1 AN ACT concerning

2 Transportation Authority – Transportation Facilities Projects – 3 Cash Toll All–Electronic Tolling – Study

4 FOR the purpose of requiring the Maryland Transportation Authority to maintain at 5 certain transportation facilities projects at least one cash toll and as many 6 additional cash toll lanes as necessary to ensure that motorists are not unduly 7 delayed in passing through the toll plaza; and generally relating to cash toll 8 lanes at transportation facilities projects complete a study and submit a report 9 on the status of its initiative to implement all–electronic tolling; requiring the 10 study to include certain matters; requiring the Authority to submit a report of 11 its findings and recommendations to certain persons on or before a certain date; 12 prohibiting the Authority from implementing all–electronic tolling at a certain 13 facility before a certain date; and generally relating to all–electronic tolling.

14 BY repealing and reenacting, without amendments, 15 Article – Transportation 16 Section 4–101(h) 17 Annotated Code of Maryland 18 (2008 Replacement Volume and 2013 Supplement)

19 BY adding to 20 Article – Transportation 21 Section 4–406 22 Annotated Code of Maryland 23 (2008 Replacement Volume and 2013 Supplement)

1 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF 2 MARYLAND, That the Laws of Maryland read as follows:

3 Article – Transportation

4 4–101.

5 (h) “Transportation facilities project” includes:

6 (1) The Susquehanna River Bridge, the Harry W. Nice Memorial 7 Potomac River Bridge, the William Preston Lane, Jr. Memorial Chesapeake Bay 8 Bridge and parallel , the Harbor , the Fort 9 McHenry Tunnel, the Francis Scott Key Bridge, and the John F. Kennedy Memorial 10 Highway, together with their appurtenant causeways, approaches, interchanges, 11 entrance plazas, toll stations, and service facilities;

12 (2) A vehicle parking facility located in a priority funding area as 13 defined in § 5–7B–02 of the State Finance and Procurement Article;

14 (3) Any other project for transportation facilities that the Authority 15 authorizes to be acquired or constructed; and

16 (4) Any additions, improvements, or enlargements to any of these 17 projects, whenever authorized.

19 AT EACH TRANSPORTATION FACILITIES PROJECT, EXCLUDING THE 20 INTERCOUNTY CONNECTOR, EXPRESS TOLL LANES, OR A 21 VEHICLE PARKING FACILITY, THE AUTHORITY SHALL MAINTAIN:

22 (1) AT LEAST ONE LANE WHERE MOTORISTS MAY PAY THE TOLL 23 IN CASH; AND

24 (2) AS MANY ADDITIONAL LANES WHERE MOTORISTS MAY PAY 25 THE TOLL IN CASH AS ARE NECESSARY TO ENSURE THAT MOTORISTS PAYING 26 THE TOLL IN CASH ARE NOT UNDULY DELAYED IN PASSING THROUGH THE TOLL 27 PLAZA.

28 (a) (1) In this section the following words have the meanings indicated.

29 (2) “All–electronic tolling” means electronic toll collection at highway 30 speeds through the use of a transponder and video tolling, with no cash transactions 31 occurring on the roadway.

1 (3) “Authority” means the Maryland Transportation Authority.

2 (4) “Project” means the:

3 (i) Thomas J. Hatem Memorial Bridge;

4 (ii) Harry W. Nice Memorial Potomac River Bridge;

5 (iii) William Preston Lane, Jr. Memorial Chesapeake Bay Bridge 6 and parallel Chesapeake Bay Bridge;

7 (iv) ;

8 (v) Fort McHenry Tunnel;

9 (vi) Francis Scott Key Bridge; or

10 (vii) Millard Tydings Memorial Bridge.

11 (b) (1) The Authority shall complete a study and submit a report on the 12 status of its initiative to implement all–electronic tolling in accordance with this 13 subsection.

14 (2) The study shall include:

15 (i) an analysis of all–electronic tolling in other states and a 16 description of various all–electronic tolling programs;

17 (ii) an analysis of electronic toll collection interoperability;

18 (iii) an analysis of:

19 1. alternative payment methods that do not exceed the 20 existing cash toll rate at each project;

21 2. a video toll rate based on an analysis of actual costs 22 and potential savings to collect video tolls; and

23 3. a toll rate needed to address concerns with video toll 24 collection associated with trucks;

25 (iv) an analysis of issues and factors related to all–electronic 26 tolling that must be addressed before all–electronic tolling becomes effective at each 27 project;

28 (v) an overview of revisions, if any, to the Authority’s initial 29 all–electronic tolling proposal; and

1 (vi) proposed legislation, if required, relating to the 2 implementation of all–electronic tolling.

3 (3) The Authority shall submit a report of its findings and 4 recommendations on or before January 1, 2016, to:

5 (i) the County Executive and County Council of Cecil County;

6 (ii) the County Executive and County Council of Harford 7 County;

8 (iii) the Mayor and Town Commission of the Town of Perryville;

9 (iv) the Mayor and City Council of the City of Havre de Grace; 10 and

11 (v) in accordance with § 2–1246 of the State Government 12 Article, the House Committee on Ways and Means and the Senate Finance 13 Committee.

14 (c) The Authority’s initial proposal for all–electronic tolling at the Thomas J. 15 Hatem Memorial Bridge is withdrawn and the Authority may not implement 16 all–electronic tolling at the Thomas J. Hatem Memorial Bridge before January 1, 17 2016.

18 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 19 June 1, 2014.
