Independent Contractor Status of REALTORS® – In recent years court challenges have been brought in a few states (CA, MA et al.) to the traditional independent contractor status of real estate agents. With the rise of “new economy” or “sharing economy”, the U.S. Department of Labor has been looking closely at worker classification issues. Both of these developments may have ramifications for the traditional independent contractor model in real estate sales. High Importance .................... .................... .................... Data Privacy/Security – Public concern about the confidentiality of personal data and information has put pressure on policymakers to increase regulation on the uses of this information. The continued proliferation of data breaches by retailers and businesses will likely motivate policymakers to introduce and apply privacy regulations governing the way large and small businesses, including real estate professionals, collect, store and share consumer information. Electronic Signatures and Closings –Electronic signatures are a way to increase security, speed up transactions and cut costs of doing business. TILA/RESPA Integrated Disclosure (TRID) Regulations – New regulation that combined the prior TILA and RESPA disclosures into two forms: the Loan Estimate and the Closing Disclosure. Use of the new forms started October 3rd. Industry concerns still remain related to delays, availability of the buyer’s Closing Disclosure for agents, and what transaction documentation is provided to the seller. Net Neutrality – Net Neutrality means that Internet service providers may not discriminate between different kinds of content and applications online. The Federal Communications Commission (FCC) implemented an “Open Internet Rule” in 2010 but that rule is being challenged in court. If that rule is overturned, real estate professionals and other consumers could find that a network operator can block certain websites or slow them down so much that they are unusable. Patent Litigation Reform – “Patent Trolls” are increasingly targeting real estate professionals by sending demands to extract licensing fees for common business technologies like scanner copiers, drop down menus and website search alerts. Congress is considering legislation to close loopholes and reduce incentives for trolls to stay in business. High Importance .................... .................... .................... Low Importance Unfamiliar with this issue 7 2016 Public Policy Agenda Survey Commercial Real Estate Issues *8. 179D Energy Efficient Commercial Buildings Tax Provision – The Section 179D tax deduction incentivizes energy efficiency in commercial building construction. 179D is not a permanent part of the tax code, and thus must be reauthorized by Congress regularly. Shortterm reauthorizations create uncertainty in the market, and do not effectively promote energy efficiency in commercial construction. Low Importance Unfamiliar with this issue 9. 1031 LikeKind Exchanges – Proposals have called for changes that would undermine the deferral mechanisms associated with Section 1031 LikeKind Exchanges, which is an important aspect of the commercial real estate market. LikeKind Exchanges encourage efficient use of property, economic growth and job creation, as well as flexibility in managing real estate portfolios. High Importance ...................
