GENERAL LEVEL OF ESTABLISHMENTSIN THE FEDERAL PUBLIC SERVICE I am directed to refer to my Circular No. 13/1960 republished as Government Notice No. 528, and for the purposes ofclarification and the avoidanceofany doubtthe instructions given in the following paragraphs ~ are now published. It should be noted that this Circular replaces Circular No. 13]1960 whichts to be regarded as withdrawn. . : Government has decided :--

(a) that no new posts shouldbe created in future without the approval of the Council of Ministers ; (6) that there should be no recruitment to posts which have ‘been vacant for more than two years, and that the Ministriés of Finance and Pensions should be provided with details of such posts in order that an estimate can be made of the savings thus available ; (c) with regard to posts which have been vacant for up to two years the Minister concerned should consider whether recruitment is necessary and should arrange for the Ministries of Finance and Pensions to be informed of any posts which it was considered need notbefilled.

3. It will be noted from the above decisions that a distinction has been made between twotypes of posts. This distinction is :— : . (a) there is to be no recruitment at all to any posts which have been vacant for two years or more as at the ist of March, 1960 ; and (6) in cases of posts which have been vacant for less than two years.there shall be no recruitmentatall until each Minister concerned has considered whether recruitment is necessary. — The effect of this distinction is set out in the following paragraphs.

_ 4, Posts vacant for two years or more.—{a) Staff Indents which have been outstanding for two years “or more at the Ist March, 1960, have already been cancelled by this Office. Details of the Indents cancelled are being separately notified to addressees. That this has been done in no way abates the need for full details of all the posts concerned to be forwarded to this Office and the Ministry of Finance as required by paragraph 2 (b) above. , , , (5) In cases where Staff Indents have not been submitted in respect of a particular post or posts, no recruitment to such vacant posts may take place if the posts have been w.cant for two years or more as at the ist of March, 1960. . , \ . (c) As time passes posts which have notbeenfilled within two years from the date oftheir creation will gradually come underthe prohibition of-recruitment when the two-year mark is passed. 7 (d) Thus there is a total ban on recruitment to anypost which has now been vacant for two years or which, in future, comes within the two-year limit. 5. Posts vacant for less than twoyears.—Theprovisions of the General Warrantissued by the Minister of Finance, in accordance with section 17 of the Finance Control and Management Ordinance 1958, speci- - fically provide that recruitment cannot take place to any posts created in the 1960-61 Estimates until the necessary Appropriation Bill has been passed into law. Butthere will still be avery large numberof vacant postsin the Approved 1959-60 Establishments which have not remained vacant for as long as two years.

il 6. in the case of posts vacant for less than two years as at the date ofthis Circular the follewing procedure will apply :— oe - (a). Addressees should examine their establishment/vacancy position and, as appropriate, should discuss with their Ministers theposts to which recruitmentis considered absolutely necessary. It should be noted that this examination refers to all grades of posts and not just to those which are usually filled by overseas recruitment. 610 OFFICIAL GAZETTE No. 29,Vol. 47

(2) Having examined the establishment/vacancy position, addressees should then submit to this Office three copies of a full statement of the existing vacancy position, together with a detail of those vacancies for which it is still considered essential that recruitment should proceed. Appended to the statement should be list showing those posts which it is considered need not be filled. This list should give financial details so that the Ministry of Finance can easily assess the financial savings resulting from this examination. A copy of the statement required by this paragraph should be sent to the Permanent Secretary, Ministry of Finance.+

(c) The statement or covering letter should be signed personally by the substantive, or gazetted acting PermanentSecretary or by the Head of an Extra-Ministerial Department.

(d) In the cases of returns from Permanent Secretaries it should be clearly stated that any recommenda- tions for further recruitment have the full support of the responsible Minister. - oe

8.—-Recruitments arising from wastage.—(a) If vacancies arise after the date of this Circular as a result. of the departure of a holderof a post (e.g., as a result of resignation, retirement, transfer, removal from the’ . service, dismissal, invaliding, promotion, etc.) recruitment to replace such wastage may take place. Lists, of all appointments so made should be submitted to this Office by the 6th of each month. Thelist should = give details of the wastage which enabled recruitmentto take place. o ; -

: (4) In the case of a vacant promotion post that post may befilled in consonance with the normal procedure, and any resulting lower grade vacancy may thereuponbe filled. ‘The action should be notified in the monthly list referred to above. ,

(c) In cases of officers going on study courses, courses of instruction,etc., thepresent practice is to autho-. rise the creation of supernumerary posts to allow a relief to be recruited. This practice will cease. Officers absent from duty for a lengthy period ofinstruction may be replaced by a temporary appointment being made in consultation with this Office. That appointment will be terminated on the resumption of duty by the substantive holder of the post. “

(d) If an Officer sent onstudy course, etc., subsequently qualifies for and receives promotion the resulting vacancy may befilled as set out in sub-paragraph(a).

9. New or additional posts.—The procedure set out in the Federal Establishment Secretary’s Circular No. A.1/1959 still applies and care should be taken to initiate-requests for new or additional posts as soon as‘ the need for them is apparent. The application should give full supporting reasons and Permanent Secre-~ taries are asked to ensure thatit is clearly stated that the application is supported by the responsible Minister. Applications for new posts will be considered and processed in this Office in accordance with the present procedure. No Advance Proposal may be put forward unless the new post has actually been approved, andthe reference numberoftheletter of approval issued by this Office must be quoted on the Advance Pro- posal. an

10. Nigerianisation.—The decisions conveyed in this Circular will not interfere with any decision already taken by Governmentthe aim of which is to speed up Nigerianisation in theprofessional and administrative classes, ‘This means that the decision in Government Notice No. 1912 published in Official Gazette No.70,. Vol. 45 of the 9th October, 1958, where it was stated that in the- interests of Nigerianisation Scale A and B posts could be over-established by 25 per cent of the authorised establishment, will continueto operate.

2 11. This circular is issued on a wide and liberal basis and will be republished as a Government Notice in three successive issues of the Official Gazette.
