While cycling near Lowick, just before 3pm, he saw one soldier lying on his back and the other two, under the influence. He reported them to the police station. Mr HENDERSON acting for the defence said both licence holders were of good character: it was an error of judgement.

Mr SMIRK appeared on behalf no.771 Newcastle upon of the Territorial Forces Association, Tyne Accused had been drawing the allowance on account of her son, Private T DUNN, of the 2/7th Northumberland Fusiliers, which was made out in the name of his wife, although the papers had been sent to the mother’s address. Defendant went to the Post Office at Wooler to draw the money, signing as Bella DUNN from 20th Feb to Aug 1916, she claimed about £25. She said that she had not received any of the money but Miss CURRY, Post Office assistant, confirmed that the accused had drawn the money. It came to light when the soldier’s wife applied for the papers to be transferred to Newcastle. Accused said that she had 35s and would pay it all back as soon as she could. Berwick Advertiser 10th March, page 6, col 7. The fraudulent sum given as £1 15s and date of offence as 7 Aug 1915. Thomas DUNN, recorded as being a private in the 2-6th Northumberland Fusiliers, stated that he and his wife had not been living together although they had not quarrelled and under his directions the papers were sent to his mother’s address. The Post Office assistant’s full name was Arabella CURRY. Isabella DUNN stated that she had not received any of the allowance. The prisoner felt her position very keenly, having always been a respectable hardworking woman.

Sergeant SPRATT visited DUNCAN’S house in his capacity as Inspector under the Food and Drugs Act and asked for a small whisky and for a pint of whisky for the purpose of analysis. Mr DUNCAN offered him a bottle already filled, which he refused. He needed the sample from the same cask from which he had been supplied on entering. DUNCAN took a bottle (produced) and filled it at the cask. Quantity was deficient as the capacity of the bottle being only 13¾ instead of 20 oz. The price paid, 2s 5d, was not exorbitant: the question was one of measure only. The deficiency might cause difficulty and error in the analysis. DUNCAN said he had never been asked for a pint of whisky in this part of the country: he pleaded ignorance as to the cause of any technical offence. The Bench took into consideration that it was a first offence.

MOODY and their parents, PS 9/6 page23/ case no.786 and 787] Neither child had obtained a school proficiency certificate. LOUGH visited Wooler Council School and found the children absent and that they were employed at Turvelaws gathering potatoes. Both children had been absent 27 times. Mr HD IRWIN, who appeared on behalf of the Education Authority, said that they were prepared to receive applications to employ children under certain local conditions and had sent CABRY an application form, which he had ignored. LOUGH said that on being spoken to, CABRY admitted employing the children, but pleaded in extenuation that the potatoes had remained in the ground all winter and unless they were removed it would be impossible to get the land sown with a crop that year. CABRY asked when the final notice had been served on the parents: the date was 26th April. LOUGH said that the notice was served so late, as he had not expected CABRY to refuse to comply with the regulations when written to by Head Office. The children said they were employed by Mr WOOD, the steward at Turvelaws. CABRY had seen them working. CABRY said that the children had not been employed for one hour after the notice had been received by the parents and that he had applied to the Education Authority, in the autumn, for leave to employ school children and been flatly refused. CONTINUED CONTINUED causing him a loss of £600 to £700. In the spring he had advertised for workers and had been unable to get any. He had instructed his steward to get people whenever he could but the children had been engaged without his knowledge and he believed he was not legally responsible for their employment. CABRY going into the witness box, said that he regarded the letter from the Education Committee dated 17th Nov 1915, which put a lot of questions to him which he could not and would not answer, as a direct refusal of permission to employ the children. The letter stated that he was expected to take advantage of the closing of the school due to a measles epidemic, without regard as to whether the time was suitable for the work. Only some children were suitable for farm work: Thomas HALL had been working alongside his mother and had earned the same wages. IRWIN said that the letter was not a refusal and permission would probably have been granted if CABRY had fulfilled the conditions under which the applications were to be made. CABRY paid for the fines of the parents and gave notice of appeal in his own case. He had fewer than half a dozen logs in the cart. When cross-examined he said that the wood was not built up but lying around. Mr Roderick WIGAN was in the vicinity when ARMSTRONG put the wood in the cart. The Chairman warned the accused that in future such cases would be dealt with more seriously. Mr Hugh PERCY, solicitor of Alnwick, appearing for the complainant explained that the four men [and one woman], employed as farm servants had refused to carry out a just and reasonable order to work on a Saturday afternoon. It was a case of principles rather than damages. The men were under the false impression that under the Corn Production Act they were entitled to half day every Saturday, whereas the order only required the payment of overtime if a man worked more than the fixed hours. Mr R Strother STEWART, barrister at law, instructed by Mr Thomas HALL, solicitor, High Market, Newcastle-on- Tyne, acting for the defence, pointed out that the case was not about the half day but on overtime for work done after the required hours had been worked. Mr PERCY denied that this was so. The case of George MOFFAT was taken as a test. Mr William WOOD, farm steward for Mr CABRY, had, on the instructions of his master, ordered the four men to take up the potatoes on the Saturday afternoon. The hours worked that day were 6.15am to 11.30am less 20 minutes for breakfast. They refused to work. REPORT CONTINUES BELOW.

Prior no.978 Farm Servant to asking the men to work, WOOD told CONT. CONTINUED them that there would be no more half- holidays until March, but to THOMPSON, he said that there would be paid overtime if necessary. MOFFAT’s wage was 52s a week with keep of a cow and perquisites. On Monday to Friday, they worked 6.15am to 11.30m less breakfast time, and 1pm to 5pm. MOFFAT worked on Turvelaws before going to the army, and had worked since and been a good worker. The keep of his cow was 6s per week. PERCY queried whether 12s or 15s would be a more reasonable sum to keep a cow: WOOD replied No, 8s. CABRY said that he had suffered serious loss due to the men refusing to work: he had 14 horses and only 6 were being worked. Some had not been worked since. His loss for potatoes still in the field was between £300 and £400. STEWART asked CABRY, if because he paid more than the minimum wage he felt entitled to have overtime for nothing, and why had he dismissed the men when the potatoes were still in the ground? CABRY said that the men dismissed themselves by not following orders. STEWART said the men had already worked 50 hours that week instead of the standard 48. A case of unusual interest to case Superintendent of Lowick intoxicating liquor at 11.30pm, 4s licence holders. Walter TAIT was from no.48 Police Innkeeper when premises were required to be Lowick, Edward ORD, butler, Eshott closed under provisions of the Hall and James LAIDLAW from New Licencing Consolidation Act, 1910. Haggerston. Mr HR PETERS, solicitor, Berwick put forward the defence that the men had been entertained to supper and liquor as guests of FORESTER. Superintendent BOLTON, Alnwick, prosecuted. BOLTON said that it was not necessary for him to prove that the liquor was paid for after hours, but only that a transaction of the nature of a sale had taken place and that liquor had either been consumed or was about to be consumed. He continued that the Police Constables would give their evidence and state that after FORESTER followed them outside, he was in such a drunken condition himself that he fell down drunk and had to be assisted back into the house. PC HENDERSON, Lowick, said that there had been a dance in the Drill Hall, which was attached to the Commercial Inn, Lowick. He had the Inn under observation from 9pm to 11pm and during that time saw men enter and leave on several occasions. As people entered he went to a small window which overlooked the cellar, in which a lamp was burning, and he invariably saw the barman come into the cellar and draw beer from a barrel. Sergeant TOWNSEND joined him soon after 11pm. Hearing loud talking, the Sergeant knocked on the door: the door was opened by Mr FORESTER. In the kitchen, they found TAIT, ORD and LAIDLAW, and the barman. There were two partly consumed half pint glasses of beer on the table and three smaller glasses, two containing whisky and one rum. CONTINUED BELOW 62 PS 9/6 10th April 1920 Thomas BOLTON Robert FORESTER CONTINUED (1): On being told that page97/ 4th May 1920 Alnwick Commercial Inn he would be reported, FORESTER, case CONTINUED (1) Superintendent of Lowick replied that they were his guests: he had no.48 Police Innkeeper asked them to stay for supper. They had CONT. (1) CONTINUED (1) CONTINUED (1) had a few drinks and a quiet chat. The men were asked to leave. As the PC and Sergeant were leaving, FORESTER followed them outside and fell down drunk. There were no signs of supper having been served and there was nothing on the table other than glasses. TAIT had entered the Commercial about 8pm; LAIDLAW and ORD came out of the dance and went into the Inn between 9 and 10pm. He did not think that they would have had time to have had supper in the house. Mr PETERS pointed out that Mr FORESTER cannot have been very drunk as he had answered HENDERSON’S question clearly. He stated that these men were friends of Mr FORESTER who was entertaining them at his own expense. Mr FORESTER when in the box, said that LAIDLAW and ORD had come for a drink at about 7pm and he had invited them to come back later for supper. LAIDLAW was a nephew of his by marriage and ORD was an old acquaintance having formerly stayed in Fenwick. TAIT had stayed behind to help clear up. The barman and the rest sat down to a supper of tea, bread and butter, cold boiled bacon and cheese. After they had finished eating, they washed and put away the dishes. He supplied the drink at his expense. Two of the men had two small whiskeys with a little wine added, and the barman had a glass of beer. CONTINUED BELOW.

63 PS 9/6 10th April 1920 Thomas BOLTON Robert FORESTER CONTINUED (2): When the police page97/ 4th May 1920 Alnwick Commercial Inn knocked at the door, he asked who was case CONTINUED (2) Superintendent of Lowick there and was told the PC’s. They no.48 Police Innkeeper walked in and took the names of the CONT. (2) CONTINUED (2) CONTINUED (2) men but did not charge him with selling liquor. He was not drunk: he fell when he went out because he tripped on a stone. Witnesses could prove that. Several people came to and went from the house after closing as it was common for people attending the dance to leave some of their clothing in the house. TAIT stayed to help wash the glasses and clean the rooms as there had been a large company present; as well as the dance, he thought there had been a football match. LAIDLAW confirmed that he had not paid for the liquor and that FORESTER appeared to be all right. John TAYLOR, barman, corroborated the evidence given so far. He had washed and put away the supper dishes himself. There was a lamp burning in the cellar: he had only drawn beer once but had been down there several times putting empty bottles into boxes. Superintendent BOLTON failed to shake the witnesses evidence. ORD was unable to be present as he had had an operation as a result of an old wound but had sent a letter stating that he had been invited to the house by Mr FORESTER and been given a drink. TAIT was unable to be present due to the illness of his father. The Bench gave FORESTER the benefit of the doubt but were not satisfied with the way the house appeared to be run and they hoped that he would be more careful in future else his licence might be enquired into.

Accused from Yeavering, stole case Superintendent of the mackintosh from Thomas ALLAN, no.60 Police farmer at Branxton Hill, out of a trap in the Black Bull Yard, Wooler. The Ostler had seen the prisoner, who works at He[a]thpool and informed PC WILLOGHBY who traced the accused to Barrow Banks and found him wearing it. PS 9/6 1st June 1920 John WILKINSON Thomas BRUCE Application for ejectment Application Berwick Advertiser 4th June1920, page page100/ Ashington Villa, dismissed 3, col 6 & 7. Mr WILKINSON from case Wooler Ashington, explained that he had no.61 applied for an ejectment order to obtain his house for his daughter who had very bad health. While at Harrogate recently they had been told by a doctor, that a place with plenty of fresh air was essential for her recovery. Notice had been served in Nov 1917, 1918, 1919 and 1920. He had been told by a member of the BRUCE family that it was their house and that they could do what they liked with it. He was quite willing to allow them one half of the house: there were seven rooms. Mr PERCY acting for Mr BRUCE, cross examined WILKINSON: his son had served notice on 12th Nov. Rent receipts were produced showing the terms were from 11th Nov to 12th May. Notice should have been given on or before the term day. PERCY produced a medical certificate from Dr A DEY explaining the serious condition of Mr BRUCE’s son. If he was moved it would go hard with him as he was very ill.
