Category of Projects: 1(a) category B

 SMPL has originally submitted two individual and separate applications for grant of EC for Laterite and Bauxite mining leases under violation category.  These applications were considered during the 9th EAC Meeting of the Violation Committee held on 27th June 2018.  During the above meeting, EAC has suggested to submit a combined application for both the minerals Laterite and Bauxite for assessment of remediation plan and community and resource augmentation plan  The committee also solicited additional information which was mentioned in the MoM of the 9thEAC Meeting.  MOEF&CC recommended the ToR for the project vide its letter no. 23- 155/2018-IA. III (V) dated 16thJanuary 2020 and Project is transferred to SEAC, Gujarat as project is falls under B category as per the amended EIA notification 2006 dtd 14.08/2018.  Online EIA report submitted to SEAC Gujarat on 13th Feb 2020 covering compliance of ToR points given by MoEF&CC and SEAC Gujarat  As per the ToR issued by MoEF& CC,it was noted that Public Hearing (PH) was Conducted on 20th November 2015 covering all Issues,hence EAC exempted public hearing.  Public Hearing for Bauxite mine was conducted on 20/11/2015  Public Hearing for Laterite mine was conducted on 28/01/2016 Status of the Project: New (Violation)

Project Details:

 The lease area of 90.5279 Ha is located in Survey Nos. 184, 185, 286, 290, 299 & 300 and lease area 65.3971 Ha Survey Nos. 185, 286, 290, & 299 in village Palakhada of Porbandar Taluka, District Porbandar, Gujarat.  Laterite lease was granted Order No. MCR/1571/S-126/7931-CHH/1331 dated 15.10.1980 issued by the Govt of Gujarat and the lease deed was executed on 11.02.1981 for a period of 20 years i.e. from 1981 to 2001 and renewed vide Order No. MCR-1501-2734-CHH dated 12.07.2004 for a period of twenty years from 10.02.2001 to 09.02.2021.Govt of Gujarat has further extended the validity upto 31.03.2030 vide Gujarat Minor Mineral Concession Rules, as per Rule 12, sub rule (1) (a), which relate to the extension of the lease period for minor mineral leases on government land.  Bauxite lease was vide Order No. MCR/1581/S-211/5576 (iii)-CHH dated 29/08/1981 issued by the Govt of Gujarat and the lease deed was by executed on 16/11/1981 for a period of 20 years i.e. from 1981 to 2001 and renewed vide Order No. MCR-1580-2734-CHH dated 12.07.2004 for a period of twenty years i.e. from 16.11.2001 to 15.11.2021.As per MMDR Amendment Act 2015 sub sections 5 and 6

of section 8A the mining lease is deemed to have been granted for 50 years and the lease validity is now up to the year 2031.  The proposed project is for 76,520 TPA ROM of Laterite &1,78,794 TPA ROM of Bauxite Mining  As per the approved mining plan, mining will be carried out without the use of drilling and blasting.  Laterite and Bauxite are present at the surface and are soft in nature. There is not much overburden and therefore there is no plan for drilling and blasting. It is a basic truck and shovel mining operation without the use of explosives. Machinery required for Laterite and Bauxite mining is an excavator and tipper and one pump for dewatering during rainy season.  Details of surrounding location with reference to the study area is as below

According to the CER office memorandum dated 01st May, 2018 of MoEF&CC the CER budget for 5 years comes to INR 4.9 lakhs i.e. 2% of project cost INR 245 lacs being a green field project. According to the State Committee ToR for violation cases shall pursue CER activities for the amount double than arise from the actual provision as per MoEFCC office memorandum which comes to INR 9.8 lakhs for 5 years.

As project falls under violation category, Gujarat Pollution Control Board had filed Violation Case Nos. 2819/13 and 2820/13 against company on 19.09.2013 under the provision of section 19 of Environmental (Protection) Act 1986.It is mentioned that after filing of the violation case, our company has not carried out any mining at the site. Violation Case Nos. 2819/13 and 2820/13 were compounded and settled during the LokAdalat at Porbandar on 11.02.2017.Orders thereto for both matters were passed by Addl. Chief Judicial Magistrate, Porbandar Court on 11.02.2017. The Project Proponent Company as well as its Directors individually have paid the fine imposed by the court. Deliberation Committee noted that the proposal does not fall in CRZ and in cluster of homogeneous mineral. There is no intersection of ground water table due to working. Committed asked PP to explain component of the project cost considered and asked to resubmit the same considering the upfront cost,performance security,total royalty,weigh bridge cost,labor cost equipment,environment protection and implementation cost, green belt development and maintenance cost, cost for post closure mine plan including total cost of back filling of mined out pit as per the OM of MOEF&CC dated 16/01/2020 mentioning that after ceasing mining operations, PP shall undertake re-grassing the mining area and any other area which have been disturbed due to their mining activities and restore the land to a condition which is for the growth of fodder, flora and faunaetc. After correction if the project cost, PP was asked to resubmit outlay of CER over 5 years. Committee felt that CER shall be prepared pertaining to the public hearing involving issues pertaining to the backfilling of mined out pit, blasting and associated impact mitigation, fugitive emission due to mine work including its impact on crop in fileds, fencing toavoid casualty, salinity ingress etc. It is also noted by the committee that the nearest village is Palakhada which is less than 500 meter from the boundary of the lease area hence committee askedPP to leave distance of more than 500 meter as a safety barrier from the nearest human habitation considering the shortest aerial distance from outer periphery of the lease boundary.It is also deliberated that due to the reduction in lease area for maintaining the safety barrier of 500 meter, lease area for Laterite and Bauxite, their mining reserve and accordingly rate of mining for both the minerals are required to be readdressed.. After deliberation it was decided to consider the proposal after submission of the following details in one of the upcoming SEAC meeting. 1. Revised project cost considering the upfront cost, performance security, total royalty, weigh bridge cost, labor cost equipment, environment protection and implementation cost, green belt development and maintenance cost, cost for post closure mine plan including total cost of back filling of mined out pit as per the OM of MOEF&CC dated 16/01/2020.

2. To resubmit remediation plan and natural and community resource augmentation plan for the amount as per the indicative guideline approved by SEIAA, Gujarat OR equivalent to the revised CER amount as per the MOEF&CC‟s office Memorandum No: F NO 22-65/2017-IA-III dated 01/05/2018, whichever is higher.A Remediation Plan and Natural and Community Resource Augmentation Plan shall be based on focus group discussion with nearby villagers and their requirement with details of (a) activities (b) associated environmental/social attribute (c) proposed budgetary provision for each activity (d) implementation period (e) Authentic/certified document justifying budget .

Status of the Project: New (Violation)

Project Details:

Mining lease near village Habardi, Taluka – Kalyanpur & District – Devbhumi Dwarka (Guj.) was granted by Government of Gujarat to Shri Naresh Kumar P. Makhecha for 7.0820 Ha. area for a period of 20 years vide their letter no.MCR-1580(M-63)/ 9235/CHH dated 17-2-1982. The lease deed was executed on 29-12-1983. The mining operations commenced on 29.12.1983.The first lease period expired on 28-12-2003. The state Govt. has recommended extension of lease period up to 28.12.2033 under Section 8A(5) of MMDR (Amendment ) Act 2015. Mining Scheme with progressive mine closure plan has been approved by IBM, Udaipur vide letter no. 682 (23) MS – 581/2010 – Khanijs, dated 08/06/2016.Review of Mining plan with progressive mine closure plan has been approved by IBM, Gandhinagar vide letter no. 684 (4) MP – 223/2019-20 – GNR, dated 17/06/2019.Ultimate working depth is 2.4 meter BGL and water table is 22 meter BG, ,hence there will not be intersection of ground water due to working.No National Parks, Sanctuaries, Biosphere Reserves, Wildlife corridors, Tiger / Elephant located within 10 km of the mine lease area. Arabian Sea is at 9.03 Km in North-West direction from the lease.The area is devoid of any perennial or semi perennial river. No drainage is passing through the area. The area is plain with gentle slope towards northeast.In buffer zone Pindara Bay - 9.5 Km in NW direction, Jamvati Nadi - 2.7 Km in NE direction, KarvoNadi - 7.5 Km in NE direction and Dhang River - 4.5 Km in West direction is present.Total 35 Persons (Man Power) to be engaged in the mine. Mining operation will be carried out by open cast semi mechanised method. Benches shall be developed in mineral and shall be handled from the pit by JCB. Height of benches will be kept 3.0 mtr. & width will be kept more than he height. The O/B removal will done by local labours on contract basis, because local persons expected to be employed in the mine, or a hired JCB excavator will be used.The mineral will be transported by dumper to the site of crusher of the plant/buyer.A diesel engine operated pump will be deployed in the mine for pumping out accumulated rain water from pit bottom.There is top soil, which will be used in plantation. It is proposed that If the mineral reject quality are found more than threshold value 30% Al2O3 & 7.0%. It will be sold out. Otherwise this quantity shall be used for backfilling purpose.Land proposed for mining is Govt. Waste land and Mining will be done as per Land use policy of the state. No forest land is involved. At the end of lease period, total 2.6620 ha. area will be covered under plantation including 1.3410 ha. Along lease boundary, 0.121 ha. over mined out benches & 1.2 ha. Over backfilled area. At the end of lease period about 4.4200 ha mined out area will be used for rain water storage.The study of flora & fauna has been done in core as well as in buffer zone, no endangered species found in study area. No negative impact on wildlife of surrounding area, the mining will be confined to core zone only.Fugitive emission from vehicle movement will form a layer in leaves thus reducing the gaseous exchange process. This ultimately affects the growth of plants.Mitigation Measures: Plantation will be carried out in lease area and approach roads. Native plant species which are stress and pollution tolerant and comparatively well acclimatized should be grown.For selection of plant species it is necessary to consider certain factors as agro- climatic suitability, height and canopy architecture, growth rate and habit and aesthetic effect (foliage, conspicuous and attractive flower color). The plants selected should be hardy so as to withstand severe climatic conditions and should not use much of irrigation.Impact on Fauna - The operational activities such as population influx, transportation and noise generation may have an adverse impact on fauna.

Impact on Agriculture There will be no impact on the Agriculture. Dust generated will be suppressed during mining operation atmining site as well as during transportation will be suppressed by sprinkling.

The proposed mining project does not fall under CRZOne season (non-monsoon) primary baseline data on ambient air quality (PM2.5, PM10, SO2 and NOx), water quality, noise level, soil and flora and fauna has been collected during winter season (Dec. 2018 to Feb. 2019).Baseline study and AERMOD modelling considering impact of mine revelas that Pollutant concentrations in the ambient air will remain well below the National Ambient Air Quality Standard prescribed by CPCB.Water requirement for domestic/drinking purpose will be met through the nearby village and transported by water tanker. The total water requirement for the project (dust suppression, domestic & drinking purpose) is estimated 6.0KLD.

Deliberation

Committee noted that the project cost considered does not include upfront cost, performance security, total royalty, weigh bridge cost, labor cost equipment, environment protection and implementation cost, green belt development and maintenance cost, cost for post closure mine plan including total cost of back filling of mined out pit as per the OM of MOEF&CC dated 16/01/2020.PP was asked to resubmit need based CER with outlay after revised project cost considering the aforementioned heads over 5 years. It is noted by the committee that based on cost of assessment of ecological damage and value of CER whichever is high, PP could not satisfactorily addressed remediation plan and natural and community resource augmentation planconsidering amended EIA notification dtd 08 March 2018. It is deliberated that the amount for ecological damage assessed for preparing remediation plan and natural and community resource augmentation plan shall be as per the indicative guideline approved by SEIAA, Gujarat OR equivalent to the revised CER amount as per the MOEF&CC‟s office Memorandum No: F NO 22-65/2017-IA-III dated 01/05/2018, whichever is higher.However, considering the revision of the project cost, value of CER will differ and hence committee asked PP to readdress the need-based CER and submit remediation plan and natural and community resource augmentation plan accordingly. Committee felt that CER shall be prepared pertaining to the public hearing involving issues pertaining to the backfilling of mined out pit, fugitive emission due to mine work including its impact on crop in filed, fencing to avoid casualty, noise etc. After deliberation it was decided to consider the proposal after submission of the following details in one of the upcoming SEAC meeting. 1. PP shall ensure participation of people during public hearing with equality in genders so as to encourage women participation in public hearing and at the same time the issues of women shall also be given weightage. 2. To incorporate dust mitigation measures due to mining, handling of mineral, loading, unloading, transportation and other allied activities shall be implemented in letter and spirit similar to the applicable measures guided in Notification issued by MOEF&CC dated 25/01/2018 vide GSR 94(E).

The draft EIA report also covering the above TOR shall be prepared and submitted to the GPCB for conducting the public hearing / consultation process as per the provisions of the EIA Notification, 2006. The project shall be appraised after submission of the final EIA report.

After scoping for the aforementioned proposal, committee decided to consider the proposal under B1 category keeping cluster situation &Hon‟ble National Green Tribunal Order dated 13 September 2018 in view, It was decided to recommend TOR approved by SEIAA on 07/03/2019 for Non sand mining with blasting for conducting the EIA study to be done for the proposals in cluster considering 10 Km radius from the periphery of the mine lease area including public hearing including following additional TOR to SEIAA.

1. PP shall ensure participation of people during public hearing with equality in genders so as to encourage women participation in public hearing and at the same time the issues of women shall also be given weightage. 2. Carry out need based survey for CER and give details of budgetary provision for five years for effective utilization of the same. 3. To incorporate dust mitigation measures due to mining, handling of mineral, loading, unloading, transportation and other allied activities shall be implemented in letter and spirit similar to the applicable measures guided in Notification issued by MOEF&CC dated 25/01/2018 vide GSR 94(E). 664thSEAC meeting through Video Conference dated 17.06.2020

The draft EIA report also covering the above TOR shall be prepared and submitted to the GPCB for conducting the public hearing / consultation process as per the provisions of the EIA Notification, 2006. The project shall be appraised after submission of the final EIA report.
