There is no PDF attachment in this response. I have some serious doubts as to what Kate Patterson's constant mistakes have to do with me. She sends emails saying she doesn't want to engage in a, "back and forth". Yet, when I contact her to explain she has not satisfied the request-it takes time from me. She has made this same mistake over 50 times. Please open a file and schedule a hearing. Bruce Wolfe, I really do not see where I fit in at this June 27 special meeting. According to the audio recording taken at the hearing, at the end of public comment Mr. Lazar addressed the Commissioners, as follows: "Just wanted to tell you, if any of the Commissioners are interested in the history of what the City Attorney advised me to do, and what the Director of Cultural Affairs at that time advised me to do, I'm more than happy to speak with you about it. I was there, some people weren't. Thank you." In response to your request for "any and all documentation {Including City Attorney Opinions)" related to this issue, please be advised that the City Attorney's advice to Mr. Lazar was, and remains, privileged and confidential. Furthermore, according to Lazar, the Arts Commission were only interested in screening the Street Artists at the Embarcadero Plaza (now called Justin Herman Plaza) as they had been doing for some time. I stated that Mr. Lazar had done this on his own without authorization that cause a catastrophe of 3000 unverified Artists and vendors flooding the streets of San Francisco. Mr. Lazar later stated to the Commissioners that my statement was incorrect and that he would later show the Commissioners a City Attorney opinion that advised him not to screen the Street Artists under Prop J. Yet, in a Sept 1, 2016 email (see below) I specific request these very records and you replied on Sept 7, 2016: In response to question #3 - "Please provide me with any and all documentation regarding the San Francisco Arts Commission' and I or Mr. Howard Lazar's refusal to screen San Francisco Street Artists under the 1974 Proposition J aka "The Street Artist Ordinance." As Mr. Lazar was quoted in the Berkeley Barb: "We only screen the work ofstreet artists who are going to sell at the Embarcadero Plaza, we have nothing to do with Proposition J." Our answer is that we have no records related to this request. Street Artist Frank Dong #7194 in 2006 failed to pay his license Street for months when he was discovered by other members. As stated in the minutes of the April 11, 2017 Street Artists Committee meeting on this matter: "Commissioner Johnston moved that Frank Dong be found in violation of the street artists ordinance by selling without a certificate, that a new certificate be issued to Mr. Dong, and that the Program Director accept Mr. Dong's offer to donate money to the street artist fund to cover the period of time in which he offered his items for sale without a valid certificate; ... " [Bold Mine]" Please find attached Mr. Dong's receipt. We are still researching the record that shows that his "payment was placed into the Street Artist Program account".
