1 Philosophical Statism and the Illusions of Citizenship Reflections on the Neutral State Frank van Dun ∗ Is the welfare state neutral to personal morality? 1 In today's welfare states one can find numerous life-styles existing side by side. These indicate a wide scope for 'personal mo- ralities' 2, but do not prove that the welfare state is 'neutral' to them. Welfare states interfere in more or less onerous ways with the business of (private) life with police checks, administrative controls and a vast arsenal of regulatory, penal and/or fiscal regimes. Some of the regulations may be more or less reasonable attempts to minimise the risk of one person inflicting irreparable damage on others or their property, but a great many are not. It is not too difficult to see the hand of special (economic, ideological, even sectarian) interests in the bulk of the rules and regulations on the books. 3 The state's non-neutrality is often an unintended outcome, but not always. Officials introduce new regulations with proud declarations of their intention to enforce particular 'moral choices', to treat one thing as a 'merit good' and another as an evil. They also justify intrusive policies with blatantly paternalistic arguments—remember their promise, or was it threat, to take care of us "from the cradle to the grave"—, with self-congratulatory references to an unspecified 'responsibility of the government'. There is no more direct negation of the role of private mo- rality than the claim that one discharges one's own responsibility by depriving others of the opportunity to exercise theirs. -

Since the publication of John Rawls’ magnum opus A Theory of Justice in 1971, there has been a significant resurgence of philosophical work in the tradition of contractarianism. The distinguished bourgeois political philosopher Robert Nozick has argued that A Theory of Justice is one of the most important works in political philosophy since the writings of John Stuart Mill. “Political philosophers,” Nozick concludes, “now must either work within Rawls’ theory or explain why.”1 It is not far from the truth that Rawls single-handedly not only gave life to analytical political philosophy, but also resuscitated contractarianism, a philosophical tradition that — in many respects — had been lying dormant in a philosophical coma. In fact, social contract theory has become the hegemonic tradition in liberal social and political philosophy. Flora Iowa State University Social Contract Early social theorists (Thomas Hobbes, John Locke, and Jean-Jacques Rousseau) were intrigued by the notion of order and the mutual obligation it entails. For them, a critical part of social order is the relation between the ruler and the ruled, which includes collective agreement on the criteria for distinguishing right behavior from wrong, and enforcing right action. Why do the vast majority of people do what they are supposed to do? Hobbes addressed the question by theorizing what he felt separated "civilized" society from savagery. The "state of nature," according to Hobbes, was based on each person gaining the most possible on an individual basis, resulting in a life that was "solitary, poor, nasty, brutish and short." Only when individuals, through a social contract, give up their individual liberty to a sovereign committed to defending the subjects' lives in exchange for obedience to the sovereign's rules, does order, and thus security, emerge. The Hobbesian argument justifies the power of the sovereign. If citizens do not obey the rules, harsh and even extreme punishment isj ustifiable, indeed, necessary. Locke differed from Hobbes in his view of history. He argued that the rights of life and property were recognized under natural law. Insecurity arose from lack of clarity as to who was to enforce those rights. The social contract involves individuals agreeing to obey the laws of the state in exchange for the state's protection of the person and property. -

To What Extent is Squatting an Alternative to Capitalism? Squatting in Europe Beyond the Housing Question Miguel Martínez, Claudio Cattaneo Abstract Is squatting a feasible alternative to the housing problems within the capitalist system? Is squatting only a marginal activity undertaken by people in need who are motivated against the rule of capitalism? Is squatting no more than a temporary reaction, to the unsolved “housing question” in the current crisis due to the malfunctioning of the capitalist mechanisms? In spite of several decades of social and political squatting, most of these questions remain very controversial nowadays. In this article we argue that there are evidences in both the practice and the discourse of political squatters, that various forms of alternatives, interferences and challenges to the capitalist system are actually developed. In addition, squatting not only satisfies housing needs, but also other social needs within a context of political experiments of self-management and autonomous mobilisation against many facets of capitalism and urban speculation. However, we also raise the question of the limits and contradictions of such an alternative. These can occur when the squatting experiences are isolated, when they carry on internal reproduction of capitalist relationships or when the capitalist and urban growth machine is not really affected by occasional cases of squatting. This ambivalence may explain the usually opposed approaches that squatting receives in the political arena. Therefore, it is not just a matter of turning every form of squatting into a political anti-capitalist collective what can contribute to enhance its anti-capitalist struggle, but the depth of the contentious interactions with the capitalist processes, and contradictions as well, in which the squatters movements engage. -

Unequal Societies: Income Distribution and the Social Contract By ROLAND BE´NABOU* This paper develops a theory of inequality and the social contract aiming to explain how countries with similar economic and political “fundamentals” can sustain such different systems of social insurance, fiscal redistribution, and education finance as those of the United States and Western Europe. With imperfect credit and insurance markets some redistributive policies can improve ex ante welfare, and this implies that their political support tends to decrease with inequality. Conversely, with credit constraints, lower redistribution translates into more persistent inequality; hence the potential for multiple steady states, with mutually reinforcing high inequality and low redistribution, or vice versa. Sci., xlviii (2010) THE ORDER OF THE PROPHETS: SERIES IN EARLY FRENCH SOCIAL SCIENCE AND SOCIALISM John Tresch University of Pennsylvania Everything that can be thought by the mind or perceived by the senses is necessarily a series.1 According to the editors of an influential text in the history of social science, “in the first half of the nineteenth century the expression series seemed destined to a great philosophical future”.2 The expression itself seems to encourage speculation on destiny. Elements laid out in a temporal sequence ask to be continued through the addition of subsequent terms. “Series” were particularly prominent in the French Restoration and July Monarchy (1815–48) in works announcing a new social science. For example, the physician and republican conspirator J. P. B. Buchez, a former fol- lower of Henri de Saint-Simon who led a movement of Catholic social reform, made “series” central to his Introduction à la science de l’histoire. Mathematical series show a “progression”, not “a simple succession of unrelated numbers”; in human history, we discover two simultaneous series: “one growing, that of good; one diminishing, that of evil.” The inevitability of positive progress was confirmed by recent findings in physiology, zoology and geology. Correlations between the developmental stages of organisms, species, and the Earth were proof that humanity’s presence in the world “was no accident”, and that “labour, devotion and sacrifice” were part of the “universal order”. The “great law of progress” pointed toward a socialist republic in fulfilment both of scripture and of the promise of 1789.
