  • COMMENTS the Original Celebrity Champagne Created in 1876 by Louis Roederer to Satisfy Tsar Alexander II of Russia
98 Entertainment Law Review Background The brand at issue in the present case was CRISTAL, COMMENTS the original celebrity champagne created in 1876 by Louis Roederer to satisfy Tsar Alexander II of Russia. At the time, the political situation in Russia was unstable and the Tsar was in constant fear of his life; he commissioned Roederer to produce bottles made of transparent crystal glass with a flat bottom, in order to foil the insertion of explosives in the indentation by would-be assassins—so that he didn’t go out with a “bang”. After the fall of the Russian monarchy in 1917, Roederer decided to continue producing CRISTAL champagne and market it internationally, and the unique flat-bottomed design, glass and cellophane (shown in the pictures below) are now subject to a series of strict patents. CASE 0:06-cv-00213-JNE-SER Document 346 Filed 08/10/10 Page 1 of 77 UNITED STATES DISTRICT COURT DISTRICT OF MINNESOTA Champagne Louis Roederer, Plaintiff, v. Civil No. 06-213 (JNE/SRN) NON-CONFIDENTIAL FINDINGS J. Garcia Carrión, S.A., OF FACT AND NON- and CIV USA, CONFIDENTIAL CONCLUSIONS OF LAW Defendants. Allen W. Hinderaker, Esq., John A. Clifford, Esq., and Heather J. Kliebenstein, Esq., Merchant & Gould P.C., appeared for Plaintiff Champagne Louis Roederer. Peter J. Gleekel, Esq., Michael T. Olsen, Esq., and Bradley J. Walz, Esq., Winthrop & Weinstine, P.A., appeared for Defendants J. Garcia Carrión, S.A., and CIV USA. This matter came before the Court for trial starting on February 10, 2010, and ending on February 24, 2010, to determine whether use of the name CRISTALINO on cava produced by J. Garcia Carrión, S.A., (Carrión) and imported by CIV USA, infringes or dilutes the CRISTAL trademarks of Champagne Louis Roederer (Roederer).1 Based on the evidence received at trial, the Court makes the following Non-Confidential Findings of Fact and Non-Confidential Conclusions of Law.2 1 Roederer filed suit on January 13, 2006. On July 23, 2008, the Court granted the motion for summary judgment of Carrión and CIV USA (collectively, Defendants) on the ground that Roederer’s claims were barred by laches. The United States Court of Appeals for the Eighth Circuit reversed that decision and remanded for further proceedings on June 24, 2009. Champagne Louis Roederer v. J. Garcia Carrión, S.A., 569 F.3d 855 (8th Cir. 2009).

  • Champagne Louis Roederer Cristal Library Pack
CHAMPAGNE LOUIS ROEDERER CRISTAL LIBRARY PACK Jean-Baptiste Lécaillon calls Cristal “the first terroir cuvée of the Champagne.” He furthers, “It’s not just Chardonnay or Pinot Noir, but the chalk that brings the ultimate finesse, length and precision of Cristal.” Forty-five blocks with averaging age of 43-years-old, low-yielding vines form the base of Cristal, which is usually made of approximately 60% Pinot Noir and 40% Chardonnay. — Stephan Reinhardt, The Wine Advocate Cristal 2004 Exceptionally rich and dense, an exceptional wine that reveals itself in layers, from the first fruit attack to the mineral texture and the way it gradually fills the mouth. Selected from old vines, there is a great flavor in this wine, with the promise of many years’ aging. pts. 97 December 2010 CELLAR SELECTION A pale beauty with delicate power, energy and dimension, the 2004 Cristal is an impressive follow-up to the 2002. Scents of apple blossom hint at the depth and clarity of the fruit, layered with ginger and spice in a flavor delivered over the course of several minutes. The freshness of the wine comes through in a subtle hum rather than anything as overt as a buzz, bright, airy and unstoppable. 97 pts. December 2010 Cristal 2006 Broad, ample and resonant on the palate, the 2006 Cristal dazzles with its pure richness and volume. Readers need to give the 2006 another 4-5 years in bottle, perhaps longer. Tasted next to the 2002, today the 2006 is a bit less opulent but just as intense, layered and deep.
