Terrorism risk insurance studies provide the backbone of data and analysis to inform appropriate choices for the government’s role in supporting the terrorism insurance market. The research on the eco- nomics of various liability decisions informs the policy decisions of the U.S. Congress and the opinions of state and federal judges. Studies of compensation help Congress to ensure that appropriate compensation is made to the victims of terrorist attacks. Research on security helps to protect critical infrastructure and to improve collective security in rational and cost-effective ways. Wechsler Chief Underwriting Officer President and Chief Executive American Reinsurance Officer RiskPartners NAREIT Preface Intelligence analysts, law enforcement officials, and policymakers have become increasingly concerned about the possibility of future maritime terrorist attacks. The maritime environment possesses some unique characteristics that, in principle, could make it attractive to terrorist operations, including the extraterritoriality of the high seas and poor or inconsistent security measures that apply in coastal areas and facili- ties in many parts of the world. Maritime attacks have the potential to inflict significant harms on persons and property and, in at least some instances, could be highly disruptive to U.S. commerce. This book focuses on the study of terrorism risk and liability issues in connection with two general types of maritime terrorism sce- narios: attacks that target passenger vessels and attacks that target (or leverage) containerized shipping. With regard to analyzing risk, this book explores underlying threats, vulnerabilities, and potential con- sequences, and then combines this information to construct a picture of the relative risks posed by different terrorism scenarios. With regard to analyzing liability, this book outlines key concepts, legal authori- ties, and ambiguities that would apply in determining civil liability for acts of maritime terrorism, focusing particularly on third-party (com- mercial) defendants. By combining the investigation of risk and liabil- ity into a single study, this book offers insights both into the nature of maritime terrorism risk, as well as the ways in which government might respond to that risk through the instrumentality of the civil jus- tice system. This book would be of interest to anyone who is concerned with understanding and managing maritime terrorist risks. vii viii Maritime Terrorism: Risk and Liability This version corrects errors in the book first posted on the RAND Web site in October 2006 and available through January 1, 2007. Errata associated with that version appear on the Web site. The correc- tions affect Figures 6.2, 6.3, 6.4, and 7.2 and Tables A.5 and A.6. As a result of these corrections, the revised version of the book identifies an additional scenario as being high risk; USS Cole–style attacks involving ramming an improvised explosive device into a pas- senger ferry. This additional high-risk scenario is also reflected in the appropriate places in the text. This research was funded by CTRMP, a partnership between RAND and Risk Management Solutions, Inc. CTRMP is funded by voluntary contributions from several organizations that represent prop- erty owners and other insurance purchasers, reinsurers, and insurers. An advisory board that included representatives of the donor organizations was invited to comment on the book, but RAND alone determined the scope, analytical methods, conclusions, and recommendations. This research was conducted under the auspices of RAND Infra- structure, Safety, and Environment (ISE), a division of the RAND Corporation. A new purpose-built fire station fit for 21st century firefighting was opened by Nick Chard, Chairman of the Kent and Medway Fire and Rescue Authority. As of 7 January 2019, it had become home to whole full-time crews and 14 on-call firefighters, together providing an emergency response 24 hours a day, 365 days a year. It is also a base for the British Red Cross, which has a vehicle in the bays alongside the fire engines, ready to respond to incidents that require the charity’s support. I use the term “ferrygate” to refer to the matters under consideration in this Written Evidence. 2. On 28th December 2018 information was published in Tenders Electronic Daily, a supplement to the Official Journal of the European Union relating to three contracts awarded by the Department for Transport for “shipping operations”. 3. The contracts were awarded without a public competition of the kind normally required by Directive 2014/24/EU and the Public Contracts Regulations 2015. 4. The analysis presented in this document leads me to conclude that the Department of Transport has awarded contracts in a manner which is contrary to both UK and European Union Law. 5. I reached that conclusion on the basis of an examination of the contracts as published on 28th December 2018, the text of Directive 2014/24/EU and the Public Contracts Regulations 2015. 6. The Public Contracts Regulations 2015 appear to be the United Kingdom legislation intended to implement the requirements of Directive 2014/24/EU.

Theresa May's deal with the EU is still opposed by most MPs, most members of the Tory party and most people across the entire country. She has been desperately trying to create assurances that would enable the deal to scrape through and avoid "uncharted territory", as she called the alternative. But at the time of writing, that still looks unlikely. It would mean appeasing rebel Tory and DUP MPs by coming up with some seemingly impossible guarantee against an indefinite resort to the EU-insisted "backstop" regarding the Irish border. Alternatively, she can hope that enough Labour MPs would abstain or vote for the deal. But most of the right- wing Labour MPs who have considered this still view it as too great a liability. This hasn't stopped May from continuing to apply pressure, for instance by saying: "MPs of every party will face the same question when the division bell rings. It is a question of profound significance for our democracy and for our constituents. The only way to both honour the result of the referendum and protect jobs and security is by backing the deal." However, rescuing the Tory prime minister won't, at this stage, help the prime objectives of the pro-capitalist Blairite MPs, which are to undermine Jeremy Corbyn and to further their political careers.
