Nageshwarappa, HCGP) This Criminal Petition is filed under section 439 of Cr.P.C., praying to enlarge the petitioner on bail in Crime No.330/2016 of Mangaluru Rural Police Station, Mangaluru 2 for the offence punishable under Sections 143, 147, 148, 120B, 341, 302 and 506 read with Section 34 and 149 of IPC. This criminal petition coming on for orders this day, the Court made the following: ORDER Heard the petitioner’s counsel and the learned High Court Government Pleader for respondent-State. 2. This is a petition under Section 439 of Cr.P.C. The petitioner is accused No.2 in Crime No.330/2016 registered by the respondent-police for the offences punishable under Section 143, 147, 148, 120B, 341, 302 and 506 read with Section 34 and 149 of IPC. 3. It is not necessary to narrate the incident, because, this Court has already disposed of the bail applications filed by other accused. The allegation against this petitioner is same as the allegations found against other accused who have been released on bail. Therefore, 3 on the ground of parity, this petitioner can be admitted to bail. Hence, the following: ORDER Petition is allowed. The petitioner is ordered to be released on bail in connection with Crime No.330/2016 registered by Mangaluru Rural Police Station, subject to his executing a bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) and furnishing two sureties for the likesum to the satisfaction of the concerned Court. The petitioner is also subjected to following conditions: i. He shall not tamper with the evidence collected by the investigation officer; ii. He shall not directly or indirectly threaten the witnesses; iii. He shall regularly appear before the concerned Court for trial, without fail. Sd/- Kmv /- JUDGE .
