attainment of the sustainable economic and social development of the country. The sector is an essential enabling service with proven links to economic growth and poverty reduction which are the primary objectives of two of the key national planning documents to which Government has committed – Malawi Growth and Development Strategy (MGDS) II and the Economic Recovery Plan (ERP). It is acknowledged that an integrated transport system is a catalyst for development and is central to improving domestic and international connectivity. This National Transport Policy builds on a process that started in 1994 when the United States Agency for International Development (USAID) provided the Ministry with Technical Assistance to ensure that policy proposals were taken through the traditional public policy making process that includes consultation and interaction with significant role players regarding issues to be placed on the agenda. The policy that emanated from this assistance and was approved by cabinet in 1999 was further developed on the basis of implementation experience, and a revised policy developed in 2004. This Policy, along with its accompanying Implementation Plan, provides a further positive step in the development of the transport sector in Malawi and is a necessary update of the policy to meet the expectations of MGDS II and the ERP. However, it is also recognised that in terms of meeting longer-term visions there is still some way to go, and that the impetus developed under earlier policies needs to be maintained by the Ministry. The Policy goal is to ensure the provision of a coordinated transport environment that fosters a safe and competitive operation of commercially viable, financially sustainable, and environmentally friendly transport services and enterprises. The scope of the Policy covers all modes of transport namely; road, rail, air and marine and is made up of six (6) priority areas which are : Transport Infrastructure, Transport Services, International Transport Corridors, Private Sector Participation, Strengthening of Institutional Framework and Cross-cutting Issues. This Policy has the full commitment of Government and therefore, all stakeholders are urged to embrace and implement the Policy. Successful implementation of the Policy will ensure that the transport sector makes its full contribution to the achievement of the Malawi’s development goals. Hon. Francis L. Kasaila, M.P. Minister of Transport and Public Works iii Preface This National Transport Policy offers opportunities for a range of stakeholders to contribute positively to the overall development objectives of the country. Government is committed to increasing private sector participation in the provision, management and operation of transport infrastructure and services, and this Policy is designed to encourage further development of the strategies adopted to date in this regard. The major challenge for Government will be to ensure that sufficient funds are available for implementation of the strategies developed under the Policy, and the encouragement of the private sector to increase their involvement in transport is seen as the key to meeting this challenge. The reduction of the country’s extremely high transport costs is the key objective of the Policy. The approach adopted to achieve this goal has been to move from a highly controlled transport sector to a more liberalised market oriented transport sector, in which private sector participation is encouraged, including promotion of effective and fair competition among and within all modes of transport. The role of Government, therefore, increasingly becomes that of providing an enabling environment in which the private sector or other

We were stopped in a queue of trucks and cars negotiating speedbumps, army, police, paramilitary, immigration agents and sellers of nuts, cooldrinks and much else at the bridge that spans the great Save River in Mozambique’s Inhambane Province, just north of the popular tourist destination of Vilanculos. We saw no tourists at all on the road to Malawi from Maputo, not even adventuresome overlanders and members of the 4x4 brigade. This may have (partly) been down to Covid-19, but their absence was hardly surprising given the levels of intimidation and friction from officialdom. We had set off from Johannesburg two days earlier, a short (and, as it turned out, fast and friction free) 550 kms day’s driving to Maputo.

This paper assesses the structure of markets, competition, and prices and costs of road transportation between urban hubs in Malawi, Mozambique, South Africa, Zambia, and Zimbabwe. Key findings are that certain routes, such as that between Lusaka and Johannesburg, have become more competitive over time and relative to benchmarks due to the availability of loads in each direction, improved efficiencies, and greater competitive rivalry between trucking firms from different countries. However, border delays and control of access to loads by large brokers continue to negatively affect competition and efficiency.     Competition Assessment in Malawi Transport Sector (A paper prepared for ACER 2016 Conference, Livingstone, Zambia) By Competition and Fair Trading Commission, P/Bag 332, Lilongwe 3, Malawi, [email protected] Abstract Transport sector plays a crucial role in Malawi’s economic development. The sector has been identified among key factors that are crucial to trade. Malawi, being land- locked and importer of fuel, registers relatively high transport costs. However, past studies observed that the transport costs in Malawi do not compare favourably with other land-locked countries in the region. It was against this background that CFTC conducted a study into the transport sector to establish the level of competition and its effect on the market. The study reviewed the structure, existing regulation, conduct of market players and how they influence market outcomes. The study found that performance of transport sector is affected by a number of factors some of which are competition related. The study found substantial evidence that suggest price-fixing cartels and other unilateral conducts. These were found to contribute to poor performance. Furthermore, the study found that competition in the transport sector is impeded due to existing regulations which create barriers to entry and do not incentivize market players to behave in a competitive manner. For example in air transport, the study found that reforms in licensing of airlines would improve competition in airline industry and result in reduction in fares which are currently among the highest in the region. Owning a private car or a motorized two-wheeler is a major aspiration for people in cities In Malawi Have a vehicle population of about 290,935 as of 2016 With a total classified network of about 15,400 km of which only 4,312 km PUBLIC TRANSPORT IN MALAWI Malawi used to have state controlled Public Transport before 1990’s UTM, stage coach and then Shire Bus Lines In early 1980’s the sector was liberalized and more players started coming in with minibuses Since the 1990s the transport business in general and public transport in particular was deregulated this lead to dissolving of the public enterprise Transport policies Shift to permit market-determined decisions, enterprise autonomy, and private participation in the ownership and management of transport businesses. As a result, the number of private operators increased exponentially with the influx of many minibuses in the mid-1990s, which provided relief access to public transport. Public Transport Regulation The responsibility for public transport management lies with the Ministry of Transport and Public Works through the Directorate of Road Traffic and Safety Services. The Directorate is charged with administering regulatory provisions relating to motor vehicle administration, driver licensing administration, operator authorization and control of permits.
