RESEARCH PAPER SERIES, 2017–18 14 JUNE 2018 Office of profit under the Crown Professor Anne Twomey, University of Sydney Law School Executive summary • Section 44(iv) of the Constitution provides that a person is incapable of being chosen as a Member of Parliament if he or she holds an ‘office of profit under the Crown’. This is also a ground for disqualification from office for existing members and senators under section 45. There has been considerable uncertainty about what is meant by holding an office of profit under the Crown. • First the person must hold an ‘office’. This is a position to which duties attach of a work-like nature. It is usually, but not always the case, that the office continues to exist independently of the person who holds it. However, a person on the ‘unattached’ list of the public service still holds an office. • Second, it must be an ‘office of profit’. This means that some form of ‘profit’ or remuneration must attach to the office, regardless of whether or not that profit is transferred to the office- holder. Reimbursement of actual expenses does not amount to ‘profit’, but a public servant who is on leave without pay or an office-holder who declines to accept a salary or allowances still holds an office of profit. The source of the profit does not matter. Even if it comes from fees paid by members of the public or other private sources, as long as the profit is attached to the office, that is sufficient. • Third, the office of profit must be ‘under the Crown’. -

THE HONOURABLE JOHN WINSTON HOWARD OM AC Citation for the conferral of Doctor of the University (honoris causa) Chancellor, it is a privilege to present to you and to this gathering, for the award of Doctor of the University (honoris causa), the Honourable John Winston Howard OM AC. The Honourable John Howard is an Australian politician who served as the 25th Prime Minister of Australia from 11 March 1996 to 3 December 2007. He is the second-longest serving Australian Prime Minister after Sir Robert Menzies. Mr Howard was a member of the House of Representatives from 1974 to 2007, representing the Division of Bennelong, New South Wales. He served as Treasurer in the Fraser government from 1977 to 1983 and was Leader of the Liberal Party and Coalition Opposition from 1985 to 1989, which included the 1987 federal election against Bob Hawke. Mr Howard was re-elected as Leader of the Opposition in 1995. He led the Liberal- National coalition to victory at the 1996 federal election, defeating Paul Keating's Labor government and ending a record 13 years of Coalition opposition. The Howard Government was re-elected at the 1998, 2001 and 2004 elections, presiding over a period of strong economic growth and prosperity. During his term as Prime Minister, Mr Howard was a supporter of Charles Sturt University and its work in addressing the needs of rural communities. Mr Howard was integral to the development of local solutions to address the chronic shortage of dentists and oral health professionals in rural and regional Australia. During his term, Mr Howard was a proponent for the establishment of dental schools in rural and regional Australia including at Charles Sturt University in Orange and Wagga Wagga and La Trobe University in Bendigo. -

2 2007 election overview and key issues Background 2.1 The 2007 federal election was announced by the Prime Minister the Hon John Howard MP on Sunday 14 October 2007. Writs for the election were issued on Wednesday 17 October for the House of Representatives election and a half-Senate election.1 2.2 Once the writs are issued, a timetable is specified in the Commonwealth Electoral Act 1918 for a range of tasks and events including the close of the electoral rolls, the nomination of candidates, the declaration of nominations and polling day. The date of other events associated with the election, including the return of the writs, flow on from these events (table 2.1). 2.3 Following amendments to the Commonwealth Electoral Act in 2006, the close of rolls period changed from seven days after the issue of the writ to 8pm on the day the writs for the election are issued for a person enrolling for the first time or re-enrolling after having been removed from the roll. 2.4 The close of roll amendments also provided for a period of three ‘working days’ after the writs are issued for people to complete and submit a proof of identity compliant enrolment form in limited circumstances: if a person is 17 years of age, but will turn 18 between the day after the issue of the writs and election day (inclusive); if a person will become an Australian citizen between the day after the issue of the writs and the day before election day (inclusive); or 1 Australian Electoral Commission, submission 169, p 5. -

International Snapshot: Australia 2007 By Aurelie Marfort IRV system was crucial to ensure democratic results for the last Australian federal legislative election. Introduction: On November 24 th 2007, Australia elected its House of Representatives with instant runoff voting (IRV), as it has for more than eight decades. After four straight election defeats, the Labor Party won a landslide majority of seats. Under IRV, Labor's initial 44% of first choices turned into a clear majority after considering the choices of supporters of third party candidates with too little support to win seats. The Green Party's 7.79% share of the national vote largely went to Labor in House races; that share earned several senate seats elected by proportional voting. Due in large part to compulsory voting, turnout was 94.77%; Australians rank near the top of national comparisons of voter satisfaction with their government. Background: IRV or preferential voting was introduced in Australia in 1918 to deal with the “spoiler” problem created by the rise of the Country Party. Australia’s democracy faced negative side effects with the increased voter choice, as the Country Party split the right-of-center vote in rural areas, thus allowing some left-of-center Labor Party candidates to win with a minority of votes. Prime Minister Bill Hughes’ conservative government enacted IRV so as to allow competition and choice between parties but without putting seats in jeopardy. Since 1918, use of IRV has gradually been extended, and it is now applied to the House of Representatives of the Australian Parliament, in the federal, state and territory legislatures, to municipal elections, party primaries, and for some elections to corporate boards. -

5 Members THE MEMBER’S ROLE This chapter is confined, in the main, to the role of the private Member,1 who may be defined generally as a Member who does not hold any of the following positions: Prime Minister, Speaker, Minister, Parliamentary Secretary, Leader of the Opposition, Deputy Leader of the Opposition, or leader of a recognised party.2 The commonly used term backbencher, which is sometimes used as a synonym of the term private Member, strictly refers to a Member who sits on a back bench as opposed to those Members who sit on the front benches which are reserved for Ministers and members of the opposition executive. The private Member has a number of distinct and sometimes competing roles. His or her responsibilities and loyalties lie with: the House of Representatives but with an overriding duty to the national interest; constituents—he or she has a primary duty to represent their interests; and his or her political party. These roles are discussed briefly below. Parliamentary The national Parliament is the forum for debating legislation and discussing and publicising matters of national and international importance. The role played by the Member in the House is the one with which the general observer is most familiar. In the Chamber (or in the additional forum provided by the Federation Chamber) Members participate in public debate of legislation and government policy. They also have opportunities to elicit information from the Government, and to raise matters of their own concern for discussion. It is this role which probably attracts the most publicity but, at the same time, it is the one which is probably least demanding of a Member’s time. -

As a major metropolitan university, serving Australia's fastest growing, and most culturally and socioeconomically diverse region, Western Sydney University remains committed to supporting its community through the current challenging period and beyond. Legislative reform is an impo1tant opportunity to optimise the cenh·al role universities perform in responding to large-scale labour market dislocation, economic disruption and social upheaval. The Commonwealth's Job-ready Graduates Reform Package is, in the University's view, a mechanism designed to support recovery through structural change, funding efficiencies, and related shifts in emphasis. While supportive of its intent, the University notes the package presents challenges to an institution in a setting like Western Sydney. This is particularly so on the issues of 1) student growth, and 2) support for socioeconomically disadvantaged students. As this submission details, Western Sydney is fares poorly, overall, on both counts under the reforms. Other aspects of the package, such as the 'priority' student places for areas of national interest, are well suited supporting large-scale infrashucture, employment and industry attraction initiatives like the Western Sydney City Deal, the coming airport and Aeroh·opolis. -

MELBOURNE LAW SCHOOL ERRN Electoral Regulation Research Network Newsletter December 2012 Message from the Director and Editor It is our great pleasure to introduce the inaugural newsletter of the Electoral Regulation Research Network, published in conjunction with the Democratic Audit of Australia. The Network was formally established in March this year with the aim of fostering exchange and discussion on research relating to electoral regulation. The Network – a collaborative project between the New South Wales Electoral Commission, the Victorian Electoral Commission and the Melbourne Law School – is an Australian-first and has no equivalent in Canada, New Zealand, the United Kingdom or the United States. It has been an energetic first year for the Network. 16 events have been held across the country under the auspices of the Network and five working papers published. These have dealt with a wide and diverse range of topics relating to electoral regulation from youth electoral participation to integrity in government. Domestic as well as international perspectives have been brought to bear on these topics. The Network’s seminars have been forums where parliamentarians, electoral commission officials, academics and other interested persons and groups can engage in robust discussion of issues related to electoral law, issues that are often controversial. They have also been a vehicle for collaboration with other organisations including electoral commissions and non-government organisations. Bi-annual newsletters are intended to be another key function of the Network. Building on the success of the Democratic Audit of Australia’s efforts, the purposes of these newsletters are twofold: to provide an overview of the state of both research and practice in the field of electoral regulation across the Commonwealth, States and Territories; and to report on the activities of the Network.
