O R D E R Sri Katika Balaji, Mahabubnagar District has filed 2nd appeal dated 01-12-2018 which was received by this Commission on 01-12-2018 for not getting the information sought by him from the PIO / O/o. the Station House Officer, Midjil Police Station, Mahabubnagar District and 1st Appellate Authority / The Circle Inspector of Police, Jadcherla Rural Circle, Mahabubnagar District. The brief facts of the case as per the appeal and other records received along with it are that the appellant herein filed an application dated 12-10-2018 before the PIO requesting to furnish the information under Sec.6(1) of the RTI Act, 2005, on the following points mentioned in his application: TSIC The Public Information Officer has not furnished the information to the appellant. Since the appellant did not receive the information from the Public Information Officer, he filed 1st appeal dated 12-11-2018 before the 1st Appellate Authority requesting him to furnish the information sought by him u/s 19(1) of the RTI Act, 2005. The 1st Appellate Authority / The Circle Inspector of Police, Jadcherla Rural Circle, Vide Letter No. 113/JDL/2018, Dated 20-11-2018, has informed that the copy of FIR was furnished to the appellant and such that he was advised to approach the Hon’ble JFCM court Kalwakurthy and obtain the required certified copies of the case. As the appellant did not get the complete information from the Public Information Officer / 1st Appellate Authority even after 30 days of filing his 1st appeal, he preferred this 2nd appeal before this Commission requesting to take action against the PIO and 1st Appellate Authority for not furnishing information sought by him and also to arrange to furnish the information sought by him u/s 19(3) of the RTI Act, 2005. Note: This is system generated copy and no signature is required. The 2nd appeal was taken on file and notices were issued to both the parties for hearing on 20-1-2020. On 20-1-2020 the case is called. The appellant is present. The Public Information Officer, Sub Inspector of Police, Midjil Police Station is present. The appellant submitted that he did not receive complete information from the PIO. The Public Information Officer did not furnish witnesses statements, medical fitness statements of Anita and K. Srinivas and physical fitness certificate of K. Srinivas in Cr.No.65/2018. The Public Information Officer submitted that the appellant is neither the complainant nor an accused in the said case which relates to woman missing. As per Cr.PC and as per Police Manual the copies of FIR and complaint will be furnished to the complainant. However, through letter dated 20.11.2018 the appellant was informed that copy of FIR was already furnished to the complainant and as such he was advised to approach the Hon’ble JFCM Court, Kalwakurthy for the certified copies of the required documents. The Public Information Officer further submitted that the said case is closed as “action dropped” as the missing woman was traced. Heard the Public Information Officer and perused the records. The Commission observed that the appellant in his 6(1) application is seeking information pertaining to Crime No.65/2018. Admittedly, it is a case of missing of women and the Appellant herein is not the defacto Complainant. The Public Information Officer through letter dated 20.11.2018 furnished factual information to the appellant along with a copy of the FIR. The PIO is directed to take appropriate action u/s 11 of the RTI Act, 2005 with regard to furnishing of remaining information. With the above direction, the appeal is closed.
