Policy Seaside Police Department 470 Policy Manual Sobering Center Commitments 470.1 PURPOSE AND SCOPE This policy provides Seaside Police Department personnel with guidelines for use of the Sun Street Sobering Center, a supervised facility where subjects arrested by law enforcement for non-violent offenses of public intoxication, or first time offenders arrested for driving under the influence of alcohol, may be delivered to the facility in order to be safely monitored while sobering in lieu of traditional booking and incarceration in the Monterey County Jail. 470.2 POLICY It is the policy of this department that Seaside Police Officers may utilize the Sun Street Sobering Center for those individuals who meet the criteria set forth in this policy. 470.3 ROLES AND RESPONSIBILITIES 470.3.1 SUN STREET CENTER RESPONSIBILITIES (a) Provide a safe and secure setting, supervised 24 hours a day, 7 days a week, by both medical assistants and recovery specialists, where men and women who are contacted by law enforcement agencies for non-violent public intoxication, or are first time offenders driving under the influence of alcohol, can remain while achieving sobriety, staying no less than 4 hours but not more than 23 hours. (b) Accept all law enforcement referrals for subjects who are under the influence of alcohol, in a timely manner, and upon availability of bed space, if the person is not in need of immediate medical attention, is not a known registered sex offender, and is a willing participant to the sobering center. (c) Provide a basic assessment of the sobering center client to determine their level of addiction and needed services, and to provide appropriate referrals for services. (d) Provide transportation to the client, once sober, to a treatment facility, outpatient facility, other service provider, or to their home as needed. 470.3.2 SEASIDE POLICE DEPARTMENT RESPONSIBILITIES (a) Transport individuals, determined by law enforcement officers to be appropriate for diversion to the sobering center, who have been contacted for the offenses of public intoxication CA Penal Code Section 647(f) and/or first time offenders arrested for driving under the influence CA Vehicle Code Section 23152, who have no immediate emergency medical needs, are not known to be registered sex offenders and who are willing to accept the services of the sobering center. (Refer to Section 418.4.1 DIVERSION CRITERIA for intake criteria.). (b) Provide the sobering center staff with basic information regarding the individual including the name and date of birth of the individual, the time and location of the contact, the reason for the contact, the officer’s name and badge number and any arrest or citation information, if applicable. Sobering Center Commitments - 422 Published with permission by Seaside Police Department Seaside Police Department Policy Manual Sobering Center Commitments 470.4 PLACEMENT REQUIREMENTS The Sobering Center is designed to accept individuals arrested for public intoxication CA. Penal Code Section 647(f) and/or first time offenders arrested for CA. Vehicle Code Section 23152, driving under the influence, who are not under the influence of drugs, who are non-violent and who have no other charges. 470.4.1 DIVERSION CRITERIA Eligibility Requirement: (a) Arrestee must agree to placement at the Sobering Center. (b) Registered sex offenders cannot be placed at the Center. (c) Arrestee must be at least 18 years of age or older. (d) Must be non-combative and agreeable. (e) Have a measurable BAC (f) Be verbally responsive and able to communicate. (g) Must not have any severe medical conditions or medical issue that requires immediate attention. (h) Referrals to the program must come from law enforcement only (No self-referrals or walk-ins. 470.5 PLACEMENT PROCEDURES Officers Shall: (a) Inquire of the in-custody if they agree to placement at the Sobering Center. If yes, proceed with placement. If they refuse, book them into Monterey County Jail. (b) Telephone the Sobering Center directly or, if necessary, have County Communications contact the Sobering Center to determine bed availability. (Telephone No. (831) 272-3983). (c) Transport the in-custody to the Sobering Center, located at 119 Capitol Street in the City of Salinas. (d) If first time offender arrested for 23152 CVC, Cite and release the subject in-custody and turn them over to Sobering Center staff. (e) If arrested for 647(f) PC the subject shall be turned over to Sobering Center staff. Per 647(g) PC they shall not thereafter be subject to any criminal prosecution or juvenile court proceeding based on the facts giving rise to this placement. (f) Obtain a copy of the Sobering Center’s “Initial Contact Sheet – Sobering Center” for attachment to your criminal report. 470.6 DOCUMENTATION The officer shall complete all reports as required for cite and release arrests made for 647(f) PC 23152 CVC. (b) The subject was released to the Sobering Center. (c) Include a copy of the Sobering Center “Initial Contact Sheet – Sobering Center” for attachment to your report.
