INTRODUCTION Title IX is a federal civil rights law, and applies to all departments (academics and athletics) in all educational institutions that receive federal funds.1 Title IX of the Educational Amendments of 1972 states: “[n]o person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.”2 Although the statute does not explicitly cover sexual harassment or sexual violence within the definition of “sex discrimination,” Title IX, by virtue of Supreme Court decisions and Regulations of the US -
