010/21 MAYOR’S REPORT CIVIC ENGAGEMENTS The Town Mayor reported on the death of former Town Councillor and Town Mayor Mrs Cathy Ingledow.

011/21 CLERK’S REPORT a. Scarborough Borough Council – views on Zip Wire Proposal Councillors considered and discussed the Zip wire proposal raising concerns about the detrimental effect it will have on the building and landscape.

b. Scarborough Borough Council – Local Plan The Planning Committee will submit the Town Council’s Formal response to SBC Local Plan Consultation relating to the addition of 10 further sites in Whitby including the Golf Course.

Under the town council’s Scheme of Delegation, as amended [007/21(k)], the following decisions have been taken by the Proper Officer since 4 May 2021.

Public Spaces Protection Orders (PSPO) are designed to stop individuals or groups committing anti-social behaviour in public places.

Scarborough Borough Council (“the Council”) is commencing a 5 week consultation on the review of a current Car Cruising PSPO in exercise of its powers under sections 59 to 75 of the Anti-social Behaviour, Crime and Policing Act 2014 (“the Act”).

Under the Act, the Council can: set blanket restrictions and requirements; set targeted restrictions and requirements against certain behaviours by certain groups at certain times; restrict access to public spaces (including certain types of highway) where that route is being used to commit anti-social behaviour.

PSPOs can be enforced by a police officer, a community support officer, or Council officers.

Behaviour being restricted has to be: having, or be likely to have, a detrimental effect on the quality of life of those in the locality; persistent or continuing in nature; and unreasonable.

Any person who without reasonable excuse: does anything that they are prohibited from doing by a PSPO; or fails to comply with a requirement to which the person is subject under a PSPO; will commit an offence and be liable to; prosecution and fine not exceeding level 3 on the standard scale (£1,000); or being issued with a fixed penalty notice under which an amount not exceeding £100 is due.

The current PSPO is designed to tackle car cruising in public places (as defined by the Act) throughout the Borough of Scarborough (the restricted area).

We hereby invite representations on our proposals to continue with the current restrictions within the PSPO.

Up until 2018 when the current PSPO came into force Car cruises operated in Scarborough for a number of years. They can be large scale gatherings of car owners. There have been occasions that have involved in excess of five hundred vehicles. Cruises have taken place on the Marine Drive area of Scarborough which is one of the main routes from the North Bay to the South Bay of the Town. Marine Drive is used by thousands of residents and visitors every year both on foot and in vehicles.

The following concerns were raised in connection with the car cruises prior to the PSPO implementation in July 2018:

Excessive noise nuisance including car engines revving persistently, sounding of horns, amplified music, dough-nutting, wheel spinning and burn outs;

Danger to the safety of pedestrians who could become seriously injured should one of these drivers lose control of their vehicles whilst undertaking the above stunts;

Environmental implications – the condition of the footpaths and roads after the group leaves the area – litter and costs to clean this up;

Danger to car drivers – e.g. young drivers putting themselves at serious risk of harm even death through dangerous driving of high performance vehicles;

Danger to the safety of pedestrians who are passing by and having to walk in the road as these cars are parked on the pavement;

Damage to highways (this has already taken place to the public highway causing £50,000 of damage on one occasion);

Disruption to local businesses and the community – the event takes place on the main route to both the South and North Bays of Scarborough;

Substantial impact on the resources of the Council and North Yorkshire Police;

Potential links to other crime/driving offences and substance use;

A vehicles Or vehicles? travelling in excess of 124 mph on public roads when enter and leave the Borough;

Preventing police or other authorised officers from going about their business, diversion of stretched resources so that the events can be managed safely e.g. congregating in large numbers, jeering and using offensive language.

The following concerns are in connection with the car cruises since the PSPO implementation in July 2018.

21st Feb 2020 - Police incident

Facebook page report that they intend to hold a car cruise vent in Scarborough Marine Drive on Sunday 1st March 2020 despite the PSPO being in place. There were 3,300 + people seen, shared & liked the post. This is in breach of the Public Space Protection Order.

1st March 2020

Approximately one thousand modified cars attended the east coast on Sunday 1st March 2020.

This resulted in –

> Police arrest a driver aged 18 years in Vauxhall Corsa for drug driving offences.

> Vehicle makes off from police at McDonalds in Eastfield. The driver is from

Hull & is he is prosecuted for failing to stop for police.

> Police stop a twenty seven year old driver who tests positive for drugs at the road side & is arrested. Driver is disqualified from driving for 12 months.

> Driver summons to court for travelling on Road, Scarborough at speeds excess of 50mph..

> Driver summons to court for travelling on Filey Road, Scarborough at speeds excess of 50mph.

> Driver summons to court for travelling on Filey Road, Scarborough at speeds excess of 50mph.

> Driver summons to court for travelling on Scarborough at speeds excess of 60mph.

> Driver summons to court for travelling on A171 Pickering - Scarborough Road at speeds excess of 30 mph

> Single vehicle RTC at Victoria Road, Scarborough.

The Marine Drive, Scarborough had to be closed by NYP at 17.00 hours with the support of Scarborough Borough Council on the 1st March 2020.

This closure saw some of those involved leave Scarborough without any police contact. However those that remained continued to move to other locations –

> Alpamare Car Park, Rd Scarborough.

Whilst doing so they continued to drive dangerously, without consideration to other road users.

Several of the car drivers were given a Dispersal Order to leave the Borough of Scarborough with immediate effect. The Marine Drive was re-opened at 21.00 hours the same day.

It is the view of North Yorkshire Police, North Yorkshire County Council and Scarborough Borough Council that the PSPO needs extending in order to prevent the reoccurrence of the significant issues caused by this activity prior to the current PSPO being implemented in 2018.

Current PSPO

The Public Spaces Protection Order 2018 which prohibits car cruising came into force on the 9th July 2018 and is in force for a period of 3 years. It applies to all land within the Borough of Scarborough which is open to the air and where the public are permitted to have access, with or without payment.

Police Community Support Officers

Scarborough Borough Council Officers that have written authorisation

Offence

It is an offence for a person who without reasonable excuse -

Participates in car cruising (by being the driver of or being carried in or on a motor vehicle when car cruising is going on); or promotes, organises or publicises car cruising (including but not limited to via email, the internet, social media, or via any publication or broadcast medium) to take place; or attends any meeting either as a vehicle owner, driver, passenger or spectator where a reasonable person would consider that Car Cruising was or is taking place.

What is car cruising?

“Car Cruising” is defined as two or more motor vehicles (including motorbikes) being on or in a highway or a public place (as defined in the Act), where any such vehicle or occupant of a vehicle performs any of the Prohibited Activities listed below.

“Participating in Car Cruising” means being the driver of, or being carried in (or on) a motor vehicle in circumstances where Car Cruising is taking place.

The Prohibited activities causing danger or risk of injury to road users (including pedestrians) causing damage or risk of damage to property speeding or racing performing stunts sounding horns or playing music so as to cause a nuisance

Clerks Report Item 11a using foul or abusive language using threatening or intimidating behaviour; or causing obstruction (whether moving or stationary).

OFFENCES and PENALTY

The various offences that can be committed are outlined in the section underlined ‘Offence’ in this report.

A person who is guilty of an offence under this Order shall be liable on summary conviction to a fine not exceeding level 3 on the standard scale (£1,000).

A constable or authorised person may issue a fixed penalty notice to any person they have reason to believe has committed an offence under this Order.

Where a person is issued with a fixed penalty notice under this Order, the amount of the fixed penalty shall be £100.

CHALLENGING THE VALIDITY OF ORDERS

Any interested person who wishes to challenge the validity of the order on the grounds that the Council did not have power to make the order, or to include particular prohibitions or requirements imposed by the order, or that a requirement under the Act has not been complied with may apply to the High Court within six weeks from the date upon which the order is made. Section 66 of the Act contains the information relating to this.

PLEASE NOTE – It is proposed that the PSPO, as the current order does, will include a scheme under which certain events and activities that have been properly planned and authorised in writing by the Council can be exempted from some or all of the provisions of the PSPO.
