Acts, 1956. — Chap. 711. 729 tracts and agreements and do all other things necessary to co-operate with the United States in the construction of highways now located within the area of certain projects, which are authorized by congress under the flood control acts of June twenty-second, nineteen hundred and thirty- six, June twent3''-eighth, ninet^een hundred and thirty-eight and December twent3''-second, nineteen hundred and fiftj''- five and all other acts amendatory thereto, and which are specified in chapter six hundred and thirteen of the acts of nineteen hundred and fifty-six. Land or rights in land may be acquired for such highways by eminent domain under chapter seventy-nine of the Gen- eral Laws by the department in behalf of the commonwealth, or in behalf of the city or town in which the land lies, at the option of the department. Section twenty-five of chapter eighty-one of the General Laws shall apply to highways laid out or constructed under authority of this act. Section 2. For the purposes authorized by this act the department may use any funds which may be available for the construction and maintenance of state highways, and aU reimbursements from the United States for sums so ex- pended shall be received by the state treasurer and shall be expended upon the order or approval of the department without specific appropriation. Section 3. The department is hereby authorized to aban- don to the United States any land or rights in land which may have been taken or acquu'ed by it and which are within the area of said projects; provided, that the United States has acquired the title to the abutting land in conformity with said chapter six hundred and thirteen of the acts of nineteen hundred and fifty-six. Whereas, The deferred operation of this act would tend p^ambiT^' to defeat its purpose, which is to provide funds immediately for a special capital outlay program for the commonwealth, therefore it is hereby declared to be an emergency law, neces- sary for the immediate preservation of the public conven- ience. Be it enacted, etc., as follows: Section L To provide for a special program of con- struction, reconstruction, alteration and improvement of various state institutions and properties, and for the pur- chase of certain property, the sums set forth in section two of this act, for the several purposes and subject to the con- ditions specified in said section two, are hereby made avail- able, subject to the provisions of law regulating the disburse- ment of pubhc funds and the approval thereof. 730 Acts, 1956. — Chap. 711. SI 57-09 For the reimbursement to cities and towns for the state's share of airport construction as provided in sections ttdrty-nine F and fifty-one K of chapter ninety of the General Laws, as amended, to be available for matching federal funds for the fiscal year Acts, 1956. — Chap. 711. 731 Item nineteen hundred and fifty-seven and suc- ceeding years, to be in addition to the amount appropriated in item 8356-28 of section two of chapter seven hundred and thirty-eight of the acts of nineteen hundred and fifty-five; provided, tliat this item shall not be subject to section thirty A of 00 chapter seven of the General Laws . $400,000 Service of the Department of Natural Resources. 8157-10 For the acquisition by gift, transfer or pur- chase and the development of certain new areas and for the development of existing areas within state parks and forests, to be selected by the commissioner with the ap- proval of the board of natural resources; provided, that in the selection the commis- sioner shall give consideration to projects included in the following house documents of the year nineteen hundred and fifty-six: numbers forty-eight, three hundred and forty-nine, four hundred and twenty-one, six hundred and ninety-nine, nine hundred and seven, one thousand seven hundred and forty-two, one thousand nine hundred and twenty, two thousand and ninety-two, two thousand and ninety-three, two thou- sand and ninety-four and two thousand six hundred; and, provided further, that no payment shall be made from this item for the purchase of land until an independ- ent appraisal of the value of said land has been made by a quahfied, disinterested ap- praiser, and the acquisition of any addi- > tionai land shall require the approval of the commission on administration and finance; and, provided further, that the provisions of section thirty A of chapter seven of the General Laws shall not apply to expenditures made from this item; and, provided further, that to cover this item the comptroller shall include in the assess- ment made under the provisions of section five of chapter one hundred and thirty-two A of the General Laws the sum of thirty-one thousand two hundred and fifty dollars yearly for the years nineteen hundred and fifty-eight to nineteen hundred and seventy-seven, inclusive, and shall credit said amount to the General Fund, to be in addition to the amount appropriated in item 8256-09 of section two of chapter seven hundred and thirty-eight of the acts of nineteen hundred and fifty-five . $500,000 00 8157-72 To continue the survey and inventory of the resources of the commonwealth as author- ized by chapter four hundred and seventy- one of the acts of nineteen hundred and fifty-five, as amended, to be in addition to the amount appropriated by item 1001-05 of section two of chapter seven hundred and eighty-four of the acts of nineteen hun- dred and fifty-five 50,000 00 732 Acts, 1956. — Chap. 711.
