RESEARCH PAPER SERIES, 2017–18 14 JUNE 2018 Office of profit under the Crown Professor Anne Twomey, University of Sydney Law School Executive summary • Section 44(iv) of the Constitution provides that a person is incapable of being chosen as a Member of Parliament if he or she holds an ‘office of profit under the Crown’. This is also a ground for disqualification from office for existing members and senators under section 45. There has been considerable uncertainty about what is meant by holding an office of profit under the Crown. • First the person must hold an ‘office’. This is a position to which duties attach of a work-like nature. It is usually, but not always the case, that the office continues to exist independently of the person who holds it. However, a person on the ‘unattached’ list of the public service still holds an office. • Second, it must be an ‘office of profit’. This means that some form of ‘profit’ or remuneration must attach to the office, regardless of whether or not that profit is transferred to the office- holder. Reimbursement of actual expenses does not amount to ‘profit’, but a public servant who is on leave without pay or an office-holder who declines to accept a salary or allowances still holds an office of profit. The source of the profit does not matter. Even if it comes from fees paid by members of the public or other private sources, as long as the profit is attached to the office, that is sufficient. • Third, the office of profit must be ‘under the Crown’. -

These reforms included changes to redistribution processes, the implementation of public funding of election campaigns and the establishment of the Australian Electoral Commission (AEC). This report continues the tradition of examining and reporting on the conduct of federal elections and relevant legislation which has been carried out by the Joint Standing Committee on Electoral Matters and its predecessor, the Joint Select Committee on Electoral Reform. Federal elections in Australia are remarkably complex logistical events. The 2007 election was the largest electoral event undertaken in Australia’s history, with 13,646,539 electors on the electoral roll, to whom 13,364,359 sets of ballot papers were issued, with some 12,930,814 actually being counted in House of Representatives Elections. Australian citizens enjoy a fundamental right to vote which has its basis in sections 7 and 24 of the Constitution. It is evident, however, that at least 466,794 electors were unable to exercise the franchise correctly at the 2007 election, either because they were not on the electoral roll, or they were on the roll with incomplete or incorrect details. -

In developing and considering the impacts of the redistribution proposal, the Committee has satisfied itself that the proposed boundaries meet the requirements of the Commonwealth Electoral Act 1918 (Electoral Act). The Committee unanimously agreed on the boundaries and names of the proposed electoral divisions, and recommends its redistribution proposal for New South Wales. -

5 Members THE MEMBER’S ROLE This chapter is confined, in the main, to the role of the private Member,1 who may be defined generally as a Member who does not hold any of the following positions: Prime Minister, Speaker, Minister, Parliamentary Secretary, Leader of the Opposition, Deputy Leader of the Opposition, or leader of a recognised party.2 The commonly used term backbencher, which is sometimes used as a synonym of the term private Member, strictly refers to a Member who sits on a back bench as opposed to those Members who sit on the front benches which are reserved for Ministers and members of the opposition executive. The private Member has a number of distinct and sometimes competing roles. His or her responsibilities and loyalties lie with: the House of Representatives but with an overriding duty to the national interest; constituents—he or she has a primary duty to represent their interests; and his or her political party. These roles are discussed briefly below. Parliamentary The national Parliament is the forum for debating legislation and discussing and publicising matters of national and international importance. The role played by the Member in the House is the one with which the general observer is most familiar. In the Chamber (or in the additional forum provided by the Federation Chamber) Members participate in public debate of legislation and government policy. They also have opportunities to elicit information from the Government, and to raise matters of their own concern for discussion. It is this role which probably attracts the most publicity but, at the same time, it is the one which is probably least demanding of a Member’s time. -

As a major metropolitan university, serving Australia's fastest growing, and most culturally and socioeconomically diverse region, Western Sydney University remains committed to supporting its community through the current challenging period and beyond. Legislative reform is an impo1tant opportunity to optimise the cenh·al role universities perform in responding to large-scale labour market dislocation, economic disruption and social upheaval. The Commonwealth's Job-ready Graduates Reform Package is, in the University's view, a mechanism designed to support recovery through structural change, funding efficiencies, and related shifts in emphasis. While supportive of its intent, the University notes the package presents challenges to an institution in a setting like Western Sydney. This is particularly so on the issues of 1) student growth, and 2) support for socioeconomically disadvantaged students. As this submission details, Western Sydney is fares poorly, overall, on both counts under the reforms. Other aspects of the package, such as the 'priority' student places for areas of national interest, are well suited supporting large-scale infrashucture, employment and industry attraction initiatives like the Western Sydney City Deal, the coming airport and Aeroh·opolis. -

There was concern in rural areas over the loss of a country seat— which was also a ‘Federation’ seat—and dismay over the apparent pushing–aside of the ‘community of interest’ principle by the Redistribution Committee. The controversy revealed a lack of community understanding of the redistribution process and an apparent reluctance by the Australian Electoral Commission to engage fully with the public. This paper discusses the controversy, analyses the changes to the redistribution that were made as a result the controversy, and poses the question of whether the redistribution arrangements need alteration. In developing and considering the impacts of the redistribution, the augmented Electoral Commission has satisfied itself that the electoral divisions comply with the requirements of the Commonwealth Electoral Act 1918 (the Electoral Act). The augmented Electoral Commission commends its redistribution for New South Wales. This report is prepared to fulfil the requirements of section 74 of the Electoral Act.
