Miviludes 2012 Execouv.Indd MIVILUDES 13, rue Vaneau Mission interministérielle de vigilance et de lutte contre les dérives sectaires 75007 Paris www.derives-sectes.gouv.fr Après avoir examiné, les années précédentes, la situation des mineurs au regard du risque de dérives sectaires, puis les dangers de nature sectaire qui peuvent sur- gir de certaines pratiques de santé, la Miviludes évalue, dans ce rapport, le risque chez une catégorie de personnes particulièrement vulnérable, nos anciens. Ma- 2011 - 2012 lades, isolés, installés en établissements d’accueil pour personnes âgées ou restant à leur domicile, ils constituent une cible de choix pour les mouvements à caractère sectaire. Aussi la Miviludes formule-t-elle un certain nombre de propositions visant à améliorer leur protection en ce domaine. De même, les victimes de mouvements sectaires qui cherchent à se ré-insérer 2011-2012 dans la société ont besoin souvent d’appuis spécifiques. Aussi a-t-elle réuni, dans cette perspective, un groupe de travail constitué d’associations et de représentants d’institutions variées en vue de proposer des mesures, tant sur le plan sanitaire que social, visant à réduire les difficultés que rencontrent les ex-adeptes. E RAPPORT R L’ entrisme des mouvements à caractère sectaire dans la vie professionnelle continue de mobiliser l’attention de la Miviludes. À ce titre, la Mission exerce une veille attentive sur les risques dans le domaine de la formation professionnelle, en AU PrEMIER MINISTRE particulier celui du développement personnel. Elle ne manque pas de rappeler ici MINIST R où se situe exactement le risque. Nommé à la présidence de la Miviludes au mois d’août 2012, j’ai trouvé une équipe très motivée et j’ai pu constater la qualité du travail accompli par le président Georges Fenech qui a retrouvé l’Assemblée nationale en juin. Comme nous le signalons depuis plusieurs années, le phénomène sectaire poursuit sa mutation. Dans les années 1980/1990 de grands mouvements avaient sévi dans notre pays ; leur impact et leur dangerosité avaient entraîné la forte réaction des parlementaires et la création d’associations de victimes, dont le rôle doit être salué, avant que le gouvernement ne crée la Mils puis la Miviludes. On observe aujourd’hui une atomisation du phénomène sectaire et un éparpillement de petits groupes centrés autour d’un individu qui impose sa loi aux « adeptes ». On appâte une personne, le plus souvent à un moment critique de sa vie (rupture familiale, deuil, maladie grave, perte d’emploi…), on l’amène peu à peu par d’insidieuses manœuvres psychologiques, accompagnées parfois de pressions physiques, à perdre son autonomie et son libre-arbitre. L’emprise mentale est dès lors constituée avec son cortège de délits voire de crimes. Que l’on songe aux trois graves affaires jugées en première instance à la fi n de l’année 2012 : celle des « Reclus de Monfl anquin », celle d’Epinal où un gourou accusé de viol sur une adepte mineure a écopé de dix-sept ans de réclusion, ou encore celle de Lisieux où une femme était jugée (à huis clos) pour abus frauduleux de la faiblesse d’un tiers recouvrant des actes d’une extrême gravité. Ces trois procès démontrent que le travail d’information, d’alerte et de formation, accompli par l’équipe de la Miviludes auprès des magistrats, des travailleurs sociaux, des enseignants et des personnels de la gendarmerie et de la police nationale, commence à porter ses fruits. L’abus de faiblesse par mani- pulation mentale (article 223-15-2 du Code pénal) souvent diffi cile à mettre en évidence devient plus familier pour les enquêteurs et les juges. Cette meilleure visibilité se traduit aussi par l’augmentation impor- tante (+ 20 % en un an) des signalements à la Mission dont 80 % lui arrivent par Internet. Rapport annuel 2011-2012 ▼ 5 Internet qui ouvre de belles fenêtres sur le monde mais peut aussi char- rier le pire : théories complotistes, pseudo-conseils psychologiques ou théra- peutiques derrière lesquels se cachent dangereux gourous et vrais prédateurs. C’est pourquoi en 2013, notre réfl exion portera sur la question des « dérives sectaires et Internet » et nous nous attacherons au développement de notre action internationale en particulier avec la Fécris qui a assuré une belle réunion de tous nos amis européens à Salses le Château afi n de dénoncer la menace des sectes apocalyptiques, qui ont tenté sans grand succès de profi ter de la rumeur d’une « fi n du monde le 21/12/2012 ». De même, nous nous réjouissons du vaste travail accompli par la Commission d’enquête parlementaire du Sénat consacrée aux dérives sectaires dans le domaine de la santé et dont nous attendons les conclusions au printemps. Forte de l’appui de la représentation nationale et du gouvernement, la Miviludes continuera dans le respect des lois de la République à lutter contre ces groupes et ces individus qui profi tent du désarroi des personnes les plus vulnérables. SERGE BLISKO Président 6 MIVILUDES ▼ RE 1 PARTIE Le risque sectaire Rapport annuel 2011-2012 ▼ 7 Les personnes vulnérables : des victimes particulièrement exposées aux dérives sectaires Il n’existe aucune étude spécifi que sur l’action des mouvements sec- taires auprès des personnes âgées. Aucun chiffre n’est donc disponible. De même, les condamnations pour abus de faiblesse ne permettent pas, selon les statistiques délivrées par le ministère de la Justice, d’identifi er les situations dans lesquelles les personnes âgées ont été les victimes principales. Les diffi cultés qui ont pour effet un manque de connaissances sur l’action des mouvements sectaires auprès des personnes âgées résultent des facteurs suivants : – diffi cultés de pénétrer dans la sphère privée pour s’assurer de l’ab- sence de sollicitations de nature sectaire ; en l’absence d’un proche vigilant, les abus dont peuvent être victimes les personnes âgées isolées risquent de passer totalement inaperçus ; – réticence des victimes à déposer plainte ou à signaler les faits par honte de s’être fait « berner » ; – la détection des dérives sectaires dont sont victimes les mineurs, mal- gré un consensus social fort et un arsenal législatif et réglementaire complet pour assurer une protection des personnes considérées comme les plus vulné- rables de la population, est déjà délicate ; elle l’est plus encore pour les per- sonnes âgées, qui ne bénéfi cient pas de la même attention des pouvoirs publics. Les personnes âgées, fragilisées par l’âge, l’isolement, le deuil, la mala- die, la perte des repères, l’altération des capacités physiques et intellectuelles, sont des victimes idéales des mouvements sectaires, pas autant comme cibles à recruter que comme sources potentielles de revenus et de capitaux. Interrogé par la Miviludes, Bernard Ennuyer, docteur en sociologie, enseignant-chercheur à l’université Paris-Descartes, ancien directeur d’un ser- vice d’aide et de soins à domicile, évoque dans les termes suivants les caracté- ristiques des personnes âgées qui sont les plus exposées aux risques de dérives sectaires : « Il y a une fraction des populations vieillissantes qui est beaucoup plus à risques que d’autres au regard des risques de dérives thérapeutiques et de dérives sectaires. C’est de toute évidence la fraction de la population âgée à partir de 80-85 ans qui est beaucoup plus à risque que les autres. Rapport annuel 2011-2012 ▼ Le risque sectaire 9 La grande vieillesse concerne aujourd’hui les femmes : la fragilité, en termes d’insuffi sances de ressources, d’isolement social et de santé, touche essentiellement des femmes âgées. Cette situation justifi e une attention particulière à leur égard. Pensons par exemple à des personnes pour qui les euros n’existent pas aujourd’hui : une dame de 95 ans, qui a eu déjà un peu de mal avec les nouveaux francs, n’est pas armée face aux arnaques qui jouent sur la confusion entre euros et francs. Les personnes âgées sont le plus souvent a priori extrêmement méfi antes. Donc, par exemple, elles ne vont pas ouvrir leur porte à n’importe qui, d’autant qu’on leur recommande instamment de ne pas le faire.

    France Page 1 of 14 France BUREAU OF DEMOCRACY, HUMAN RIGHTS, AND LABOR International Religious Freedom Report 2009 October 26, 2009 The Constitution provides for freedom of religion, and other laws and policies contributed to the generally free practice of religion; however, discriminatory treatment of Jehovah's Witnesses and Scientologists remained a concern. Some religious groups voiced opposition to legislation passed in 2001 and 2004, which provides for the dissolution of groups under certain circumstances and bans the wearing of conspicuous religious symbols by public school employees and students. A 1905 law on the separation of religion and state prohibits discrimination on the basis of faith. The Government generally respected religious freedom in practice, but there continued to be concerns about the treatment of some minority religious groups. There was no change in the status of respect for religious freedom by the Government during the reporting period. A 2004 law prohibiting the wearing of conspicuous religious symbols in public schools by employees and students continued to be implemented during the reporting period. The Government has a stated policy of monitoring potentially "dangerous" cult activity through the Inter-Ministerial Monitoring Mission against Sectarian Abuses (MIVILUDES). Discrimination against Jehovah's Witnesses, Scientologists, and other groups considered dangerous sects or cults remained a concern and may have contributed to acts of vandalism against these groups. Some groups expressed concern that MIVILUDES publications contributed to public mistrust of minority religions. There were reports of societal abuses or discrimination based on religious affiliation, belief, or practice; however, prominent societal leaders took positive steps to promote religious freedom.

You should reject this application. To do otherwise would be to under- mine the very principles that the Council of Europe stands for and expose the Council to severe political embarrassment. FECRIS claims to be a network made up of “anti-cult” organisations in various states of the Council of Europe. In fact, it is mostly a French body and receives more than 90% of its funding from the French govern- ment. The French anti-cult organisa- tions, UNADFI and CCMM are both government funded and are leading members of FECRIS. They tend to dominate FECRIS’s agenda. Because of pressure coming from certain quarters in France, FECRIS’s application for INGO status is on course to be approved by the Council of Europe’s Parliamentary Assembly some time in January. This would be a severe blow to human rights, how- ever, as FECRIS and its member groups have condoned the campaign Many Falun Gong practitioners have died from police beatings, including 19-year-old of torture, death and persecution of Chu Congrui inset. RELIGIOUS LIBERTY AND PROTECTIONS IN EUROPE ELIZABETH F. DEFEISt INTRODUCTION In his remarkably perceptive book, CAN GOD AND CAESAR COEXIST? BALANCING RELIGIOUS FREEDOM AND INTERNATIONAL LAW, Father Robert F. Drinan ("Fr. Drinan") is critical of the decisions of the European Court of Human Rights ("ECHR") for its lack of deference to the free exercise claims of petitioners to the Court.1 As a partial answer, he questions whether an international mechanism could better resolve claims of violations of religious liberty. The failure of the ECHR to address more sensitively infringement of religious liberty is symptomatic of the increasing secularization of Europe, particularly the so-called Old Europe, best exemplified by France, Spain, and Italy. The ECHR has found secularism to be consistent with values underpinning the European Convention on Human Rights and Fundamental Freedoms ("ECHRFF"), in harmony with the rule of law and respect for human rights, and may be necessary to protect a democratic system.2 Despite strong opposition from church leaders in traditionally Catholic countries, Italy enacted legislation permitting abortions in 1978,3 and Spain recently enacted the t Professor of Law, Seton Hall University School of Law.

Ikke desto mindre et det et høyst betimelig tema innen statsvitenskapen. Religiøse minoriteter har alltid vært en kime til sosial og politisk uro. Denne oppgaven vil vise at dette ikke har endret seg, selv om den ”trusselen” som nye religiøse bevegelser hevdes å utgjøre i dag kanskje kommer i en noe forskjellig innpakning sammenlignet med tidligere tider. Det er mange som fortjener en takk i forbindelse med mitt arbeid med denne oppgaven – først og fremst min engasjerte og motiverende veileder, Bernt Hagtvet. Takk for alle gode innspill! Anti-sektproblematikken ble først introdusert som tema for en hovedoppgave av Forum 18, formidlet via Vitenskapsbutikken ved UiO. Forum 18 fortjener en stor takk for god starthjelp i den innledende runden av studien. Jeg ønsker også å takke stiftelsen Fritt Ord, som gjorde det mulig for meg å foreta feltstudier, bl.a. intervjuer av sentrale aktører i den franske anti-sektdebatten (mai og juni 2004).   • Introduction a Well Grounded Propaganda System
    Centre of Information and Counseling on New Spiritualities Human Dimension Implementation Meeting (OSCE) Warsaw, 27 September 2011 - Working Session n°2 - - France - The fight against sectarian abuse revealed as a vehicle for propaganda Introduction Our last contribution1 to this audience, commenting upon the French policy on so-called ‘fight against sectarian abuse’, took place on the 29 September 2009. Two years later, our critical analysis is even more relevant as we have witnessed a gradual intensification of this fight, supported at the highest level of the state. In its nine years of existence, MIVILUDES (the French inter-ministerial mission to monitor and combat sectarian abuse, under the Prime Minister’s authority) has blacklisted nearly all alternative approaches whether spiritual, therapeutic or educational, using a substantial propaganda strategy. Furthermore, this has been enforced in the name of secular values and the defence of individual rights. We describe the main features of this propaganda in the first part of this document. In the second part we provide examples showing, on a monthly basis, the excesses of the anti-cult mindset. A well grounded propaganda system 1. A conservative ‘one way of thinking’: After more than thirty years of misinformation, the ‘cult’/‘sect’ issue has become an orthodox mindset. The mere mention of the word ‘cult’ is enough to spur a consensual feeling of rejection, usually without any real knowledge of the groups or people referred to. The integrity of the French fight against sectarian abuse is rarely put under scrutiny, or even brought into perspective, within the broader European context, whether it be in political, media or intellectual circles2; not even the allocated resources and their effectiveness are discussed.
