PART I: THE AmERICAN EXPERIENCE WITH DIPLOMACY AND MILITARY RESTRAINT i. Orphaned Diplomats: The American Struggle to Match Diplomacy with Power Jeremi Suri E. Gordon Fox Professor of History and Director, European Union Center of Excellence, University of Wisconsin, Madison Benjamin Franklin spent the American Revolution in Paris. He had helped to draft the Declaration of Independence in the summer of 1776, one of the most radical documents of the eighteenth century—sparking rebellion on both sides of the Atlantic Ocean. Serving as a representative for the Continental Congress in France during the next decade, Franklin became a celebrity. He was the enlightened idealist from the frontier, the man of principled action who enthralled onlookers in the rigid European class societies of the 1770s and ’80s. Franklin embodied the American critique of Old World society, economy, and diplomacy. He was one of many American revolutionaries to take aim at the degenerate world of powdered wigs, fancy uniforms, and silver-service dinners where the great men of Europe decided the fate of distant societies. Franklin was a representative of the enduring American urge to replace the diplomacy of aristocrats with the openness and freedom of democrats.1 Despite his radical criticisms of aristocracy, Franklin was also a prominent participant in Parisian salons. To the consternation of John Adams and John Jay, he dined most evenings with the most conservative elements of French high society. Unlike Adams, he did not refuse to dress the part. For all his frontiers- man claims, Franklin relished high-society silver-service meals, especially if generous portions of wine were available for the guests. -

INTRODUCTION Self-censorship refers to the decision by an individual or group to refrain from speaking and to the decision by a media organization to refrain from publishing information. Whenever an individual or group or the media engages in self-censorship, the values of the First Amendment are compromised, because the public is denied information or ideas.' It should not be sur- prising, therefore, that the principles, doctrines, and precedents of what I refer to as "the law of the First Amendment"' are designed to prevent self-censorship premised on fear of govern- mental sanctions against expression. This fear-induced self-cen- sorship will here be called "self-censorship bad." At the same time, the First Amendment also values and pro- tects a right to silence. -

Press release Embargoed: 00.01 April 7, 2016 Innovate or risk irrelevance, new report warns TV news providers Traditional television viewing is falling, and the rapid rise of online video viewing continues. If television news providers fail to respond to these profound shifts in how people use media, they risk eventually becoming irrelevant, a new report from the Reuters Institute for the Study of Journalism, University of Oxford warns. While television remains an important medium for news – and will remain so in years to come, according to authors Rasmus Kleis Nielsen and Richard Sambrook – failure to recognise and engage with the steep changes in the industry now could lead to losing touch with audiences as people, especially younger people, spend less and less time with traditional television. Television viewing figures in the UK and the US have declined by 3 to 4% a year on average since 2012 – directly comparable to the decline in print readership seen by newspapers during the 2000s. The decline is particularly pronounced amongst younger people. Meanwhile, the rise of video- sharing sites, video-on-demand services and social media-integrated video means that younger audiences watch more and more online video. “There are no reasons to believe that a generation that has grown up with and enjoys digital, on- demand, social and mobile video viewing across a range of connected devices will come to prefer live, linear, scheduled programming tied to a single device just because they grow older,” says Dr Nielsen, Director of Research at the Reuters Institute. “This raises wider questions about how sustainable the broad public interest role broadcast news has played in many countries over the last 60 years is.” What’s the solution? At the moment, says the report, there is no one clear way forward, but the key is to recognise the challenge now, rather than maintaining a defensive, pragmatic approach. -

Abstract During the past several years, as traditional news operations have faced sharp declines in circulation, advertising, viewership, and audiences, and as they have begun to make a seemingly unrelenting series of cuts in the newsroom budgets, scholars and professionals have been seeking formulas or models designed to reverse the trend. During those same years, many of the major news organizations that dominated the landscape a generation ago, those that David Halberstam called “The Powers That Be,” have lost their leadership role and been absorbed by other companies. This paper argues that while there is good reason to worry about the decline in what might be called “boots-on-the-ground” journalism, there are reasons to be hopeful. While most of those concerned with the topic have urged structural changes in ownership, this paper argues that the key is leadership. To understand the demands on leaders, it is essential to understand which of three motives is most important to the publication’s owners: profits, influence, or personal prestige. Each motive presents distinct challenges and opportunities. Looking at the fate of a number of large media organizations over the past decade, the paper argues that the most important model for success is outstanding leadership that combines a talent for business, entrepreneurship and innovation with a profound commitment to great journalism. -

Personal Liability as Administrative Law David Zaring* Abstract Administrative law has almost exclusively concerned itself with lawsuits against agencies as collective entities, under the auspices of the Administrative Procedure Act. In light of the growing number and prominence of suits by war on terror plaintiffs against senior government officials, this Article considers the use of personal liability to discipline government officials and assesses it as an alternative to traditional administrative law. It compares the civil suits to criminal prosecutions of these officials and compares both of them to less- obviously law related scandal campaigns. Personal sanctions—of which Bivens complaints are a principal example—are worth more attention. These mechanisms, and the constitutional tort in particular, are case studies of the popular inclination to decentralize government, of the value of symbolic laws, and, increasingly, of the personalization of law and politics. Solving some of the problems of personal liability, as it works today, might best be done not by enhancing the bite of the always-challenged lawsuits and prosecutions, but by making sure that the law makes it more possible for political cases to be made against government officials, rather than legal ones. Soja, Esq. 1101 Wilson Blvd., Suite 1100 Arlington, Virginia 22209 (703) 807-2100 Executive Summary The corporate structure of the news media has created new obstacles, both financial and practical, for journalists who must keep promises of confidentiality. Information that once existed only in a reporter’s notebook can now be accessed by companies that have obligations not only to their reporters, but to their shareholders, their other employees, and the public. Additionally, in the wake of an unprecedented settlement in the Wen Ho Lee Privacy Act case, parties can target news media corporations not just for their access to a reporter’s information, but also for their deep pockets. The potential for conflicts of interest is staggering, but the primary concerns of The Reporters Committee for Freedom of the Press are that: • because of the 21st-century newsroom’s reliance on technology, corporations now have access to notes, correspondence and work-product information that before only existed in a reporter’s notebook; • the new federal “e-discovery” court rules allow litigants to discover vastly more information than a printed page – or even a saved e-mail – would provide during litigation; • while reporters generally only have responsibilities to themselves, -

Tuesday we mentioned briefly the alleged Iraq-Niger deal concerning shipping Iraq 500 tons of yellowcake {lightly enriched uranium oxide ore}, referenced to British sources in George Bush's State of the Union Speech, January, 2003. The story is murky and convoluted. Here are highlights: The Intelligence Community failed to authenticate in a timely fashion transparently forged documents purporting to show that Iraq had attempted to procure uranium from Niger. Finding 4: Robb-Silberman Report, 2004, "The Commission on the Intelligence Capabilities of the United States regarding Weapons of Mass Destruction." • A small Iraqi delegation visits Niger in 1999, reportedly for "expanding commercial relations" and other matters. • In late 2001, early 2002, three reports from a foreign liaison service state that an agreement was signed between Iraq and Niger to deliver 500 tons of yellowcake to Iraq. Intelligence analysts in the Dept. of State and some in CIA question the reliability of the source. The original documents, including a copy of the presumed agreement, is not received at this time. • Niger is an important producer of yellowcake; the mining operation is a consortium of nations, controlled by France. • The reporting of this proposed deal is included in a CIA briefing of Vice President Cheney in early 2002; he expresses interest in the report which originated with the DIA. CIA officials are skeptical, but decide to sent Ambassador Joseph Wilson, whose wife works undercover for CIA, to Niger to investigate the report. Wilson previously served in Niger and other African countries and has good contacts there. The CIA does not have a station in Niger. -

He was also one of the most controversial figures of the Cold War, both here and overseas. Burchett published more than 30 books, and this volume brings together extracts from most of these, spanning the entire breadth of his career, from World War II, through Hiroshima, Eastern Europe, Korea, Russia, Laos, Cambodia, China, Vietnam, Angola, Rhodesia (Zimbabwe) and other areas from which Burchett reported. The book presents these documents of reportage mostly in chronological order, and thus serves not only as a significant historical overview of the period, but also as a reader in Cold War journalism. George Burchett is an artist and translator. In 2005 he co-edited, with Nick Shimmin, Memoirs of a Rebel Journalist: The Autobiography of Wilfred Burchett. Nick Shimmin completed a doctorate at the University of Lancaster in 1989 on the Manx writers T.E. Brown and Hall Caine.
