The story can be found in Beveridge’s great Life of John Marshall,2 and a few years earlier in Corwin’s writings.3 Parts of the narrative may trace back to more obscure (2003) 89 Virginia LR 1237 earlier sources.4 The background is the election of 1800. The Republicans have swept the political branches, but the Federalists are hunkered down in the judiciary. Dewey, Marshall Versus Jefferson: The President John Adams’s last-minute judicial appointments—the so-called “midnight judges.”6 The Republican Congress embarks on a purge of the Federalist judiciary with a series of arbitrary impeachments. Meanwhile, Congress fires all the federal circuit judges by repealing7 the 1801 statute that created the federal circuit bench.8 To avoid an immediate challenge to this enormity, Congress shuts down the Supreme Court of the United States for the entire year of 1802. It is a constitutional crisis. (2003) 89 Virginia LR 1238 In the traditional account, the new Chief Justice, John Marshall, presides over a low-prestige Supreme Court.9 He wants to build it up, just as the political branches want to tear it down. Then along comes William Marbury. Although Marbury is not one of the new circuit judges, he is one of the midnight judges.10 Jefferson does not acknowledge Marbury’s appointment because Marbury’s commission was found in a batch of midnight judges’ commissions that were never delivered. As the story has it, John Marshall, under threat of impeachment himself, is badly frightened. Marbury’s case presents him with a dilemma. If he orders Secretary of State James Madison to deliver Marbury’s commission, Madison will not obey, and the Supreme Court will be a laughingstock. But if Marshall declines to order Madison to deliver, it will look as though the Supreme Court is backing down. The Court will still be a laughingstock. Either way, the Court will suffer a blow to whatever small authority it possesses, rendering it even more politically vulnerable. In Marbury v. Madison, so the story goes, Chief Justice Marshall dodges both horns of this dilemma and achieves a “strategic coup.”11 Marshall holds that the Supreme Court has no jurisdiction. The first is the territorial theory.- According to this theory the matter of prime importance is the determination of the place where the offense was committed. The courts of the territory within which the offender committed his offense have jurisdiction over that offense. Courts out- side of that territory had no power to try the offender or to take cog- nizance of the offense in any way. The place where the "gist" of the offense occurred fixed the locus of the crime. The gist of the offense was deemed to be that element of the offense without which the offense could not be said to exist. Sometimes the gist of the offense was looked upon as the act which was done, as in the case of homicide, where the act of shooting was the gist of the offense.

Carr (1962) Argued: April 19–21, 1961 Re-argued: October 9, 1961 Decided: March 26, 1962 Background In the U.S. each state is responsible for determining its legislative districts. For many decades states drew districts however they wanted. By the 1950s and 1960s, questions arose about whether the states’ division of voting districts was fair. Many states had not changed their district lines in decades. During that time many people moved from rural areas to cities. As a result, a significant number of legislative districts became uneven—for example, a rural district with 500 people and an urban district with 5,000 people each would have only one representative in the state legislature. Some voters filed lawsuits to address the inequities, but federal courts deferred to state laws and would not hear these cases. Federal courts did not hear these cases because they were thought to be “political” matters. Courts were reluctant to interfere when another branch of government (the executive or legislative) made a decision on an issue that was assigned to it by the Constitution. For example, if the president negotiated a treaty with another country (a power granted to the president by the Constitution), the courts would generally not decide a case questioning the legality of the treaty. The power of state legislatures to create voting districts was one of those “political questions” that the courts traditionally had avoided. This is a case about whether federal courts could rule on the way states draw their state boundaries for the purpose of electing members of the state legislature.

Burset* The prohibition against advisory opinions is fundamental to our understanding of federal judicial power, but we have misunderstood its origins. Discussions of the doctrine begin not with a constitutional text or even a court case, but a letter in which the Jay Court rejected President Washington’s request for legal advice. Courts and scholars have offered a variety of explanations for the Jay Court’s behavior. But they all depict the earliest Justices as responding to uniquely American concerns about advisory opinions. This Article offers a different explanation. Drawing on previously untapped archival sources, it shows that judges throughout the anglophone world—not only in the United States but also in England and British India— became opposed to advisory opinions in the second half of the eighteenth century. The death of advisory opinions was a global phenomenon, rooted in a period of anxiety about common-law authority.

NOT THE KING'S BENCH Edward A. Hartnett* Speaking at a public birthday party for an icon, even if the honoree is one or two hundred years old, can be a surprisingly tricky business. Short of turning the party into a roast, it seems rude to criticize the birthday boy too harshly. On the other hand, it is at least as important to avoid unwarranted and exaggerated praise.1 The difficult task, then, is to try to say something re­ motely new or interesting while navigating that strait. The conference organizers did make it easier for me in one respect: My assignment does not involve those ideas for which Marbury is invoked as an icon.     Wilson as a Justice MAEVA MARCUS* ABSTRACT James Wilson, a founding father of great intellect and promise, never ful®lled his potential as a Justice. This paper explores his experience on the Supreme Court and the reasons that led to his failure to achieve the distinction that was expected of him. James Wilson very much wanted to be the ®rst Chief Justice.1 But when George Washington denied him that honor and nominated him to be an Associate Justice, he accepted and threw himself into the work with characteristic industry.2 Other than a title and $500 more in annual salary3 (Wilson probably wanted this more than anything else), Wilson lost little. Life as an Associate Justice would be no different from life as the Chief. A Justice occupied one of the most exalted positions in the new government and was paid more than any other federal em- ployee, except the President and the Vice-President.4 Nominations were the sub- ject of ®erce competition.5 But in 1789 no one knew exactly what that job would entail. CHOPER† ABSTRACT Whether there should be a political question doctrine and, if so, how it should be implemented continue to be contentious and controversial issues, both within and outside the Court. This Article urges that the Justices should reformulate the detailed definition that they have utilized (at least formally) since 1962, and adopt four criteria to be applied in future cases. The least disputed—textual commitment—is the initial factor listed in Baker v. Carr. The other three are based on functional considerations rather than constitutional language or original understanding. The first of these—structural issues: federalism and separation of powers—has been advanced and developed at length in my earlier work. It is based on a comparative advantage of the political process over the Court in sound constitutional decisionmaking respecting the relevant issues, as well as the trustworthiness respecting fundamental values of the national legislative/executive branches in doing so. The remaining two criteria involve removing questions of individual rights from the judiciary's realm, something that would (and should) occur very infrequently. The manageable standards test recognizes that there may be constitutional provisions for which the Court lacks the capacity to develop clear and coherent principles. The generalized grievance guide is similar in many ways to structural issues in that it is also grounded in matters of comparative advantage and trustworthiness of results. Copyright © 2005 Jesse H.
