THE BROKEN PROMISES OF AN ALL-VOLUNTEER MILITARY * Matthew Ivey “God and the soldier all men adore[.] In time of trouble—and no more, For when war is over, and all things righted, God is neglected—and the old soldier slighted.”1 “Only when the privileged classes perform military service does the country define the cause as worth young people’s blood. Only when elite youth are on the firing line do war losses become more acceptable.”2 “Non sibi sed patriae”3 INTRODUCTION In the predawn hours of March 11, 2012, Staff Sergeant Robert Bales snuck out of his American military post in Kandahar, Afghanistan, and allegedly murdered seventeen civilians and injured six others in two nearby villages in Panjwai district.4 After Bales purportedly shot or stabbed his victims, he piled their bodies and burned them.5 Bales pleaded guilty to these crimes in June 2013, which spared him the death penalty, and he was sentenced to life in prison without parole.6 How did this former high school football star, model soldier, and once-admired husband and father come to commit some of the most atrocious war crimes in United States history?7 Although there are many likely explanations for Bales’s alleged behavior, one cannot help but to * The author is a Lieutenant Commander in the United States Navy. The Fragility of the Free American Press

West ABSTRACT—President Donald Trump has faced criticism for attacking the press and for abandoning longstanding traditions of accommodating and respecting it. This Essay argues that the national discussion spurred by Trump’s treatment of the press has fallen short of capturing the true seriousness of the situation. Trump’s assault on the custom of press accommodation follows a generation-long collapse of other major press protections. In order to fully understand the critical juncture at which American press freedom now stands, we must expand the discussion beyond talk of a rogue president’s aberrant attacks on the press and consider the increasingly fragile edifice on which the American free press sits. This is because the kind of press we value and need in the United States—one that is free, independent, and democracy-enhancing—does not just occur naturally. Nor is it protected by a single, robust constitutional right. Rather, it is supported by a number of legal and nonlegal pillars, such as the institutional media’s relative financial strength, the goodwill of the public, a mutually dependent relationship with government officials, and the backing of sympathetic judges. Each of these supports has weakened substantially in recent years, leaving the one remaining pillar of tradition and custom to bear more of the weight. Contrary to widespread belief, our concern should not be that Trump might be taking the first step toward crippling the power of the free press, but rather that he might be taking the final step in a process that has long been underway. -

Transition teams formulate policy details and perform the all-important function of vetting potential appointees to staff the next administration. Transition teams have long had quasi-governmental status. Since the Presidential Transition Act of 1963, transition teams of the president-elect have received public funding and office space. Amendments to that act in 2010 and 2015 provided funding for transition teams of presidential nominees for work prior to Election Day, and the laws formalized processes for handoffs between incoming and outgoing administrations.1 Despite the government’s role in funding transitions, laws to ensure transparency and deter conflicts of interest that cover ordinary government work generally do not apply to transition teams. -

Mueller is tasked with investigating Russian interference in the 2016 presidential election and any potential collusion between the Trump campaign and the Russians. This mandate gives the special counsel ample imperative to study an array of links between Trump, Trump associates, and Russia, in a list of concerns that seems to grow by the day. The pace and intensity of this investigation was only highlighted by the recent release of the indictment and guilty plea of Trump campaign adviser George Papadopoulos, who admitted under oath lying to the FBI about his multiple contacts with Russians during the campaign, and acknowledged that the Russians informed him that they possessed “thousands of emails” hacked from Democrats well before any public knowledge of the fact.1 Papadopoulos admitted that he shared information about his Russian contacts and desire to broker meetings with the Russians with his Trump campaign supervisors. -

Russian government influence and potential Trump campaign coordination in the 2016 election FREE SPEECH FOR PEOPLE SPECIAL REPORT 2017-01 MAY 2017 Ron Fein FREE SPEECH FOR PEOPLE Following this report, on December 12, 2016, Senator Mitch McConnell (R-Ky.) and Representative Paul Ryan (R-Wis.) called for an inquiry into possible Russian interference in the 2016 election.4 On January 6, 2017, the Office of the DNI released an unclassified report titled Assessing Russian Activities and Intentions in Recent US Elections (Assessing Russian Activities). 5 This report was an abbreviated, declassified version of a still-classified detailed report provided to the President and presidentially-approved recipients at the highest levels of the U.S. government. The unclassified report states unequivocally in its header that “its conclusions are identical to those in the highly classified assessment.”6 As set forth in Assessing Russian Activities, the Central Intelligence Agency, Federal Bureau of Investigation (FBI), and National Security Agency jointly concluded that “Russian President Vladimir Putin ordered an influence campaign in 2016 aimed at the US presidential election.” The tactics of this influence campaign included “state- funded media, third-party intermediaries, and paid social media users or ‘trolls.’” In pursuing this campaign, “Russia’s goals were to undermine public faith in the US democratic process, denigrate [former U.S. Secretary of State Hillary] Clinton, and harm her electability and potential presidency,” and reflected Russia’s “clear preference for President-elect Trump.”7 II. Russia’s Motive to Interfere in the U.S. Presidential Election According to Assessing Russian Activities, Russia had numerous motives for interfering in the U.S.
