Proposal for Specific ToR for Tvl.Chanthraa Granites, Adaichani Village, Ambasamudram Taluk, Tirunelveli District Proposal for Specific Terms of Reference for Violation cases The Proponent, Tvl.Chanthraa Granites, having vast experience and skill on quarrying of granite blocks in Ambasamudram Taluk, Adaichani area for the last 5 years. They have been granted mining Lease from the State Government over an extent of 1.20.0 Hectares in S.F.No.353/2B, Adaichani village of Ambasamudram Taluk, Tirunelveli District to quarry Multi colour granite vide G.O.3(D) N0.5 dated 15.02.2010 (08.04.2010 – 07.04.2030) to quarry granite blocks. The Location of the area is represented by Survey of India Toposheet No. 58 H/6 with latitude and longitude ranges from 08º45’27.3”N - 08º45’29.8”N and 77º25’34.6”E - 77º25’42.4”E with elevation 105m above MSL. The project falls under “B1” Category, as the total extent of this quarry exceeds 25 Ha around 500m radius as per EIA Notification, 2006. Application for ToR was already submitted to SEIAA/SEAC Tamil Nadu vide File No. 6031 dated 20.12.2016. In view of delayed application for obtaining Environment Clearance, the project is treated as a violation case as per MoEF&CC notification S.O. No. 804(E), dated 14.03.2017. The MoEF&CC treated all such projects or activities requiring prior environmental clearance under Environment Impact Assessment Notification, 2006 from the concerned Regulatory Authority are brought for environmental clearance after starting the construction work, or have undertaken expansion, modernization, and change in product- mix without prior environmental clearance, these projects be treated as cases of violations and in such cases, even Category B projects which are granted environmental clearance by the State Environment Impact Assessment Authority constituted under sub-section (3) Section 3 of the Environment (Protection) Act, 1986 should be appraised for grant of environmental clearance only by the Expert Appraisal Committee and environmental clearance will be granted at the Central level, MoEF&CC, New Delhi. 1. Specific ToR : The Project Proponent has to submit a specific Terms of Reference for the project on assessment of ecological damage, remediation plan and natural and community resource augmentation plan since 15.01.2016, which shall be later incorporated as an independent chapter in the environment impact assessment report as follows: AADHI BOOMI MINING AND ENVIRO TECH (P) LTD., SALEM, TAMIL NADU. Natural and community resource augmentation plan The proposal is to assess the environmental damage for this mine includes assessment of land degradation by mine workings, waste dumping, hydro geological studies in core and buffer zone around 1km, afforestation programme with respect to flora, deforestation if any, mine traffic analysis using public roads, impact of ground vibrations if any habitation within 300m radius, measuring socio economic impact by means of CSR activities, analysis of production schedule, waste removal with respect to approved mining plan/scheme. 2. Standard ToR Salient details of the project activity etc are given in Feasibility report enclosed along with this form. Standard Terms of Reference for conducting Environment Impact Assessment study for non-coal mining projects given by MoEF in April, 2015 will be followed as given below. 1. Year-wise production details since 1994 will be given, clearly stating the highest production achieved in any one year prior to 1994. 2. A copy of the supporting documents in support of the fact that the Proponent is the rightful lessee of the mine will be given. 3. All documents including approved mining plan, EIA and Public Hearing will be compatible with one another in terms of the mine lease area, production levels, waste generation and its management, mining technology etc. and will be in the name of the lessee. 4. All corner coordinates of the mine lease area, superimposed on a High Resolution Imagery/ toposheet, topographic sheet, geomorphology and geology of the area will be provided (core and buffer zone).. 5. Information will be provided in Survey of India Toposheet in 1:50,000 scale indicating geological map of the area, geomorphology of land forms of the area, existing minerals and mining history of the area, important water bodies, streams and rivers and soil characteristics. Details about the land proposed for mining activities will be given with information as to whether mining conforms to the land use policy of the State. 7. Environment Policy approved by Board of Directors, procedures to bring into focus any infringement / deviation / violation of the environmental or forest norms / conditions, hierarchical system or Administrative order of the company to deal with the environmental issues and for ensuring compliance with the EC conditions and the system of reporting of non compliances / violations of environmental norms to the Board of Directors of the company and or shareholders will be detailed in the EIA report. 8. Issues relating to Mine Safety like slope stability study, blasting study etc. for open cast mining shall be detailed. The proposed safeguard measures in each case will be provided. 9. The study area will comprise of 10 km zone around the mine lease from lease periphery and the data contained in the EIA such as waste generation etc. will be for the life of the mine / lease period. 10. Land use of the study area delineating forest area, agricultural land, grazing land, wildlife sanctuary, national park, migratory routes of fauna, water bodies, human settlements and other ecological features will be indicated. Land use plan of the mine lease area will be prepared to encompass preoperational, operational and post operational phases and will be submitted. 11. Details of the land for any Over Burden Dumps outside the mine lease, such as extent of land area, distance from mine lease, its land use, R&R issues will be given. 12. A Certificate from the Competent Authority in the State Forest Department will be provided, confirming the involvement of forest land, if any, in the project area. 13. Status of forestry clearance if any for the broken up area and virgin forestland involved in the Project including deposition of net present value (NPV) and compensatory afforestation (CA) will be indicated. 14. Implementation status of recognition of forest rights under the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 if any will be indicated. The vegetation in the RF / PF areas in the study area, with necessary details, will be given in the EIA report, if any. 16. A study will be done to ascertain the impact of the Mining Project on wildlife of the study area and details will be furnished in EIA report, if any. 17. Location of National Parks, Sanctuaries, Biosphere Reserves, Wildlife Corridors, Tiger/Elephant Reserves/(existing as well as proposed), if any, within 10 km of the mine lease will be clearly indicated, supported by a location map duly authenticated by Chief Wildlife Warden. Necessary clearance, as may be applicable to such projects due to proximity of the ecologically sensitive areas as mentioned above, should be obtained from the Standing Committee of National Board of Wildlife will be furnished if applicable. 18. A detailed biological study of the study area [core zone and buffer zone (10 km radius of the periphery of the mine lease)] will be carried out and incorporated in the report. 19. Proximity to Areas declared as 'Critically Polluted' or the Project areas attracting court restrictions for mining operations, will also be indicated and where so required, clearance certifications from the prescribed Authorities, such as the SPCB or State Mining Department will be secured and furnished if any. 20. Similarly, for coastal Projects, if applicable, A CRZ map duly authenticated by one of the authorized agencies demarcating LTL. HTL, CRZ area, location of the mine lease w.r.t CRZ, coastal features such as mangroves, if any, will be furnished. 21. R&R Plan/compensation details for the Project Affected People (PAP) will be furnished if any. 22. Existing environmental quality within 10 KM. radius of the project site will be assessed based on secondary data collected from various sources supplemented by primary data generated at site. Baseline data will be generated for One season (non-monsoon) [i.e. March- May (Summer Season); October-December (post monsoon season) ; December-February (winter season) as given below, AADHI BOOMI MINING AND ENVIRO TECH (P) LTD., SALEM, TAMIL NADU. Meteorology: Meteorological data for wind speed, wind direction, relative humidity and ambient temperature will be generated close to the site form IMD. Readings will be noted on hourly basis. Historical meteorological data will be obtained to assess the climatic trend. ii. Ambient Air: AAQ data of the study area will be generated by following the guidelines for ambient air quality monitoring published by CPCB (Guidelines for Ambient Air Quality Monitoring: Particulate matters (PM10& PM2.5), Sulphur dioxide and nitrogen dioxide will be monitored for one full season (except monsoon). The baseline ambient air quality will be monitored. The monitoring stations will be selected taking into account the predominant wind direction, population zone, sensitive receptors etc. iii. Water Quality: Surface and groundwater sampling locations within the study area will be identified based on drainage pattern, water utilization and location of bore wells / dug wells.
