CHAPTER 1: INTRODUCTION

1.1 TITLE OF PROJECT 1.1.1 Name of Project

This Environmental Impact Assessment (EIA) Report for the Project will be terms as “Proposed 2,497 Hectares Reforestation in Bukit Tarek Forest Reserve, Mukim Kerling, District of Hulu Selangor, Selangor Darul Ehsan”. The Project shall be thereafter referred as ‘the Project’ in this report.

The proposed Project is a conversion of the secondary forested area into a high- quality trees plantation, located on a state land with total area of 2,497 ha (6,170.22 ac) at Hutan Simpan Bukit Tarek and Hutan Simpan Bukit Tarek Tambahan in Mukim Kerling, Daerah Hulu Selangor, Selangor Darul Ehsan. The Project area will be developed into high quality trees plantation by using quality rubber tree from the timber-latex clone (TLC) and other forest species.

1.1.2 Location of the Project and Project Accessibility

The proposed Project site is located in within the Hutan Simpan Bukit Tarek and Hutan Simpan Bukit Tarek Tambahan, Mukim Kerling, District of Hulu Selangor (Figure 1.1.1). The proposed Project site (Phase 5 and 6) is located adjoining the northern and southern boundary of the existing developed 1,769 ha area (Phase 0). The Project site, located at approximately latitude from N 03° 35’ 0.41” to N 03° 29’ 24.64” and longitude E 101° 30’ 27.33” to longitude E 101° 37’ 35.84” as shown in Table 1.1.1 and Figure 1.1.2.

The Project site is located about 50 km to the north of the town, 6 km to the east of Kubu Bharu town and 12 km south of town, hugging both sides of the North-South Expressway (NSE) (Figure 1.1.2). The best access to the area (Phase 5 & 6) is through the highway exit 120 at , a semi-abandoned township bordering the plantation. For the Phase 1 – 4, a new main access road to connect with existing road (Jalan Persiaran Zurah 1) in Kawasan Perindustrian Zurah will be constructed.

1.2 PROJECT PROPONENT AND QUALIFIED PERSONS 1.2.1 Project Proponent

The Project Proponent (PP) is Perbadanan Kemajuan Pertanian Selangor (PKPS). It is government agency.

He is responsible to supervise the conduct of the EIA study and coordinate the writing of the entire EIA report. All the other EIA team

1.3 SURROUNDING ENVIRONMENT AND SENSITIVE RECEPTOR

The Project site is located within Hutan Simpan Bukit Tarek and Hutan Simpan Bukit Tarek Tambahan which is reserved for forest plantation activities. The landuse within 500 m radius from the boundary of Project site are predominantly comprises of agriculture and some forest land. Oil palm plantation forms the primary agriculture crops apart of some rubber and orchard plantation. Sg Tinggi Dam catchment is recorded at the north-western of the Project boundary, next to Phase 5 Project site. While Lembah Beringin Golf Club and Kawasan Perindustrian Zurah are the only two developed areas recorded within the 250 m radius, at the eastern of Phase 5 and Phase 1, respectively.

The Project area is located within ESA II but bordering ESA I of Sg Tinggi Dam catchment along the western boundary of Phase 5. Other ESA II area located within the Zone of Study (ZOS) includes small area of Hutan Simpan Bukit Belata on the western of Phase 5, Hutan Simpan Bukit Tarek on the northern of Phase 5, small area at the edge of Hutan Simpan Hulu Selangor on the north-eastern of Phase 4 and a very small area of Hutan Simpan Rantau Panjang (U) at the southwest Project boundary as shown in Figure 1.3.1.

The Project sites are located close to the secondary ecological corridor link area with ecological links recorded on the eastern and western boundaries as well as at the central region bordering Phase 0, 6, 3 and 1. The location of the ecological corridor namely the central forest spine CFS2-SL3 is shown is Figure 1.3.2. Two water intake points are located within the study area i.e. at Sg Tinggi Dam Pump- Refill Scheme and near Sg Rasa Water Treatment Plant.

In general, there is no socially sensitive area was recorded within the Project site up to 250 m radius from the site boundary. The nearest settlements are recorded at around 500 m radius near Lembah Beringin and Rasa. This is followed by Quarters Ladang Termin at around 750 m northwest of Phase 4. Two orang asli settlements namely Kampung Orang Asli (KOA) Kuala Kerling and KOA Sg Jang is located within the ZOS at a distance of around 2 km from Phase 3 and 4.6 km from Phase 4 respectively.

Table 1.3.1 presented the environmental and sensitive receptors that identified within 5-km from the Project site boundary. The detail environmental and socially sensitive receptor within ZOS is discussed in Chapter 6 in landuse section.

1.4 PROJECT BACKGROUND AND SCOPE

The Project Operator, Peninsular Forest Management Sdn Bhd (PFMSB), formerly known as Schrader Forest Management Sdn Bhd has obtained sub-lease agreement from the Perbadanan Kemajuan Pertanian Selangor (PKPS) on 7 March 2001 to develop a 5,000 ha of forest area in Hutan Simpan Bukit Tarek. And, 1,769 ha of the areas have been cultivated and most of the area has been re-planted with rubber tree species of Hevea brasiliensis from the timber-latex clone (TLC) and other timber and herb species such as Azadirachta Excelsa and Hopea Odorata.

On 27 September 2017, the supplementary lease agreement (Appendix 1.1) between PKPS and PFMSB was signed to develop the remaining 2,497 ha of the forest area in the Hutan Simpan Bukit Tarek, to continue with the planned reforestation program.

An EIA report on the overall development of the Project, was approved by the DOE Selangor vide letter Ref: (B) B 12/200/000/003 Jilid (19) dated 12 January 2010 (Appendix 1.2). Subsequently, an EMP was submitted to the DOE Selangor on 23 February 2011 and approval was obtained as per letter Ref: (B) B 12/200/000/003 Jilid 2(8) dated 10 March 2011 (Appendix 1.3).

In 2013 and 2017, PFMSB apply to DOE Selangor for extension of the existing EIA Approval and DOE requested an EIA report for the second schedule to be prepared and submitted by the PKPS to the DOE HQ vide the Ref: (B)B 12/200/000/003 Jld.2 (16) dated 5 December 2017 (Appendix 1.4).

The overall reforestation development layout plan, which was approved by the DOE during the EIA and EMP stages, has been revised on 27 September 2017. The total area for the overall Project development decrease from 5,000 ha to 4,266 ha. The area of 734 ha of the 5,000 ha has been reserved for the rehabilitation program [for the buffer zone and central forest spine (CFS)] as stated in the supplementary lease agreement.

PFMSB through PKPS (Project Proponent, PP) will continue to manage the Project area and the lease term is for period of 59 years until 6 March 2060. This EIA, will focus on the reforestation program to be carried out on 19 compartments which include compartment of 39, 43 & 43 (Phase 1), 35, 36 & 37 (Phase 2), 33, 38 & 42 (Phase 3), 44, 45, 46 & part of the 47 (Phase 4), 5, part of the 13, 11 &12 (Phase 5) and 20, 28 & 31 (Phase 6) with the total area of 2,497 ha (6,170.22 ac).

1.5 LEGAL ASPECTS 1.5.1 Prescribed Activity

As stipulated in the Environmental Quality Act 1974 (Section 34A) and the Environmental Quality (Prescribed Activities) (Environmental Impact Assessment) Order 2015, activities identified as Prescribed Activities are required to conduct an Environmental Impact Assessment (EIA).

The Project falls under:-

Second Schedule,

• Activity 5(b) (i) (Forestry: Logging or conversion of forest to other land use within a catchment area of reservoirs used for municipal water supply, irrigation or hydro-power);

• Activity 5(d) (Forestry: Logging, cutting or taking of timber covering an area of 500 hectare or more); and

• Activity 5(e) (Forestry: Development of planted forest covering an area of 500 hectares or more).

Term of Reference (TOR) for the conduct of this EIA has been prepared and submitted to DOE, Putrajaya on 26 October 2018. Revised TOR was submitted on 14 February 2019 and TOR approval was obtained on 21 March 2019 (Ruj: JAS- 600-2/5/12(23). (Refer Appendix 1.5).

1.5.2 EIA Study Approach

In general, the EIA study was undertaken in accordance with the general guidelines outlined in the EIA Guidelines in Malaysia 2016, EIA Guidelines for Forestry and EIA Guidelines for Agriculture. The relevant Malaysian legislative requirements principally the Environmental Quality Act 1974 (Act 127) and its subsidiary regulations forms the compliance reference for this EIA.

In specifically, the EIA is conducted in accordance to the TOR approved by DOE Putrajaya on 21 March 2019 [Ruj: JAS-600-2/5/12(23), refer Appendix 1.5]. The detail of the study requirements as approved in the TOR for the Project is discussed in detailed in Chapter 2.

1.6 CONFORMANCE OF PROJECT TO GOVERNMENT DEVELOPMENT PLANS 1.6.1 National Physical Plan-3 (NPP-3)

National Physical Plan is a written statement that summarises strategic policies to determine direction for physical development and conservation for the country. This national level planning document form a framework for planning at state and local levels and the macro planning strategies in the document would have to be detailed and/or refined in the State Structure Plan and Local Plan.

NPP-3 is emphasising on economic, social and environmental relations as main components of sustainable development within a holistic ecosystem with three main thrusts:

(i) Thrust 1: Dynamic Urban and Rural Growth (ii) Thrust 2: Spatial Sustainability and Resilience to Climate Change (iii) Thrust 3: Building Inclusive and Liveable Communities

Discussions on the Project in terms of its conformity to NPP-3 are provided below:

Thrust 1: Dynamic Urban and Rural Growth

(i) Tindakan PD1.1A: Mempertingkatkan pembangunan perbandaran di kawasan pertumbuhan semasa – The Project site is located about 6 km away by road from Kuala Kubu Bharu, one of the selected Catalyst Centres. Development and investment such as resource-based and agricultural-based industries are encouraged at the Catalyst Centres; although as indicated in the State Level Spatial Growth Framework, Kuala Kubu Bharu will focus on tourism, transportation, communication and logistic activities (Figure 1.6.1). Timber and latex productions from the Project development is in line with this Action Plan by providing raw materials for furniture and rubber industries development at the area.

Thrust 2: Spatial Sustainability and Resilience to Climate Change

(i) Tindakan KD1.1C: Mewujudkan dan memperkukuhkan pelaksanaan koridor ekologi daratan dan marin – Hutan Simpan Bukit Tarek, where the Project is located at, is next to the secondary ecological corridor link of Central Forest Spine (CFS) namely CFS2-SL3: Hutan Simpan Raja Musa – Hutan Simpan Bukit Tarek – Hutan Simpan Bukit Gading (Figure 1.3.2).

(ii) Tindakan KD1.2A: Mengguna pakai rangka kerja KSAS sebagai asas kawalan pembangunan – Hutan Simpan Bukit Tarek is under Rank 2 and Rank 3 of environmental sensitive area (ESA) (Figure 1.6.2). At Rank 2 ESA, only sustainable logging and low-impact ecotourism activities are allowed (subject to local constraints); while at Rank 3 ESA, controlled development is allowed but the types and intensity of

development are subject to local constraints.

In summary, location of the Project next to the CFS2-SL3 and within Rank 2 & Rank 3 ESAs could be sensitive from ecological point of view. However, from economical point of view, the proposed Project could help to boost development at Kuala Kubu Bharu, which has been selected as one of the Catalyst Centres in the State of Selangor.

Moreover, it should be noted that NPP-3 is a macro planning at national level and the gazettal of ESA as well as the development criteria will be provided in the State and Local Plans. Therefore, conformity of the proposed Project to government development plan shall be referred to the Rancangan Struktur Negeri (RSN) Selangor 2035 and Rancangan Tempatan Daerah Hulu Selangor (RTDHS) 2020. These are discussed in the subsequent Sections.

1.6.2 Rancangan Struktur Negeri (RSN) Selangor 2035

In line with NPP-3, RSN Selangor 2035 is also emphasising on sustainable economic and social development while not to compromise the environment and natural resources of the State, with three main trusts:

(i) Thrust 1: Towards Thriving City Region (ii) Thrust 2: Towards Sustainable City Region (iii) Thrust 3: Towards Prosperous City Region

Discussions on the Project in terms of its conformity to RSN Selangor 2035 are provided below:

Thrust 2: Towards Sustainable City Region

(i) Principal MP1 P1: Menggalakkan pembangunan perbandaran di dalam kawasan yang telah dikenal pasti sebagai kawasan keutamaan perbandaran (KPP) yang dikategorikan kepada KPP 1 dan KPP 2

- Kuala Kubu Bharu has been selected as one of the KKP 1 (Figure 1.6.3), where urban growth is encouraged. As discussed previously under NPP-3, the Project could be a catalyst in achieving the objective to boost development at Kuala Kubu Bharu.

(ii) Principal MP16 P4: Merancang guna tanah mengikut kesesuaian tahap KSAS dan garis panduan yang berkaitan Tahap KSAS

- Under this policy statement, ESA landuse should be planned according to the ESA ranking and guidelines, which in case, shall refer to Garispanduan Perancangan (GPP) Pemuliharaan dan Pembanguan Kawasan Sensitive Alam Sekitar (KSAS) Hutan Simpan Kekal. However, ESA ranking for the State was not provided in the RSN Selangor 2035. Therefore, Local Plan shall be referred.

(iii) Principal MP16 P6: Membangun dan memulihara kawasan hutan simpanan hutan dara dan hutan yang tinggi nilai pemuliharaannya sebagai kawasan arboretum

- Under this planning principal, Hutan Simpan Bukit Tarek is one of the selected forest to be developed and preserved as arboretum. An arboretum is a repository of living plants that are maintained for the primary purpose of research, germplasm conservation and education. Although it is located within Hutan Simpan Bukit Tarek and Hutan Simpan Bukit Tarek Tambahan, the Project site is mostly grown with common lowland and hill trees species and introduced species such as Acacia mangium trees planted in early 1980s under the Compensatory Forest Plantation Project (CFPP) by the Forestry Department.

Therefore, the conservation value is low. Refer to Section 6.8.1 for details.

(iv) Principal MP16 P10: Memastikan semua pembangunan di KSAS perlu merujuk kepada Jawatankuasa KSAS serta menjalankan kajian impak terhadap aspek alam sekitar dan ekologi keseluruhan

- The environmental impacts from this Project were assessed in Chapter 7 of this EIA Report.

(v) Principal MP17 P2: Memastikan perancangan guna tanah mengambil kira rangkaian CFS untuk mengelakkan pemecahan habitat supaya laluan hidupan liar tidak terputus

- As shown in Figure 1.6.4, the proposed Project is located next to the CFS2-SL3 (Hutan Simpan Raja Muda – Hutan Simpan Bukit Tarek – Hutan Simpan Bukit Gading), where fragmentation of habitat should be avoided. As mentioned in Section 1.4, the overall reforestation development layout plan with 5,000 ha which approved in 2011, part of the area was within the CFS2-SL3, however in 2017, a total area of 734 ha has already been surrendered by PP for the rehabilitation program, 125 ha for buffer zone and 609 ha of the area are for the CFS (refer to Appendix 1.1).

(vi) Principal MP26 P2: Memperuntukkan rizab sungai sepertimana garis panduan

- In this Study, Garispanduan Pembangunan Melibatkan Sungai dan Rizab Sungai (DID, 2009) has been referred. Based on field observations, all rivers/ streams flowing through the Project site have channel width between 2 and 6 m. Therefore, river reserve to be provided on each side of river bank should be 5 m for river width < 5 m; and 10 m for river width < 10 m.

1.6.3 Rancangan Tempatan Daerah Hulu Selangor (RTDHS) 2020

RTDHS 2020 is the latest Local Plan gazetted in 2011 (No. Gazette 142), prepared based on NPP-2 and RSN Selangor 2020. The Local Plan refines development principals under NPP and RSN and transforms them into planning guidelines supplemented with plans and written statements.

Under RTDHS 2020, the District was aimed to be developed into Catalyst for Development of Northern Region Selangor, with seven main thrusts:

(i) Thrust 1: Optimum Landuse Balance (ii) Thrust 2: Progressive Catalyst Economy (iii) Thrust 3: Sustainable Environmental Conservation and Preservation (iv) Thrust 4: Planning and Strengthening of Service Centres (v) Thrust 5: Dynamic Development of Brownfield (vi) Thrust 6: Improving Efficiency of Integrated Accessibility (vii) Thrust 7: Improving Good Governance and Quality of Life

Discussions on the Project in terms of its conformity to RTDHS 2020 are provided below:

Thrust 1: Optimum Landuse Balance

(i) Strategi 1: Peningkatan Keseimbangan Spatial – Under this Strategy, the Project site is located within forest reserve zone to be preserved as ESA.

(ii) Strategi 2: Pembangunan Perbandaran Berfungsi dan Berhierarki – Kuala Kubu Bharu is selected as State Region Partial Centre, which functions to be a district centre, heritage and tourism city as well as transition city to tourism centre Bukit Fraser. In this context, the proposed Project would neither contribute nor jeopardise the development planned for the town.

(iii) Strategi 3: Pembangunan Koridor dan Kluster – Under this Strategy, Kuala Kubu Bharu and Lembah Beringin that are located adjacent to the Project site would be encouraged to develop into tourism corridor and institution & agricultural corridor, respectively. No significant impact is expected from the Project activities on this development strategy.

Thrust 3: Sustainable Environmental Conservation and Preservation (For Environment)

(i) Strategi 1: Mewujudkan Pelan Pengurusan Kawasan Sensitif Alam Sekitar (KSAS) – Cadangan 1 “Pengurusan Kawasan Sensitif Alam Sekitar (KSAS)”: The proposed Project is in line with the Local Plan as it has been categorised under Rank 2 ESA (Figure 1.3.1) for timber production (Figure 1.6.5) and

life supporting. However, it should also be noted that the Project site is next to the secondary linkage of CFS to connect Hutan Simpan Raja Muda Musa, Hutan Simpan Bukit Belata and Hutan Simpan Rantau Panjang to Hutan Simpan Bukit Gading (Figure 1.6.5). In addition, as mentioned in Section 1.4, a separate area of 609 ha has already been surrendered by the PP for CFS program. With implementation of sustainable reforestation management, the proposed Project will not likely to affect the CFS secondary linkage.

(ii) Strategi 2: Pemantauan Kualiti Alam Sekitar Secara Berterusan – Cadangan 2 “Pengurusan Kualiti Alam Sekitar”: Wastes from the proposed Project should be properly managed and regular environmental monitoring to be conducted throughout the Project implementation.

1.6.4 National Policy on Biological Diversity 2016 – 2025

The relevant key actions stated under the Policy that should be looked into at this planning stage of the proposed Project are discussed below:

(i) Action 4.1(a): Ensure that all our production forests obtain certification under the Malaysian Timber Certification Scheme (MTCS) and/or other internationally recognised schemes

- The Selangor Forest Management Unit (FMU) was issued with a Forest Management Certificate under the MTCS for a natural forest area of 238,474 ha. The Project area, excluded from the certified area, has been leased by State to the PP for harvesting and replanting.

(ii) Action 4.1(g): Ensure that forest plantations, including timber latex clone plantations, are only developed outside ESA/ high conservation value (HCV) areas and that they avoid areas that are crucial for wildlife movement

- The Project area with Rank 2 ESA has been leased by the State Government of Selangor to the PP for harvesting and replanting. In addition, the area is demarcated for forest plantation landuse under the RTDHS 2020, in line with the government policy to encourage large- scale commercial forest plantations. However, knowing the importance of wildlife corridor preservation under CFS program, a separate land of 734 ha was surrendered by the PP for buffer zone and CFS.

1.6.5 Central Forest Spine Pelan Induk Rangkaian Ekologi

In reference to the Central Forest Spine Pelan Induk Rangkaian Ekologi, main objective of the CFS2-SL3 is to maintain continuity of forest between Peat Swamp in Northern Selangor and Main Range (Titiwangsa).

Under the Plan, sustainable agricultural development is required within and surrounding the corridor. The PP will conduct sustainable reforestation management practices throughout the Project implementation. He will also monitor closely on the reforestation operation to: (i) prevent trespassing of human settlement and agricultural activities; and (ii) prohibit wildlife poaching activities within the Project area, complying with the requirements under the Plan.

1.6.6 Garis Panduan Perancangan (GPP) Pemuliharaan dan Pembangunan Kawasan Sensitif Alam Sekitar (KSAS) Hutan Simpan Kekal

The Project site within Hutan Simpan Bukit Tarek and Hutan Simpan Bukit Tarek Tambahan is categorised under Dipterocarp Forest (Low Land/ Hill). These categories of forest are under Rank 3 ESA as stated in Jadual 3: Garis pandusan khusus pembangunan dan pemuliharaan hutan simpan of the Guidelines.
