To the extent that funds are available in excess of those required for the entrance canal dredging, a portion of such assessments will •a also fund any as-needed dredging analysis (anticipated to be in 2015) of the Shell Harbor and Sanibel Estates Area Canals to determine future dredging needs and requirements; and WHEREAS, such project is a public improvement and the City is establishing the assessment district pursuant to its Home Rule Power, general law, including without limitation Chapters 166, 170 and 180, Florida Statutes, and the Sanibel Charter, and through the procedures set forth in Chapter 170, Florida Statutes; and

WHEREAS, Chapter 170.03, Florida Statutes, provides that a municipality making public improvements when utilizing special assessments shall adopt a resolution stating the nature of the improvement, the location of the improvement, the part or portion of the expense to be paid by the special assessments, the manner in which said assessments shall be made, when said assessments are to be paid, what portion, if any, is to be paid from the general improvement fund of the municipality, a designation of the lands upon which the assessments shall be levied and the total estimated cost of the improvement;

I NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Sanibel, Florida: u Section 1. Determination of Need for Special Assessments; Description of the District. The City Council of the City of Sanibel hereby makes a finding of the need for the levy of special assessments for the public improvement project of canal dredging of the entrance canal to the Shell Harbor and Sanibel Estates "E Canal Area and for as-needed dredging evaluations within such canal area located within the City of Sanibel, Florida. Such special assessments shall be applicable within an area to be known as the Shell Harbor and Sanibel Estates Canal Area Dredging Assessment District, the lands within such Assessment District depicted on Exhibit "A" and generally described on Exhibit "B" (both exhibits attached hereto and incorporated herein). The Shell Harbor and Sanibel Estates Canal Area Dredging Assessment District shall be a single special assessment district, but for purposes of record keeping and certain uses of funds shall be composed of the: s (a) West District (assessed lands depicted in yellow on attached Exhibit "A"); and (b) East District (assessed lands depicted in green on attached Exhibit "A"). Section 2. Description of the Project. A more specific description of the dredging improvement project for which the special assessments are being levied and collected (hereafter sometimes referred to as the "Project") is as follows: (a) To provide annually collected funds for the dredging of the entrance canal (depicted on Exhibit "A" and hereinafter sometimes referred to as "Entrance Canal") which provides access to all of the Shell Harbor and Sanibel Estates Area Canals. The dredging of the Entrance Canal will occur on an as-needed basis (currently anticipated to be every two years) in order to provide for navigability by owners, lessees and the general public through the Entrance Canal to the canals of both the West District and the East District, and to protect the health, safety and welfare of the adjacent ai owners and public in general; and (b) To provide annually collected funds for the future as-needed evaluation of the canals within the Shell Harbor and Sanibel Estates Canal Area (estimated to first occur in 2015) in order to determine the need, cost and scope of any necessary future dredging required within such internal a canals (i.e., other than the Entrance Canal) of the Shell Harbor and Sanibel Estates Canal Area. The actual funding for any such internal canal dredging would be pursuant to a subsequently establishedtanal dredging assessment district or as otherwise determined by City Council pursuant to law. The as-needed internal canal dredging analysis for canals within the West District shall be paid with funds derived from the assessments applicable to such West District and the as-needed internal canal dredging analysis for canals within the East District shall be paid with funds derived from the assessments applicable to such East District. Section 3. Costs and Payment. The total cost of the dredging of the Entrance Canal to the Shell Harbor and Sanibel Estates Canal Area is currently estimated to be $16,500 per year (with dredging to occur every two years at a current estimated cost of $33,000). (a) The Entrance Canal Dredging. It is anticipated that the costs and payment for the Entrance Canal dredging shall be as follows: (1) A portion equaling 33% of the total dredging costs, financing and interest costs (if any), engineering and surveying costs (if any), permit fees, legal costs (if any), and administrative costs for the Entrance Canal shall be paid by the City and shall be budgeted by the City for the fiscal year in which any such dredging is to occur; (2) A portion equaling 27% of the dredging costs, financing and interest costs (if any), engineering and surveying costs (if any), permit fees, legal costs (if any), and administrative costs for the Entrance Canal will be paid by assessments levied each year against the real property located in the Shell Harbor and Sanibel Estates Canal Area Assessment District as shown on Exhibit "A" and described on Exhibit "B"; and (3) A portion equaling 40% of the dredging costs, financing and interest costs (if any), engineering and surveying costs (if any), permit fees, legal costs (if any) and administrative costs for the Entrance Canal dredging shall be assessed against and paid yearly by the owner of that property commonly known as the Sanibel Marina located at 634 North Yachtsman Drive, Sanibel, Florida (hereinafter referred to as "Sanibel Marina Property"; legal property description and legal property ownership to be more fully described in the Assessment Roll to be prepared for the Assessment District). (b) The as-needed internal canal dredging analysis. It is anticipated that the cost and payments for an as-needed internal canal dredging analysis shall be as follows: (1) To the extent that assessment funds are available for such as-needed internal canal dredging analysis within the West District, any dredging analysis of the internal canals of the West District (as depicted in yellow on attached Exhibit "A") shall be paid in the amount of 66.66% from the West District assessment funds and 33.33% by the City. (2) To the extent that assessment funds are available for such as-needed internal canal dredging analysis within the East District, any dredging analysis of the internal canals of the East District (as depicted in green on attached Exhibit "A") shall be paid in the amount of 66.66% from the East District assessment funds and 33.33% by the City. (3) In the event that sufficient West District assessment funds are not available for the West District as-needed dredging analysis and/or sufficient East District assessment funds are not available for the East District as-needed dredging analysis, the City shall be under no obligation to contribute more than 33.33% for any as-needed internal canal dredging analysis. I

(4) The owner of the Sanibel Marina Property shall have no obligation to participate in any as-needed dredging analysis of the internal canals of either the East District or West District and no assessments collected from that property shall be used for any dredging analysis of an internal canal. Section 4. Method and basis for assessment. Each parcel within the Shell Harbor and Sanibel Estates Canal Area Dredging Assessment District shall be assessed based upon an assessable unit. An assessable unit is defined as an existing dock or mooring space, berthing slip or the like or the ability to legally place a dock or mooring slip on the parcel of property. (a) For single family residential parcels (either vacant or improved), each parcel shall be deemed to have one assessable unit based upon the fact H that such parcel cither has or is legally entitled to have one dock. s (b) For each duplex (two family) residential parcel, each residential unit shall be deemed to have one assessable unit based upon the fact that each of the two residential units has legal access to a dock for the parcel or that the parcel is legally entitled to have one dock for use by both residential units. I (c) Each multi-family parcel shall be assigned assessable units based upon the existing dock spaces, mooring spaces, berthing slips or the like, or 85 the legal entitlement to such dock, mooring or berthing spaces. The number of assessable units shall be specifically designated on the Preliminary Assessment Roll for each multi-family parcel in the Shell Harbor and Sanibel Estates Canal Area Dredging Assessment District. (d) The Sanibel Marina parcel described in Section 3 of this Resolution, by consent and agreement of the owner, shall be assessed 40% of the total cost of ONLY the dredging costs of the Entrance Canal (as described in Section 3(a) of this Resolution) to the Shell Harbor and Sanibel Estates Canal Area and, by consent and agreement of the owner, shall be deemed to be allocated the number of assessable units necessary to support the payment of such 40% of such cost. (e) The City shall pay its 33%'of the Project as described in Section 3 of this Resolution. Section 5. Annual assessment to be authorized. This Shell Harbor and Sanibel Estates Canal Area Dredging Assessment District shall be established as an ongoing capital improvement and service assessment district which shall provide a funding source for the as-needed dredging of the Entrance Canal of the Shell Harbor and Sanibel Estates Canal Area and future as-needed dredging analysis of the internal canals. Such assessments shall continue to be paid as described in this Resolution on an annual basis by the specially benefited property owners as shown on the map attached as Exhibit "A", and as will be reflected each year by the then-existing list of properties and property owners available through the Lee County Property Appraiser's office at the time of the annual assessment. The methodology and the amount of the yearly assessment for each property shall be set forth in a Preliminary Assessment Roll, a copy of which shall also re be kept on file with the City Clerk and available for public inspection and which will be presented to the City Council at a public hearing to establish the Assessment District. All assessments shall be paid on an annual basis, and it is currently planned that the City will utilize the uniform method of collection (i.e., real estate tax bill collection) in accordance with Chapter 197, Florida Statutes, as amended, commencing with the tax year 2011 and the 2011 real estate tax bill and X! continuing as an annual capital improvement and service assessment until terminated by City Council. re Section 6. Intent to establish Assessment District. The City Council hereby declares and evidences its intent to make such public improvements as oh described in this Resolution and to finance such improvements and the Project through, in part, a levy and special assessment against all lots and lands adjoining and contiguous or bounding and abutting upon said improvements or specially benefited thereby, and further designated by the Assessment Plat hereinafter provided for. Such Assessment Plat is attached hereto as Exhibit "A" and is also on file in the office of the Sanibel City Clerk. The plans and specifications and an estimate of the cost of the improvements are on file with the City Clerk, Sanibel City Hall, 800 Dunlop Road, Sanibel, Florida, 33957, as of the date of adoption of this resolution. Section 7. Publication of Resolution. The City Clerk is directed to publish this resolution one time in a newspaper of general circulation published in the City of Sanibel, or as otherwise may be required by law. Section 8. Effective Date. This resolution shall take effect immediately upon adoption.
