INTRODUCTION The Supreme Court litigation over the Patient Protection and Affordable Care Act (“PPACA”) came to a conclusion in the first half of 2012, characterized by a series of surprises. The first surprise occurred when the Court scheduled the case for six hours of oral argument, spread over three days. Such an expanded argument was unprecedented in modern times, leading to much speculation that the issues would be more troublesome for the Court than many observers had previously assumed.
