Lintott found that UPD Sgt. Sean Kaeser and Officer Chris Gordon acted in self defense and in defense of others when they shot Hernan Martinez Perez as he was trying to break into his girlfriend’s home at 495 N. Dora St. on the evening of Dec. 29, 2007. According to police reports, the girlfriend called 911 to report that Perez was banging on her door, that he had assaulter her earlier in the evening, that he had been drinking and that he might be armed. Kaeser and Gordon responded to the house and found that the front window had been shattered and the front doorknob had been broken off. The two officers entered the house where they found Derrick Castillo, a neighbor, holding the back door closed while Perez pounded on it, according to the DA’s report.
