It was on a desert island in the Atlantic Ocean off the coast of Florida in late June of 1979. The sun scorched the sand each day, until the afternoon thundershowers awoke the mosquitoes. In these difficult conditions, we seldom left our air-conditioned hotel. (After citation counts, the best measure of academic influence is the number of resorts a professor has visited in the offseason.) We were marooned there with a small group of professors in Henry Manne’s Legal Institute for Economists. All day, drillmasters from Ivy League law faculties taught us to march. After two and a half weeks, our legal education was complete, so Tom and I decided to write a textbook on law and economics. Neither of us had ever taken a class in the subject – none were offered at the universities that we had attended, including Harvard and Stanford.

New Legal Realism seeks to address the failings of Legal Realism, by directing greater attention to the challenges of incorporating social scientific insights into legal discourse. In this chapter, I argue that to accomplish the integration of social science and law, legal education must be reoriented to further the goals of New Legal Realism. In particular, I consider how the formal curriculum, hidden curriculum, and law school pedagogy might be reformed to provide skills, knowledge, and values that are consistent with New Legal Realism’s emphasis on empiricism, interdisciplinarity, and social contextualization. Using civil procedure as an example, I illustrate what a New Legal Realist approach to legal education might look like.

Yet even in the U.S., the way in which empirical work is useful for normative legal arguments remains unclear. This article first points out the junction between empirical facts and normative arguments. Both teleological and consequentialist arguments, in one of the premises, require “difference-making facts” which point out causal relations. Many empirical research makes causal inferences and thus constitute an essential part in teleological and consequentialist arguments, which are typical normative arguments in legal reasoning.

GEORGE* "For the rational study of the law[,] ... the man of the future is the man of statistics and the master of economics.' - Oliver Wendell Holmes (1897) "[I]t is vitally important to determine whether the law is based on sound assumptions about how the world works and to what extent a particular2 law or process is achieving its stated objective and at what cost." - N. William Hines, President of Association of American Law Schools (AALS) (2005) Empirical legal scholarship (ELS) is arguably the next big thing in legal intellectual thought. ELS, as the term is generally used in law schools, refers to a specific type of empirical research: a model-based approach coupled with a quantitative method. The empirical legal scholar offers a positive theory of a law or legal institution and then tests that theory using quantitative techniques developed in the social sciences. The evidence may be produced by controlled experiment or collected systematically from real world observation. In either event, quantitative or statistical analysis is a central component of the project. Empirical research in law is not new.3 Law professors, in the past, offered statistical studies on issues small, say parking violations in New Haven in the 1940s, 4 and large, such as jury versus judge verdicts in criminal trials. 5 Despite Holmes's forecast, however, work of this type was uncommon in law schools through most of the last century. 6 Few legal scholars published empirical studies in law reviews, the primary t Copyright 2006 Tracy E.

    651 Legal Mobilization in Schools: The Paradox of Rights and Race Among Youth Calvin Morrill Karolyn Tyson Lauren B. Edelman Richard Arum In this article, we analyze ethnoracial patterns in youth perceptions and re­ sponses to rights violations and advance a new model oflegal mobilization that includes formal, quasi-, and extralegal action. Slightly more than half of the 5,461 students in our sample reported past rights violations involving dis­ crimination, harassment, freedom of expression/assembly, and due process violations in disciplinary procedures. Students, regardless of race, are more likely to take extralegal than formal legal actions in response to perceived rights violations. Self-identified African American and Latina/a students are significantly more likely than white and Asian American students to perceive rights violations and are more likely to claim they would take formal legal action in response to hypothetical rights violations. However, when they per­ ceive rights violations, African American and Asian American students are no more likely than whites to take formal legal action and Latina/a students are less likely than whites to take formal legal action. ABSTRACT This introductory chapter shows the distinctive qualities of New Legal Realism (NLR), captures where it stands around its fifteenth anniversary, and explains the goal of the larger book. In doing so, we demonstrate NLR’s fruitful continuation of the legal realist adventure as it reaches beyond historical and national boundaries to form new international conversations, based heavily on law-and-society networks and traditions. In addition, we provide a contrast to Empirical Legal Studies, because the NLR project clearly visible in this volume does not just use quantitative methods to study lawyers and legal institutions as they have been traditionally viewed. Instead, it includes chapters by social scientists and law professors using social science theory and multiple methods to understand law and address legal problems – across an impressive variety of subject areas such as immigration, policing, globalization, legal education, and access to justice.
