5 Design requirements All conveyor belting used in underground coal mines must be designed to be fire resistant and antistatic. The designer must specify the published technical standards, or the engineering principles used to identify controls, in the order of the hierarchy of risk controls in Part 3.1 of the Work Health and Safety Regulation 2017, incorporated in the design. 6 Testing requirements 6.1 General Conveyor belts must be type tested, and retested, in accordance with the requirements of clauses 5.2 and 5.3 ‘Type testing’ and clause 6.3 ‘Retesting for type tests’ of AS 4606-2012 Grade S fire resistant and antistatic requirements for conveyor belting and conveyor accessories (as amended from time to time). 6.2 Test Facility (1) Despite the requirements of clause 5.5 ‘Test facility’ of AS 4606-2012, that the test facility used for type testing shall be a test facility unrelated to the organisation manufacturing or supplying the conveyor belt, the test facility shall either be: (a) An independent facility in Australia that is accredited by the National Association of Testing Authorities (NATA) for performing the specific tests described in the standards referred to in this Order, or (b) where a NATA-accredited laboratory is not available, a suitably qualified and experienced independent testing facility having regard to test equipment, equipment calibration, quality processes, work methods, past test experience and independent technical verification should be used. 6 Performance standards (1) Conveyor belts must comply with the requirements of Grade S conveyor belting as set out in AS 4606- 2012. (2) Despite the performance requirements of clause 6.1.3 of AS 4606-2012, ‘Ignitability and maximum surface temperature of belting subjected to friction (Drum friction test)’, conveyor belts for use in applications where they are too inflexible to wrap around the drum, need not comply with those requirements, provided: (a) it can be demonstrated that it is not reasonably practicable to comply, and (b) specify the published technical standards, or the engineering principles used to identify controls, in the order of the hierarchy of risk controls in Part 3.1 of the Work Health and Safety Regulation 2017, to protect from the risk of heating of the conveyor belt due to belt slip and/or friction between the conveyor belt and a metal object. Regulation means the Work Health and Safety (Mines and Petroleum Sites) Regulation 2014. 4 Revocation The Registration of Explosive-Powered Design Order 2015 published in the NSW Government Gazette No 52 of 26 June 2015 at pages 1851-1852 is revoked. 5 Design requirement (1) All explosive-powered tools used in underground coal mines must be designed, in accordance with the following standards, as amended from time to time: (a) AS/NZS 1873.1:2003 Powder-actuated (PA) hand-held fastening tools –Selection, operation and maintenance (b) AS/NZS 1873.2:2003 Powder-actuated (PA) hand-held fastening tools – Design and construction (c) AS/NZS 1873.3:2003 Powder-actuated (PA) hand-held fastening tools – Charges (d) AS/NZS 1873.4:2003 Powder-actuated (PA) hand-held fastening tools – Fasteners (2) Without limiting 5 (1) above, all explosive-powered tools including its associated range of explosive charges and fasteners, must be designed such that the tool itself is not an effective ignition source of a methane-enriched atmosphere. (3) Where a design does not comply, in full or part, with the guidelines listed in paragraphs 5(1)(a)-(d), the designer must specify the published technical standards or the engineering principles used to identify controls, in the order of the hierarchy of risk controls in Part 3.1 of the Work Health and Safety Regulation 2017, incorporated in the design to achieve at least an equivalent level of safety as the design requirements in 5 (1) and 5 (2). 6 Testing requirements 6.1 General The explosive-powered tool, including its associated range of explosive charges and fasteners as intended for use in the underground coal mine, must be tested to determine if the explosive-powered tool is likely to ignite an explosive atmosphere. 6.2 Test method (1) All explosive-powered tools must be tested as follows: (a) the explosive-powered tool is to be placed in a small flameproof test chamber which is filled with a mixture of 7.5% volume ethylene in air, (b) the tool is to be loaded with the range of relevant strip-mounted cartridges and range of relevant sized fasteners for which registration is sought, (c) testing is to be performed at maximum and minimum power selections, using short and long fasteners firing into a range of target materials, (d) testing is to be performed with a range of expected target materials including industry brick, concrete and steel plate, (e) where applicable, the tool is to be tested with supplied extension trigger assembly fitted and with magazine. (2) Testing must be repeated at least five times for each combination to be able to demonstrate the repeatability of the results. (3) Testing must be repeated to simulate all reasonably foreseeable operating conditions of the explosive- powered tool.

6.3 Test facility All testing must be carried out by: (a) a laboratory in Australia that is accredited by the National Association of Testing Authorities Australia (NATA) for performing the specific tests described in the standards referred to in this Order, or (b) where a NATA-accredited laboratory is not available, a suitably qualified and experienced independent facility having regard to test equipment, equipment calibration, quality processes, work methods, past test experience and independent technical verification should be used. 7 Performance standards When the explosive-powered tool is fired in the test chamber, the surrounding ethylene environment must not ignite.

The skiing events will involve the use of powered vessels, persons being towed at speed using tow-lines and persons in the water from time to time, presenting a significant potential hazard to other waterway users. Fireworks displays will be staged from land at the location specified above. The area directly around this location may be dangerous and hazardous during the fireworks display. An EXCLUSION ZONE is specified during the events, which will be marked by buoys and monitored by control vessels on the perimeter. All vessel operators and persons in the vicinity should exercise extreme caution, keep a proper lookout, and keep well clear of competing vessels and the fireworks launch position. Unauthorised vessels and persons are strictly prohibited from entering the exclusion zone, which will be monitored by control vessels. MARINE SAFETY ACT 1998 MARINE NOTICE Section 12(2) REGULATION OF VESSELS – EXCLUSION ZONE AND SPECIAL RESTRICTIONS Location Sydney Harbour – Farm Cove to North Head as follows:

All navigable waters bounded by imaginary lines drawn between: • Bennelong Point Port Hand Beacon and Kirribilli Point, • the most northerly point of Middle Head, and Cannae Point Flagstaff, • North Head starboard hand beacon and Hornby Light Event Duration Tuesday 11 December 2018, from 12:00pm to 3:00pm Exclusion Zones A special event, the SOLAS Big Boat Challenge 2018, will take place on Sydney Harbour at the above location. Due to the potential to affect the safety of navigation, Exclusion Zones are specified which will set aside a starting area for competing vessels and protect the course rounding buoys. • Spectator vessels wishing to watch the start (in the vicinity of the area between Clark Island and Point Piper) are required to keep out of the exclusion zone, which will be marked by yellow buoys. Spectator vessels are required to remain to the west of the western line of buoys and east of the eastern line of buoys. • In the vicinity of the orange CYCA inflatable race turning mark approximately 500m south west from Cannae Point a series of exclusion buoys will be installed. Spectators are not to navigate between the exclusion buoys and the orange turning mark. • In the vicinity of the orange CYCA inflatable race turning mark approximately 100m south east of Shark Island a series of exclusion buoys will be installed. Spectators are not to navigate between the exclusion buoys and orange turning mark. • In the vicinity of the west cardinal mark off Shark Island a series of five yellow exclusion buoys will be installed in a line to the north-west. Spectators are not to navigate to the south of the buoys when race yachts are in the vicinity. Only competing vessels, authorised media vessels and official control vessels are permitted in the exclusion zones. All other vessels are required to stay clear. Penalties may apply (Marine Safety Act 1998, s.12(5) – Maximum Penalty $1,100.00) Special Restrictions Pursuant to section 12(3) of the Marine Safety Act 1998, a strict 6 knot speed limit zone and a “no wash” zone will be in place within 200m of the exclusion zones from 12:20pm to 12:40pm Directions RMS advises: 1) Persons within the vicinity of the event must comply with any directions given by a Boating Safety Officer or Police Officer in relation to the Special Event or to marine safety. Failure to comply with any such direction is an offence (Marine Safety Act 1998, s.15A – Maximum Penalty $3,300.00). 2) Any vessel operator breaching the Special Restrictions above is liable to be guilty of an offence (Marine Safety Act 1998, s.12(5) – Maximum Penalty $1,100.00) 3) Vessels intending to accompany or follow the racing fleet are required to follow strict instructions from Roads and Maritime and Police control vessels and not impede the passage of ferries, ships or competing yachts. MARINE SAFETY ACT 1998 MARINE NOTICE Section 12(2) REGULATION OF VESSELS – EXCLUSION ZONE Location Lake Jindabyne, Jindabyne as follows: All navigable waters bounded and marked by buoys between: • The western shore of the ‘Cooper Tom Reach’ from the land based feature of Townsend Street, Jindabyne; • The south-eastern extent of Cub Island; • The eastern extent of Lion Island to the north-western extent of the Island; • The western extent of McEvoy Island to the south-eastern extent of the Island; • The shoreline adjacent to the land based feature of Old Kosciuszko Road, East Jindabyne; and • Back along the eastern shore of the ‘Cooper Tom Reach’ to a position opposite the land based feature of Townsend Street, Jindabyne. Duration 8.00am to 6.00pm – On each day from Tuesday 8 January 2019 to Saturday 12 January 2019. Detail Competitive ski racing will be conducted on the waters of Lake Jindabyne involving the use of high speed power vessels which will be active on the days during the above times. There will also be support vessels present to manage the event, persons in the water from time to time, and persons being towed at speed using tow-lines – presenting a significant potential hazard to other waterway users. An EXCLUSION ZONE is specified during the event and will be created at the location detailed above. Course rounding buoys will be placed. The exclusion zone will extend for 100 metres outside the buoys, and will be patrolled by official vessels • A ‘transit lane’ through the exclusion zone to the northern waters of Lake Jindabyne will be established, and marked by large yellow buoys, from the Widows Inlet public boat ramp along the western side of Lion Island and McEvoy Island. If using the transit lane, vessel operators should follow all directions from control vessels. • Access to the Cooper Tom Reach between the land based feature of Townsend Street, Jindabyne and the limit of available waters near the Dam Wall in the South will be from the adjoining shore only. All vessel operators and persons should keep well clear of competing and support vessels, and exercise extreme caution when near the exclusion zone. Fisheries Management Act 1994

1 Name of Order

This Order is the Fisheries Management (Special Approval for Modifications to Estuary Prawn Trawl Nets) Order 2018.

2 Commencement and Duration

(a) This Order commences on the date it is published in the NSW Government Gazette.

(b) This Order will remain in force until 1 October 2021.

Note: Notice of this Order will be given by publishing it in the NSW Government Gazette and on the Department of Primary Industries website.

3 Definitions

(a) In this Order:

the Act means the Fisheries Management Act 1994 (NSW).

diamond-shaped mesh net means mesh not less than 32 millimetres and constructed of single twine material not more than 2.5 millimetres in diameter and hung so that the meshes are diamond shaped.

the Regulation means Fisheries Management (Estuary Prawn Trawl Share Management Plan) Regulation 2006.

otter trawl net (prawns) has the meaning given by rule 17A of the Regulation.

square-shaped mesh net means mesh not less than 27 millimetres and constructed of single twine knotless polyamide or polyethylene material not more than 2.5 millimetres in diameter and hung on a bar so that the meshes are square shaped.

try net means net which is either a diamond-shaped mesh net or a square-shaped mesh net.

Note: fish, fishing activity, marine vegetation, possession, net and take have the same meaning as in the Act.

(b) Words and expressions that occur in this Order have the same meaning as they have in the Regulation, unless otherwise specified in this Order.

4 Special approval for taking or possessing fish by any method

(a) This order applies to any person who holds and is operating pursuant to a valid Estuary Prawn Trawl endorsement as prescribed in the Regulation.

(b) Estuary Prawn Trawl endorsement holders are authorised to use a try net attached to a frame not exceeding 0.6 metres in width and 0.5 metres in height, with a total length not exceeding 2 metres from the centre of the frame to the extremity of the net.

(c) Estuary Prawn Trawl endorsement holders are authorised to use an otter-trawl net (prawns) with one or more of the following modifications:

(i) Multiple nets - three (3) or four (4) nets (of any headline length) may be used at any one time provided that the total headline length of all of the otter trawl nets (prawns) combined does not exceed 15 metres; and/or

(ii) Spreading mechanism (beam) - in lieu of otter boards, a single beam between two sleds may be used to spread one or more nets, subject to the following:

A. The beam is a single and straight structure; and B. The sleds are no greater than 150 millimetres wide at the base (shoe); and C. The points of attachment of the headline and footrope to the sleds are no more than 1 metre apart,

and/or

(iii) Diamond-mesh size (body of net) - the body (including belly, wings and extension) of an otter-trawl net (prawns) may consist of mesh not less than 34 millimetres, subject to the following conditions:

A. Side taper - if the body of the net consists of less than 40 millimetres of diamond-shaped mesh net, the length of the body of the net (centre head rope to end taper) must not exceed 3.2 metres, 3 metres and 2.8 metres for double or dual, triple and quad net configurations, respectively, measured in a straight line along the centre line of each net from the headline to the attachment of the extension (where the body taper finishes); and

B. Wing depth – if the body of the net consists of less than 40 millimetres of diamond-shaped mesh net, the depth of the wings must not exceed 2.3 metres measure in a straight line from the inside edge of the top knot (along the top seam) to the inside edge of the bottom knot (at the bottom seam) along any single line/row of meshes when stretched, and/or

(iv) The wings and side panels of a net or parts thereof may consist of a mesh not less than 34 millimetres, subject to the mesh being hung on the bar so that the meshes are square-shaped.

(a) Estuary Prawn Trawl endorsement holders must abide by any instruction given by an Officer of the Department of Primary Industries relating to the operation of this order.

(b) Estuary Prawn Trawl endorsement holders must, in writing, advise the local District Fisheries Officer, in the area where fishing is to be undertaken, at least 24 hours prior to commencement of fishing if using try nets or otter-trawl net (prawn) modifications provided for by this Order.

(c) Estuary Prawn Trawl endorsement holders must maintain records of the modifications made to any try net or otter-trawl net (prawn) and produce such records to any Officer of the NSW Department of Primary Industries upon request.

(d) Estuary Prawn Trawl endorsement holders must accept and assist any observer/s as directed by any Officer of the NSW Department of Primary Industries.

(e) This Order does not permit the taking of fish or marine vegetation by a prohibited fishing method specified in relation to those waters in Schedule 3 to the Fisheries Management (General) Regulation 2010.

(f) This Order does not permit Estuary Prawn Trawl endorsement holders to take action that is likely to result in one or more of the following:

(i) Harm to a threatened species, population or ecological community; or (ii) Damage to critical habitat; or (iii) Damage to a habitat of a threatened species, population or ecological community.

(g) Other than where expressly stated, this Order does not authorise fishing activities in contravention of the Act or any Regulation under the Act.

(a) This Order may be varied, suspended or cancelled at any time by a duly delegated Officer of the NSW Department of Primary Industries.

(b) The issue of this order in no way implies or guarantees future rights in any fishery or continued use of the authorised methods and modifications beyond the date of expiry of this order.

If, during the course of construction or operations, the Applicant becomes aware of any Aboriginal heritage and/or archaeological relics not previously identified, the Applicant must ensure all work likely to affect the material ceases immediately and the relevant authorities consulted about an appropriate course of action prior to recommencement of work. The relevant authorities may include the OEH and the relevant local Aboriginal group(s). Any necessary permits or consents must be obtained and complied with prior to recommencement of work in the relevant area. 4. If, during the course of construction or operations, the Applicant becomes aware of any European heritage items or archaeological relics not previously identified, the Applicant must ensure all work likely to affect the material ceases immediately and the relevant organisations consulted about an appropriate course of action prior to recommencement of work. The relevant authorities may include the OEH and WLC. 5. If threatened species (listed under the Biodiversity Conservation Act 2016) are identified on the site during construction of the tourist park, the Applicant must immediately notify the OEH. The Applicant must cease any work which could adversely impact on the identified species, should an appropriately qualified and experienced ecologist (approved by the Director–General) in consultation with OEH deem it necessary. In the event that work ceases, work must not recommence until written advice has been received from the OEH. 6. The Applicant must provide adequate fire protection works on site in accordance with all relevant legislation and requirements from the Rural Fire Service. 7. The Applicant must ensure all dirty water, potentially contaminated surface water runoff and waste water is not discharged offsite of the licence area onto adjoining roads, Crown land (including WLLs) or other persons land, any river, creek or watercourse, groundwater aquifer, any area of native vegetation or any wetlands, unless otherwise authorised by a license under the Protection of the Environment Operations Act 1997. 8. If, in the opinion of any responsible officer of the DPI Water, any work is carried out in such a manner as it may damage or detrimentally affect a watercourse, or damage or interfere in any way with any work, the

Applicant must ensure that the operation on that section of the watercourse ceases immediately upon written or oral direction of such officer. Any necessary permits or consents, and/or actions, must be obtained and complied with prior to recommencement of work in the relevant area. 9. The Applicant must ensure all activities are undertaken in a manner which ensures efficient use of water and which maximises the reuse of water. 10. The Applicant must ensure buildings and structures are designed and constructed so as to present a neat and orderly appearance and to blend as far as practicable with the surrounding landscape. 11. The Applicant must ensure buildings and structures are constructed in accordance with all relevant legislative requirements. 12. The Applicant must ensure that onsite lighting is designed and operated to minimise any offsite impacts. 13. The Applicant must ensure arrangements for the disposal of all solid wastes, domestic waste and putrescible matter are in accordance with the Protection of the Environment Operations Act 1997 and the ‘Environmental Guidelines: Assessment, Classification and Management of Liquid and Non-liquid Wastes’ from the Department of Environment and Conservation (1999) or its latest version. 14. Prior to commencement of construction works, the Applicant must arrange with the RMS the installation of “Turning Traffic” signs (W5-25) with distance plates on the Barrier Highway at each approach to the site access. The signs are to be positioned within 240-260 metres either side of the access from the Barrier Highway 15. The Applicant must ensure Safe Intersection Sight Distance (SISD) requirements (as outlined in Part 4A of the Austroads Guide to Road Design and relevant RMS supplements) are provided in both directions at the vehicular access to the site from the Barrier Highway. For a 100km/h speed zone, the minimum SISD is 250 metres. 16. The Applicant must ensure that all statutory requirements including, but not restricted to those set down by the, Local Government Act 1993, National Parks and Wildlife Act 1974, Native Vegetation Act 2003, Protection of the Environment Administration Act 1991, Protection of the Environment Operations Act 1997 (including any Environmental Protection Licences), Rural Fires Act 1997, Threatened Species Conservation Act 1995, Water Act 1912 and Water Management Act 2000, and Work Health and Safety Act 2013, and all other relevant legislation, Regulations, Australian Standards, Codes, Guidelines and Notices, Conditions, Directions, Notices and Requirements issued pursuant to statutory powers by the EPA, DPI Water, OEH, RMS and WLC are fully met. LAND TAX MANAGEMENT ACT 1956 Land Tax (including Surcharge Land Tax) Returns for 2019 Tax Year 1. This Order is made under section 12(1) of the Land Tax Management Act 1956 (the Act) and section 37 of the Taxation Administration Act 1996 (TAA). The purpose of this Order is to inform persons who own land in New South Wales if and when they are required to lodge an initial return or a variation return for the 2019 land tax year, and any subsequent tax year. 2. A “person” includes a company, a trustee, a beneficiary of a trust and a natural person. 3. Under section 12(2) of the Act, the Chief Commissioner of State Revenue (the Chief Commissioner) may require any person to lodge a return or further return, in circumstances other than those described in this Notice.

4. A requirement to lodge a return specified in this notice does not affect a requirement to lodge a return by an earlier date specified by the Chief Commissioner under section 12(2) of the Act or an earlier date specified in any previous Order made under section12(1). Persons Who Must Lodge an Initial Return 5. The requirement to lodge an initial land tax return applies to “persons” who are “owners” of land in New South Wales at midnight on 31 December of 2018 or any subsequent land tax year. The reference to an “owner” includes a reference to a person who is an owner of land or is deemed to be an owner for land tax purposes by the Act. 6. Persons who own land in New South Wales at midnight on 31 December of 2018 and any subsequent land tax year must lodge an initial return unless they were assessed and received a land tax notice of assessment for the previous land tax year. 7. Persons who are foreign persons for the purposes of surcharge land tax and who own residential land in New South Wales at midnight on 31 December 2018 and any subsequent land tax year must lodge an initial return unless they were assessed and received a land tax notice of assessment for surcharge land tax for the previous land tax year. 8. Persons who received a land tax notice of assessment for any land tax year showing NIL land tax payable, and subsequently acquire an additional ownership interest in land, must lodge an initial return. 9. Persons who are liable to be assessed for land tax for any tax year and have not previously lodged a return for that tax year, or have lodged a return but have not received a land tax notice of assessment by 31 December of that tax year, must lodge an initial return for the following tax year. 10. Persons who own land that was exempt from land tax in any tax year but the land ceases to be exempt for a subsequent land tax year, must lodge an initial return. 11. Where land is subject to a trust, and the trustee has not previously lodged a land tax return, the trustee must lodge an initial return on behalf of the trust. (Note that if the trustee fails to lodge a return, or fails to provide the information specified on the form about the beneficiaries of the trust, the trust may be assessed as a special trust). 12. Examples of when an owner must lodge an initial return for a particular tax year include: (a) A residence that is not the owner’s exempt principal place of residence was purchased prior to the taxing date for the relevant tax year; (b) The owner of land is liable for land tax for the previous tax year but did not receive an assessment by 31 December of that year; (c) a foreign person has not previously advised their residency status; (d) an assessment notice showing zero tax was received for a particular land tax year and new land or an additional ownership interest in land has subsequently been acquired; (e) land that was previously the owner’s exempt principal place of residence is subsequently left vacant or rented to tenants; (f) land is subject to a trust and the trustee has not previously lodged a land tax return on behalf of the trust. 13. A Land Tax Registration Form is an initial return for the purposes of section 12. Due Date for Lodgement of Initial Returns 14. Any person who is required by this Order to lodge an initial return must do so by 31 March during the relevant tax year. 15. Penalty tax and interest may be imposed under the Act and the TAA for failing to lodge an initial return by the due date. Late lodgement interest applies from 1 April of the relevant tax year until the date of lodgement of the return. Persons Who Must Lodge a Variation Return 16. A variation return is required to be lodged by a person who receives an incorrect notice of assessment of land tax. Errors that require a variation return to be lodged include errors in the description of the land and errors in the details about the owners of the land.

17. Examples of errors on a notice of assessment that require lodgement of a variation return include: (a) the assessment notice is missing land or contains land that is not owned by the person at the taxing date; (b) the percentage interest in land is incorrect for land that is jointly owned; (c) an error occurred in the calculation of the average value of a parcel of land; (d) a foreign person has not been assessed for surcharge land tax on residential land; (e) a foreign person has changed the use of the land from non-residential to residential or residential to non-residential purposes; (f) beneficiaries of a trust which owns residential land have not been correctly classified as foreign persons; (g) land shown in an assessment for a natural person, is actually owned by the person in the capacity of trustee; (h) an exemption is incorrectly applied to land that is not exempt; (i) an exemption was granted subject to conditions which were not fulfilled; (j) the calculation of tax is incorrect (being either too high or too low); (k) a trustee of a trust has an interest in land that is not included in the notice of assessment; (l) a special trust is incorrectly assessed as a fixed trust or fixed trust is incorrectly assessed as a special trust; (m) the beneficiaries of a family unit trust have changed since 31 December 2005; (n) additional land was acquired by a family unit trust, and the total liable land owned by the trust has a taxable value of more than $1 million for the tax year during which the land was acquired; (o) a group constituted under section 29 of the Act does not have a member classified as a concessional company or has more than one member classified and separately assessed as a concessional company (note: two or more companies can be correctly classified as joint concessional companies and jointly assessed). Due Date for Lodgement of Variation Returns 18. A variation return is required to be lodged by the first instalment date shown on the notice of assessment. If the notice of assessment shows that no tax is payable, the due date for lodgement of a variation return is 40 days after the “Issue Date” shown on the notice. 19. Penalty tax and interest may be imposed under the Act and the TAA for failing to lodge a variation return by the due date. How to Lodge a Return 20.
