Toronto Blue Jays Baseball Club Under Armour All-America Baseball Game PLAYER RELEASE AND WAIVER In consideration of the Chicago Cubs (hereinafter “Cubs”) allowing me, or my minor Child minimum age 10 or older (my “Child”), as applicable, to participate in the “Under Armour All-America Baseball Game” and associated events (the “Event”), being held on August 15, 2015, at Wrigley Field, I, on behalf of myself (and my minor Child, as applicable) hereby acknowledge, appreciate and agree that: 1. I know baseball and softball are action sports. I also know natural and man-made obstacles or hazards and surface and environmental conditions may be present on the field, in the stands, in the batting cage, in the outfield, on the warning track and throughout the stadium during the Event, and each may carry a significant risk, including, without limitation, the risk of death or serious injury to myself, my minor Child or others, and damage to the property of myself, my minor Child or others. At all times when on or around Wrigley Field, I agree to take an active role in identifying and accepting those risks, conditions, obstacles and hazards. I am not required to undertake or participate in the Event—I have freely elected to do so and choose to participate in the Event at my own risk; 2. I, for myself, my heirs, assigns, administrators, executors, legal and personal representatives, and next of kin HEREBY RELEASE, WAIVE AND FOREVER DISCHARGE, PROTECT AND SAVE HARMLESS Headfirst Professional Sports Camps, LLC; Baseball Factory, Under Armour, Chicago Cubs Baseball Club, LLC; Wrigley Field Enterprises, LLC; Wrigley Field Holdings, LLC, Chicago Baseball Holdings, LLC, Levy Premium Food Service Limited Partnership, the other Major League Clubs (individually and collectively), the Office of the Commissioner of Baseball, Major League Enterprises, Inc., Major League Baseball Properties, Inc., MLB Advanced Media, L.P., The MLB Network, LLC, the respective owners (direct and indirect), and their respective parent and affiliated companies, subsidiaries, successors, assigns, officers, officials, directors, employees, agents, representatives, other participants, ushers, grounds crew, security officials, players, umpires, sponsors, and advertisers, and the owners and lessors of the premises used to conduct the Event (collectively, the “Released Parties”), from all past, present and future claims or allegations of any nature whatsoever, whether known or unknown, and including but not limited to bodily injury or death, WITH RESPECT TO THE EVENT, any promotion or publicity about the Event, AND/OR ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER CAUSED BY THE NEGLIGENCE OF ANY OF THE RELEASED PARTIES, OTHER EVENT PARTICIPANTS, OR OTHERWISE; 3. I agree to abide by all rules and regulations of Wrigley Field and the directions of Wrigley Field personnel. I understand the Cubs have the right to remove me from Wrigley Field and/or to terminate the Event at any time and for any reason in Cubs’ sole and absolute discretion; 4. I understand and agree the Event is for the sole purpose of my entertainment. Any pictures or photographs taken shall be used solely for my private, non-commercial use. No commercial use may be made of the pictures, descriptions or use of Wrigley Field or the Event. Absolutely no sale, transmission, distribution or commercial use of any picture or description is permitted; 5. I hereby grant to the Released Parties and their respective designees the right to use my name, voice, photograph, actions and likeness, any video and/or audio recordings of my appearance in or around Wrigley Field and any other facts about me or my participation in the Event, in perpetuity (i.e., forever) throughout the universe in all media without limitation and without additional compensation or consideration, notification or permission, unless prohibited by law; 6. I, my heirs, assigns, administrators, executors, legal and personal representatives, and next of kin will not make any claim or take any actions or proceedings of any type in respect of any matter referred to in this release against any of the Released Parties or against any other person, corporation, firm or government authority who or which might claim contribution, indemnity or relief from or over the Cubs; and 7. I, HEREBY AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS the Released Parties from any loss, liability, damage, or cost they may incur due to my, or my minor Child’s participation in the Event, whether caused by the negligence of the Released Parties or otherwise. I hereby declare that I have reached the age of 18 years; (or if not, I am at least ten years of age and my custodial parent/legal guardian is signing below on my behalf), that I have carefully read all of the foregoing; that I fully understand its contents; that I have given this release and waiver of my own free will; and, that this release and waiver binds my heirs, assigns, administrators, executors, legal and personal representatives, and next of kin. When his playing career concluded he coached at his Alma Mater UNM and he is currently a hitting coach in the Los Angeles Angels organization. Brian Betancourth: Brian currently serves as a hitting coach in the Los Angeles Angels of Anaheim organization. Prior to that, he was in the Colorado Rockies organization. He spent this past summer with their affiliate in Modesto. He played his college baseball at Mount San Jacinto Junior College in Southern California. After his collegiate career, Brian went on to play for the Long Beach Armada in the Golden Baseball League, an independent professional league on the West Coast.
