THIS CRL.P COMING ON FOR ADMISSION, THIS DAY, THE COURT MADE THE FOLLOWING: O R D E R The petitioners are the accused in C.C.No.3665/2014 on the file of JMFC-II Court, Mangalore. They have filed this petition to quash the proceedings initiated against them for the offences punishable under Sections 79 and 80 of Karnataka Police Act, 1963, as both the offences are non- cognisable and the police have no authority to investigate without prior permission of the Magistrate under Section 155(2) of Cr.P.C. 2. The records disclose that no such permission has been obtained from the jurisdictional Magistrate as required under Section 155(2) Cr.P.C.. In that case, the Investigating Officer gets no jurisdiction to investigate into the crime and to file charge-sheet. As such, the charge-sheet filed against the 9 petitioners for the offences punishable under Sections 79 and 80 of Karnataka Police Act is bad in law for want of prior permission under Section 155(2) Cr.P.C. 3. Hence, petition is allowed. The proceedings initiated against the petitioners in C.C.No.3665/2014 on the file of JMFC-II Court, Mangalore are hereby quashed. Sd/- JUDGE *mn/- .

In India trees are given Ethical, Social and Emotional dimension but conversely, trees and green spaces are neglected by the Urban Developers and Law Makers. Since 1980’s, there was a wide approach towards sustainable cities, making cities from gray to green but here also role of green spaces was limited to “city beautification”. Trees are an important asset for ecological sustainability and biodiversity. Mangalore is perched strategically on the threshold of a “smart city”. This study gives an account of the green cover present in the city of Mangalore, highlighting the importance of green zones in major cities not only for its aesthetic appeal but also for benefits they provide to environment and human population.

Venkatarama Reddi, J. 1. The decision taken by the State Government to discontinue with effect from 1-4-1994 the payment of House Rent Allowance (hereinafter referred to as 'HRA') and City Compensatory Allowance (hereinafter referred to as 'CCA') to the employees of Mangalore University and the consequential action taken by the State Government and the University to recover the excess payments made after 1-4-1994 in instalments was called in question by the respondents herein by filing Writ Petitions under Article 226. The learned single Judge of the Karnataka High Court declined to grant relief and dismissed the Writ Petitions. However, on an intra-court appeal by the aggrieved employees/association of employees, the Division Bench of the High Court reversed the order of the learned single Judge and set aside the impugned orders of the Government, thereby allowing the Writ Petitions. It is against this judgment of the Division Bench, these appeals are preferred by the State of Karnataka. 2. The campus of the Mangalore University which was established in the year 1980 is situated at a place called 'Konaje' which is at a distance of about 5 Kms. from the boundary of the Mangalore City Corporation. The payment of allowances - HRA and CCA to the teaching and non-teaching staff of University is regulated by the various Government Orders issued from time to time.

    ETR 136, Energy & Wetlands Research Group Annexure E The union government (MoEFCC, GoI) constituted Gadgil Committee, known as WGEEP or Western Ghats Ecology Expert Panel to identify ecological sensitive areas. Objectives of this research panel were to study the present-day condition of the Western Ghats regarding of ecology of Western Ghats region, to distinguish Ecologically Sensitive Areas (ESA) within the Western Ghats, to make recommendations for Western Ghats conservation, protection, and rejuvenation (Gadgil et al., 2011). WGEEP has submitted a report to the government of India on 31 August 2011. This panel assigned an entire hilly range of Western Ghats as an ecologically sensitive area by considering different parameters such as biological features like habitat, cultural and historical significance. According to this report, 142 taluks in the Western Ghats consider into the ecologically sensitive zones 1, 2, 3 and restricted the all developmental activities like mining, thermal power plants etc. Figure 55 shows ESA map as per Gadgil report. The report highlights, taluks such as Belthangadi, Sulya, Karkala, Madikeri, Somwarpet, Mudigeri, Sakleshpur as ESA 1 and Puttur as ESA 3. The taluks such as Mangalore, Bantwal are not assigned any status. Dr. K. Kasthurirangan with researchers of 10 members of the high-level working group (HLWG) has been formed by MoEFCC to prepare a report on Western Ghats to retard the agitations raised for Gadgil committee report. The Objectives of this research committee were a present- day condition of the Western Ghats regarding vegetation, endemism, rainfall, deforestation, Ecological sensitive regions, population density, the area under the natural and cultural landscapes, the number of villages and taluks under Western Ghats region in the different states (Kasturirangan, 2013).
