Letter Reso 1..2 *LRB10021359MST37744r* HR0941 LRB100 21359 MST 37744 r 1 HOUSE RESOLUTION 2 WHEREAS, The members of the Illinois House of 3 Representatives are saddened to learn of the death of Zena Ray 4 "Zeke" Upshaw, who passed away on March 26, 2018; and 5 WHEREAS, Zeke Upshaw was born in Chicago on May 27, 1991 6 and grew up in the Hyde Park neighborhood; he attended the 7 University of Chicago Laboratory Schools and played for the 8 Maroons, where as a junior in 2008, he was named the most 9 valuable player of the Independent School League; he was one of 10 the school's first players to earn a Division I basketball 11 scholarship when he went to play for the Illinois State 12 University (ISU) Redbirds; he graduated from ISU with a degree 13 in apparel, merchandising, and design in 2013; he then played 14 for the Hofstra University Pride while studying for a 15 post-graduate degree; and 16 WHEREAS, Zeke Upshaw played for the Helios Suns in Slovenia 17 during the 2014-2015 season and for Basket Esch in Luxembourg 18 during the 2015-2016 season; and 19 WHEREAS, Zeke Upshaw was drafted by the Grand Rapids Drive 20 in the 2016 NBA Developmental League Draft; and 21 WHEREAS, Zeke Upshaw was in his second season with the HR0941 -2- LRB100 21359 MST 37744 r 1 Grand Rapids Drive, an affiliate of the Detroit Pistons; 2 therefore, be it 3 RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE 4 HUNDREDTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we 5 mourn the passing of Zena Ray "Zeke" Upshaw, and extend our 6 sincere condolences to his family, friends, and all who knew 7 and loved him; and be it further 8 RESOLVED, That a suitable copy of this resolution be 9 presented to the family of Zeke Upshaw as an expression of our 10 deepest sympathy..

I. Background Zena “Zeke” Upshaw (“Mr. Upshaw”) was a professional basketball player in the “G-League,” the official minor league of the NBA, for the Grand Rapids Drive. On March 24, 2018, during the final minutes of the team’s last regular season game, in which the Drive defeated the Long Case 1:19-cv-00341-PLM-PJG ECF No. 55, PageID.<pageID> Filed 04/30/19 Page 2 of 8 Island Nets to earn a play-off spot, Upshaw collapsed at the DeltaPlex Arena in Grand Rapids and was taken off the court. Mr. Upshaw died two days later. On October 22, 2018, Mr. Upshaw’s mother, Plaintiff Jewel Upshaw, individually and as personal representative for the Estate of Mr. Upshaw, filed a ten-count Complaint in the United States District Court for the Eastern District of Michigan. Defendants are the National Basketball Association (“NBA”), Detroit Pistons Basketball Company (“Pistons”), SSJ Group, LLC (“SSJ”)1, and DeltaPlex Arena (“DeltaPlex”). Plaintiff alleges that Defendants failed to administer adequate emergency medical treatment when Mr. Upshaw collapsed on the court, ultimately resulting in his death.

Case No. 1:19-cv-341 SSJ GROUP LLC, et al., Defendants. ____________________________________/ REPORT AND RECOMMENDATION This case arises from the tragic death of Zena “Zeke” Upshaw. In the spring of 2018, Upshaw was a player for the Grand Rapids Drive, a member of the National Basketball Association’s G League. During a March 24, 2018, Drive game, Upshaw collapsed and died two days later. Upshaw’s mother, Jewel Upshaw, initiated this action against one individual and several entities. This matter is before the Court on the motions to dismiss filed by all but one of the remaining defendants. (ECF No. 108, 112, 126, and 146). Pursuant to 28 U.S.C. 636(b)(1)(B), the undersigned recommends that Defendants’ motions be granted in part and denied in part as detailed herein. BACKGROUND In her Second Amended Complaint, Jewel Upshaw (Plaintiff) alleges the following.
