AGENDA ITEM Consider bids received to resurface the courts.

SUMMARY RECOMMENDATION City staff recommends awarding the low bid to Mid- American Courtworks in the amount of $28,800.

BACKGROUND Bids were received on May 10, 2018 from four contractors as follows:

BUDGET IMPACT The Capital Improvement Plan approved by the City Commission last year included $35,000 for the resurfacing of the tennis courts in 2018.

SUGGESTED MOTION I move to award the low bid to Mid-American Courtworks in the amount of $28,800 to resurface the tennis courts and authorize the Mayor to sign the contract.

GAMECO PRODUCT DATA AND SPECIFICATIONS MULTI- PURPOSE ACRYLIC COLOR COAT PREPARATION AND APPLICATION FOR COATING ASPHALT SURFACES

SPECIFICATION NO. G- 200

DESCRIPTION:

GAMECO ACRYLICS are designed and engineered to create a uniform ( non- glare) colored wearing surface over both asphalt and concrete surfaces that require a tough surface for recreational facilities and general foot traffic. GAMECO products are generally designed for use on game courts such as tennis, , , pickleball courts, but are also used on above grade decks, traffic islands, airports, and many other surfaces requiring waterproofing, reflective colors, and a general uniform colored surface.

PREPARATION & APPLICATION:

A. ALL newly installed asphalt must cure a minimum of twenty-eight (28) days prior to application of surfacing materials. GAMECO products are specially designed for use by professional applicators to create a specific texture or speed of play by adding various sizes of sands at the job site. This specification consists of the installation of a new colored wearing surface over new or existing asphalt surfaces that are sound, have sufficient slope to insure proper drainage and must meet or exceed the American Sports Builders Association( ASBA) applicable guidelines. Additional leveling courses of asphalt may be required to correct the tolerance.

B. Prior to application of coatings or the surface shall be flooded with water and allowed to drain. When the surface has dried mark all areas holding water in excess of 1/ 8" in depth. NOTE: Areas less than 1/ 8" in depth are acceptable and will dry within a reasonable amount of time. Areas deeper than one-eighth of an inch ( 1/ 8") in depth, shall be patched with GAMECO AC PATCHING COMPOUND ( refer to G- 600 for mixing and application instructions).

C. Prior to application of color coats, remove loose materials, high areas by sanding, grinding, etc. Fill all cracks, dings, and other irregularities by using either GAMECO AC PATCHING COMPOUND or GAMECO SUPER- FLEX CRACK FILLER. Application can be made using a cement trowel or putty knife. Surface to be coated must be clean and dry. When patching has thoroughly dried, patches may be scraped smooth or sanded flush with surface. NOTE: THERE IS NO PERMANENT REPAIR FOR CRACKS. REPAIR PRODUCTS MUST HAVE FLEXIBILITY IN ORDER TO MOVE WITH THE CRACKS, BUT ASPHALT MATERIALS CAN CRACK BEYOND THE STRETCH OF FILLERS, AND REPAIR PRODUCTS WILL PULL AWAY FROM THE SIDES OF CRACKED ASPHALT SINCE IT IS AN UNSTABLE AND TEMPORARY SURFACE REQUIRING CONSTANT MAINTENANCE.

D. Once patching is complete, one to two applications of GAMECO, Acrylic Resurfacer or Super- Surfacer, as specified, shall be applied to the surface. Refer to the individual technical data sheets for mixture and application details. Please note that resurfacer coats may NOT be necessary over previously coated surfaces that are in good condition.

COVERAGE:

Texture coat coverage is approximately .04-. 05 gal/yd2( 180- 225 ft2/ gal) per application of undiluted material. Finish coat coverage is approximately . 03-. 04 gal/ ydz( 225- 300 ft2/ gal) per application of undiluted material. Coverage may vary depending on porosity of surface, texture, and Silica sand size used.

APPLICATION: ( GAMECO MULTI- PURPOSE ACRYLIC COLOR COAT

E. Mix filler coat formulation above and apply one to two coats ( as specified) by squeegee. Allow each coating to thoroughly dry before proceeding to the next. Remove all ridges and other irregularities by scraping the surface with cement scrapers and high- powered air blowing.

F. Mix finish coat formulation above and apply one ( 1) coating by squeegee.

PLAYING LINES:

Mix GAMECO ACRYLIC LINE PAINT thoroughly and apply by hand brush or roller method. DO NOT DILUTE PRODUCT, APPLY" AS IS" AFTER MIXING.

LIMITATIONS:

Do not apply during inclement weather or when it is anticipated. Do not apply over damp or wet substrates. Do not apply to surfaces during the out- gassing of vapor. Do not apply when temperature is below fifty degrees Fahrenheit ( 50° F). Do not apply when surface temperature exceeds one hundred thirty degrees Fahrenheit( 130° F). Do not over dilute. Do not allow to freeze. Minimum cure time for concrete substrates is twenty- eight( 28) days. Maximum moisture content of substrate is 4%. Substrate temperature must be a minimum of 4° above the dew point.

Outdoor Applications Outdoor surfaces coated with acrylic materials are fairly easy to maintain because of the cleansing effect of rain. However, site conditions( surrounding environment) vary and your acrylic surface may become dirtied from mud, grass, pine needles, leaves, food/ drink droppings and other foreign debris. It is very important to remove foreign debris in a timely manner in order to maintain the aesthetics and texture of the surface.

The surface should be swept clean as needed with a soft nylon or hair type broom to prevent foot traffic from grinding debris into the court surface. Do not use a stiff bristle broom as it may scuff and abrade the surface. During the playing season, the surface should be hosed off with water using normal garden hose water pressure( 70 lb. per sq. inch or less) approximately once a month depending on court usage and site conditions. Stains may be cleaned by carefully scrubbing the surface with a soft bristle scrub brush using a mild, cold water detergent.

If mold or mildew forms on your court surface apply a solution of 2 parts water and 1 part household bleach and add 2 tablespoons of liquid dishwashing detergent per gallon of solution. After blowing court clean, brush solution onto court surface( affected area) with a stiff broom or nylon brush. Let stand for 15 to 20 minutes and thoroughly rinse off solution with a garden hose or high- pressure washer as needed. Poorly maintained courts with excessive mildew buildup may require 2 or more solution applications. Please note that fungus will only grow on areas of the acrylic surface contaminated by foreign organic matter. Acrylic coatings will not support the growth of fungus.

Indoor Applications Indoor applications require a more meticulous cleaning/ maintenance schedule than do outdoor applications. Although pine needles and leaves are less of a problem, indoor surfaces do not get the cleansing benefits associated with rain and wind. Poor ventilation, humidity, and the quicker accumulation of debris( dust, tracked in dirt, ball fuzz, rubber from shoe soles, and other extrinsic materials) will cause the surface to become excessively dirty and unsightly in a short period of time if a regular cleaning schedule is not maintained.

It is recommended that indoor surfaces be swept via vacuum or rotary sweeper once a day, and cleaned with fresh water via water vacuum or self contained water brush unit( floor scrubber) approximately once a month depending on court usage. If using a water brush unit, do not add detergent to the water but do change the water frequently so contaminants are not spread across the court surface. Indoor surfaces that are not regularly( once a month) water cleaned may develop the formation of mold or other fungus growths due to the combination of humidity, temperature, and organic contamination( perspiration, food& drink spills, and dirt). Stains and fungus should be addressed as previously mentioned in the" Outdoor Applications" section.

Oil and Grease Contamination Gently remove excess contamination with a straight edge( 4" spackle knife) and blot spill with a clean dry cloth to remove as much of the spill as possible. Clean the spill with a mild detergent( such as Formula 409, Spray Nine, Fantastic) and a soft nylon or hair type brush. Always test the detergent in an inconspicuous area first for discoloration to the surface. Repeat as needed. DO NOT scrub the surface forcefully and DO NOT apply a solvent as the surface may be damaged by such actions.

Resurfacing& Repairs Resurfacing frequency for your surface is dependent upon court usage and the severity of climate. However, the basic time frame that most courts need resurfacing is every 5 years. If your court develops cracks between resurfacings it is very important to keep the crack filled to prevent extensive water damage from freeze-thaw cycles.

THIS AGREEMENT, entered into this day of 2018, by and between the CITY OF INDEPENDENCE, KANSAS, hereinafter referred to as " CITY" and hereinafter referred to as " CONTRACTOR".

WITNESSETH: That for and in consideration of the payments and agreements stated hereinafter:

1. The Contractor will commence and complete tennis court repair and resurfacing operations as contained herein.

2. The Contractor will furnish all the materials, supplies, tools, equipment, labor and other necessary services for the completion of the project as described herein.

3. The Contractor will commence the work required by the Contract Documents within ten 10) calendar days after the date of the Notice To Proceed and will complete the same within thirty( 30) calendar days from the date ofthe Notice To Proceed unless the period for completion is extended otherwise by conditions set forth in the Contract Documents.

4. The Contractor agrees to perform all the work as described in the Contract Documents and comply with the terms and conditions as set forth therein.

5. The term " Contract Documents" means and shall include the following:

a) Advertisement For Bid b) Information For Bidders c) Bid( as completed by Contractor at the time of bidding) d) Contract Agreement

e) General Conditions f) Special Conditions

g) Notice To Proceed h) Change Orders ( if any issued)

6. Upon satisfactory completion of all required work, the City shall pay the Contractor the specified contract amount within thirty( 30) days.

7. This agreement shall be binding upon all parties hereto and their respective heirs, executors, administrators, successors and assigns.

8. Should the Contractor not complete the work described in the Contract Documents by the date of completion as set out in the Notice To Proceed, the City shall suspend the work, reimburse the Contractor for work completed to said date of completion and rebid or otherwise cause the work to be completed by the City or other outside contractors as may best benefit the City.

PROJECT: Repair and resurface the six( 6) outdoor concrete tennis courts @ Riverside Park

SCOPE OF WORK: ( Contractor: To provide materials and labor necessary to do the following)

I. Take down nets and store and re- hang after work completed. ( See" Add Cost" for new nets)

2. Power- wash the entire surface( Min. 3, 500 psi) using a turbo-tip to remove the loose surface coatings, dirt, mildew and/ or court debris.

3. Mark low areas that hold water after surface water has had time to drain. Fill low spots with Court Patch Binder s mix. Fill to a tolerance of 1/ 16` inch. ( No standing water deeper than a nickel)

4. Fill any" open" surface cracks or expansion joints. Small cracks to be filled with the resurfacing materials below). Note: These courts are post-tensioned concrete and any cracks will be extremely small. Small cracks will re- crack over time thru the color system. ( Not affect play.)

5. Buff ( sand) patches, repairs, and leveling materials as needed to help hide edges of repair materials.

6. After making the above court repairs, resurface courts with Laykold or Vance Brothers Color System as follows: a.) Apply one( 1) coat of Acrylic Resurfacer mixed with fine sand. b.) Apply two( 2) coats of Acryl Color mixed with silica sand. Color(s): Dark Green, Light Green, Royal Blue, Light Blue, Red, Maroon, Tan, Grey, Purple( Add Cost) c.) Stripe courts per U.S. T.A. court specifications Re-hang nets and leave courts in a" ready to use" condition.

GENERAL TERMS AND CONDITIONS: 1. Total Due upon completion of work. To avoid sales taxes on materials, Owner to provide State Project Exemption Certificate. 2. Two( 2) years warranty on materials and workmanship. Exclusions: a.) NO Warranty crack repairs or coatings on surfaces that lack sufficient slope, perimeter drainage, or have abnormal sub-base moisture content. b.) Concrete courts should have a vapor barrier, and a surface texture that is not too slick to guarantee proper adhesion of leveling materials and color system. 3. Work scheduled upon receipt of Signed Contract. This proposal is good for 60 days from the origination date 5- 7- 18) 4. Work to be done at time that both Contractor and Owner agrees. Previous commitments by Contractor to determine available time to perform work.( Est.8- 10 days). 5. Water and available electricity to be provided by Owner.

SUPPLEMENTAL TERMS AND CONDITIONS: When patching cracks or resurfacing courts with cracking, we guarantee the cracks will reappear, and they can reappear within 24 hours, depending upon temperature fluctuations. All work will be guaranteed for labor and materials for a period of one( 1) year from the date of substantial completion except for cracking, pealing, bubbling, due to causes beyond contractor' s control. Should the materials-prove to be defective or the workmanship flawed, the work will be remedied within a reasonable time from the receipt of notification of the specific problem.

All material is guaranteed to be as specified. All work to be finished in a workmanlike manner according to standard practices. Any alteration or deviation form the specifications involving extra costs will be executed only upon written orders, and will become an extra charge over and above the contract total.

The payment schedule will be required as follows: Down payment( 0%) with balance due( 100%) paid upon completion. Owner shall establish suitable access to the construction site. Potable water will be available within one hundred and fifty feet( 150') of the site.
