed by Russian and Iranian support, the Syrian president and his supporters now control most of the population and all the major cities, although the government struggles to keep afloat economically. About one-third of the country remains under the control of Turkish-backed Sunni factions or US-backed Kurds, but deals imposed by external actors, chief among them Russia, prevent either side from moving against the other. Unless or until the foreign actors pull out, Syria is likely to remain as a half-active, half-frozen conflict, with Russia operating as the chief arbiter of its internal tensions – or trying to. This report is a companion piece to UI Paper 2/2019, Russia in the Middle East, which looks at Russia’s involvement with the Middle East more generally and discusses the regional impact of the Syria intervention.1 The present paper seeks to focus on the Russian-Syrian relationship itself through a largely chronological description of its evolution up to the present day, with additional thematically organised material on Russia’s current role in Syria. -

Currently the population of the region is about 531 mil- lion. Europe is highly urbanized and, for the most part, relatively wealthy, par- ticularly the western portion.
