CHAPTER 1

EXECUTIVE SUMMARY

1.1 Project and public purpose

The proposed project area is intended for the doubling of railway line from Trivandrum to Nemom. The urgent need for this project arises from the increased congestion inside trains and loss in transit time due to crossing from a train travelling in opposite direction. The presence of a double track is a prerequisite for introducing block signalling that can considerable speed up trains and reduce transit time. The existing track capacity utilization of this line is over 100 percent and the every existing single line is saturated, leading to congestion and slow movements of trains. The successful implementation of this project will ensure smooth movements of trains without many disruptions. In addition to that, the better operational efficiency of railway system will reduce the journey time and hence this will be an advantage for every passenger.

1.2 Location

The proposed project is intended to for the doubling of Railway line from Thiruvananthapuram to Nemom. The 14.8067 Hectares of land that is considered to be acquired for this project belongs to four villages in Thiruvananthapuram district, namely Thycaud, Thirumala, Nemom and Pallichal.

1.3. Size and attributes of land acquisition

An extent of 14.8067 Hectares of land collectively from the villages of Thycaud, Thirumala, Nemom and Pallichal is required for the implementation the project. The land identified for the project for doubling of Railway line from Thiruvananthapuram to Nemom is spread over 759 survey numbers.

1.4 Alternatives considered

The proposed project aims at the doubling of Railway line from Thiruvananthapuram to Nemom and construction of terminal. Since the project is for doubling of railway line, only lands adjacent to the existing line can be acquired. Hence, no alternative land has been considered for the proposed project.

1.5 Social impacts

Land under 759 survey number spread over 14.8067 hectares of land from Thycaud, Thirumala, Nemom and Pallichal villages need to be acquired for the project. The major social impact will be the displacement of families residing in the area. In addition to that some commercial institutions, government organisations etc. are also present. Loss of land for these organisations and institutions can be considered as a negative impact as the people who are employed in the institutions, which will be lost completely, will face a loss in livelihood. The proposed area includes land owned by the CSIR-NIIST, SBI, SIDCO, Government Women & Children’s Hospital, Thycaud.

1.6 Mitigation measures

To mitigate the social impact of the proposed land acquisition, R&R package should be provided to the families as per the Policies issued by Revenue(B) Department, Government of vide G.O.(MS)No.485/2015/RD dated 23/09/2015 and G.O.(Ms)No.448/2017/RD dated 29/12/2017 for the rehabilitation and resettlement package for land acquisition in the state in lieu of RFCT in LAR&R Act 2013.

 The authorities should take necessary actions to ensure that the existing water bodies such as canals, streams etc. in the vicinity of the project area will not be affected during and after each stage of the implementation of the project.  Reconstruction of livelihood of people is an important factor in this project. It is a very difficult task to the people to recreate their commercial enterprises in a new area. So, the assistance should be provided to them in order to successfully recreate their livelihood.  The families who are losing the courtyard of their house demanded the reconstruction of proper boundary wall.  Safety of the people during the construction phase of the project and healthy disposal of wastages which may arise out of construction should be ensured.

 Retaining the natural drainage system is very important as majority of the land near the project area will face severe water logging problems during rainy seasons.  Maintaining roads, pathways, bridges present on the proposed land should be given priorities as the people residing on the boundary of the proposed land will face difficulties for free passage.

CHAPTER 2

DETAILED PROJECT DESCRIPTION

2.1 Background of the Project including Developer’s Background and Governance/Management structure

This project is for the doubling of Railway line from Thiruvananthapuram to Nemom in Thiruvananthapuram district and Construction of Terminal. The project intends to improve the commute between the two sates through developing a well structured railway network. The project requires a total area of 14.8067 hectares of land spread over Pallichal, Nemom, Thycaud and Thirumala Villages of Thiruvananthapuram District. The District Collector Thiruvananthapuram as per letter no. K 13-183091/19 dated 24/04/2019 invited proposals to conduct Social Impact Assessment prior to the Land Acquisition for the project. The Centre for Management was entrusted with the work by the Government of Kerala vide GO(P)No.44/2019/RD dated 30/07/2019 (Kerala Gazette No. 1766 – Vol. 8 dated 05/08/2019) to conduct the Social Impact Assessment.

2.2 Rationale for Project, including how the project fits the public purpose criteria listed in the Act.

As per the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 Section 2(vi), the project can be considered as a public purpose.

2.3 Details of Project size, location, capacity outputs, production targets, costs and risks

The affected area belongs to four different villages in Thiruvananthapuram district namely, Thycaud, Thirumala, Nemom and Pallichal villages. The project completion requires 14.8067 Hectares of land from various survey numbers to be acquired. This project aims for the doubling of Railway line from Thiruvananthapuram to Nemom and Constructon of Terminal. By implementing this project, the operational efficiency of Railway transport systems will be improved to a great extent.

2.4 Examination of alternatives

The proposed project aims at the doubling of Railway line from Thiruvananthapuram to Nemom and construction of terminal. Since the project is for doubling of railway line, only lands adjacent to the existing line can be acquired. Hence, no alternative land has been considered for the proposed project.

2.5 Phases of the Project Construction

In accordance with the proposed project, the railway line passing through the four villages will be doubled along with the construction of the Nemom Terminal.

2.6 Core design Features, size and Type of Facilities

The proposed project aims at the doubling of Railway line from Thiruvananthapuram to Nemom and construction of terminal.

2.7 Need for Ancillary Infrastructural Facilities

In addition to the doubling of railway line and construction of the terminal, there is a need for the widening and or reconstruction of various bridges present in the route. With the development of the terminal road facilities also need to be developed for the well connectivity of the terminal and the national highway which runs within 1 km from the proposed site for the terminal.

2.8 Workforce Requirements (temporary and permanent)

The work force for the project is not yet assessed. Both temporary and permanent workforce need be employed with modern machineries and equipment at appropriate stages of the project implementation.

2.9 Details of Social Impact Assessment/Environment Impact Assessment if Already Conducted and any Technical Facility Reports

No Social Impact Assessment/Environment Impact Assessment has been conducted previously in association with the proposed project.

2.10 Applicable legislations and policies

The land acquisition for the proposed project is governed by the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act 2013.

CHAPTER 3

TEAM COMPOSITION, APPROACH, METHODOLOGY AND SCHEDULE OF THE SOCIAL IMPACT ASSESSMENT

Background As part of the decision to improve the infrastructure of railway transit systems in Thiruvananthapuram by doubling of railway line from Thiruvananthapuram to Nemom and Construction of Terminal, Government of Kerala (GoK) had accorded administrative sanction vide to acquire a total area of 14.8067 Hectares of land spread over Thycaud, Thirumala, Nemom and Pallichal villages of Thiruvananthapuram district. The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (RFCTLARR) Act 2013, enacted by the Government of , has mandated the conduct of Social Impact Assessment study prior to the land acquisition. Government of Kerala had accorded administration sanction vide GO(P)No.44/2019/RD dated 30/07/2019 (Kerala Gazette No. 1766 – Vol. 8 dated 05/08/2019) to Centre for Management Development, Thiruvananthapuram to conduct SIA in this regard and to prepare a Social Impact Management Plan for the same.

3.1 List of all Team Members with Qualifications

The details of the team members involved in the SIA are given in Annexure III.

3.2 Description and Rationale for the Methodology and Tools Used to collect Information for the Social Impact Assessment

An inclusive and participatory approach through involvement of multiple stakeholders such as elected representatives and project affected people including vulnerable sections such as Scheduled Castes, Scheduled Tribes, women, and those among below poverty line, at appropriate stages of the project.

3.3 Sampling Methodology Used

Qualitative information was gathered along with the field survey through public consultation/Focus Group Discussions (FGDs) with all relevant stakeholders. The public consultation encompassed the project components as well as its socio-

economic impacts. The SIA team had preliminary discussions with the key officials of the district administration and gathered information regarding the status of the government procedures, the project area and intensity of the acquisition. The team also made a preliminary site visit with the officials for physical inspection and information dissemination purposes. The existing conditions of land, status of infrastructure/structures, land use pattern and the facilities available to people residing in the project area were analysed.

The quantitative information regarding the families affected by the project was collected through household surveys, in the form of structured questionnaires. The survey was conducted in all the households of the persons affected by the project. The results of the survey provided information pertaining to the demography, socio-economic status and livelihood status of the target community, and formed the basis for development of Social Impact Management Plan.

3.4 Overview of Information/Data Sources Used

The primary data was collected directly from the representatives all affected families through face to face interview. Structured questionnaires were used for collecting the details of the affected people. The results of the survey provided information pertaining to the demography, socio-economic status and livelihood status of the target community.

The secondary data was collected from the Requiring Body and the Revenue department. The SIA team had preliminary discussions with the key officials of the district administration and gathered information regarding the status of the government procedures, the project area and intensity of the acquisition.

3.6 Public Hearing

In accordance with the Section 5 of Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, a Public Hearing will be conducted to collect the views and opinions of the people affected by the project. Prior intimation will be given to all the stakeholders regarding the date and venue of the public hearing through advertisements in leading newspapers, individual letters and/or over telephone.

CHAPTER 4

LAND ASSESSMENT

4.1 Description of Land with the help of Maps, Information from Land Inventories and Primary Sources

The land to be acquired for the project is spread over Pallichal, Nemom, Thycaud and Thirumala Villages of Thiruvananthapuram District. The sketch of the land for the proposed project is shown in annexure no. VI

4.2 Entire area of impact under the influence of the project

A total extend of 14.8067 hectares of land spread over Pallichal, Nemon, Thycaud and Thirumala Villages needs to be acquired for the project.

4.3 Total Land Requirement for the Project

For the implementation of the proposed project an extend of 1.5792 Hectares of land from Thycaud Village, 1.7584 Hectares of land from Thirumala Village, 4.5773 Hectares of land from Nemom Village and 6.8918 Hectares of land from Pallichal Village is required.

4.4 Present Use of any Public, Utilized land in the Vicinity of the Project Area

The proposed area includes land owned by the CSIR-NIIST, SBI, SIDCO, Government Women & Children’s Hospital, Thycaud.

4.5 Land (if any) Already Purchased, Alienated, Leased or Acquired, and the intended Use for Each Plot of Land required for the project

No land has been already acquired for the proposed project.

4.6 Quantity and Location of Land Proposed to be Acquired for the Project

A total extend of 14.8067 hectares of land spread over Pallichal, Nemom, Thycaud and Thirumala Villages needs to be acquired for the project.

4.7 Nature, Present use and classification of Land and if Agricultural Land, Irrigation Coverage and Cropping Patterns

The land identified for the project include nilam, purayidom, purambokke.

4.8 Size of Holding, Ownership Pattern, Land Distributions and Number of Residential Houses

The details of the affected families is given in annexure no. VII

4.9 Land prices and recent changes in ownership, transfer and use of lands over the last 3 years

As per the information received from the respondents, no land transactions were done in the proposed area for the last 3 years.

CHAPTER 5

ESTIMATION AND ENUMERATION OF AFFECTED FAMILIES AND ASSETS

5.1 Estimation of families

The details of families which lose their land and or place of stay is given in annexure no. VII. In addition to that, the individuals who are running shops in the project area will lose their business which will then affect them with loss of income. The people who are working in these shops will also get affected by losing their livelihood.

5.2 Family of Scheduled Tribes and other Traditional Forest Dwellers who have lost any of their Forest Rights

5.3 Families which depend on Common Property Resources which will be Affected due to Land Acquisition for their Livelihood

5.4 Families which have been assigned Land by the State Government for the Central Government Under any of its Schemes and such Land is Under Acquisition

Some of the residents in the proposed area depend on their neighbourhood for livelihood. Petty shops, coolie workers, tailors etc. are identified who earn money

from their respective fields by depending on the business from the locale, which is non-consistent in nature.

5.6.1 Families which are indirectly impacted by the project (not affected directly by the acquisition of own lands)

During the implementation stage of the project, the families and shops close to the project area are prone to be affected with different types of pollutions. Most of the residents who resides near to the boundary of the proposed sketch expressed their concerns over the pathways that will get acquired as part of the land acquisition of the project. They also raised concerns for the natural drainage system.

5.6.2 Inventory of productive assets and significant lands

Any type of agriculture or cultivations are almost absent in the project area.

6.2 Land Use and Livelihood

Agriculture or cultivation of any kind is almost absent in the project are, hence there is no impact on agricultural resources. However, the loss of commercial buildings will affect both the owners of the property, the people who run business here and the people who employed here.

6.3 Local Economic Activities

The area is mainly used for residential purposes. In addition to that a very few commercial structures are also present in the land. So, the loss of commercial buildings will affect both the owners of the property, the people who run business here and the people who employed here.

6.4 Factors that Contribute to Local Livelihood

The buildings that used for the commercial activities was a major source of income especially for the people who run business and their employees. So, the loss of these structures by the acquisition will make a negative impact to this local livelihood.

6.5 Kinship Patterns and Social and Cultural Organization

Majority of the properties are hereditary property and very less are purchased properties. Most of the families follow nuclear family system. However there are considerable numbers of joint families living in the area.

6.6 Administrative Organization

The proposed area includes land owned by the CSIR-NIIST, SBI, SIDCO, Government Women & Children’s Hospital, Thycaud.

6.7 Political Organization

Properties of any political organizations are not included in the area of the proposed acquisition.

6.8 Community Based Civil Society Organization

No such organizations are affected by the proposed the project.

6.9 Regional Dynamics & Historical Change Process

No major negative impact could be found regarding the regional dynamics and historical change processes.

6.10 Quality of the Living Environment

The Quality of the Living Environment is fair in the project area with decent livelihood options and transportation facilities with access to amenities such as Schools, Hospitals, Civil Organisations, etc.

CHAPTER 7

SOCIAL IMPACT MANAGEMENT

7.1 Approach to Mitigation

The CMD team made use of a combination of two research approaches i.e., quantitative and qualitative, for the identification of various social impact and the mitigation measures. Adoption of a combination of both qualitative and quantitative methodology was indented to obtain a more comprehensive data and more holistic result without excluding any important area of assessment.

7.2 Measures to avoid, mitigate and compensate impact

The proposed project will need an area of 14.8067 hectares of land from Thycaud, Thirumala, Nemom and Pallichal Villages. The land is mainly used for residential purposes. Mitigation measures can be framed as per the details given below:

7.4 Measures that the Requiring Body has stated it will introduce in the project proposal

The requiring body has stated that sufficient fund has been reserved as compensation.

7.5 Alterations to project design and additional measures that may be required to address the extend and intensity of impacts across various groups as identified during SIA

The alignment for the proposed project was prepared by minimising the negative impacts. No alterations to the project design is suggested.

SOCIAL IMPACT MANAGEMENT PLAN INSTITUTIONAL FRAMEWORK

8.1 Description of institutional structures and key person responsible for each mitigation measures

The Government of Kerala had appointed Special Tehsildar LA Railway to perform one or more functions of the collector under in the Right to Fair Compensation and Transparency in Land Acquisition, Resettlement and Rehabilitation Act (RFCTLARR), 2013 within their area of jurisdiction.

Also vide G. O. (P) M. No. 590/2015/RD dated 11 November 2015, Government of Kerala, in line with the sub-section (1) of section 43 of the Right to Fair Compensation and Transparency in Land Acquisition, Resettlement and Rehabilitation Act (RFCTLARR) 2013 and sub-rule (1) of rule 21 of Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Kerala) Rules, 2015, the Deputy Collector (Land Acquisition) in each district has been appointed as the Administrator for Rehabilitation and Resettlement, for performing the functions under the said act and Rules in respect of involuntary displacement of persons due to requisition of land. The Administrator shall be responsible for the formulation, execution and monitoring of the Rehabilitation and Resettlement scheme in respect of land acquisition.

Vide G. O. (P) M. No. 589/2015/RD dated 11 November 2015, in exercise of the powers conferred by sub-section (1) of section 44 of the Right to Fair Compensation and Transparency in Land Acquisition, Resettlement and Rehabilitation Act (RFCTLARR), 2013, the commissioner for Rehabilitation and Resettlement supervising the formulation of Rehabilitation and Resettlement scheme or plans, proper implementation of the same and post implementation of social audit.

CHAPTER 10

SOCIAL IMPACT MANAGEMENT PLAN MONITORING AND EVALUATION

10.1 Key monitoring and evaluative indicators

Monitoring is a long-term process, which should begin from the starting of the project and should continue throughout the life of the project. Its purpose is to establish benchmarks so that the nature and magnitude of anticipated social impacts can be continually assessed. Monitoring involves the continuous or periodic review to determine the effectiveness of recommended mitigation measures. The types of parameters that can be monitored may include mitigation measures or design features, or actual impacts. All the mitigation measures stated in Chapter 7 should be considered as the indicators for evaluation.

10.2 Reporting mechanisms and monitoring roles

Rehabilitation and Resettlement procedures as stated in the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement act, 2013 will be applicable.

CHAPTER 11

ANALYSIS OF COSTS AND BENEFITS AND RECOMMENDATION ON ACQUISITION

11.1 Final conclusions on: Assessment of public purpose, less displacing alternatives, minimum requirements of land, the nature and intensity of social impacts, and viable mitigation measures and the extent to which mitigation measures will address will address costs

The proposed project aims at the doubling of Railway line from Thiruvananthapuram to Nemom and construction of terminal. The better facilities of rail transportation system will facilitate the easy commute of passengers as well as goods. Land spread over 759 survey numbers have to be acquired for the project.

The impacts shall be mitigated by providing suitable Resettlement/ Rehabilitation/Compensation measures as per RFCTLAR&R Act2013.

The alignment of the proposed project was designed with an effort to reduce the number of people who will be affected with the land acquisition. Through the proper measures as per RFCTLAR&R Act 2013 the negative impacts of land acquisition can be mitigated.

11.2 The above analysis will use the equity principle as a framework of analysis for presenting a final recommendation on whether the acquisition should go through or not.

Comparing/weighing the positive against the negative impacts, it can be observed that even though the recreation of livelihood and rehabilitation to those families who lose their place of stay need to be provided with proper mitigation measures, the implementation of the project will improve the rail infrastructure of the state.

The families that are affected would require adequate and fair compensation. So, the authorities should make proper action plan to reconstruct the livelihood opportunities for the people who solely relied on the project area for income. It is observed that many of the negative impacts highlighted can be minimized or reduced with effective and relevant mitigation measures and strategies mentioned.
