5. Prosecution update – Fonterra Sentencing decision

5.1 Mr A D McLay, Director-Resource Management, spoke to the memorandum updating the Committee on the prosecution of Fonterra for its part in a breach of section 15(1)(c) of the Resource Management Act 1991 whereby odorous compounds were intermittently discharged into the atmosphere from the Eltham Wastewater Treatment Plan between 6 March 2014 and 16 May 2014. The Notes of Judge B P Dwyer on sentencing relating to Decision (CRI-2014-043-001198) were received.

5.2 Mr B E Pope, Compliance Manager noted that the EADER is now covered.

THAT the Taranaki Regional Council 1. receives the report on sentencing Fonterra under section 15(1)(c) of the Resource Management Act 1991. Cloke/Joyce

Purpose The purpose of this memorandum is to advise the Committee of consents granted, consents under application and of consent processing actions since the last meeting. This information is summarised in figures at the end of this report.

Recommendation That the Taranaki Regional Council: 1. receives the schedule of resource consents granted under delegated authority.

Background The following resource consent applications have been investigated by officers of the Taranaki Regional Council. They are activities with less than minor adverse effects on the environment or minor effects and affected parties have agreed to the activity. In accordance with sections 104 to 108 and section 139 of the Resource Management Act 1991, and pursuant to delegated authority to make decisions on consent applications, the Chief Executive or the Director—Resource Management has granted the consents/certificates of compliance.

The exercise of delegations under the Resource Management Act 1991 is reported for Committee Members’ information. Under the delegations manual, consent processing actions are to be reported to the Consents and Regulatory Committee.

The attached appendices (consent applications in progress) show the total number of applications in the consent processing system over the last twelve months. The number of applications for the renewal of resource consents is also shown. The difference between the two is the number of new applications, including applications for a change of conditions. New applications take priority over renewal applications. Renewal applications are generally put on hold, with the agreement of the applicant, and processed when staff resources allow. A consent holder can continue to operate under a consent that is subject to renewal. The above approach is pragmatic and ensures there are no regulatory impediments to new activities requiring authorisation.

Also attached are the following: • Applications in progress table - the number of applications in progress at the end of each month (broken down into total applications and the number of renewals in progress) for this year and the previous two years. • Consents issued table - the number of consents issued at the end of each month for this year and the previous two years. • Potential hearings spreadsheet outlining the current status of limited/notified applications where hearing committees have been appointed. • Breakdown of consents issued. This is the number of consents issued broken down by purpose – new, renewals, changes or review. • Types of consents issued, further broken down into notification types – non-notified, limited notified or public notified. • Public and iwi involvement in non-notified consents. This assessment excludes routine farm dairy discharges as generally affected party approval and iwi consultation is not required for these. • Application processing time extensions used compared to the previous years. • Consent type process shows the notification type including applications submitted on and the pre-hearing resolution numbers.

Decision-making considerations Part 6 (Planning, decision-making and accountability) of the Local Government Act 2002 has been considered and documented in the preparation of this agenda item. The recommendations made in this item comply with the decision-making obligations of the Act.

Financial considerations—LTP/Annual Plan This memorandum and the associated recommendations are consistent with the Council’s adopted Long-Term Plan and estimates. Any financial information included in this memorandum has been prepared in accordance with generally accepted accounting practice.

Policy considerations This memorandum and the associated recommendations are consistent with the policy documents and positions adopted by this Council under various legislative frameworks including, but not restricted to, the Local Government Act 2002, the Resource Management Act 1991 and the Biosecurity Act 1993.

Purpose The purpose of this memorandum is to advise the Committee of the preparation of 24 tailored compliance monitoring reports. Recommendations pertaining to each site or programme are set out in the relevant report. The attention of Committee members is directed to the Executive Summary at the front of each report.

Executive summary The Council considers the regular reporting of comprehensive and well-considered compliance monitoring is vital to undergird • community standing and reputation enhancement for companies that consistently attain good or high levels of environmental performance • public exposure for those that don’t • a respectful regard for the Taranaki region’s environment and our management of its natural resources; and • the Council’s accountability and transparency.

There are 24 reports for presentation to the meeting. Thirteen of these reports are for the recently completed 2014-2015 monitoring year and eight are biennial reports covering the 2013-2015 monitoring years. An additional two reports are for the 2013-2014 monitoring year, and one a biennial report covering the 2012-2014 monitoring year.

The reports cover programmes associated with a range of activities, including seven quarry reports, South Taranaki’s Eltham wastewater treatment plant, South Taranaki and NPDC oxidation ponds processes, hydraulic fracturing, deep well injection, landfarming, and various industrial activities, including those in the joint Mangati Catchment monitoring programme.

A total of 40 programmes have now been reported on for the 2014-2015 monitoring year (Figure 1).

All reports have been prepared by staff of the Science Services section and have been submitted to the consent holder for comment prior to publication. All reports provide environmental performance and administrative compliance ratings for each consent holder in relation to their activities over the period(s) being reported, and provide recommendations for the following monitoring year.

The 24 reports being presented to this meeting cover 33 individual consent holders, some with multiple programmes being reported. In total, 41 separate environmental performance ratings have been assigned. Of these there are 26 ‘high’ and eight ‘good’ ratings. In addition, five ‘improvement required’ and two ‘poor’ ratings (both in the Mangati Catchment) were assigned.

As a result of compliance monitoring being undertaken by the Council, there were 22 incidents lodged in regard to consent holder activities. There were as a result four abatement and three infringement notices were issued in relation to the consents being reported on. Of these, three abatement notices and two infringement notices relate to activities monitored within the Mangati Catchment. In addition, an abatement and infringement notice were issued to Osflo Limited in relation to odour issues.

All activities relating to hydrocarbon exploration, production and waste disposal were conducted without incident.

Background The Council considers the regular reporting of comprehensive and well-considered compliance monitoring is vital to undergird- • community standing and reputation enhancement for companies that consistently attain good or high levels of environmental performance. Informed feedback is appropriate and valuable, and assists a proactive alignment of industry’s interests with community and Resource Management Act expectations. Reporting describes the effective value of investment in environmental systems; • a respectful and responsible regard for the Taranaki region’s environment and our management of its natural resources. Reporting allows evaluation and demonstration of the overall rate of compliance by sector and by consent holders as a whole, and of trends in the improvement of our environment; and • the Council’s accountability and transparency. Reporting gives validity to assessments of effective intervention.

For the 2014-15 monitoring year it is anticipated that 108 reports detailing compliance monitoring of 200 programmes will be presented to the Committee. Table 2 presents the number of programmes by industry type anticipated for the 2014-15 monitoring year and the number of programmes reported on to date.

Discussion

C Boyd drilling waste disposal Monitoring Programme Report 2013-2014

Colin Boyd, in conjunction with operator MI Swaco, operates two drilling waste stockpiling facilities on his property near Inglewood, within the Waitara catchment. These sites are located on adjoining properties off Derby Road North and Surrey Road. Drilling waste from the stockpiling sites is landspread over the farm-based property. Colin Boyd is the Consent Holder.

This report for the period July 2013 – June 2014 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the Company’s environmental performance during the period under review, and the results and environmental effects of the consent holder’s activities.

Colin Boyd holds three resource consents, and Surrey Road Landfarms Limited (a subsidiary company in relation to the landfarming operations at this site) holds one. Two of these consents permit the discharge of drilling waste onto and into land via landfarming or landspreading (7559-1 & 7591-1). One consent permits the temporary stockpiling of material prior to landfarming (6900-2) and one consent permits the discharge of stormwater (7911-1). The consents include a total of 64 conditions setting out the requirements that must be satisfied.

During the monitoring period, the consent holder demonstrated an overall ‘Good’ level of environmental performance and compliance with the resource consents.

The Council’s monitoring programme for the period under review included 44 inspections, 29 groundwater samples, 18 surface water samples, five stormwater samples and six soil samples collected for analysis, four biomonitoring surveys of receiving waters and the review of annual reports provided by the consent holder.

The monitoring indicated that activities at the Derby Road drilling waste storage site did not have any significant adverse effect on the environment; the same was reported in terms of the landspreading operation. However, an adverse effect in terms of the in-situ species abundance had been recorded downstream from the discharge location of Surrey Road, with the consent holder achieving a ‘needs improvement’ level as this effect will require to be rectified.

One incident was recorded at Surrey Road incident resulted in minor short term effect on the Mangatengehu Stream. The incident is discussed in Section 3 of this report.

Origin Energy Resources (Kupe) Limited Kupe Production Station Monitoring Programme Report 2013-2014

Origin Energy Resources (Kupe) Limited (The Company) operates a gas production facility located at Inaha Road at Mania, in the Inaha catchment. This report for the period July 2013– June 2014 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the Company’s environmental performance during the period under review, and the results and environmental effects of the Company’s activities.

The Company holds nine resource consents, which include a total of 112 conditions setting out the requirements that the Company must satisfy. The Company holds two consents to allow it to take and use water, one consent to discharge stormwater into the Kapuni stream, and two consents to discharge emissions into the air at this site.

During the monitoring period, Kupe Production Facility demonstrated an overall high level of environmental performance.

The Council’s monitoring programme for the year under review included five inspections, three water samples collected for physicochemical analysis, two bio-monitoring surveys of receiving waters, and two ambient air quality analyses.

The monitoring showed that site was managed in a proactive and acceptable manner; this was detailed by the Council’s Inspectorate Officer. Bio-monitoring of the Kapuni Stream also indicated the stream had little or no measurable adverse effects as a result of the discharges of storm water from the Site, with the health of the stream rated as ‘good’ to ‘better than expected’. The physio-chemical monitoring of the discharge also detailed no exceedance with relation to the Companies Consented Conditions.

As in previous years, the monitoring indicated no measureable adverse effects had arisen as a result of the exercise of this Consent. There were no unauthorised incidents during the period under review at the Kupe Production Station.

Mangati Catchment Monitoring Programme Report 2012-2014

This report is the Biennial Report for the period July 2012 to June 2014 by the Taranaki Regional Council (the Council) describing the monitoring programme associated with seventeen industries within the catchment of the Mangati Stream, Bell Block.

The Mangati catchment has, in the past, been heavily utilised for the disposal of stormwater and wastewaters from a large number of industrial sites. As a consequence of inadequate treatment and management of discharges and minimal dilution capacity in the past, the water quality and aquatic ecosystems of the stream were significantly impacted. The Mangati Stream catchment is listed in the Regional Freshwater Plan for Taranaki (Appendix 1B) as having been identified for enhancement of natural, ecological and amenity values, and life supporting capacity. The Council has addressed this by requiring consents for discharges from every industrial site within the catchment that has significant potential for contamination. A combined monitoring programme has been implemented by Council to monitor these discharges, and since the 2002-2003 year a holistic approach has been applied to the monitoring of abstractions and discharges to all media.

During the 2012-2014 monitoring period a total of one water abstraction consent, 17 non agricultural water discharge consents, six air discharge consents1 and one discharge to land consent were held by industries in this catchment. Applications were received to renew seven consents, three renewed consents were granted, and one consent review was commenced by Council. This report covers the results and findings during this monitoring period for these 25 consents, which contain a total of up to 259 special conditions that the

consent holders must satisfy. It represents the seventeenth report produced by Council to cover water discharges by industries within the catchment and their effects, and is the ninth combined report to cover abstractions and discharges to all media.

Monitoring during the years under review included 136 site inspections, discussions with site operators over site management, 180 samples from chemical surveys of discharges and the receiving water, sediment sampling, macroinvertebrate and fish biomonitoring in the Mangati Stream, deposited, point source and ambient particulate monitoring and odour surveys. A number of modifications to processes or wastewater treatment have been instituted by site operators as a result of Council's investigations and requirements for remedial action to avoid, remedy or mitigate adverse environmental effects. Connections to trade waste sewer have also been made at several sites.

Monitoring in the 2012-2014 period found that, on the whole, the quality of most of the discharges is improving, as is the environmental performance and compliance with consent conditions for the consent holders in the catchment. There are, however some discharges that need further improvement and during the period under review, two companies were deemed to have demonstrated poor environmental performance.

ABB Limited (Transformer Division), Conveyorquip Engineering Services Limited, MI New Zealand Limited, Vector/Natural Gas Corporation of New Zealand Limited, New Plymouth District Council, Schlumberger Seaco Limited, and W Abrahams Limited demonstrated a high level of environmental and high level of administrative performance and compliance with resource consents as defined in Section 1.1.4 of this report. However, in the case of Conveyorquip, compliance with a number of the conditions of the consent could not be assessed during blasting due to the low level of activities at the site.

During the year, McKechnie Aluminium Solutions Limited demonstrated a high level of environmental and good level of administrative performance and compliance with the resource consents as defined in Section 1.1.4. During the period under review there was one exceedance of the oil and grease limit on the consent and there was one spill to ground as a result of a bung being removed from a bund. No adverse environmental effects were found as a result of either of these matters.

During the year, Olex New Zealand Limited – A Nexans Company demonstrated a high level of environmental, but an improvement was required in relation to their level of administrative performance and compliance with the resource consents as defined in Section 1.1.4. During the period under review it was identified that there were discharges occurring to the stormwater system, the potential effects of which had not been adequately addressed at the time of the consent application in 2008, and there was the outstanding matter of clarifications requested in this consent holder’s stormwater management plan. It is however noted, that all process and cooling water discharges were diverted to sewer during the period under review.

During the year, OMV New Zealand Limited demonstrated a high level of environmental performance and compliance with the resource consents as defined in Section 1.1.4. However improvement was required with regards to the level of administrative performance due to the then overdue stormwater management plan, which although not provided after the consent transfer in December 2014, has now been received and accepted.

During the year, the Tegel Foods Limited (feed mill) demonstrated a high level of environmental performance but an improvement was required in their level of administrative performance and compliance with the resource consents as defined in Section 1.1.4. During the period under review there was one non-compliance with this consent holder’s stormwater consent, however, there were no resultant adverse effects. A performance based improvement plan due 1 April 2014 was not provided during the period under review and an abatement notice was issued early in the 2014-2015 year, which was complied with.

An improvement in Greymouth Petroleum Acquisitions Company Limited’s environmental performance is required, but this consent holder demonstrated a high level of administrative performance and compliance with the resource consents as defined in Section 1.1.4. During the period under review both stormwater samples collected exceeded resource consent limits for suspended solids. The suspended solids concentration of the discharge has been an issue for a number of years, and it was hoped that improvements undertaken during the 2011-2012 year would have resolved the issue. This was not the case and further improvement was required.

An improvement in Halliburton New Zealand Limited’s environmental performance is required, but this consent holder demonstrated a good level of administrative performance and compliance with the resource consents as defined in Section 1.1.4. During the period under review there were on-going issues with sediment control at the site that resulted in two non-compliant stormwater discharges and the issuing of an abatement notice. It is however noted that the abatement notice was found to have been complied with on 1 July 2014.

An improvement in Tasman Oil Tools Limited’s environmental performance is required, and this consent holder demonstrated a good level of administrative performance and compliance with the resource consents as defined in Section 1.1.4. During the period under review all three stormwater samples collected exceeded resource consent limits for suspended solids, and the suspended solids concentration of the discharge was also found to be an issue in the 2011-2012 year. An initial request was made for works to be undertaken in November 2013. It was found that works had not been undertaken in March 2014, however this request had been complied with by the inspection on 1 July 2014.

An improvement in BLM Feeds Limited’s environmental and administrative performance (as defined in Section 1.1.4) is required. During the period under review there were on-going issues with tracking from the dry goods storage shed entering the stormwater drains, and the requested updated stormwater management and contingency plans were not received.

During the year, Hooker Bros Investments Limited (Hookers) demonstrated a poor level of environmental performance and improvement was required in their level of administrative performance and compliance with the resource consents as defined in Section 1.1.4. There were a number of breaches of this consent holder’s biochemical oxygen demand limit, which on one occasion resulted in the issuing of an infringement notice. In terms of Hookers’ administrative performance, as highlighted in the previous Annual Report, this consent holder’s stormwater plan is overdue for review, and the site contingency planning/actions did not prevent the discharge of molasses when work was undertaken on the storage facility.

Overall, during the period under review, Tegel Foods Limited (poultry processing plant) demonstrated a poor level of environmental performance and improvement was required in

the level of administrative performance and compliance with the resource consents as defined in Section 1.1.4. In relation to the discharges to water, there were a number of waste water discharges found that were not compliant with the Regional Freshwater Plan or consent limits, some of which should have been identified by this consent holder when following the site stormwater management plan. An infringement notice was issued as a result. An abatement notice was issued early in the 2014-2015 year as a result of non- provision of information required by special conditions of the consent during the period under review. In relation to discharges to air, there was a non-compliance with special conditions on the consent that resulted in off site odours.

Overall, a good level of environmental performance was achieved by the consent holders in the industrial area of the Mangati Stream catchment.

Historically, chemical and biological monitoring results for the Mangati catchment have shown there to be a two-stage reduction in water quality, one below the main stormwater outlet from Tegel Foods poultry processing plant, the other below the industrial drain which joins the stream at the main highway. During the period under review, only a small reduction in the water quality of the stream was observed, on occasion, downstream of the main industrial discharges, although a reduction in water quality was also observed, on occasion, downstream of the De Havilland Drive and combined Tasman Oil Tools/Greymouth Petroleum stormwater discharges.

Recent biomonitoring surveys had shown a recovery in the reach below Tegel Foods, and above the wetland pond 3 discharge. The results of the biological surveys of the Mangati Stream in 2004-2007 periods indicated that the macroinvertebrate communities in the stream had generally higher numbers of taxa than most past surveys, particularly in the lower part of the catchment. There had been small, but positive trends in relation to the condition of the lower stream following the installation of wetlands treatment in the mid reaches of the stream. During the years under review the biomonitoring surveys concluded that there were no effects due to the discharges upstream of Connett Road. It was found that, although there had been some improvement in the macroinvertebrate communities downstream of the wetland discharges since the discharge of washdown water from BLM Feeds Limited had stopped (late 2010), the results still indicated that there may have been a subtle impact from the wetland pond 3 discharge on three of the four surveys.

Overall MCI and SQMCIs scores indicated that the stream communities were of poor health, but generally typical of the condition recorded in similar Taranaki streams. Although 66 % of the MCI results fell into the “poor” category, 34 % were within the “fair” range. In the October 2012 survey, the MCI score indicated “fair” water quality at the sampling site below the pond 3 discharge for the second time. It is also noted that 12 of the 32 MCI scores recorded were similar to or above the respective historical maximum MCI scores, with new maximums being recorded for five of the biomonitoring sites.

All but 9 % of the SQMCI scores were above their respective medians.

Although this assessment is very general, and does not look at other influencing factors such as seasons, it illustrates that in general the MCI and SQMCIS scores had not deteriorated, and appeared to be improving.

Statistical analysis of the macroinvertebrate data for the Te Rima Place monitoring site (MGT000520), as reported in the Fresh Water Macroinvertebrate Fauna Biological

Monitoring Programme Annual State of the Environment Monitoring Reports for 2012-2013 and 2013-2014, have found that the trend in MCI scores indicated continued improvement coincident with better control and treatment of industrial point source discharges in the upper and mid-catchment and wetland installation in mid catchment. This improvement has continued in recent years. The MCI scores were indicative that the shift from ‘very poor’ to ‘poor’ generic stream health has been maintained during these periods. This trend of improvement in stream ‘health’ at this site is much more pronounced than the trend at the site 1.5 km upstream. This indicates that improvements in the activities in the catchment between these two sites have had a significant beneficial influence, with the rate of decline per kilometre between the monitoring sites being below the historical average rate during three of the four surveys undertaken during the years under review.

The fish survey found that there were a relatively high number of fish found, but that the species diversity was low. It is, however, significant to note that during this current survey a 250 mm giant kokopu was found. The presence of this giant kokopu indicated that preceding water quality immediately below the wetland and industrial drain bypass had been sufficient to support this fish, which was likely to be a number of years old.

In recent years the results tracking the overall quality of the stormwater discharged via the industrial drain and wetlands has indicated improvement, particularly in respect of lower concentrations of zinc and copper. In 2012-2014, this was again generally reflected in relatively low levels for both the acid soluble and dissolved metals, biochemical oxygen demand, chemical oxygen demand, dissolved reactive phosphorus and turbidity.

In contrast it was found that the acid soluble copper, and acid soluble and dissolved zinc, in the discharge to the stream from the tributary below the pipe yards was above median at the time of all three wet weather surveys.

Monitoring of the air discharges within the industrial area found that, with the exception of the Tegel poultry processing plant (as outlined above) the companies were effectively managing this aspect of their environmental performance.

There were a total of 17 substantiated unauthorised incidents recorded during the period under review, 14 of which were related to the consented companies monitored under this catchment programme.

For reference, in the 2012-2013 year, 35% of consent holders in Taranaki monitored through tailored compliance monitoring programmes achieved a high level of environmental performance and compliance with their consents, while another 59% demonstrated a good level of environmental performance and compliance with their consents. In the 2013-2014 year, 60% of consent holders achieved a high level of environmental performance and compliance with their consents, while another 29% demonstrated a good level of environmental performance and compliance.

This report includes recommendations for the 2014-2015 year.

Pacific Natural Gut String Company Limited Monitoring Programme Report 2014-2015

The Pacific Natural Gut String Company Limited (the Company) operates a natural gut processing plant located on SH45 west of Manaia, in the Kaupokonui River catchment. The Company holds a resource consent to allow it to discharge wastewater directly into the Tasman Sea. This report for the period July 2014-June 2015 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the Company’s environmental performance during the period under review, and the results and effects of the Company’s activities.

The Company holds one resource consent, which includes a total of seven conditions setting out the requirements that the Company must satisfy.

During the monitoring period, the Company demonstrated an overall high level of environmental performance.

The Council’s monitoring programme included two inspections, and one water sample collected from the wastewater discharge for physicochemical analysis.

During the 2014-2015 monitoring year, the factory was not in operation and as a result there had been no consent related activity on-site.

The monitoring showed that the wastewater discharge met the consent conditions and as such is not expected to cause any adverse effects on the receiving marine environment. As the factory had been inactive, the wastewater discharge was mainly composed of stormwater runoff from site.

During the year, the Company demonstrated a high level of administrative and environmental performance and compliance with the resource consent.

Trustpower Ltd Motukawa HEP Scheme Monitoring Programme Annual Report 2014-2015

Trustpower Limited (Trustpower) operates the Motukawa hydroelectric power (HEP) scheme in the Manganui River and Waitara River catchment. Trustpower draws water from behind a weir on the Manganui River near Tariki and diverts this water through a race to Lake and then through penstocks to the Motukawa Power Station. The power station discharges into the Makara Stream, a tributary of the Waitara River. Consents for the Motukawa HEP scheme allow Taranaki Generation Ltd to maintain structures, to take, divert and discharge water, and to disturb the bed of Lake Ratapiko. This report for the period July 2014-June 2015 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess Trustpower’s environmental performance during the period under review, and the results and environmental effects of their activities.

Trustpower holds a total of 23 resource consents, which include a total of 186 conditions setting out the requirements that the Company must satisfy. The Company holds five consents to allow it to take and use water, five consents to discharge water or sediment into the Makara, Mangaotea, and Mako streams, one consent to discharge wastes to land around Lake Ratapiko and four land use permits for bed disturbance and structures in the Manganui

River, Mangaotea Stream and Lake Ratapiko. Seven additional consents allow Trustpower to abstract water, and construct and maintain structures in the Mangaotea Stream.

During the period under review, Trustpower demonstrated a good level of environmental performance at the Motukawa power scheme.

The Council’s monitoring for the period under review included nine inspections of fish passage and residual flow facilities, continuous river monitoring at two sites between November and April each year, a biomonitoring survey, and review of abstraction, discharge, and lake and race water level data forwarded by the Company, as well as elver transfer data.

The monitoring showed that during the period under review, the management of abstraction rates, race and lake water levels were generally good. With regard to the management and recording of flows within the diversion race, performance has improved significantly compared to previous monitoring years, with few significant losses of data. There was only one occasion when the maximum water levels within the race and lake were breached during the reported period. This occurred during the flood event of late June 2015, which affected much of eastern Taranaki. A special investigation into this flood event (detailed herein) found that Trustpower had taken all practical steps to minimise flooding, and that the significant flooding that occurred was primarily due to the extremely heavy rain that fell in the area at this time.

Water temperature differences appear to have reduced between natural flows and those in the residual flow reach since the establishment of the 400 litre per second residual flow limit. Over the reported period, there was a slight increase in the number of days that water temperatures in the residual flow reach exceeded 25˚C, all occurring in January 2015. However, the temperature differences between upstream and downstream of the weir were lower than the average.

Macroinvertebrate monitoring indicates improvement at some sites since the increased residual flow was implemented, however elevated water temperatures and denser periphyton substrate cover have affected macroinvertebrate communities of the residual flow reach in more recent surveys. In terms of the current report, it is considered that the communities sampled were representative of more ‘natural’ conditions, as the surveys were preceded by flushing flows. The results indicate that the MCI scores at these sites were higher than most previous surveys, as were the SQMCIS scores, which were almost all significantly higher than their respective medians. However, a similar result was recorded at the control site indicating that there is a catchment wide improvement also.

Overall, the results indicate that the invertebrate community supported by a residual flow of 400 L/s, with regards to presence/absence of taxa, and their respective abundances, is not significantly different to that supported by natural flows. The principal difference between the two flows is that there is a greater amount of invertebrate habitat available under natural flow conditions due to the increased amount of wetted riverbed width.

A significant result of fish monitoring undertaken to date, was the presence of the key indicator species redfin bully, shortjaw kokopu and inanga upstream of the weir. Although no fish monitoring was undertaken in the reported period, previous results indicate that with respect to the management objectives for which the residual flow was developed: • reasonable water quality is being maintained;

• passage for trout is probably being achieved through the residual flow reach and past the weir; • passage for some (but not all) native fish is being achieved in the residual flow reach and it would appear through the fish pass; • habitat of native fish has improved but fish diversity is similar to that recorded prior to the 400 L/s residual flow and may suggest that the objective of ‘some native fish habitat’ is not being achieved for torrentfish, although redfin bullies and inanga have been recorded in the residual flow reach.

Eel and elver passage requirements were generally fulfilled with the elver transfer system at the power station working well. Electric fields have been installed at the intake and forebay and testing indicates that these are successful in deterring fish from these areas. Transfer of adult eels was attempted during each migration season, although due to low numbers only one longfin eel was transferred in the most recent migration season.

During the reported period, Trustpower’s performance was generally maintained at a high level. There were no incidents that warranted enforcement action. There were a number of minor incidents, but due to the swift response of the consent holder, they remained minor, and it is likely no environmental impact resulted.

The improved environment al performance of the consent holder is a result of efforts to improve their internal systems and monitoring of this highly complex scheme. Trustpower has maintained a good level of communication with the Council, including notifying the Council of any breach of consent, no matter how minor. Overall, it is considered that Trustpower was able to demonstrate a good level of environmental performance and compliance with the resource consents, and compliance with the administrative requirements of the consents was high. The reason that the scheme did not achieve a high rating relates to the effects of the flooding that were observed in June 2015. However, it is acknowledged that there was little that Trustpower could have done different at the time to avoid or minimise this flooding and the associated impacts.

This report includes recommendations for the 2015-2016 year.

New Plymouth District Council Inglewood Oxidation Ponds System Monitoring Programme Annual Report 2014-2015

The New Plymouth District Council (NPDC) operates the Inglewood municipal oxidation ponds treatment system located at Inglewood in the Kurapete catchment.

NPDC holds a renewed resource consent allowing for the discharge of treated wastewater overflows to the Kurapete Stream, a small tributary of the Manganui River in the Waitara catchment. Following the successful diversion of all dry weather wastewater inflows from the ponds’ system to the New Plymouth wastewater treatment plant (via the former Moa- Nui dairy pipeline) in late 1999, the renewed consent authorises only intermittent wet weather overflows of treated wastewater to the Kurapete Stream. The previous consent expired in June 2003 and was renewed in September 2004. The renewed resource consent includes a total of 13 special conditions setting out the requirements that NPDC must satisfy.

During the monitoring period New Plymouth District Council demonstrated an overall high level of environmental performance.

This report for the period July 2014 to June 2015 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the environmental performance during the period under review, and the results and effects of the consent holder’s activities.

The Council’s monitoring programme included three regular inspections, one additional inspection, and two biological receiving water surveys. Three short duration overflows (four to nine days) following prolonged and intensive rainfall events, occurred between mid April and late June 2015.

Regular inspections indicated no problems with the ponds’ system maintenance or operation, with no unauthorised overflows to the stream of any nature. Three incidents of stormwater/sewage overflows were reported in the Konini and Brown Streets areas of the township due to surcharging of the reticulation under very heavy rainfall conditions. Reactivation of an alarmed and telemetered overflow site has been necessary to alleviate sewage entry to domestic property. Signage requirements have been recognised and provided for should such events re-occur.

Pond microfloral monitoring which had indicated a trend of improved in-pond conditions under the post-diversion operating regime of maintenance of mainly low main pond levels for stormwater infiltration storage purposes, has been superceded by chlorophyll-a monitoring which although indicating marked variability in microfloral populations, was coincident with relatively high dissolved oxygen saturation levels.

Reduction in stormwater infiltration to the reticulation system had been the subject of completed work, and generally had been successful in reducing the frequency of authorised overflows until very recently. Some overflows have continued to occur, but in compliance with the condition authorised by the consent. However, considerable investigative work has been programmed by the consent holder subsequent to more frequent 2011-2012, 2012-2013, 2013-2014, and 2014-2015 overflow events which have indicated more recent direct stormwater inflows to the reticulation. One major source was found and eliminated during the previous year and the pumping system was replaced with improvements made to delivery capabilities via the pipeline to the New Plymouth waste water treatment plant.

The spring and summer biomonitoring surveys in the Kurapete Stream documented maintenance of the marked recovery in biological communities which had been recorded soon after the diversion of all discharges out of the stream (in late 1999), and the satisfactory sealing of the new outfall. The evaluation of nineteen years of biomonitoring data has highlighted a significant statistical temporal improvement in the biological ‘health’ of the lower reaches of the Kurapete Stream, attributable to the removal of the continuous discharge. The temporal trend has lessened in significance more recently, but stream biological ‘health’ has been maintained at an improved level relative to pre-diversion ‘health’.

Riparian initiatives have been undertaken by most landowners in the Kurapete Stream catchment (twenty-seven plans prepared to date) and the financial contribution provided by the consent holder (as a condition of the previous discharge permit) has been completely utilised.

New Plymouth District Council demonstrated a high level of environmental and administrative performance with the resource consents.

Recommendations include continuation of the reduced monitoring programme formulated for the renewed consent, and provision for timely reporting of each overflow event in order that any additional relevant monitoring can be undertaken. This recognises the marked improvement in receiving water conditions documented in recent years and relative infrequency of overflows from the system over the past eleven years, although it has been noted that the number of these consented overflows has increased in the last six year period.

Gold International Meat Processors Ltd Monitoring Programme Annual Report 2014-2015

Gold International Meat Processors Ltd (the Company) operate an abattoir and rendering plant, located on Mountain Road at Stratford, in the Kahouri Stream catchment, a tributary of the Patea River. The Company processes primarily pigs, but also sheep and beef. Offal, blood and bones were processed on site in the rendering plant, producing meal and tallow. Wastewater is treated in a two pond system, which is either irrigated to land when conditions allowed, or to the Kahouri Stream during high flow conditions. This report for the period July 2014 to June 2015 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the Company’s environmental performance during the period under review, and the results and environmental effects of the Company’s activities.

During the period, the Company demonstrated an overall ‘good’ level for environmental performance and compliance with the resource consents.

The Company holds six resource consents, which include a total of 90 conditions setting out the requirements that the Company must satisfy. The Company holds one consent to allow it to take and use water, two consents to discharge effluent and stormwater into the Kahouri Stream, two consents to discharge wastewater and degenerating product to land, and one consent to discharge emissions into the air at this site.

During the 2014-15 period, throughput at the plant reduced significantly, primarily as the Company was awaiting a license to export to China. It is anticipated that once this license has been issued, throughput will increase significantly.

The Council’s monitoring programme for the period under review included six inspections, 11 water samples collected for physicochemical analysis, and a three site biomonitoring survey of receiving waters.

The monitoring showed that the day to day running of the site was generally of a good standard, with processes in place to minimise the generation of wastewater, and to minimise the contamination of stormwater. The practice of discharging wastewater to the Kahouri Stream during high flow conditions did not cause any recorded impact on the macroinvertebrate communities of this stream, and the impact on water quality was minimal. The irrigation of wastewater was undertaken with no significant adverse effects on the environment, and there was improved performance with regards to the application of nitrogen to land. However, there was improvement still required regarding compliance with the application depth of wastewater. Those paddocks that received excessive nitrogen loadings in the previously reported period did not receive any wastewater in the 2014-15 period. However, despite this, water quality monitoring indicated an increase in ammoniacal

nitrogen in the unnamed tributary as it flowed through these paddocks, although not to the extent as to have a lethal impact on the stream biota. This increase may be due to the historical over application of nitrogen to these paddocks.

There were no incidents recorded in respect of this consent holder during the period under review. In addition, although odour was noted during some inspections, there was no odour noted that was considered likely to cause off-site effects. The rendering plant has closed, and this is likely to reduce the number of odour complaints related to the site. However, it is noted that there may be an increase in the volume of paunch to be processed on site, which can result in odour incidents.

During the period, the Company demonstrated a ‘good’ level for environmental performance and compliance with the resource consents. Administrative compliance was good also.

The previous monitoring report indicated that the Company needed to give a higher priority to consent compliance, and the results of the monitoring undertaken in the 2014-15 period indicates that they have done this. It should be note that the previous report related to when the consents were held by Taranaki Abattoirs Ltd, but that the site was going through a change of ownership, to Gold International Meat Holdings Limited. The consents were transferred to Gold International Meat Processors in October 2014.

South Taranaki District Council Eltham Wastewater Treatment Plant Monitoring Programme Annual Report 2014-2015

The South Taranaki District Council (STDC), operates the Eltham municipal wastewater treatment system located to the east of Eltham in the Mangawhero catchment. STDC holds a resource consent to allow it to discharge treated wastewater to the Mangawhero Stream under high rainfall conditions only. Previously STDC also held a consent for the discharge of emissions into the air but this expired in mid 2011 when it was no longer considered necessary as the nature of the biological processes at the plant met a ‘permitted’ category in the Regional Air Quality Plan. This report for the period July 2014 to June 2015 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the environmental performance during the period under review, and the results and effects of the consent holder’s activities, particularly the environmental improvements associated with recent major modifications to the disposal system. This report also records the state of riparian planting and channel improvement initiatives in the lower Mangawhero catchment. Good progress has been made in terms of riparian fencing and vegetation within both the Mangawhero and Mangawharawhara Streams’ catchments in recent years. Significant modifications to the WWTP included the construction of a new pipeline system and associated pumping and screening facilities (at the WWTP), which were completed in June 2010 and the holding pond (conversion of the wetland) in early 2011. The pipeline transfers the treated wastewater out of the Mangawhero Stream catchment to the Hawera waste water treatment plant (WWTP) system and then to the Tasman Sea through the ocean outfall.

The consent to discharge treated wastewater to the Mangawhero Stream under very high rainfall conditions was granted during the 2009-2010 period to provide for hydraulic overloading of the pumping capacity of the system should such situations eventuate. This consent includes a total of nine special conditions setting out the requirements that the STDC must satisfy. During the monitoring period, South Taranaki District Council demonstrated an overall good level of environmental performance. The Council’s monitoring programme included inspections, odour surveys, and limited biological surveys of the receiving waters of the Mangawhero Stream and Waingongoro River. These latter surveys were a means of documenting anticipated improvements in receiving water conditions in the absence of continuous wastewater discharges (a result of the diverted pipeline to the Hawera WWTP in mid 2010). The upgraded treatment system, although previously identified as extensively overloaded (with industrial dairy wastes), was well maintained and operated during the monitoring year in terms of its general performance. Mechanical aeration of the primary pond was successful in maintaining aerobic conditions throughout the majority of the period, although additional industrial loadings at times placed the system under pressure in terms of maintaining positive dissolved oxygen levels. Although slight localised pond odours were noted on occasions, there were no noticeable odours offsite or complaints received during the monitoring year in relation to normal operating conditions in the ponds. A high level of compliance was achieved with the discharge consent in terms of general conditions, with minimal usage of the converted holding basin, and no overflow discharges at any time. Relatively low dissolved oxygen levels were recorded in the primary oxidation pond during the monitoring period. This pond has had a high bacterial component of its microflora and average algal taxa richness, although certain of these taxa had been indicative of high wastes loadings on the system. An ongoing issue from the previous 2013-2014 monitoring period, associated with the site was the odour resulting from the disposal of a significant volume of surplus buttermilk and contaminated milk within the EADER. This EADER was originally an anaerobic digester pond component at the WWTP but the component had become redundant and was not in use prior to the discharge. The odour incident had resulted in Abatement and Infringement Notices and an Enforcement Order being issued and ultimately in the successful prosecution of both STDC and Fonterra. Subsequent treatment of the EADER wastes by gradual controlled loadings on the primary pond necessitated a marked increase in mechanical aeration and control of gas emissions prior to diversion of these treated wastes by pipeline to the Hawera WWTP. The transfer of the contents of the EADER was almost completed by 30 June 2014 but further odour complaints ensued from local neighbouring properties during 2014-2015, two of which resulted in breaches of the Regional Air Quality Plan. Remediation of the EADER at the time of preparing this report has mainly involved in-filling of the EADER with soil and provision of an improved cover. Minimal buttermilk was transferred from the EADER to the Hawera WWTP during the 2014-2015 period. Overall, with consideration also given to performance in terms of adherence to the Regional Air Quality Plan, environmental performance was good and administrational performance was high. Spring and late summer biological monitoring surveys continued to confirm significant improvements in the biological ‘health’ of the Mangawhero Stream and further downstream in the mid-reaches of the Waingongoro River, compared with pre-wastes diversion

monitoring periods. The significant improvement in biological river/stream ‘health’ can be expected to be maintained now that wastes are completely diverted to the Hawera WWTP via the pipeline which became operative in June 2010. Components of a suitable monitoring programme for 2015-2016 have been identified and included in recommendations. This programme was reduced in complexity in 2012-2013 in recognition of the significant upgrade to the system. Recommendations relating to on-going monitoring of the WWTP consent and further consideration of trade wastes monitoring and additional wastes loadings on the WWTP are also provided.

Greymouth Petroleum Limited - Deep Well Injection Monitoring Programme Report 2014-2015

The following Annual Report by the Taranaki Regional Council (the Council) outlines Greymouth Petroleum Limited’s (the Company) deep well injection (DWI) activities during the monitoring period 1 July 2014 - 30 June 2015. The report provides details of the DWI consents held by the Company during the period under review, and the compliance monitoring programme implemented by the Council with regard to these consents. The report also discusses the results of the monitoring carried out, and provides an assessment of the Company’s performance with regard to consent compliance.

The Company held eight consents throughout the monitoring period for the discharge of fluids by DWI. The consents held by the Company authorise the discharge of a range of fluids by DWI, including water, produced water, contaminated stormwater, waste drilling fluids, ‘off-spec’ stormwater from the Company’s wellsites and well workover fluids (including hydraulic fracturing fluids). The consents include a number of special conditions, setting out specific requirements with which the Company must comply.

During the 2014-2015 monitoring period, the Company exercised five DWI consents. These consents authorised discharges at the Kaimiro-O, Kowhai-A, Kaimiro-J, Turangi-A and Kaimiro-G wellsites.

During the monitoring period, Greymouth Petroleum Limited demonstrated an overall high level of environmental performance.

The monitoring of the Company’s DWI activities by the Council included undertaking inspections of injection operations, the review and assessment of injection data submitted by the Company, and groundwater monitoring in the vicinity of active injection sites.

The Council carried out six inspections of the Company’s active DWI sites during the period under review. Inspection visits comprised liaison with on-site staff, identification of the active injection well, viewing the injection well monitoring equipment and injection logs, and spot sampling of the injectate.

As required by the special conditions of the consents exercised by the Company, the Company supplied the Council with process monitoring data and injection records at the required intervals. Data supplied by the Company was reviewed by the Council on submission. In total, the Company discharged 91,909 cubic metres (m3) of fluids by DWI during the 2014-2015 monitoring period.

The Kowhai-2 injection well, at the Kowhai-A wellsite, was the Company’s most used injection well (by volume) during this period. In total, 35,918 m3 of fluid was discharged from the well during this period. A total of 41,245 m3 of waste fluid was discharged from the Company’s Kaimiro field during the period under review. This was comprised of 13,403 m3 from the K-17 well, 16,960 m3 from the K-11 well and 10,882 m3 from the K-10 well. A total of 14,746 m3 was injected at the Turangi-A wellsite via the Turangi-5 injection well.

The volumes of fluid discharged, and the pressure at which it was injected into the receiving formations, were within the limits specified in the respective resource consents.

The information gathered during inspection visits and the data supplied by the consent holder for Council audit have been used in compiling this report.

The Council did not receive any complaints or register any unauthorised incidents associated with any of the Company’s DWI activities during the 2014-2015 monitoring period.

During the year under review Greymouth Petroleum Limited demonstrated both a high level of environmental and administrative performance and compliance with their resource consents.

For reference, in the 2014-2015 year, 75% of consent holders in Taranaki monitored through tailored compliance monitoring programmes achieved a high level o f environmental performance and compliance with their consents, while another 22% demonstrated a good level of environmental performance and compliance with their consents.

Greymouth Petroleum Limited - Ngatoro-E Hydraulic Fracturing Monitoring Programme Report 2014-2015

Greymouth Petroleum Limited (GPL) operates the Ngatoro-E wellsite, located at 615 Dudley Road, Inglewood. The wellsite lies within the Waitara catchment and contains a hydrocarbon producing well and associated infrastructure.

GPL hold resource consent 9744-1, authorising the discharge of water based hydraulic fracturing fluids into land at depths greater than 3,620 m TVD beneath the Ngatoro-E wellsite. The consent was issued by Taranaki Regional Council (the Council) on 11 December 2013 and contains 16 special conditions which set out the requirements that GPL must satisfy.

The following report for the period July 2014 to June 2015 outlines and discusses the results of the monitoring programme implemented by the Council in relation to the programme of hydraulic fracturing undertaken by GPL, within their Ngatoro-E wellsite. The report also assesses GPL’s level of environmental performance and compliance with the resource consent held in relation to the activity.

During the monitoring period being reported, GPL demonstrated a high level of environmental performance.

The programme of hydraulic fracturing undertaken by GPL at Ngatoro-E included the fracturing of one well; Ngatoro-17. The hydraulic fracturing of this well took place between 3 October 2014 and 15 April 2015.

The programme of monitoring implemented by the Council in relation to these activities spanned the 2014-2015 monitoring period. The programme included the analysis of samples taken from a groundwater site on the wellsite. Samples of groundwater were obtained prior to hydraulic fracturing being undertaken to provide a baseline reference of groundwater composition, with a further round of sampling carried out post hydraulic fracturing for comparison with baseline results.

In addition, samples of both the hydraulic fracturing fluid and the formation fluids produced back to the wellhead immediately following the fracturing event were obtained for analysis.

The monitoring programme also incorporated a surface water component, whereby biomonitoring surveys were undertaken in surface water bodies surrounding the wellsite. In order to provide a baseline reference for stream health, surveys were undertaken prior to hydraulic fracturing. Additional surveys were then carried out post hydraulic fracturing to determine whether the activity had resulted in any adverse effects on stream health.

The monitoring carried out by the Council indicates that the hydraulic fracturing activities undertaken by GPL had no adverse effects on local groundwater or surface water resources. There were no unauthorised incidents recording non-compliance in respect of the resource consent, or provisions in regional plans, during the period under review.

During the year, the Company demonstrated a high level of environmental and administrative performance with the resource consents.

Greymouth Petroleum Limited - Urenui Hydraulic Fracturing Monitoring Programme Report 2014-2015

Greymouth Petroleum Limited (GPL) operates the Urenui-1 wellsite, located at 229 Ohanga Road, Onaero. The wellsite lies within the Onaero catchment and contains a hydrocarbon producing well and associated infrastructure.

GPL hold resource consent 9632-1, authorising the discharge of contaminants associated with hydraulic fracturing activities into land at depths greater than 3,000 m TVD beneath the Urenui-1 wellsite. The consent was issued by Taranaki Regional Council (the Council) on 24 September 2013 and contains 16 special conditions which set out the requirements that GPL must satisfy.

The following report for the period July 2014 to June 2015 outlines and discusses the results of the monitoring programme implemented by the Council in relation to the programme of hydraulic fracturing undertaken by GPL within their Urenui-1 wellsite. The report also assesses GPL’s level of environmental performance and compliance with the resource consent held in relation to the activity.

During the monitoring period being reported, GPL demonstrated a high level of environmental performance.

The programme of hydraulic fracturing undertaken by GPL at Urenui-1 included the fracturing of one well; Urenui-1. The hydraulic fracturing of this well took place on 12 January 2015.

Origin Energy Resources New Zealand - Deep Well Injection Monitoring Programme Report 2014-2015

The following Annual Report by the Taranaki Regional Council (the Council) encompasses the monitoring period 1 July 2014 to 30 June 2015. The report details the deep well injection (DWI) consents held by Origin Energy Resources New Zealand Limited (the Company) during the period under review, outlines the Company’s DWI activities during this period, discusses the monitoring programme implemented by the Council and its results, and also provides an assessment of Company performance with regard to consent compliance.

During the period under review, the Company held a total of three resource consents for the injection of fluids by DWI, permitting discharges from three separate sites in the South and Central Taranaki area. The consents permit the discharge of a range of fluids, including produced water, heated water, contaminated stormwater, water based drilling fluids, and hydraulic fracturing fluids including return fluids. The consents include a number of special conditions which set out specific requirements with which the Company must comply.

During the monitoring period, Origin Energy Resources New Zealand Limited demonstrated an overall high level of environmental performance.

During the period under review, the Council carried out two routine DWI inspection visits. Inspection visits included liaising with on-site staff, identification of the active injection well(s), viewing of the injection well monitoring equipment and injection logs, and the spot sampling of the injectate. In addition to the DWI inspection visits, the Manutahi-D wellsite was visited by Council staff on one occasion in the 2014-2015 monitoring period for inspections relating to other consents held by the Company for various activities at the site.

As required by the special conditions of the DWI consents held by the Company, process monitoring data and injection records were supplied to the Council during the 2014-2015 monitoring period. In total 11,310 cubic metres of fluids were discharged under consent 7905-1. Consents 5503-1 and 6544-1 were not exercised during the 2014-2015 monitoring period. An assessment of process data provided by the consent holder and data gathered during Council inspections do not indicate any potential issues with the integrity of the injection well or the injection zone.

Groundwater monitoring carried out by the Council in the vicinity of the Manutahi-D wellsite does not indicate any contamination of shallow aquifers as a result of injection activities, further supporting the conclusion that the injection wells and injection zone remain secure.

The information gathered during inspection visits and the data supplied by the consent holder have been used in compiling this report.

The Council did not receive any complaints or register any unauthorised incidents associated with any of the Company’s DWI activities during the 2014-2015 monitoring period.

During the year, the Company demonstrated a high level of environmental and a good level of administrative performance with the resource consents.

STDC Hawera Oxidation Ponds Monitoring Programme Report 2014-2015

The South Taranaki District Council (STDC) operates seven municipal oxidation pond systems within the district of South Taranaki. This report, for the period July 2014 to June 2015, focusses on the oxidation ponds system located at Hawera, which has recently been refurbished and comprises an anaerobic pond, two primary/facultative ponds in parallel, and a maturation pond. This report for the period July 2014-June 2015 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess STDC’s environmental performance during the period under review, and the results and environmental effects of STDC’s activities in relation to the Hawera Wastewater Treatment Plant (HWWTP).

STDC holds two resource consents which include a total of 26 conditions setting out the requirements that STDC must satisfy. STDC holds consent 5079-1 for operation of the Hawera oxidation ponds system, and consent 7520-1 to discharge to an unnamed stream in the event of high rainfall. Monitoring was performed to ensure continued maintenance and efficient operation of the treatment system, plus compliance with discharge consent conditions.

During the monitoring period, STDC demonstrated an overall good level of environmental performance.

Since February 2001, the treated wastewater from the HWWTP has been discharged into the Tasman Sea via the marine outfall that also discharges water from the Fonterra Co-operative Group Limited dairy factory at Whareroa. The discharge from the Fonterra Co-operative Group Limited dairy factory is reported on separately (Technical Reports 2013-24 and 2014- 73).

The Council’s monitoring programme over the 2014-2015 period included six site inspections, six pond samples collected for physicochemical analysis, 23 shoreline water samples collected for microbiological analyses, 15 shellfish samples collected for microbiological analyses and two marine ecological surveys.

During the year, STDC demonstrated a good level of environmental performance and a high level of administrative compliance with resource consents at the HWWTP. Dissolved oxygen (DO) levels did not often comply with consent conditions due to on-going maintenance issues with the aerators. DO is monitored to ensure the ponds are functioning appropriately and ensure odours are reduced. While DO levels often did not comply, there were no significant odours from the two aerobic ponds during the monitoring period. No odours were detected off-site.

During the period under review there were no unauthorised incidents reported at the site.

Malandra Downs Ltd Greenwaste Dipsosal Monitoring Programme Report 2014- 2015

Malandra Downs Limited (the Company) holds one resource consent to discharge greenwaste to land for the purposes of dune stabilisation at Albany Road, Patea in the Patea catchment.

Green waste from a Hawera based contractor is transported to the site and discharged over areas of sandy pasture that have undergone aeolian erosion. The green waste helps trap soil and sand and upon decomposition, adds nutrients and condition to the sandy soils.

This report for the period July 2014 to June 2015 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the Company’s environmental performance during the period under review, and the results and environmental effects of the consent holder’s activities. This is the seventh Annual Report for this site.

Malandra Downs Ltd holds one resource consent to discharge green waste to land. This consent has 10 conditions setting out the requirements that the consent holder must satisfy, and was varied during the period under review to allow the use of tomato green house green waste from a specific property.

During the monitoring period, Malandra Downs demonstrated an overall high level of environmental performance and compliance with consent conditions.

The Council’s monitoring programme for the year under review was comprised of two inspections, assessing the types of materials being received and how the discharge to land was being managed.

During the year, the consent holder demonstrated a high level of environmental performance and a high level of administrative performance. During the year under review there were no incidents or complaints recorded or non-compliances observed at inspection.

This report includes recommendations for the 2015-2016 year, including a recommendation that the optional review provided for in June 2016 not be exercised.

Hickman JD 1997 Family Trust Monitoring Programme Report 2014-2015

The Hickman JD 1997 Family Trust (the Company) operates a road transport depot located on Waitara Road at Brixton, Waitara, in the Waiongana catchment. The operations at this site mainly involve packaged dairy related products. Goods are stored under roofed catchments with the remaining areas being paved or gravel. The site also has a truck wash facility with waste water draining to sumps and then to the stormwater system.

This report for the period July 2014 to June 2015 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the Company’s environmental performance during the period under review, and the results and environmental effects of the Company’s activities.

The Company holds one resource consent, which includes a total of six conditions setting out the requirements that the Company must satisfy. The Company holds the consent to allow it to discharge truck washwater and stormwater into an unnamed tributary of the Waiongana Stream.

During the monitoring period, the Company demonstrated an overall high level of environmental performance.

The Council’s monitoring programme for the year under review included four inspections.

The monitoring showed that the discharges to water from the site were not having a significant adverse effect on the receiving environment. There were no unauthorised incidents (UI) recorded in respect of this consent holder during the period under review.

During the year, the Company demonstrated a high level of environmental compliance and a high level of administrative performance with the resource consent.

RKM Farm Limited (Macdonald's Piggery) Monitoring Programme Report 2014- 2015

RKM Farms Limited (the Company) operates a piggery located on 599A South Road at Hawera, in the Tangahoe catchment. The piggery is a breeder, grower and finishing operation with up to 5000 pigs and piglets at any one time, employing between five and six full time staff.

This report for the period July 2014 to June 2015 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the Company’s environmental performance during the period under review, and the results and environmental effects of the Company’s activities.

During the monitoring period, the Company demonstrated an overall high level of environmental performance.

The Company holds two resource consents, which include a total of 13 conditions setting out the requirements that the Company must satisfy. Resource consent 5108-2 allows the discharge of treated effluent into the Tawhiti Stream, and consent 5266-1 relates to the discharge of emissions into the air at this site.

Hey Trust Quarry Monitoring Programme Report 2013-2015

The Hey Trust (the Trust) operates a quarry located on Monmouth Road, Stratford in the Patea catchment. The consent holder holds a resource consent to allow the discharge of treated stormwater from a quarry site onto and into land and into the Kahouri Stream in the Patea catchment. This report for the period July 2013 to June 2015 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the Trust’s environmental performance during the period under review, and the results and environmental effects of the Trust’s activities.

The Trust holds one resource consent, which includes a total of 15 special conditions setting out the requirements that the Trust must satisfy.

During the monitoring period, the Trust demonstrated an overall good level of environmental performance.

The Council’s monitoring programme for the period under review included three inspections. No water samples were collected for laboratory analyses.

Overall the site was found to be well maintained and complying with consent conditions. The first inspection found an issue regarding sediment controls, however this had been remedied prior to the following visit. No adverse effects were observed in the receiving waters.

During the reporting period there were no unauthorised incidents associated with the consent holder.

The Trust achieved a good level of environmental and administrative performance and compliance with the resource consent in the 2013-2015 monitoring period.

DM & DL Bourke Biennial Quarry Monitoring Programme Report 2013-2015

DM & DL Bourke (the Company) operate a quarry located on Onewhaia Road, Normanby in the Waingongoro catchment. The Company holds a resource consent authorising the discharge of treated stormwater into the Waingongoro River. This biennial report for the period July 2013-June 2015 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the Company’s environmental

performance during the period under review, and the results and environmental effects of the Company’s quarrying activities.

The Company holds a resource consent, which includes a total of nine conditions setting out the requirements that the Company must satisfy. This renewed consent was granted in January 2012 for a period expiring in June 2029. The next optional review is in June 2017.

During the monitoring period, the Company demonstrated an overall high level of environmental performance.

The Council’s monitoring programme for the 2013-2015 period included five inspections of the site and receiving waters. No water samples were collected for chemical analyses.

During the 2013-2015 monitoring period the site was found to be generally tidy and well maintained, and as such, any stormwater that was discharged from site was subjected to appropriate treatment. There were no unauthorised incidents associated with the Company’s quarry during this period.

The Company’s quarry achieved a high level of both environmental and administrative performance and compliance with the resource consent in the 2013-2015 monitoring period.

Waverley Bulk Transport Limited Monitoring Programme Report 2013-2015

Waverley Bulk Transport Limited (The Company) operates a dry crushing shell rock quarry located on Rangitatau West Road at Maxwell, in the Waitotara catchment two kilometres from the Makokako Stream. It operates on a commercial basis. This report for the period July 2013–June 2015 describes the monitoring programme implemented by the Taranaki Regional Council (The Council) to assess the Company’s environmental performance during the period under review, and the results and environmental effects of the Company’s activities.

This report addresses two resource consents held by the Company, which includes a total of 16 conditions setting out the requirements that the Company must satisfy. Resource consent 9570-1 permits the discharge of stormwater into and onto land. Resource consent 9972-1.2 permits the discharge of cleanfill onto and into land.

During the monitoring period, the Company demonstrated an overall high level of environmental performance.

The Council’s monitoring programme for the period under review included four inspections. The monitoring showed that the site was being well managed with respect to stormwater treatment controls. No water samples were taken during the monitoring period as it was not warranted upon inspection of the site.

The monitoring showed that there had been no significant adverse effects in the receiving environment as a result of the Company’s quarrying activities. During the period under review, the Company demonstrated a high level of environmental and administrative performance and compliance with the resource consents.

Taunt Contracting Limited Biennial Quarry Monitoring Programme Report 2013-2015

Taunt Contracting Limited (the Company) operates a quarry and shingle washing operation located on Bird Road near Toko, in the Patea catchment. The quarry has been operating for approximately 60 years and mainly provides aggregate for on farm purposes, but has also sold aggregate commercially from the site. This report for the period July 2013 to June 2015 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the Company’s environmental performance during the period under review, and the results and environmental effects of the Company’s activities.

The Company holds one resource consent, which includes 8 conditions setting out the requirements that the Company must satisfy. The consent allows the Company to discharge treated stormwater/washwater into an unnamed tributary of the Patea River.

During the monitoring period, the Company demonstrated an overall high level of environmental performance.

The Council’s monitoring programme for the period under review included two site inspections. It was not necessary to collect samples for analysis during this period.

As in the previous years, the monitoring indicated that the site was complying with the requirements of their resource consent. There were no unauthorised incidents recorded during 2013-2015.

During the period, the Company demonstrated a high level of both administrative and environmental performance and compliance with their resource consent.

Grant Cudby Contracting Limited – Whenuku Road quarry Monitoring Programme Report 2013-2015

Grant Cudby Contracting Limited (the Company) operates a quarry located on Whenuku Road near Normanby, in the Waingongoro catchment. This report for the period July 2013 to June 2015 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the Company’s environmental performance during the period under review, and the results and environmental effects of the Company’s activities.

The Company held one resource consent during the period under review, which included a total of 10 conditions setting out the requirements that the Company would have to satisfy. The resource consent allowed the Company to discharge stormwater into land.

During the monitoring period, the Company demonstrated an overall good level of environmental performance.

The Council’s monitoring programme included four inspections. No water samples were collected for physicochemical analysis.

Routine monitoring found that the site had an adequate stormwater system in place and was generally well maintained. Further investigation in relation to the Company’s quarry expansion proposal revealed issues with the site’s stormwater discharge system and

unauthorised streambed works. The potential environmental effects were considered to be negligible. Subsequently, the existing resource consent has been amended, and additional consents have been granted. There were no Unauthorised Incidents (UIs) recording non- compliance in respect of this consent holder during the period under review.

During the year, the Company demonstrated both a good level of environmental and administrative performance with the resource consent.

C D Boyd – Surrey Road quarry Monitoring Programme Report 2013-2015

C D Boyd (the consent holder) operates a quarry located off Surrey Road at Inglewood, in the Waitara catchment. This report for the period July 2013-June 2015 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the consent holder’s environmental performance during the period under review, and the results and environmental effects of the consent holder’s activities.

The consent holder holds one resource consent to discharge treated stormwater and treated washwater into an unnamed tributary of the Mangamawhete Stream, and onto and into land. It includes a total of 18 conditions setting out the requirements that the consent holder must comply with.

During the monitoring period, the consent holder demonstrated an overall good level of environmental performance.

The Council’s monitoring programme for the period under review included five inspections. No water samples were collected for physicochemical analysis.

During the monitoring period it was found that the site was generally tidy, well maintained and compliant. Silt and sediment controls tended to be suitable for the stormwater runoff generated by the quarrying operation and any deficiencies were promptly resolved.

During the 2013-2015 monitoring period there were no unauthorised incidents associated with the consent holder’s quarry.

The consent holder achieved a good level of environmental and administrative performance and compliance with the resource consent in the 2013-2015 monitoring period.

Burgess and Crowley Limited Monitoring Programme Report 2013-2015

Burgess and Crowley Limited (the Company) operates a quarry located on East Road in Toko, in the Patea catchment. This report for the period July 2013 to June 2015 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the Company’s environmental performance during the period under review, and the results and environmental effects of the Company’s activities.

During the 2013-2015 monitoring period, the Company held four resource consents, which included a total of 38 conditions setting out the requirements that the Company had to satisfy. Of these consents, one was related to the take and diversion of groundwater, two

consents related to stormwater discharge, and one consent related to the discharge of waste onto and into land at this site.

During the monitoring period, the Company demonstrated an overall high level of environmental performance.

The Council’s monitoring programme for the period under review included eight inspections and one water sample collected for physicochemical analysis.

The monitoring showed that the site was processing and storing a lot of product on site at times during the monitoring period. Stormwater was directed to the ponds. During the inspections the silt controls were in place and the stormwater discharge complied with consent limits. The cleanfill area generally looked good.

During the monitoring period, the Company demonstrated a high level of environmental and administrative performance with the resource consents. The Council was not required to undertake significant additional investigations and interventions, or record incidents, in association with the Company’s conditions in resource consents or provisions in Regional Plans.

Osflo Fertiliser Limited Monitoring Programme Report 2013-2015

Osflo Fertiliser Limited (Osflo), formerly Osflo Spreading Industries Limited, operates a facility for storage, blending and distribution of poultry waste fertiliser located on Hursthouse Road, Lepperton, in the Waiongana Catchment. This report for the period July 2013-June 2015 describes the monitoring programme implemented by the Taranaki Regional Council to assess the Company’s environmental performance during the period under review, and the results and environmental effects of the Company’s activities.

The Company holds two resource consents, which included a total of 18 conditions setting out the requirements that the Company must satisfy. The Company holds one consent to allow it to discharge stormwater and treated waste water from the poultry litter storage area into land in the vicinity of the Awai Stream, and one consent to discharge emissions into the air from the use and storage of the used chicken litter. Both consents expired in June 2014 and were replaced at the end of the review period. This represents the twentieth and twenty-first reports on the environmental performance of the Company.

During the period under review, Osflo demonstrated overall improvement required level of environmental performance.

The Council’s monitoring programme for the period under review included four inspections each year, which looked at the plant processes and any potential or actual discharges to the receiving watercourses and to air. Fourteen complaints about odour were investigated; all but one occurred in the 2013-2014 year.

For the water discharges, the monitoring showed that, generally, operations were carried out in a manner that was environmentally sound. The disposal system was improved through construction of a third soakage pit beside the Awai Stream.

For the air emissions, the distinctive chicken litter odour was noted beyond the boundary during most inspections, and most of the investigations into odour complaints. On one

occasion, in April 2014, the odour was found to be offensive and objectionable, for which an abatement notice was issued and an infringement notice was given.

After consultation with neighbours and Council during the consents replacement process, the Company formulated a four-year plan to develop the site for expansion of fertiliser handling capacity while improving odour control and the treatment and disposal of contaminated water. The agreed plan, which is to be completed by 1 June 2019, was incorporated into the new consents.

During the review period, Osflo demonstrated a high level of environmental and administrative performance with the consent to discharge into land and water. For the consent to discharge emissions to air Osflo demonstrated a poor environmental performance, and there was a high level of administrative performance.

Decision-making considerations Part 6 (Planning, decision-making and accountability) of the Local Government Act 2002 has been considered and documented in the preparation of this agenda item. The recommendations made in this item comply with the decision-making obligations of the Act.

Purpose The purpose of this memorandum is to allow the Council to consider and receive the summary of the Incident Register for the period 15 August 2015 to 25 September 2015.

Executive summary There are 81 incidents reported.

24 of the incidents were found to be compliant and 48 were found to be non-compliant. Nine of the incidents reported relate to non-compliance from previous periods (updates). The action taken is set out for Members information.

There are 21 non-compliant incidents reported as a result of the 2015/2016 annual dairy inspection round, from 230 monitoring inspections.

Recommendations That the Taranaki Regional Council: 1. receives this memorandum 2. receives the summary of the Incident Register for the period from 15 August 2015 to 25 September 2015 and adopts the recommendations therein.

Background The Council receives and responds to pollution events and public complaints throughout the year. Compliance monitoring undertaken can also identify non-compliance. This information is recorded in the Incident Register together with the results of investigations and any follow-up actions. Incidents are publicly reported to the Council through the

Consents and Regulatory Committee via the Incident Register or the Annual Compliance Monitoring Reports.

Attached is the summary of the Incident Register for the period from 15 August 2015 to 25 September 2015.

Change of Format to Increase Understanding The incident register information presentation was reviewed in 2014-2015 to increase reader understanding. The first section addresses compliant incidents and can be publically discussed. The second section provides an update on non-complaint incidents from previous meetings and where an incident has been resolved it can be publically discussed. The third section provides information on non-compliant incidents during the period that are still under investigation and staff are limited in terms of public disclosure of information while the investigation is ongoing and enforcement responses have not been determined. The incident register flow chart and definition of terms provide further detail.

Discussion Council responds to all complaints received with most complaints responded to within four hours. Responses to complaints and non-compliances with rules in the Council’s regional plans, resource consents and the Resource Management Act 1991 are recorded in the Incident Register. Where necessary, appropriate advisory or enforcement actions are implemented. The latter may include issuing an inspection, abatement or infringement notice, or initiating a prosecution. Where an infringement notice or prosecution is possible, details of the incident in the Incident Register and staff comment will be restricted for legal reasons. Further information will be provided at a later date to the Council and for prosecutions a detailed report will be provided, in the confidential section of the agenda.

A summary of incidents for the period 15 August 2015 to 25 September 2015 is attached. The ‘compliant’ incidents are presented first in a table and the ‘non-compliant’ incidents are presented after in a more detailed summary.

A series of graphs are also attached comparing the number of incidents between 2014-2015 and 2015-2016, and also showing how the incidents are tracking in 2015-2016 in relation to environment type and compliance status. There is also a graphs showing enforcement action taken to date during 2015-2016. The graphs are for the year to date, up until 2 October 2015, and will show some data outside the date range of the incidents in this report.

Investigation found that a spill of synthetic drilling mud had occurred onsite and some drilling mud had discharged into the stormwater network. Further investigation found that drilling muds had entered the Mangati stormwater treatment ponds. The Company and Council staff undertook an immediate containment and recovery operation in the primary pond. The recovery continued for several days and extensive sampling was undertaken of the receiving environment. No environmental impacts were found in the receiving environment. Enforcement action is being considered.
