It is considered that the proposal does not accord with the principles and policies contained within the Development Plan and is unacceptable in terms of applicable material considerations. 2. Recommendation 2.1 Members are asked to agree the recommendation to refuse as set out in section 11 of the report. 3. PROPOSED DEVELOPMENT 3.1 The application, in principle, is for the erection of a house and associated access and services. 3.2 The application proposes use of an existing access onto the minor road to Tore, which joins the B9161 public road close by its junction with the A9 trunk road to the south. The Highland Licensing Board Agenda 4 Item Meeting – 27 August 2013 Report HLB/107/13 No Consultation on Proposals for Overprovision Statement 2013-16 Report by the Clerk to the Board Summary Following receipt of the evidence and recommendations submitted by NHS Highland attached at Appendix 1 and a further assessment of crime statistics submitted by Police Scotland attached at Appendix 2, the Board is invited to agree options in relation to proposals for an Overprovision Statement on which to consult statutory consultees and the public and to agree an appropriate consultation period. 1. Background 1.1 On 7 August 2013, the Board agreed proposals for the process of developing a statement under section 7 of the Licensing (Scotland) Act 2005 (the “Act) as to the extent to which the Board considers there to be overprovision of licensed premises, or licensed premises of a particular description, in any locality within the Board’s area. This process involved first ingathering evidence, where available, in relation to all of the five licensing objectives, with the assistance, in particular, of NHS Highland and Northern Constabulary – now part of Police Scotland. 1.2 The ingathering and analysis of evidence has taken longer than was initially anticipated and has not been an easy task. This is particularly because of the differences in the way in which data on alcohol-related harm is and has been collected by the various agencies in Highland, some being collected at intermediate geography/data zone level but some being collected at multimember ward level or, in the case of crime statistics, at police area level or police beat level. -

Item Sutherland County Committee Report SCC/ Caithness Committee No 19/16 30 August 2016 31 August 2016 Caithness and Sutherland Local Development Plan Report by Director of Development and Infrastructure Summary This report presents a summary of issues raised in comments received on the Proposed Caithness and Sutherland Local Development Plan (CaSPlan) and seeks approval for the Council’s response to these issues and next steps. In accordance with the Council’s Scheme of Delegation, the two Local Committees are asked to consider the report and decide on these matters. The recommended Council position is to defend the Proposed Plan, subject to only minor modifications, which would mean that the next stage would be submission to Ministers and progression to Examination. Other options would involve further consultation on a Modified Plan. The report explains the implications of each way forward. 1. Background 1.1 The Caithness and Sutherland Local Development Plan (CaSPlan) is the second of three area local development plans to be prepared by the Highland Council. Together with the Highland-wide Local Development Plan (HwLDP) and more detailed Supplementary Guidance, CaSPlan will form part of the Council’s Development Plan against which planning decisions will be made in the Caithness and Sutherland area. 1.2 The Proposed Plan consultation for CaSPlan ran from 22 January to 18 March 2016. Around 201 organisations or individuals responded, raising around 636 comments. This includes a few comments received on the associated Proposed Action Programme. All these comments have been published on the development plans consultation portal consult.highland.gov.uk. -

Representee Comment Whole Policy Text WS General Comment Scottish Water In relation to the Local Plan Map Booklet, we welcome the inclusion of the table prepared for each settlement, suggesting the level of capacity for both water and sewerage treatment. A detailed assessment of the proposed site allocations provided in the map booklet has been undertaken in terms of capacity and future capacity1 of Scottish Water’s infrastructure to accommodate the level of development detailed within the local plan. The capacity data section in the map booklet appears to be consistent with our assessment and the planned future development of our infrastructure. Scottish Natural Heritage Master Planning and Design Statements SNH recommends that relevant PANs such as PAN83 Masterplanning, PAN68 Design Statements are referred to and their requirements consistently applied in relation to housing allocations within1 the Local Plan. DEPOSIT DRAFT NOV 08 RESPONSE - Not done – but para 2.6 1st b/p advises applicants to check the Scottish Government website for current PANs – which are listed in topic order – and SNH has no further comments on this. Scottish Natural Heritage Renewable energy, and some other development related issues will, SNH understands, be taken forward soon in policy terms through the Highland-wide Local Development Plan in order that they can be considered at the Highland rather than at any Area level. -

Kildermorie Hydro-Electric Scheme, Alness, Easter Ross Cultural Heritage and Archaeological Evaluation 1.0 Background A hydro-electric scheme is proposed at Kildermorie, Alness, Easter Ross. This evaluation has been prepared for inclusion in an Environmental Impact Assessment and Environmental Statement on the proposed development, and covers the potential impact of the scheme on the archaeological record and cultural heritage of the area. This evaluation aims to • Identify the cultural heritage baseline within and in the vicinity of the proposed area of the development • Assess the proposed development site in terms of its archaeological and historic environment • Consider the potential impacts of construction and operation of the proposed development on the cultural heritage and archaeological record. • Propose measures (where appropriate) to mitigate any predicted adverse impacts The cultural heritage resource of an area is taken to consist of the following elements which might be adversely affected by the development: • Scheduled Ancient Monuments • Listed Buildings • Designed Landscapes and Gardens • Other archaeological features, conservation areas, historic cemeteries and battlefield sites The evaluation contains the following elements: • A desk-based assessment of the archaeological sites and areas of historical or cultural interest considered likely to be affected by the development. • A field evaluation of the area of the proposed development, to locate known and recorded archaeological sites and areas of archaeological and cultural significance and to identify previously unrecorded sites 2.0 Baseline Conditions 2.1 Archaeological Background 2.1.1 Scheduled Ancient Monuments, Listed Buildings, Gardens and Designed Landscapes There are no sites with statutory protection within the evaluation area or within a zone of potential indirect, visual impact.
