Sanjeev Rao and Mrs. Fatima Tahir Informants Through: Shri Rakesh Sanghi and Tushar Ahmed, Advocates Andhra Pradesh Hire Purchase Association & 162 others Opposite Parties Order under Section 26(2) of the Competition Act, 2002 The present information was filed under Section 19(1) (a) of the Competition Act, 2002 (the Act) by the Informants against Andhra Pradesh Hire Purchase Association and 162 others (OP1 and OPs 2 to 163 or collectively the „Opposite Parties‟) alleging cartelization and abuse of dominant position by the Opposite Parties in contravention of the provisions of sections 3and 4 of the Act. 2. The informants, two individuals, had taken auto finance services from the opposite parties 3, 4 and 5.OP-2 to the OP-163were Individuals carrying on auto finance business in the name and style of their respective Sole Proprietorship concerns or corporate names etc. OP-1, a registered Associationunder Section 25 of the Companies Act, 1956, wasformed by OP-2 to OP- 163 in the name and style of Andhra Pradesh Hire Purchase Association. The customers of the Opposite Parties were usually the persons whocould not obtain a loan from a Banking Company in India. 3. The informants alleged that the OP-2to the OP-163were controlling at least 60% of the entire auto finance market in the cities of Hyderabad & Secunderabad. The opposite parties were acting in violation of the provisions of the A.P (Telengana Area) Money Lender‟s Act, 1349 Fasli which mandated that an individual or partnership firm conducting money lending business had to mandatorily obtain Money Lender‟s License under the said Act.Further, the opposite parties were also acting in violation of the provisions contained in the Usurious Loans Act, 1918 which regulated the charging of interest by the opposite parties. -

Chapter 4 Planning, Execution and Utilisation of MMTS, Hyderabad CHAPTER 4 Planning, Execution and Utilisation of Multimodal Commuter Transport System (MMTS), Hyderabad 4.1 Highlights • The project was taken up by the Railways without conducting any independent detailed study before the project investment decision. Selection of routes was not as per the recommendations of the expert consultant agency, indicating improper planning resulting in poor occupancy. (Para 4.9.1) • The project was financially justified on the basis of inflated/incorrect data. (Para 4.9.2) • Inter modal integration measures could not be implemented as envisaged due to poor occupancy. This in turn, further affected occupancy. Only 0.36 lakh passengers per day (10.70 percent) utilised the services as against the projected traffic of 3.36 lakh per day. (Paras 4.9.3 and 4.11.1) • Method of sharing operational costs and profits/losses was not stipulated in MoU. On account of this, transfer of Rs.36.58 crore to the State Government was still pending. (Para 4.9.3) • Departmental charges to the extent of Rs.9.27 crore were not levied by Railways in respect of this cost sharing project. (Para 4.9.3) • POH facilities at Lallaguda were created at a cost of Rs.6.60 crore although the facilities available at Moula Ali Car Shed were sufficient. (Para 4.10) • Assets created at a total cost of Rs.7.13 crore on a model station, additional booking offices, parking lots and subway at a station were idling due to poor patronage. (Para 4.11.2) 4.2 Gist of recommendations • Before making plans for executions of projects, proper feasibility studies should be carried out along with accurate financial justification to ensure expected returns as well as optimal utilisation of the assets created. -

The scope and scale of work at Gandhi Hospital has grown over the years, working collaboratively with Volunteers, Hospital Administration and several partner NPOs like Seva Bharathi, Meenakshi Venkataraman Foundation (MVF), Gandhi Medical College Global Alliance (GMCGA) and Gandhi Medical College Alumni Association (GMCAA). The work has also been supported by individual donors and institutional donors that include United Way of Hyderabad and in a very significant manner in the past three years, by the Tata Trusts. A few significant areas of service that UC is currently engaged in are providing through donor support nearly 25 Nurses for enhancing services at the Medical ICU of Gandhi Hospital, the busiest ICU at Gandhi Hospital, in partnership with Seva Bharathi, providing nearly 20 staff to man helps desks at the Out-Patient Block, Emergency Block and the Labor Room Complex of Gandhi Hospital, and assisting MVF in its newborn hearing screening and intervention program. To enhance the quality of care for the patients, UC recently commenced a Nursing Assistant Skills program in the Emergency Block, wherein about 40-50 patient attendants at the Emergency Block are trained daily in some basic Nursing Assistant Skills at the small skills lab created in the Emergency Block of Gandhi Hospital. The experience and learning gained at Gandhi Hospital has helped UC to sharpen and expand its healthcare services and open-source healthcare IT solutions, to nearly 35 Government Hospitals across Telangana and Andhra Pradesh, and also to other the free healthcare providing institutions like the initiatives run by the Sri Sathya Sai Seva Organizations. -
