STATUTORY INSTRUMENTS 2006 No. 1041 REPRESENTAION OF THE PEOPLE, WALES REDISTRIBUTION OF SEATS The Parliamentary Constituencies and Assembly Electoral Regions (Wales) Order 2006 Made - - - - - 11th April 2006 Coming into force in accordance with article 1(2) £5.50 STATUTORY INSTRUMENTS 2006 No. 1041 REPRESENTATION OF THE PEOPLE, WALES REDISTRIBUTION OF SEATS The Parliamentary Constituencies and Assembly Electoral Regions (Wales) Order 2006 Made - - - - 11th April 2006 Coming into force in accordance with article 1(2) At the Court at Windsor Castle, the 11th day of April Present, The Queen’s Most Excellent Majesty in Council The Boundary Commission for Wales (“the Commission”) have, in accordance with section 3(1) of the Parliamentary Constituencies Act 1986(a), submitted to the Secretary of State a report dated 31st January 2005(b) showing the parliamentary constituencies into which they recommend, in accordance with that Act, that Wales should be divided. That report also shows, as provided for by paragraph 7(2) of Schedule 1 to the Government of Wales Act 1998(c), the alterations in the electoral regions of the National Assembly for Wales which the Commission recommend(d). A draft Order in Council together with a copy of the Commission’s report was laid before Parliament by the Secretary of State to give effect, without modifications, to the recommendations contained in the report, and each House of Parliament has by resolution approved that draft. Now, therefore, Her Majesty, is pleased, by and with the advice of Her Privy Council, to make the following Order under section 4 of the Parliamentary Constituencies Act 1986: (a) 1986 c.56. Amendments made to the Parliamentary Constituencies Act 1986 by the Political Parties, Elections and Referendums Act 2000 (c.41) are not yet in force. (b) Cmnd. HC743-1 (c) 1998 c.38. The Parliamentary Constituencies Act 1986 is extended by Schedule 1 to the Government of Wales Act 1998 (the 1998 Act) for the purposes of the alterations to the electoral regions of the National Assembly for Wales and the allocation of seats to those regions. (d) Following the coming into force of section 3(3) of, and Schedule 4 to, the European Parliamentary Elections Act 1999 (c.1) (the 1999 Act), the alignment of the National Assembly for Wales electoral regions with European Parliamentary electoral constituencies has ceased. Wales is now a single European Parliamentary electoral region. The European Parliamentary Constituencies (Wales) Order 1994 (S.I. 1994/428), which provided for the alignment of the National Assembly for Wales electoral regions with the European Parliamentary electoral constituencies, and to which paragraph 1(2) of Schedule 1 to the 1998 Act refers, lapsed by reason of the 1999 Act’s provisions. Citation, commencement and interpretation 1.—(1) This Order may be cited as the Parliamentary Constituencies and Assembly Electoral Regions (Wales) Order 2006. (2) Subject to section 4(6) of the Parliamentary Constituencies Act 1986 and paragraph 9(2) of Schedule 1 to the Government of Wales Act 1998, this Order shall come into force on the fourteenth day after the day on which it is made. (3) In this Order— (a) any reference to an electoral division is a reference to the electoral division of the local government area in which that electoral division is situated; (b) any reference to a local government area is a reference to that area as it existed on 31st January 2005; and (c) “the Assembly” means the Assembly for Wales which was established by section 1 of the Government of Wales Act 1998 and which is known as the National Assembly for Wales or Cynulliad Cenedlaethol Cymru. Parliamentary constituencies in Wales 2. Wales shall be divided into the parliamentary constituencies— (a) which are named in column 1 of Schedule 1 to this Order; (b) which comprise the areas which are set out in column 2 of that Schedule opposite the name of the constituency; and (c) which are designated as being either county constituencies or borough constituencies according to the name in column 1 of that Schedule. Assembly electoral regions 3.—(1) The Assembly electoral regions shall be the regions— (a) which are named in column 1 of Schedule 2 to this Order; and (b) which comprise the areas which are set out in column 2 of that Schedule opposite the name of the Assembly electoral region. (2) The areas set out in column 2 of that Schedule are the constituencies named in column 1 of Schedule 1 to this Order. Electoral registers 4. Each electoral registration officer for— (a) the constituencies referred to in article 2; and (b) the Assembly electoral regions referred to in article 3 shall make such re-arrangement or adaptation of the registers of parliamentary or, as the case may be, local government electors as may be necessary to give effect to this Order. Revocation 5. The Parliamentary Constituencies (Wales) Order 1995(a) is revoked.
