GOEBEL* Population transfer is an issue arising often in areas of ethnic ten- sion, from Croatia and Bosnia and Herzegovina to the Western Sahara, Tibet, Cyprus, and beyond. There are two forms of human population transfer: removals and settlements. Generally, commentators in interna- tional law have yet to discuss the two together as a single category of population transfer. In discussing the prospects for such a broad treat- ment, this article is a first to compare and contrast international law's application to removals and settlements. I. INTRODUCTION International attention is focusing on uprooted people, especially where there are tensions of ethnic proportions. The Red Cross spent a significant proportion of its budget aiding what it called "displaced peo- ple," removed en masse from their abodes. Ethnic cleansing, a term used by the Serbs, was a process of population transfer aimed at removing the non-Serbian population from large areas of Bosnia-Herzegovina.2 The large-scale Jewish settlements into the Israeli-occupied Arab territories continue to receive publicity. -

Click to Enlarge Image HISTORICAL BACKGROUND Early Human Settlement: Human settlement first occurred in the lands that now constitute Romania during the Pleistocene Epoch, which began about 600,000 years ago. About 5500 B.C. the region was inhabited by Indo-European people, who in turn gave way to Thracian tribes. Today’s Romanians are in part descended from the Getae, a Thracian tribe that lived north of the Danube River. During the Bronze Age (about 2200 to 1200 B.C.), these Thraco-Getian tribes engaged in agriculture, stock raising, and trade with inhabitants of the Aegean Sea coast. -

Displaced persons (UN DPs), refugees, returnees, ethnic German expellees (Vertriebene)1 and soldiers arrived in desperate need of care, including food, shelter, medical attention, clothing, bedding, shoes, cooking utensils, and cooking fuel. An estimated 7.3 million people transited to or through Berlin between July 1945 and March 1946.2 In part because of its geographical location, Berlin was an extreme case, with observers estimating as many as 30,000 new arrivals per day. However, cities across Germany were swollen with displaced persons, starved of es- sential supplies, and faced with catastrophic housing shortages. During that time, ethnic, religious, and linguistic “others” were frequently conferred legal privileges, while ethnic German expellees and internally displaced persons (IDPs) were disadvantaged by the occupying forces. How did refugees, returnees, DPs, IDPs and other migrants navigate the fractured governmentality and allocated scar- city of the postwar regime? How did survivors survive the postwar? The summer of 1947 in South Asia was extraordinary in diff erent ways.3 Faced with a hastily organized division of the Indian sub- continent into India and Pakistan (known as the Partition), between 10 and 14 million Muslims, Sikhs, and Hindus crossed borders in a period of only a few months. Ottoman History of South-East Europe by Markus Koller The era of Ottoman Rule, which began in the fourteenth century, is among the most controversial chapters of South-East European history. Over several stages of conquest, some of them several decades long, large parts of South-Eastern Europe were incorporated into the Ottoman Empire, or brought under its dominion. While the Ottomans had to surrender the territories north of the Danube and the Sava after the Peace Treaty of 1699, the decline of Ot- toman domination began only in the nineteenth century. Structures of imperial power which had been implemented in varying forms and intensity in different regions were replaced by emerging nation states in the nineteenth century. The development of national identities which accompanied this transformation was greatly determined by the new states distancing themselves from Ottoman rule, and consequently the image of "Turkish rule" has been a mainly negative one until the present. Can Forced Population Transfers Resolve Self-determination Conflicts? A European Perspective Stefan Wolff Department of European Studies University of Bath Bath BA2 7AY England, UK [email protected] Introduction Self-determination conflicts are among the most violent forms of civil wars that can engulf modern societies. As they are in most cases linked to claims of ethnic, religious, linguistic or otherwise defined groups for secession from, or for political domination in, an existing state they also have repercussions on regional and international stability. Self-determination conflicts can be observed on all continents. Not all of them are violent, but most have a clear potential for violent escalation and are therefore an important concern for international and regional governmental organisations seeking to preserve peace and stability. However, the capacity of organisations like the UN, the OSCE and the EU to do so has only gradually developed over the past decade and is still a far cry from being sufficient. In the past and present, states (and population groups within them) have therefore felt that they had been and are left to their own devices when it comes to preserving their internal stability and external security. The largely incongruent political and ethnic maps of Europe have meant that self- determination conflicts on this continent have mostly taken the form of ethnic conflicts: from Northern Ireland to the Caucasus, from the Basque country to the Åland islands and from Kosovo to Silesia the competing claims of distinct ethnic groups to self-determination have been the most prominent sources of conflicts within and across state boundaries. -

92 Chapter III PROVINCIA DACIA AUGUSTI: 165 years of Roman rule on the left bank of the Danube. At the beginning of the 2nd century, in the Spring of 101AD, Roman Forces marched against the Kingdom of Decebal. We already know what the Roman's rationale was for starting this war and we also know that the real reason was likely to have been the personal ambition of the first Provincial Emperor, Trajan (he was born in Hispania a man of Macedonian background among Greeks). The Roman armies marched against a client-state of Rome, which was a subordinate ally of Rome. Decebal did not want to wage war against Rome and his recurring peace offers confirm this. It is unlikely that Trajan would only have decided on the total conquest of the Dacian Kingdom after he waged his first campaign in 101-102. After this, Roman garrisons were established in the Province - their ongoing presence is reflected by the Latin names of towns (as recorded by Ptolemy). At Dobreta they begin to build the stone bridge which will span the Danube. It was built in accordance with plans made by Apollodorus of Damascus to promote continuous traffic - it was an accomplishment unmatched - even by Rome. This vast project portends that Trajan began the expedition against Dacia in 101 with the intention of incorporating the Kingdom into the Roman Empire. The Emperor, who founded a city (Nicopolis) to commemorate his victory over Dacia, has embarked on this campaign not only for reasons of personal ambition. The 93 economic situation of the Empire was dismal at the beginning of Trajan's reign; by the end of the second Dacian War it has vastly improved. -
Indicators for Monitoring the Un Declaration on the Rights of Indigenous Peoples
INDICATORS FOR MONITORING THE UN DECLARATION ON THE RIGHTS OF INDIGENOUS PEOPLES A solid framework and a practical tool for assessing the implementation of UNDRIP’s provisions. The indicators serve to detect gaps in implementation, hold duty-bearers accountable, and devise implementation strategies. 1 WHAT IS THE INDIGENOUS NAVIGATOR? The Indigenous Navigator comprises a set of tools for monitoring indigenous peoples’ rights and development. One of these tools is a set of indicators, which serve to pinpoint what to look for when measuring whether the provisions of UNDRIP are implemented in a given community or country. The indicators are structured around 13 thematic domains reflected in UNDRIP and have been systematically developed with a solid foundation in the OHCHR’s methodology for developing human rights indicators.1 Like all other human rights instruments, UNDRIP comprises standards on specific rights and cross-cutting human rights norms. The first step towards identifying the indicators has therefore been to identify the attributes – or building blocks – contained in UNDRIP. Subsequently, measurable indicators have been identified with a view to capturing States’ duties to respect, protect and fulfil indigenous peoples’ human rights. The indicators framework comprises: Structural indicators, which assess the legal and policy framework of a given country. Process indicators, which measure the states’ ongoing efforts to implement human rights commitments through programs, budget allocations, etc. Outcome indicators, which capture the actual enjoyment of human rights by indigenous peoples. The indicators can also be used to measure essential aspects of the SDGs as well as the commitments made by States at the 2014 World Conference on Indigenous Peoples. -

Koenker Professor Harriet Murav Assistant Professor Eugene Avrutin Abstract ―Parallel Ruptures: Jews of Bessarabia and Transnistria between Romanian Nationalism and Soviet Communism, 1918-1940,‖ explores the political and social debates that took place in Jewish communities in Romanian-held Bessarabia and the Moldovan Autonomous Soviet Socialist Republic during the interwar era. Both had been part of the Russian Pale of Settlement until its dissolution in 1917; they were then divided by the Romanian Army‘s occupation of Bessarabia in 1918 with the establishment of a well-guarded border along the Dniester River between two newly-formed states, Greater Romania and the Soviet Union. At its core, the project focuses in comparative context on the traumatic and multi-faceted confrontation with these two modernizing states: exclusion, discrimination and growing violence in Bessarabia; destruction of religious tradition, agricultural resettlement, and socialist re-education and assimilation in Soviet Transnistria. It examines also the similarities in both states‘ striving to create model subjects usable by the homeland, as well as commonalities within Jewish responses on both sides of the border. Contacts between Jews on either side of the border remained significant after 1918 despite the efforts of both states to curb them, thereby necessitating a transnational view in order to examine Jewish political and social life in borderland regions. -

The Catalyst for Warfare: Dacia’s Threat to the Roman Empire ______________________________________ ALEXANDRU MARTALOGU The Roman Republic and Empire survived for centuries despite imminent threats from the various peoples at the frontiers of their territory. Warfare, plundering, settlements and other diplomatic agreements were common throughout the Roman world. Contemporary scholars have given in-depth analyses of some wars and conflicts. Many, however, remain poorly analyzed given the scarce selection of period documents and subsequent inquiry. The Dacian conflicts are one such example. These emerged under the rule of Domitian1 and were ended by Trajan2. Several issues require clarification prior to discussing this topic. The few sources available on Domitian’s reign describe the emperor in hostile terms.3 They depict him as a negative figure. By contrast, the rule of Trajan, during which the Roman Empire reached its peak, is one of the least documented reigns of a major emperor. The primary sources necessary to analyze the Dacian wars include Cassius Dio’s Roman History, Jordanes’ Getica and a few other brief mentions by several ancient authors, including Pliny the Younger and Eutropius. Pliny is the only author contemporary to the wars. The others inherited an already existing opinion about the battles and emperors. It is no surprise that scholars continue to disagree on various issues concerning the Dacian conflicts, including the causes behind Domitian’s and Trajan’s individual decisions to attack Dacia. This study will explore various possible causes behind the Dacian Wars. A variety of reasons lead some to believe that the Romans felt threatened by the Dacians. -

Moving beyond approaches centered on an investigation of similar territorial debates over contested lands and their immediate outcomes, the paper primarily analyses the potential of a political conflict for generating a community of intellectuals who become involved in propagating their respective state and nation-building causes. Putting the case of interwar Dobruja into the context of “entangled history”, the study clarifies its place within the framework of similar debates regarding other borderlands. Relying on the publications of the participants of the debate, the article claims that a conflict over a territory and the possibilities of its integration binds together influential public actors, various representatives of the local intellectual elite, uniting them in an unlikely epistemic community. Keywords: epistemic community, social networking, state-building, Dobruja Introduction A borderland is not only a contact zone (Pratt 1992, p. 4), but a constant source of political creativity for the local public actors. Territorial frames of an idealized nation-state are usually vague, contested, based on various interpretations of multiple historical legacies and their application to practice.
