CONCERNING THE SUPREME FEDERAL COURT Amended by Federal Law no . 11/1977 dated 05/12/1977 , and Federal Law no . 18/1980 dated 20/12/1980 , and Federal Law no . 14/1985 dated 15/12/1985 , and Federal Law no . 26/1992 dated 25/03/1992 We , Zayed Bin Sultan Al Nahyan , President of the United Arab Emirates , Pursuant to the perusal of the provisional 2 Constitution ; and Acting upon the proposal of the Ministry of Justice and the approval of the Cabinet and the Federal National Council and the ratification of the Federal Supreme Council , Have promulgated the following Law : TITLE ONE REGULATION AND CONSTITUTION OF THE COURT Article 1 - It is established in the United Arab Emirates a Supreme Court denominated the federal Supreme Court , mentioned in this Law as the Supreme Court . This Court shall be the Supreme Judicial body in the federation . Article 2 - The Supreme Court shall have its seat in the capital of the federation . It may hold its hearings when deemed necessary in any of the capitals of the Emirates , members of the Federation . Article 3 - As amended by Federal Law no . 14 of December 15,1985 : The Supreme Court is constituted of a President ( Chief Justice ) and four judges . A sufficient number of alternate judges may be appointed in court provided that not more than one of them is seated in the circuit of constitutional matters . Excepting the specific provisions for alternate judges stipulated in this Law , they shall be subject to the same rules as those of the Supreme Court judges . -

Richard Marin 1995, BRAZIL’S ZUMBI YEAR: REFLECTIONS ON A TRICENTENNIAL COMMEMORATION In 1995, the Brazilian commemorations in honor of the tricentennial of the death of Zumbi, the legendary leader of the large maroon community of Palmares, took on every appearance of a genuine social phenomenon. The Black Movement and part of Brazilian civil society, but also the public authorities, each in different ways, were all committed to marking the event with exceptional grandeur. This article advances a perspective on this commemorative year as an important step in promoting the "Black question" along with Afro-Brazilian identity. After describing the 1995 commemorations, we aim to show how they represented the culmination of already-existing movements that had been at work in the depths of Brazilian society. We will finish by considering the period following the events of 1995, during which "the Black question" becomes truly central to debates in Brazilians society. -

A proposta prosperou pela importância da preservação da memória de vida dos membros do Poder Judiciário do Estado do Rio de Janeiro; da criação de novas fontes para recuperação da história do poder Judiciário do estado do Rio de Janeiro; e, pela possibilidade de integração do Museu da Justiça a outros órgãos de pesquisa com projetos semelhantes. Government Appointment Discretion and Judicial Independence: preference and opportunistic effects on Brazilian Courts* Felipe Lopes Paulo Furquim de Azevedo Insper Working Paper WPE: 371/2017 Government Appointment Discretion and Judicial Independence: preference and opportunistic effects on Brazilian Courts* Felipe Lopes Sao Paulo School of Economics – FGV Paulo Furquim de Azevedo† Insper Institute, and CNPq Abstract The prolific literature on de facto judicial independence misses a key variable: the government’s discretion over the appointment of Supreme Court Justices. In this paper we explore a distinct feature of the Brazilian judiciary system to assess political influence due to government appointment discretion. As there are two courts, the STF (Supreme Federal Court) and the STJ (Superior Court of Justice), which deal with similar matters and have different restrictions on the appointment of their members, it is possible to compare the degree of political influence to which they are subject. We test (1) whether there are differences in the degree of political influence depending on the president’s discretion over the nomination of a justice, and (2) whether the justices actively benefit the party of the president who has appointed them. We find evidence of the former, but not of the latter effect. Studies 9(3) (2020), DOI: 10.2478/bjals-2020-0014 Freedom of Religion in the Brazilian Supreme Court in a Period of Three Decades Fernanda Duarte* Rafael Mario Iorio Filho** ABSTRACT Judicial institutions which provide legal mechanisms for conflict resolution play an important role in maintaining the social order of complex societies. Weaknesses in the performance of their duties can contribute to social conflict developing into outright violence that will be beyond the management of law and the courts. In this sense it is strategic to study the judicial system and the decision-making processes of its judges if one wants to understand the ways conflicts are dealt in a certain place and time. In this article we focus our attention on the role of the Brazilian Federal Supreme Court as custodian of the Constitution and the discourses that its decision-making construct when dealing with human rights issues. Specifically we set out to understand how the opinions of Brazilian Supreme Court Justices are constructed when deciding cases concerning freedom of religion. The timeline considered covers 31 years, from 1988 to 2019, a period that begins with the promulgation of the new constitution in 1988 (which symbolically reinstated democracy in the country after the end of the period of military rule that began in 1964) up to the present day. We begin by presenting the legal definition of freedom of religion in Brazil which constitutes the normative background of the discussion. We then discuss our project, stressing the methodological approach we have adopted and finally we present our data findings. -

Time and Cost in Brazilian Federal Courts Tax foreclosure judicial proceedings Alexandre dos Santos Cunha Bernardo de Abreu Medeiros Elisa Sardão Colares Isabela do Valle Klin Luseni Cordeiro de Aquino Olívia Alves Gomes Pessoa Paulo Eduardo Alves da Silva Abstract This essay presents and analyses data gathered by an empirical research about tax foreclosure proceedings in Brazilian federal courts. Specifically, it focuses on issues faced by the administrative and judicial systems to collect unpaid taxes in Brazil, as well as on research conducted to describe those issues, including its goals, methodology and main results. Data- based analysis points to three possible weaknesses in the system: the large number of lawsuits aimed at collecting unpaid taxes, which has become a barrier to general access to justice in Brazil; the Executive branch’s bureaucracy that triggers most of those lawsuits and inherent delays; and the very judicial and procedural rules that work as a ritual yielding no other outcomes part from their own existence. The official purpose of that research was to calculate the cost of a specific type of lawsuit (the tax foreclosure proceeding) to the Judiciary system in terms of human, material and technological resources. -

A DIALÉTICA DA HEROIFICAÇÃO Sobre como um ministro e uma revista se convertem em heróis nacionais ROBERTO EFREM FILHO1 Resumo: Que processos políticos conduzem um membro da cúpula do Judiciário a ser proclamado como herói por um agente dominante do campo midiático? Como o direito e – consequentemente? – ministros caminham para o centro dos debates políticos nacionais? O que leva a revista semanal brasileira de maior circulação a disputar decisões judiciais? Este trabalho pretende discutir questões que dizem respeito à organização histórica de uma cumplicidade estrutural entre os meios de comunicação e o Judiciário, ou, noutros termos, entre o campo midiático e o campo jurídico. São aqui debatidas as posições de seus agentes, as presenças de suas imagens em ambos os campos, as correlações de forças internas e externas. Finalmente, busca- se traçar seus mecanismos mútuos de legitimação e suas hegemonias homólogas. Palavras – chave: mídia; direito; política. Abstract: What political processes could lead a member of the judicial cupola to be proclaimed as a hero by a dominant agent of the midiatic field? How have the Judiciary and the ministers been walking to the center of the national political debates? This text aimes to discuss questions about the historical organization of a structural complicity between the media and the Judiciary, or, in other words, between the midiatic field and the juridic field. The agents's roles, the presences of their images in both fields, the internal and external correlations of forces, all these kinds of problems have been studied. -
The Social Function of Property in Brazilian Law
THE SOCIAL FUNCTION OF PROPERTY IN BRAZILIAN LAW Alexandre dos Santos Cunha* INTRODUCTION The idea that rights serve a social function was first introduced into Brazilian legal culture about a century ago. Although the concept is historically linked to the French scholar Léon Duguit, the Brazilian version is distinct and does not share these French origins. Twentieth-century Italian jurists Pietro Cogliolo and Enrico Cimbali, who both exerted overwhelming influence over the so-called “Renovators” of Brazilian Private Law, are primarily responsible for Brazil’s version.1 Unlike Duguit, Cogliolo and Cimbali construed the concept of a social function as a justification for imposing only external limits on the exercise of rights.2 Consequently, Brazilian courts have never considered Duguit’s understanding of the social function of property as a source of internal limitations. The concept of the social function of rights first appeared in the Brazilian Constitution in 1934, and has become considerably stronger since the country adopted a new Civil Code in 2002. This Essay focuses on the 2002 Code’s impact on the way jurists and courts understand the concept, especially with respect to the social function of property. This Essay is divided into four parts.
